    Article 22 of the Convention On The High Seas of 1958, states:

    ‘1. Except where acts of interference derive from powers conferred by treaty, a warship which encounters a foreign merchant ship on the high seas is not justified in boarding her unless there is reasonable ground for suspecting:

    (a) That the ship is engaged in piracy; or

    (b) That the ship is engaged in the slave trade; or

    (c) That though flying a foreign flag or refusing to show its flag, the ship is, in reality, of the same nationality as the warship.’

    It goes on to state that the naval vessels of one nation can stop the ship of a foreign nation if that ship has violated any laws or regulations of the nation to which the naval vessel belongs if it is found in that nation’s territorial waters.

    It is clear that in the case of the boarding and detention of the Iranian oil tanker Grace 1, registered in Panama, as many ships are, off the Spanish coast, near Gibraltar, that Britain had no legal right to order its marines to board the Iranian ship which was either in international waters as the Iranians claim or in Spanish waters near Gibraltar. It is in flagrant violation of the Convention on the High seas to which it is a party and which therefore is also a part of the domestic law of the United Kingdom.

    The pretext offered by the British for this act of war against Iran, and Syria if their claim is to be believed that the oil was being delivered to Syria, in violation of a claimed European Union embargo against Syria, is manifestly bogus since the European Union has no legal right to impose “sanctions” or any type of embargo, or naval blockade against Syria or any other nation. That right remains in the sole jurisdiction of the United Nations Security Council which has not authorized any such blockade. The EU edicts against Syria are therefore illegal and in international law do not exist.

    The EU itself claims to justify its illegal oil embargo of Syria on Security Council Resolution 2254, and the 2012 Geneva Communique, both of which have the objective of seeking a peaceful political solution in Syria and do not give any EU states individually or the EU as a whole, the right to impose sanctions or any other type of warfare on Syria nor the right to enforce them against other nations such as Iran. Therefore, the British had no justification whatsoever for their actions.

    The question then becomes was this an act of piracy or an act of war and the answer is, act of war, for it is not considered piracy under the Convention if a naval vessel of one nation boards and seizes the ship of another nation. Piracy exists where the boarding is for private purposes by private individuals acting in their own interest.

    Article 15 of the Convention states,

    (1) Any illegal acts of violence, detention or any act of depredation, committed for private ends by the crew or the passengers of a private ship or a private aircraft, and directed:

    (a) On the high seas, against another ship or aircraft, or against persons or property on board such ship or aircraft;

    (b) Against a ship, aircraft, persons or property in a place outside the jurisdiction of any State;

    So the British action cannot be called “piracy” in a legal sense, though the term does fit the sense of what they have done and the Iranians like to use the term in their protestations against the British action. It is instead an act of war against Iran by Britain and in reality by the United States of America since it was admitted by the Brtish government that the seizure was conducted on orders from Washington as the Iranian foreign minister, Mr. Zarif, stated on July 17th

    The UK by confiscating our ship is helping the US in imposing its illegal oil sanctions against Iran.

    Spain’s acting foreign minister, Josep Borrell, said Gibraltar had seized Grace 1 in response to a request from the US to Britain. El Pais reported that Borrell, from the Socialist Party (PSOE) said the US intelligence implied that the supertanker was in British territorial waters. The Spanish have formally complained of a British incursion into Spanish waters, but in reality they went along with the illegal action and also cited the illegal EU oil embargo on Syria.

    Iran's actions in the Strait came just hours after authorities in Gibraltar agreed to extend the detention of an Iranian oil tanker in its custody for 30 days. That ship, the Grace 1, was seized by British authorities on July 4, accused of attempting to transport oil to Syria in violation of European Union sanctions...... (just realize why the European Union sanctions are there......]

    Observers had expected Iran to respond to the Grace 1's seizure, and the UK raised the security level for British ships in the Persian Gulf just last week.

    Always a matter of action and reaction. But we know that.

    I assume you are talking about the balkanisation of the Middle East in service of the Oded Yinon Plan and/or Western claims to fossil fuels in the region rather than the fictitious hostilities of Syria except those in self defence in response to the likes of proxy western forces.

    This event, one in a lengthening list of real and false flag ones, may be the final straw in this stage of this nauseating saga. It appears that the psychos in charge of US/UK/Iranian foreign policy want this conflict to be escalated. From a brief bit of research it becomes apparent that no one will benefit from this conflict except arms dealers/manufacturers. The damage and casualties in the middle east would be horrendous, to both Iran and other nations, including Israel and Saudi Arabia. The US would suffer from an extended conflict with Iranian proxy fighters and terrorists. In addition, the US would suffer from a costly drawn out war that would drain resources from countering the growing threats of China and Russia.

    No one wins here except parasites. And the the world would get further diverted from the healing path that is needed for a healthy future for humanity in this world.

    Sources Reveal Reasons For Capture Of UK Oil Tanker In Persian Gulf

    Informed sources revealed the legal grounds that Iran had to capture a British oil tanker which violated international maritime regulations when crossing the Strait of Hormuz in the Persian Gulf.

    Tasnim has learned from informed sources that Britain’s “Stena Impero” oil tanker was captured by the Iranian military forces for three cases of violation of the maritime law when it was passing through the high-traffic Strait of Hormuz on Friday evening.

    The UK vessel had switched off its GPS locator, in contravention of international regulations, and was sailing into the Strait of Hormuz in a wrong traffic pattern.

    The British tanker was entering the strait from the southern route which is an exit path, increasing the risk of an accident

    Moreover, Stena Impero had not heeded any of the warnings from the Iranian Ports and Maritime Organization.

    An informed source said the UK oil tanker was also polluting the Persian Gulf water heavily by dumping crude oil residue.

    The Islamic Revolution Guards Corps (IRGC) Navy captured the British oil tanker on Friday evening at the request of the Ports and Maritime Organization of Iran’s office in the province of Hormozgan.

    The oil tanker has been transferred to the Iranian coast for the necessary legal procedures.

    The UAE ship Iran seized was a lot less of a ship than even I thought . . . . It is only 190 feet long, and can only carry 1, 000 tons of oil. Furthermore, it was carrying oil that was likely stolen from Iran. Iranian authorities are stating it was "smuggling Iranian oil" and since Iran openly tries to circumvent sanctions, if the oil was not stolen (from Iran's perspective) they would not have said it was smuggling. It appears this was a setup. Most likely, this ship was going to be used as "proof" Iran was breaking sanctions, and Iran stopped it. No one wants to claim it. Surprisingly, it had 12 crew.

    It was purchased a year ago and re-named the Riah.

    Somali pirates don't go after cargo, they go after crew and demand money to have the crews returned. It is a risky affair, where they try to hook a ladder onto the ship while it is moving. They don't need a ladder for this one.

    This is the UAE tanker "Iran stole". It has only been the "Riah" since 2018. Before that it was the Chamat. It was likely purchased for the sole purpose of creating an international incident, ships of this age and size are usually scrapped.

    Due to the fact that no one wants to claim this ship, plus the fact that Panama revoked it's registration over the fact that it obviously broke the rules, it looks like Iran scored a free ship, which in this particular case amounts to "whatever that was worth".


    THE PLOT THICKENS: Panama has revoked registration for a UAE owned tanker "Iran stole" because Panama could prove the ship deliberately broke maritime procedure, which forced Iran to take it.

    So what we have is deliberate provocation, forcing seizure. What cop won't try to pull over someone for driving drunk while going 130? I sort of figured it had to be a situation like this but was not sure. Now I am sure. Take a look at the pictures RT posted. There are two tankers, the one "Iran seized" is the top one. It is a tiny ship that appears to be a POS at least 90 years old, sent deliberately to break rules and get it seized in a "no loss with that one" scenario.

    The disappearance of the ‘Riah’ fueled media speculation earlier on Tuesday. A spokesman for the shipping company that owns the tanker – Sharjah-based Mouj-al-Bahar General Trading – allegedly told TradeWinds that the ship had been “hijacked” by Iranian authorities, while CNN reported that unnamed US sources believed she’d been seized by the naval wing of Iran’s elite Islamic Revolutionary Guard Corps.

    Attention turned to Tehran, especially as the ‘Riah’ vanished on the same day that Iranian Supreme Leader Ayatollah Ali Khamenei vowed to respond to the UK’s seizure of an Iranian tanker off the coast of Gibraltar earlier this month. The incident also took place after several international tankers were attacked in the region in recent months, with Western leaders blaming Iran.

    Emirati officials distanced themselves from the tanker’s crew, with a security spokesman telling local media that “the tanker in question is neither UAE owned nor operated, does not carry Emirati personnel, and did not emit a distress call. We are monitoring the situation.”

    Tanker Seizures and the Threat to the Global Economy from Resurgent Imperialism

    The British seizure of the Iranian tanker off Gibraltar was illegal. There is no doubt of that whatsoever. The Iranian response to the seizure of its tanker in the Strait of Gibraltar, by the seizure of a British Tanker in the Strait of Hormuz, was also illegal, though more understandable as a reaction. The implications for the global economy of the collapse of the crucial international law on passage through straits would be devastating.

    It may seem improbable that the UK and or France would ever seek to close the Dover Strait, but in the current crazed climate it is no longer quite impossible to imagine the UK seeking to mess up access to Rotterdam and Hamburg. It is still easier to imagine them seeking to close the Dover Strait against the Russian Navy. Yet the essential freedom of navigation through the Kerch strait, respected by Russia which controls it, is necessary to the survival of Ukraine as a country. For Turkey to close the Bosphorus would be catastrophic and is a historically recurring possibility.

    Malaysia and Indonesia would cause severe dislocation to Australia and China by disrupting the strait of Malacca and the Suharto government certainly viewed that as an advantage from which it should have the right to seek to benefit, and was a continued nuisance in UN Law of the Sea discussions. These are just a few examples. The US Navy frequently sails through the Taiwan Strait to assert the right of passage though straits.

    Keeping the Strait of Hormuz open is perhaps the most crucial of all to the world economy, but I hope that the above examples are sufficient to convince you that the right of passage through straits, irrespective of territorial waters, is an absolutely essential pillar of international maritime law and international order. The Strait of Gibraltar is vital and Britain has absolutely no right to close it to Iran or Syria. If the obligation on coastal states to keep maritime straits open were lost, it would lead to economic dislocation and even armed conflict worldwide.

    Part III of the UN Convention on the Law of the Sea relates entirely to passage through straits.




    Please note that the right of passage through straits is here absolute, in a UN Convention which is one of the base blocks of international law. It does not state that the right to transit through straits can be subject to any sanctions regime which the coastal state chooses to impose; indeed it is clearly worded to preclude such coastal state activity. Nor can it be overridden by any regional grouping of which the coastal state is a member.

    Jeremy Hunt’s statement to parliament that the Iranian tanker had “freely navigated into UK territorial waters” was irrelevant in law and he must have known that. The whole point of passage through straits is that it is by definition through territorial waters, but the coastal state is not permitted to interfere with navigation.

    It is therefore irrelevant whether, as claimed by the government of the UK and their puppets in Gibraltar, the tanker was intending to breach EU sanctions by delivering oil to Syria. There is a very strong argument that the EU sanctions are being wilfully misinterpreted by the UK, but ultimately that makes no difference.

    Even if the EU does have sanctions seeking to preclude an Iranian ship from delivering Venezuelan oil to Syria, the EU or its member states have absolutely no right to impede the passage of an Iranian ship through the Strait of Gibraltar in enforcement of those sanctions. Anymore than Iran could declare sanctions against Saudi oil being delivered to Europe and close the Straits of Hormuz to such shipping, or Indonesia could declare sanctions on EU goods going to Australia and close the Malacca Strait, or Russia could declare sanctions on goods going to Ukraine and close the Strait of Kerch.

    There are two circumstances in which the UK could intercept the Iranian ship in the Strait of Gibraltar legally. One would be in pursuance of a resolution by the UN Security Council under Chapter VII of the UN Charter. There is no such resolution in force. The second would be in the case of a war between the UK and Iran or Syria. No such state of war exists (and even then naval blockade must be limited by the humanitarian measures of the San Remo Convention).

    What we are seeing from the UK is old fashioned Imperialism. The notion that Imperial powers can do what they want, and enforce their “sanctions” against Iran, Syria and Venezuela in defiance of international law, because they, the West, are a superior order of human being.

    The hypocrisy of arresting the Iranian ship and then threatening war when Iran commits precisely the same illegal act in retaliation is absolutely sickening.

    Finally, there will no doubt be the usual paid government trolls on social media linking to this article with claims that I am mad, a “conspiracy theorist”, alcoholic or pervert. It is therefore worth pointing out the following.

    I was for three years the Head of the Maritime Section of the Foreign and Commonwealth Office. I was Alternate Head of the UK Delegation to the UN Preparatory Commission on the UN Convention on the Law of the Sea. I both negotiated, and drafted parts of, the Protocol that enabled the Convention to come into force. I was the Head of the FCO Section of the Embargo Surveillance Centre and responsible for giving real time political and legal clearance, 24 hours a day, for naval boarding operations in the Gulf to enforce a UN mandated embargo. There are very few people alive who combine both my practical experience and theoretical knowledge of precisely the subject here discussed.

    Iranian tanker Grace 1 released in Gibraltar despite US attempts to hold it further

    Authorities in Gibraltar have released the Iranian oil tanker Grace 1, after receiving assurances that its cargo is not destined for Syria. The US had formally requested them to detain the vessel for a further period.

    Gibraltar Chief Minister Fabian Picardo agreed to lift the detention on the ship, however, after Tehran gave written assurances that its cargo – 2.1 million barrels of oil – would not be unloaded in Syria.

    “In light of the assurances we have received, there are no longer any reasonable grounds for the continued legal detention of the Grace 1 in order to ensure compliance with the EU Sanctions Regulation,” he said.

    The United States requested the government of Gibraltar not to release the tanker.

    “The US Department of Justice has applied to seize the Grace 1 on a number of allegations, which are now being considered,” the Gibraltar government said in a statement,adding that the issue would be reviewed in the courts later on Thursday afternoon.

    Iran’s ambassador to the UK, Hamid Baeidinejad, called Washington's move "its desperate, last-minute efforts, intended to prevent the release of the [Grace 1] oil tanker from detention" that ended with "humiliation.”

    Iranian Foreign Minister Javad Zarif also weighed in on Twitter, calling the move an attempt at “piracy.”

    “The US attempted to abuse the legal system to steal our property on the high seas,” Zarif said. “This piracy attempt is indicative of Trump admin's contempt for the law.”

    The Grace 1 was seized by the UK outside of Gibraltar in early July, prompting Tehran, two weeks later, to seize a British-flagged vessel in the Persian Gulf. Both sides have denied there were plans to exchange the ships.
