Scientists Sue FCC for Dismissing Studies Linking Cell Phone Radiation to Cancer

A Nobel Prize-winning scientist has filed a lawsuit alleging the Federal Communications Commission (FCC) failed to update cellular phone and wireless radiofrequency (RF) radiation limits and cellular phone testing methods in over two decades. These failures, the plaintiffs contend, ignore “peer-reviewed scientific studies showing that radiation from cell phones and cell phone towers and transmitters is associated with severe health effects in humans, including cancer, DNA damage, damage to the reproductive organs, and brain damage (including memory problems).”

Law&Crime obtained an exclusive copy of the lawsuit from Nobel co-laureate Devra Davis, who currently serves as president of the Environmental Health Trust (EHT), the lead plaintiffs in the action.

”The FCC has for years failed to protect public health by relying on 24-year-old safety tests designed when phones were the size of a shoe and used by few,” Davis told Law&Crime via email. ”We filed this appeal in order to insist that the agency take full measure of the U.S. government and other scientific evidence that cellphone radiation can be harmful.”

Davis continued, noting the FCC’s hands-off approach to cell phone-related regulation over the last three presidential administrations.

”The agency has dismissed hundreds of scientific studies submitted to its inquiry on wireless radiation and the advice of the American Academy of Pediatrics, and others, without providing any rationale for doing so,” she said.

The lawsuit specifically accuses the FCC of violating the Administrative Procedure Act (APA) and is requesting an appeal of the agency’s prior order denying to revisit cellular phone standards. From the filing:

[The FCC] (1) has improperly terminated a Notice of Inquiry begun in 2013 to review, update, and amend its emission exposure limits for radiofrequency (RF) radiation emitted by telecommunications devices and facilities, including but not limited to cell phones and cell phone towers and transmitters; (2) has improperly revised the criteria for determining when a licensee is exempt from its RF exposure evaluation criteria and the methods that RF equipment operators can use to mitigate the risk of excess exposure to the public and to workers; and (3) has improperly denied a petition for reconsideration of the [FCC’s] finding, and otherwise improperly rejected public comments, that the pinnae (outer ears) should be treated like other extremities for purposes of determining compliance with the RF emission exposure limits.

“The [FCC’s prior] Order exceeds the [FCC’s] statutory authority and poses significant risks to the public health, safety, and security,” the filing continues.

The plaintiffs’ attorney Edward Myers slammed the FCC’s prior decision in comments to Law&Crime.

“The FCC’s order terminated an inquiry into the adequacy of existing health and safety standards for radiofrequency radiation from wireless devices and facilities, including cell phones and cell phone towers and transmitters,” he said. “The existing regulations were promulgated in 1996 based on scientific data from 1992 and the FCC had commenced the inquiry in 2013 after the General Accounting Office (GAO) issued a report finding that the existing standards may be based on outdated science and may need to be updated.”

Myers continued, clarifying the relief sought:

In challenging the FCC’s decision, the petitioners contend that the agency has unlawfully disregarded a large body of evidence in violation of the Administrative Procedure Act and the National Environmental Policy Act, among others. This evidence includes numerous peer-reviewed scientific studies showing that radiation from cell phones and cell phone towers and transmitters is associated with severe health effects in humans, including cancer, DNA damage, damage to the reproductive organs, and brain damage (including memory problems). The petitioners are seeking to have the court remand the matter to the FCC so that it can complete the inquiry into its standards based on current science.

Davis went on to compare the lax regulatory environment to the state of affairs between U.S. administrative agencies and the powerhouse automobile industry until a consumer push—and concurrent litigation—led by Ralph Nader led to a series of meaningful reforms in the 1980s.

“Unlike France and Israel, many Americans are ignorant of the fact that phones are two-way microwave radios that are tested while held inches away from the body. Safety advice is also hidden within operating systems about keeping devices away from the abdomen of pregnant women or children,” Davis said. “Just like cars in the 1970s, we need the equivalent of airbags and seatbelts, that have saved millions of lives, to ensure hardware and software operate at the lowest feasible levels and protect billions of children and others using wireless radiating devices that comply with outmoded standards.”

“The FCC is ignoring the recommendation of our nation’s largest organization of children’s doctors—the American Academy of Pediatrics,” EHT Executive Director Theodora Scarato told Law&Crime—noting that the physician-led group “asked the FCC to test phones the way we use them—in positions against the body—and the FCC said it was unnecessary.”

The End of the 5G Space Appeal and the Beginning of the Real Stop 5G Movement

The International Appeal to Stop 5G on Earth and in Space has done a good job of informing people and encouraging action but it is no longer useful or relevant and has been discredited by the unilateral, misguided, egotistic and unethical action of its administrator in effectively merging it with stop5ginternational. Neither the Appeal text nor the Appeal website has ever been updated and nor do I see any press releases on the orchestrated handovers supposed to have taken place in January 2020. But perhaps I just missed them? This personal-handover initiative seems to have gone off not with a bang but with a whimper.

The recently published European parliament briefing on effects of wireless on human health mentioned the EU 5G Appeal and the EMF Scientists Appeal (http://www.europarl.europa.eu/RegDat...)646172_EN.pdf) but failed to mention the International Appeal to Stop 5G on Earth and in Space despite its 200,000 signatures. This is because the Appeal was never officially delivered by its authors. Arthur Firstenberg deliberately alienated me to ensure that he would gain complete control of the Appeal, when in fact he was morally obligated towards the signatories to cooperate on ensuring the Appeal's delivery to the addressees.

Arthur Firstenberg's egotism, shortsightedness and irresponsibility, together with stop5ginternational's grasping parasitism, have effectively destroyed the Appeal, along with 21 months of my work to produce, administer and promote it. I am heartbroken that the beautiful Appeal, in which I invested so much time, emotion and hope, ended up being tainted by the actions of Nicolya Christi, Tanja Rebel, Arthur Firstenberg and their fellow conspirators driving them behind the scenes. Many tens of thousands of other people around the world who also invested hope in the power of the Appeal to bring change may also feel betrayed. The whole miserable, self-seeking and self-aggrandizing scenario puts me in mind of King Midas, who realised too late that wishing that all he touched would turn to gold actually deprived him of everything of true value.

RIP International Appeal to Stop 5G on Earth and in Space.

Now let us look at the positive side of all of this. Thanks to Nicolya Christi's attempt to take control of the global stop 5G movement by co-opting the 5G Space Appeal and creating stop5ginternational, it has now been revealed what 5G really is and who is really behind it.

Nicolya Christi's Worldshift organisation is in charge of the international projects of the Club of Budapest, a sister organisation of the depopulationist Club of Rome. Worldshift is the New Age arm of the globalists' plan to depopulate the earth and force everyone off the land and into prison "smart' cities, while ostensibly preserving the land for "wilderness" areas but in fact commoditising and exploiting nature in the globalists' new economic system called "naturocracy", according to the diktats of Agenda 21/2030 and the UN's "sustainable development", which is widely regarded as a code word for depopulation.

5G is the technological arm of this monumental plan. 5G makes possible big data, the Internet of Things, AI, transhumanism and the complete control of everything by the globalists. 5G enables complete physical and mind monitoring and control, and inventorying, monitoring and rationing of all things, energy and activities through Agenda 21/2030, technocracy and one-world, totalitarian government. In other words ...

5G is the facilitator of the diabolical plan to carry out the most gargantuan and grotesque heist in all of human history: the theft of all life, all property and all natural resources on Earth, which includes even people's minds, i.e. consciousness itself.

The other positive result of Nicolya Christi's attempted takeover and collectivisation of the stop 5G movement on behalf of the globalists is that it has divided the stop 5G movement and exposed the fifth-columnists, which has done an indispensable service to the movement.

Children’s Health Defense (CHD) is leading a historic legal action against the Federal Communication Commission (FCC) for its refusal to review their 25 year old guidelines, and to promulgate scientific, human evidence-based radio frequency emissions (“RF”) rules that adequately protect public health from wireless technology radiation. The Petition contends the agency’s actions are capricious and not evidence-based. The Petition was filed on 2/2/2020 in the U.S. Court of Appeals for the Ninth Circuit.

The Petitioners include parents of children injured by wireless devices, a mother whose son died from a brain tumor from cell tower exposure, physicians who see the epidemic of sickness in their clinics and Professor David Carpenter, a renowned scientist.

“This action represents the first time in 25 years that we finally can expose the FCC fecklessness in court, and give those who have been injured by the FCC’s disregard for human health a voice,” says Dafna Tachover, CHD’s Director of Stop 5G & Wireless Harms.

In 1996, the FCC, responsible for regulating the safety of wireless technology, adopted guidelines which only protect consumers from thermal levels of wireless harm, ignoring substantial evidence of profound harms from non-thermal levels. The FCC hasn’t reviewed its guidelines since, despite clear scientific evidence and growing rates of RF related sickness.

He's got his MHz (1.5 to 2.8 MHz @ 58" which is the top end of the AM band and through the 160m amateur radio band) and GHz (30+ GHz @ 1' 58") mixed up. And anyway, even if his 4G/5G frequencies were correct, frequency has nothing to do with power. 30GHz is not 30,000 times more powerful than 3MHz, it is just 30,000 times higher in frequency.

If this guy really does have anything to do with working on communications towers, he's very poorly trained and completely misinformed.

Thanks to the advent of technology, we can access and share information through our phones at lightning speed. We use it to educate ourselves and keep updated with current events. We use it for entertainment, and we use it for work.

However, this advancement comes with a price. In the video above (and on YouTube here), Tucker Carlson talks about the health risks of using mobile phones, and why it’s crucial to raise awareness of this urgent matter.

Carlson states,

“The National Toxicology Program, a government organization, found that ‘high exposure to radiofrequency radiation used by cell phones was associated with clear evidence of tumors in rats.’

“In 2012, Italy’s Supreme Court upheld a ruling that said there was a link between a business executive’s brain tumor and his heavy use of a mobile phone.”

Phones Exceed the Legal Limits of Radiation Exposure
The main health-related criteria for a phone to be approved for sale by FCC is by ensuring the device will not exceed the maximum allowable Specific Absorption Rating (SAR). This standard, however, is much too relaxed and is not based on the existing body of science, but rather on the thermal effect only.

While the SAR rating is based on a heating effect only, thousands of studies indicate non-thermal effects, and thus conclude that the SAR limit is entirely inadequate.

But today’s phones are now proven to exceed even the SAR-based legal limit of radiation.

The Chicago Tribune tested almost a dozen of phones according to the federal guidelines at an FCC-accredited lab. According to the Tribune, iPhone 7, one of the most popular smartphones ever sold, measured over the legal limit and is more than twice the amount of what Apple has reported to the regulators from its own testing.

As mentioned by Tucker Carlson in the video, in another lawsuit against Apple and Samsung, a test in an FCC-accredited lab shows that at 0mm, iPhone 8 hits the user with 5 times more radiation than the federal exposure limit allows, while Samsung hits users up to 3 times the limit,

Poor Testing Standards and Lawsuit
The FCC allows manufacturers to test their phone’s radiofrequency radiation emissions from up to 25 millimeters away from the body.

However, when we talk to someone on the phone, we normally have it right beside our ears. And having our phones in our pockets puts it at 2mm or less away from our body, making the testing criteria inapplicable and useless.

Not to mention its “one-size-fits-all” approach that doesn’t consider children or pregnant users of these phones.

With all the screening and testing being done, keep in mind that only one phone needs to be tested before millions of phones go on sale. At the same time, manufacturers can select the testing lab.

These poor testing standards are not only inaccurate based on how people use their phones, but it also leaves too much room for inconsistency and perhaps, dishonesty, with the results reported to the FCC and the emissions of the actual phones that will be used by the consumer.

In a December 2019 class action lawsuit against Apple and Samsung stemming from the Tribune’s tests, a California judge called the FCC “dumb”, before moving the case to trial.

(NOTE: While this story was updated here, there are indications that pressure was likely applied by industry and/or their captured agencies to change the story in an attempt to deflect focus from the FCC as a culpable party, so there was perhaps more accuracy in the originally-published story.)

Phone Manufacturers Are Deceiving Us
One of the most censored subjects in the USA according to American organization Project Censored, the Phonegate Scandal revealed the general deception by phone manufacturers about the real exposure values of SAR (the unit used to measure RFR absorption rate).

With the Tribune’s tests, Apple disputed the results, stating that the tests were not done the way Apple does them, without going to the specifics of what was out of the ordinary, and did not respond to requests for clarification.

These and other obvious efforts to mask the truth from the consumers and hide the fact that we are being overexposed to harmful radiofrequency radiation is a serious matter that concerns all of us.

Sadly, there is not yet enough conversation in the country about this issue and our health and safety are being sidelined.

With 5G being deployed despite no testing that indicates it is safe, this makes the issue critically urgent.

There are far too few stories like this in our mainstream media, which is heavily influenced by advertising dollars and business arrangements with wireless companies.

With almost non-existent media attention, it’s up to us to spread the word and help make our voices louder until we are heard, and until action is taken to ensure the health and safety of our community.

As Tucker Carlson correctly says,

“Twenty years from now, we’re going to look at that and laugh bitterly, like one of those Camel ads with smoking doctors.”
