Cheney charged over jail 'abuses'
A judge has yet to approve the indictment against Mr Cheney
A Texas grand jury has charged US Vice-President Dick Cheney for "organised criminal activity" related to alleged abuse of private prison inmates.
The indictment says Mr Cheney - who has invested $85m (£56m) in a company that holds shares in for-profit prisons - conspired to block an investigation.
The indictment has not been seen by a judge, who could dismiss it.
Mr Cheney's spokeswoman declined to comment, saying his office had not yet received a copy of the charges.
One Texas lawyer said the charges were politically motivated.
'Conflict of interest'
The indictment was overseen by county District Attorney Juan Guerra, an outgoing prosecutor at the end of his term of office.
He cites the case of Gregorio De La Rosa, who died on 26 April, 2001 inside a private prison in Willacy County, Texas.
The grand jury in Willacy County, near the US-Mexico border, accuses Mr Cheney of committing "at least misdemeanour assaults" of inmates by allowing other inmates to assault them.
It said there was a "direct conflict of interest" because Mr Cheney had influence over federal contracts awarded to prison companies.
US grand juries weigh evidence to decide whether a case is worthy of being sent for a full trial, before issuing formal charges known as indictments.
The three-page indictment also alleges that former US Attorney General Alberto Gonzales "used his position...to stop the investigations as to the wrong doings."
The grand jury wrote that it made its decision "with great sadness," but said they had no other choice but to indict Mr Cheney and Mr Gonzales "because we love our country."
Several other related indictments were brought against a host of public officials in what one lawyer called a circus act by the outgoing prosecutor, Mr Guerra, who he said was seeking revenge in his final weeks in office.

OSCAR ADAME, ANCHOR, NEWSCHANNEL 5: NEWSCHANNEL 5's Stephanie Stone is on the story. She's live in Willacy County with details. Stephanie.
STEPHANIE STONE, NEWSCHANNEL 5 REPORTER: District Attorney Juan Guerra refuses to comment about the indictments, but he did say he presented a lot of evidence about a lot of corrupt people. The indictments are not public record yet, but attorneys for some of the people involved have confirmed the allegations, and they've confirmed who's involved. At this point we can tell you the vice president of the United States is named in that indictment, as well as the former attorney general Alberto Gonzales, state Senator Eddie Lucio Jr., Judge Migdalia Lopez, Judge Janet Leal, and Willacy County district clerk Gilbert Lozano, among others. Guerra recently told NEWSCHANNEL 5 that he was investigating corruption within the private prison system following an inmate's death. He also alleged that there were a number of public officials and elected leaders who are involved and who are profiting from the prisons. Some of the attorneys involved have said they plan to file motions to quash the indictment sometime this week. We talked to the district clerk about all of this. We'll tell you what he has to say, coming up tonight on NEWSCHANNEL 5 at 6:00. We also talk to Dick Cheney's press secretary, and we'll tell you what they have to say, coming up tonight at 6:00. RITA GARCIA, NEWSCHANNEL 5 REPORTER: State district judges Janet Leal and Migdalia Lopez are both listed on that indictment, so they cannot hear any cases right here at the Cameron County Courthouse. Now, we've learned Judge Leal was hearing a murder case this morning when she was told to step down because she's under investigation. A retired state district judge was called in to finish up the day. And in Judge Lopez's courtroom, the 197th, it's lights out.

RAYMONDVILLE, Texas — A hearing was set to determine whether or not to disqualify the judge presiding over the cases filed by a South Texas prosecutor against Vice President Dick Cheney, former Attorney General Alberto Gonzales and others.
The state Supreme Court's chief justice appointed District Judge Michael Peden of San Antonio to preside over a hearing Monday on a motion to recuse and disqualify Judge J. Manuel Banales.
The prosecutor asked that Banales not hear the case. District Attorney Juan Angel Guerra contends Banales has worked closely with state Sen. Eddie Lucio Jr., one of the defendants in the case.
Half of the indictments are linked to privately run federal detention centers in the sparsely populated southern Texas county and accuse the public officials of culpability in the alleged abuse of prisoners. The indictment against Cheney alleges that his personal investment in the Vanguard Group, which invests in private prison companies, gives him culpability in alleged prisoner abuse. Lucio is accused of illegally profiting from prison consulting fees.
The other half of the indictments target judges, special prosecutors and the district clerk who played a role in an earlier investigation of Guerra. It accuses them of abusing their powers in investigating Guerra's office.
Charges alleging Guerra extorted money from a bail bond company and used his office for personal business were dismissed in October, but he had already lost the March Democratic primary by then. Guerra has accused Banales of allowing the 2007 indictment against him to languish for more than a year to damage his re-election chances.
Banales appointed a temporary prosecutor to handle the local officials indicted in the case because Guerra has sparred with them for years and would be a witness in their cases.

RAYMONDVILLE, Texas: A county prosecutor who brought indictments against Vice President Dick Cheney, former Attorney General Alberto Gonzales and others asked on Friday for the judge to remove himself from the case.
Willacy County District Attorney Juan Angel Guerra pounded his fist and shouted at the judge, alleging he was giving special treatment to high-profile defendants. It sent the routine hearing into chaos.
Guerra, who is accusing the public officials of culpability in the alleged abuse of prisoners in a federal detention center, asked Presiding Judge Manuel Banales to recuse himself. Guerra has complained about Banales' handling of the case.
Attorneys for the vice president and other defendants leapt to their feet in objection as Guerra pounded the table and accused Banales of giving the defendants special treatment in allowing motions to quash the indictments to be heard before the defendants were arraigned.
Banales called a recess to contact the chief justice of the state Supreme Court for suggestions on how to proceed. He also ordered Guerra, who had slipped out once before in the hearing, to remain in the courthouse.

Banales adjourned court later in the afternoon after announcing that he would send all documents pertaining to the motion to the chief justice. He tentatively scheduled the parties to return to court Wednesday morning.
Some officials have questioned Guerra's motives. They've accused him of trying to end his tenure with a bang and even scores with political enemies.
The vice president is the highest public official Guerra has pursued, but he made a nearly 20-year career of passing over routine crimes in favor of public corruption before being defeated in the March Democratic primary election.
It was Guerra's interest in the contracts to build and run a federal detention center that led to some of his biggest successes — three guilty pleas on bribery charges from former county commissioners in 2005. But he also believes it was the motivation for his own legal battles.
Guerra continued working for more than a year while under indictment on charges of extorting money from a bail bond company and using his office for personal business. Banales dismissed the indictment in October.
At Friday's hearing, Guerra shouted: "Now all of a sudden there is urgency. Eighteen months you kept me indicted, through the election."
Half of the indictments returned Monday are linked to privately run federal detention centers in the sparsely populated southern Texas county. The other half target judges and special prosecutors who played a role in an earlier investigation of Guerra.
The GEO Group Corp. was indicted on a murder charge for the death of an inmate at a federal prison.
"The indictment is the product of prosecutorial vindictiveness and is void on its face," defense attorney Tony Canales, who represents the private prison operator, wrote in a motion. Canales is also the legal representative for Cheney and Gonzales.

Guerra unveils why his investigation led him to the Vice President
WILLACY COUNTY - District Attorney Juan Guerra says his investigation took him all the way to the top, to the Vice President of the United States. He showed NEWSCHANNEL 5 records that he says could be used to prove Dick Cheney is guilty of criminal activity.
The charges against the Vice President stem from the Willacy State Jail in Raymondville and from the inmate, Gregorio De La Rosa, Jr., who was killed there by a fellow inmate in 2001. Guerra says that the elected officials let the jail get away with murder so that they can keep making money.
Guerra showed us the Vice President's financial disclosure from last year and it shows he owned shares in the Vanguard Group. Guerra estimates Cheney has $85 million invested in Vanguard and in turn, into the prison companies.

Interestingly enough by the time I got to this thread every single video has been removed, as well as most of the articles except for the BBC, Truthout on one other link. Look at how they watch these sites and try to clean up the mess as soon as something spills...well the cat's out of the bag now.
