Default RAND PAUL offers Suprise Amendment to Reign in FDA Abuses

    Good Intention from Rand Paul

    From Natural News:
    http://www.naturalnews.com/035966_Ra...ensorship.html
    TRANSCRIPT:

"President, today I'm offering an amendment to the FDA. I'm troubled by images of armed agents raiding Amish farms and preventing them selling milk directly from the cow. I think we have bigger problems in our country than sending armed FDA agents into peaceful farmers' land and telling them they can't sell milk directly from the cow.

    My amendment has three parts.

First, it attempts to stop the FDA's overzealous regulations of vitamins, food and supplements by codifying the first amendment prohibition on prior restraint. What do I mean by that?

The first amendment says you can't prevent speech, even commercial speech, in advance of the speech. You can't tell cheerios that they can't say there's a health benefit to their Cheerios. Under our current FDA laws, FDA says if you want to market prune juice, you can't say that it cures constipation.

You can't make a health claim about a food supplement or about a vitamin, you can do it about a pharmaceutical, but you're not allowed to do it about a health supplement.

I think this should change. There have been several court cases that show this goes against not only the spirit but the letter of the law of the First Amendment. So this amendment would change that.

This amendment would stop the FDA from censoring claims about curative, mitigative effects of dietary supplements. It would also stop the FDA from prohibiting distribution of scientific articles and publications regarding the role of nutrients in protecting against disease.

Despite four court orders condemning the practice as a violation of the First Amendment, the FDA continues to suppress consumers' right to be informed and to make informed choices by denying them this particular information. It's time for Congress to put an end to FDA censorship.

Second, my amendment would disarm the FDA.

Now, some of you might be surprised the FDA is armed. Well, you shouldn't be.

We have nearly 40 federal agencies that are armed. I'm not against having police, I'm not against the army, the military, the FBI, but I think bureaucrats don't need to be carrying weapons and I think what we ought to do, is if there is a need for an armed policeman to be there, the FBI who are trained to do this should do it. But I don't think it's a good idea to be arming bureaucrats to go on the farm to, with arms, to stop people from selling milk from a cow.

I think we have too many armed federal agencies, and that we need to put an end to this. Criminal law seems to be increasing, increasingly is using a tool of our government bureaucracy to punish and control honest businessmen for simply attempting to make a living.

Historically the criminal law was intended to punish only the most horrible offenses that everyone agreed were inherently wrong or evil, offenses like rape, murder, theft, arson - but now we've basically federalized thousands of activities and called them crimes.

If bureaucrats need to involve the police, let's have them use the FBI, but I see no reason to have the FDA carrying weapons.

Today the criminal law is used to punish behavior such as even fishing without a permit, packaging a product incorrectly or shipping something with an improper label.

Simply said, the federal government's gone too far.

The plain language of our Constitution specifies very few federal crimes. In fact, the Constitution originally only had four federal crimes and now we have thousands of federal crimes.

We've moved beyond the original intent of the Constitution. We don't even know or have a complete list of all the federal crimes. It's estimated there are over 4,000, but no one has an exact number.

Finally, my amendment will require adequate mens rea protection. In other words, when you have a crime, you're supposed to prove the intent. People have to have intended to harm someone, it can't be an honest mistake where a businessman or woman have broken a regulation and didn't intend to harm someone. If you want to convict someone of a crime and put them in jail, it should be a mens rea requirement.

This is something we have had for hundreds of years, it comes out of our common-law tradition.

This amendment would fix this problem by strengthening the mens rea component of each of the prohibited acts and the FDA acts by including the words "knowing" and "willful" before we address and accuse someone of a crime.

This I think would give protection to folks who are guilty of inadvertently guilty of breaking a regulation and would keep from overflowing our jails. We've got plenty of violent criminals without putting people in for honest breaches of regulations. If Congress is going to criminalize conduct at the federal level as it does with the FDA act, the least it can do have is have an adequate mens rea requirement. My amendment will attempt to do this.

It's not that we won't have rules at the federal level, but the rules ought to be reasonable. We ought to allow people to market vitamins. There's no earthly reason why somebody who markets prune juice can't advertise it helps with constipation.

We've gone too far, and we've abrogated the First Amendment and what we need to do is tell the FDA that the courts have ruled that the First Amendment does apply to commercial speech and the FDA has been overstepping their bounds."

But let's not forget that Rockefeller has a major influence (chokehold?) on the FDA.

Here’s some news for those who still somehow believe the political left in Washington cares about the People. After U.S. Senator Rand Paul introduced an amendment that would have ended armed FDA raids on raw milk farmers (http://www.naturalnews.com/035966_Ra...ensorship.html) and legalized free speech about the curative properties of medicinal herbs, nutritional supplements and superfoods, are you curious how many Democrats voted in favor of this?

    Zero.

Big fat zero, to be exact.

Not a single Democrat in the United States Senate believes in fundamental food freedom, farm freedom or the principles of liberty. Every single Democrat in the Senate is a Big Brother sellout who supports the FDA having more guns pointed in the faces of raw milk farmers, arresting them and throwing them in prison, criminalizing real food and destroying America’s small family farms.

Every single Democrat in the U.S. Senate believes that telling the truth about the beneficial effects of Chinese Medicine, or medicinal herbs, or nutritional supplements should be a crime that can also get you raided, shut down and imprisoned by the FDA. There is not a single Democrat who sees anything wrong with the government sending herbal product formulators to prison. There is not a single Democrat who believes that an Amish farmer has the right to milk a cow and sell that milk to their neighbor without being threatened by the government.

This is an astonishing milestone in U.S. history. When those in Washington who pretend to represent the People openly and publicly vote to crush the very liberties and freedoms they claim to protect, you no longer have a real Democracy. You have a police state.
Only 15 Senate Republicans believe in liberty

The Republicans are only slightly better on this issue, by the way. Most Republicans also voted against this amendment. But here are the good guys who supported it:

    Kelly Ayotte (R-NH)
    John Boozman (R-AR)
    Jim Coburn (R-OK)
    John Cornyn (R-TX)
    Mike Crapo (R-ID)
    Jim DeMint (R-SC)
    Mike Johanns (R-NE)
    Ron Johnson (R-WI)
    Mike Lee (R-UT)
    Rand Paul (R-KY)
    Jim Risch (R-ID)
    John Thune (R-SD)
    Pat Toomey (R-PA)
    David Vitter (R-LA)
    Roger Wicker (R-MS)

All the above Senators — who just happen to be Republicans — deserve your thanks, by the way. Call their offices and tell them how much you appreciate them standing up for fundamental food freedom and farm freedom, even if you don’t agree with their positions on everything else.
85% of the U.S. Senate supports total FDA tyranny over raw milk, farms, food and supplements

The really astonishing point in all this is that out of 100 US Senators, only 15 voted to stop FDA tyranny against farmers.

Just a generation ago, this vote would have been 99 in favor and 1 opposed. But today, with the rise of the corrupt, criminal government police state, 85% of U.S. Senators have joined the criminal gang and only seek to expand the power of that criminality. This is a sobering realization about where our country is headed and just how little time we all have left to restore liberty before the whole thing collapses into a total police state takeover with our government murdering millions.

There is no more dangerous entity in the history of the world than a power-hungry government. Inevitably, all such governments quickly turn evil and destructive, often ending in the mass death of tens of millions of innocents. The ghosts of Hitler, Stalin, Mao and other regimes now echo throughout the chambers of the U.S. Senate and House of Representatives. With each new vote — the Patriot Act, NDAA, Food Safety Modernization Act, etc. — our own representatives thrust us one step closer to a totalitarian dictatorship. Step by step, day by day, a future of mass government death and destruction where the People are stripped of all freedoms inches every closer.

This must be stopped. America is worth saving from its enemies, even if those enemies exist within the highest ranks of the legislative branch itself. It is the duty of every American to take all (non-violent) steps necessary to remove traitors from office and demand loyalty to the U.S. Constitution and its Bill of Rights, or we will soon find ourselves conquered, enslaved, medicated and malnourished, force-fed GMOs and vaccinated at gunpoint by a tyrannical medical police state that answers only to its corporate masters.

Stand your ground, friends. Stand for liberty. Without liberty, there is no future worth fighting for, and as things exist in the U.S. Senate today, there is not a single Democrat who believes in liberty at all (and few Republicans who do either).

I use FarceBook to piss off friends and family members. Here's my latest post there:

The next Democrat who tells me he or she is voting for Democrats because they are the "lesser of two evils" is going to be tied to a board, and gallons and gallons of pasteurized, homogenized milk from feedlot cows injected with bovine growth hormone and fed GMO feed, will be poured slowly over their face - until they believe they will certainly drown in milk. That's right, *lesser of two evils Democrats*, prepare to be milk-boarded.

I dont know if their vote means they are not bought, maybe they are for rent and rent was just late this month, anyway they voted for a good thing thats whats important, could just be a long term bull**** strategy too to lull the public into a state of voting conservative and they drop the whole issue when they are elected, its still politics.

A woman in Louisville Kentucky some time ago on the news
Cooked food at lunch time near a busy working area
Word got out Hot lunch people came to her house and Ate the food
and left a donation in a bucket by the door
I remember her interview on the news She Stated People are honest and they
    leave a reasonable donation.
So my question is has there been any laws passed for this?

Ok I reacted to soon I did the research after the fact LOOK

and I think personally this is A great way around the buttholes that want to control us!!

I keep hearing about dairy farmers from all over having problems. At least the BIG BROTHER has put the fear out there by using scapegoats.

    Thanks Alie,

Finally we have some worthwhile information to absorb in the 'General Discussion' section...

Betcha they won't be discussing this at "The Pub At the End of the Universe"...

    Rgs,

    Jack

this is an interesting video by Alex Jones... yes, he's pushing a multi level product ... but then again it is a good product. This film interviews Dr Wallach, with degrees in agriculture and vetenary medicine who has taken the FDA to court multiple times and won.... An he developed the product... none the less they reveal some important details on the battle of the citizen against TPTB and the medical system.

Minerals are so so important. If you dont get it from this product get it from somewhere. I use Greens 8000 as my choice as part of my protocol.
For years naturopaths and alternative thinking people in alternative care have known that vets really know the truth in nutrition and so many aspects of healthcare.

Wallach and Jones clearly spell out just how the governement is poisoning and killing you and your children, systematically and with full knowledge. If you want to fight the FDA you must take full responsibility for your health. It is the single most important civil disobediance that you can do to turn against your doctor and against the FDA. After 37 years of alternative health experience that I have in study, application and providing guidance for people I am telling you that every single thing that they are saying is true. I hope you take the time and interest to learn

Taking control of my health is easy enough, just do it.

But if I had young children, that could be risky. If I didn't provide them the "recommended medical treatments, vaccines, diet, education, ..." then I wonder if I would be risking Child Protective Services taking them from me, for their "own good". It's unfortunate that I don't suffer from hypotension -- thinking about this would be a reliable cure.

Good angle of aproach Paul, you would probably get CPS on your butt claiming child abuse because you do not protect your child from diseases which are in turn machinations of their own labs. All they want is make cash on you and ( in your case) fictional child untill their final solution, the getting rid of most of us.

God forbid we get healthier and more knowing then we currently are, we live longer, we screw up their pretty timelime, lets buy a slow juicer and play for time to fix ourselves and get rid of them.

That is scary. My recommendation, is DO NOT sign a birth certificate and do not get your children a social security card. Once you "give" your children to the state, they own them and they can do whatever they want with them.

Yes, there is more to sovereignty than meets the eye.
