APPEAL REJECTED: Julian Assange loses extradition court battle

WIKILEAKS founder Julian Assange has lost his appeal against extradition to Sweden to answer sex crime allegations after judges rejected claims that moves to return him to Scandinavia were unfair and unlawful.

Judges John Thomas and Duncan Ousely said today Assange should be sent to be questioned over the alleged rape of one woman and the molestation of another in Stockholm last year.

The 40-year-old has denied wrongdoing and insists the case is politically motivated by those opposed to the work of his secret-spilling organisation.

Wearing a grey suit, Assange flipped through piles of documents and shook hands with supporters as he appeared in court to hear the verdict.

It was not immediately clear whether Assange, who has spent much of the past year under virtual house arrest at a supporter's country estate, will now have the right to take his case to Britain's Supreme Court.

In their ruling, the appeal judges said the decision by Swedish authorities to issue a European Arrest Warrant could not "be said to be disproportionate".

"In any event, this is self-evidently not a case relating to a trivial offence, but to serious sexual offences," the judges said.

Before the judgment, extradition lawyer Julian Knowles had said Assange would only be able to appeal to Britain's Supreme Court - the country's highest court - if the appeals court's ruling involved an issue of "real legal significance".

Knowles said that if Assange is permitted a further appeal, he would likely stay on bail for a couple of months. If not, "he'll be extradited within 10 days", he predicted.

Assange had claimed in his appeal that the alleged offences would not have been regarded as crimes under English and Welsh law, a stance the judges rejected.

"There can be no doubt that if what Mr. Assange had done had been done in England and Wales, he would have been charged," the ruling said.

Did it say exactly that? Because if so, I should say he can appeal for that alone. Nothing has been proven yet.

Law is like that, people expect legal proceedings to take into account the subtleties and intention of charges, it cannot,
Law is a rigid framework of rules-if a charge can be upheld according to the rules then it proceeds accordingly-regardless of whether
the intention of those charges is 'unjust' or devious. The Law was not called 'An Ass' for nothing. The more sincere practitioners of law are always seeking reforms, but it is a slow, slow
process. The more money you have, the more 'justice' you receive-Law is a frightful travesty.

Yes, but 2 V.I.P.s (whose identities we are not allowed to know!) were set free after being found guilty of abusing a young girl, Holly, with Down Syndrome (see www.davidicke.com) recently "in the interests of society"!!!! It's OK in Britain to sexually abuse children if you are one of the élite but people are extradited and sentenced to prison for much less if they are not. This is not democracy!

No surprises there then. Unfortunately it'll not be long before the power elite have him locked up in an American jail without charge. Just as alleged justice of Bradley manning. Disgraceful.

Assange would not face fair trial: Robertson

Australian-born lawyer Geoffrey Robertson says the Australian Government would have an obligation to help Julian Assange if he is extradited to Sweden, where he would be detained and face a secret trial.

    ** VIDEO & TRANSCRIPT Here **

    Australian Broadcasting Corporation
    Broadcast: 02/11/2011
    Reporter: Tony Jones

    Part of transcript:

ROBERTSON: But if Assange goes to Sweden there is the concern that he may be more vulnerable to extradition to America, and Sweden doesn't sentence severely. The maximum is four years. He may not be convicted. I would hope he wouldn't.

But it's really America; it's the possibility that the politicians who last year said - Sarah Palin said that he should be hunted down like bin Laden - give him nine years of freedom. But Rush Limbaugh said that he should be - die of lead poisoning from a bullet in the brain. You got Huckabee and so on condemning him in quite extravagant and outrageous terms as a terrorist who should be hunted down and killed.

Now, there is still a grand jury sitting in Virginia, and this I'm keeping a close eye on because they haven't got the slightest evidence that he groomed Bradley Manning. That's what they're looking for and that's what - Manning himself has denied it.

Julian Assange invented a kind of electronic dead letter box that sources could send him material in total confidence. And so without that evidence, it would be - I would hope that the grand jury proceedings would finish without indicting him.

We all know these are trumped up charges anyway (as usual). One of the accusers has reportedly fled already.

Assange still has one ace up his sleeve - the thousands of files which have been downloaded to the public awaiting the "key" password to open them. This is the enormous encrypted file cache allegedly said to have all the dirt on 9/11 and the existence of captured alien technology, etc.

Like so many others Julian Assange was put up on a pedestal by the media and then knocked down by both MSM and some of the alternative sites who were angered by his responses to UFO's and 9/11. There are many excellent journalists who refuse to go there. No wonder Assange doesn't want to be returned to Sweden where a legal device known as a 'temporary surrender' can send him on to the United States quickly and secretly. Just check out what happened to Egyptians Ahmed Agiza and Muhammad al-Zery - (http://en.wikipedia.org/wiki/Repatri...hammad_al-Zery). He has been accused of so many things from terrorism to cointelpro and the one that annoys me most is the feminist agenda because it is such a distraction. Yesterday there was a vitriolic peace in the Guardian (whose own handling of Assange has been far from ethical) from a Swedish Journalist - http://www.guardian.co.uk/commentisf...wedes-pitiable. Assange may be mildly aspergic and arrogant but rapist - I sincerely doubt it. Assange took on those at the top of the pyramid and they have all the tools to fight back covertly and overtly which is just what they are doing. At least Assange is still in the public eye - just - what about poor Bradley Manning?

I have it but I think it's nothing more than a publicity stunt of sorts. Notice how Wikileaks is no longer front and center, replaced by OWS?

'Wikileaks is no longer front and center' - no longer front page news but (1) they have had much of their strength reduced by restrictions on financial donations not to forget how much this law suit must be costing and (2) Assange has been under house arrest for close to a year with very few public appearances. Out of sight out of mind. Wikileaks is about freedom of information let's concentrate on that and support it. Leave the mud slinging to the those who are trying to control us.

    That isn't necessarily true.
What you speak of is black and white law, but there is grey law too.
Any court has the ability to get rid of charges due to abuse of process, lack of a cause of action (civil) and in this case, vexatious prosecution.
There are others too, you just have to know what the deal is.

Yasss... the last one expanded to a whopping 52 GB when it was uncompressed. Make sure you have plenty of room on your hard drive... can't wait to get "the KEY!"

True Corncrake. We don't hear much about the poor guys situation. Also Gary McKinnon - the young English guy who hacked into the "Elite's" computers and discovered... "their" secret space fleet. The US Govt is also trying to have him extradited for allegedly doing hundreds of thousands worth of damage to "their" computers. I guess they can't be very good computers if you're just "looking" at files Doesn't say much for "their" security either
