    Now Senator Tom Coburn [R-OK] has betrayed his promise to stand firm in the way of passing the bill by unanimous consent, and allowed the 11th-hour machinations that resulted in passage of S. 510 late Sunday night - with an unrecorded vote!

    Next S. 510 heads to the House as part of H.R. 2751, with the unconstitutional revenue-raising clause removed. This means we have one last chance to stop efforts by big Agribusiness to control our food. The House meets Tuesday, 12/21/10, to consider passage of H.R. 2571/S. 510. That leaves less than 48 hours to save food freedom!

    The critical moment is now, during the last couple days before the Holiday recess.     As we told you last week, Democrats first attempted to attach the food safety bill to the short-term spending measure to keep the government running, but Republicans balked because they wanted to keep that measure clean. So last night, the Senate raised it as an amendment to a completely unrelated bill from the House of Representatives—H.R. 2751, the Consumer Assistance to Recycle and Save Act! Quite a number of reports, including some from other health organizations, have gotten many of these details wrong. The swift approval by unanimous consent caught some aides and lobbyists working on it by surprise. Sen. Tom Coburn (R-OK) had promised to block the legislation, but lifted his objection at the final moment.

    Reid announced he would send the legislation—this time attached to a House-originated measure—back to the lower chamber for final approval. Please contact Speaker of the House Nancy Pelosi and your own Congressional representative immediately and urge that the Food Safety language be completely stripped from H.R. 2751 the Consumer Assistance to Recycle and Save Act!

    We believe Pelosi would prefer to bring up Food Safety “under suspension,” which is an expedited House procedure that requires a two-thirds vote to pass.     The FDA Food Safety Modernization Act is fundamentally flawed and is not in the best interest of small farmers, especially those who produce raw milk. The Act is a major threat to the local food movement.

    1. FDA does not respect individuals' rights to obtain healthy, quality foods of their choice. The agency has stated, as a matter of public record that:

    "There is no absolute right to consume or feed children any particular food."

    "Plaintiffs' assertion of a 'fundamental right to their own bodily and physical health, which includes what foods they do and do not choose to consume for themselves and their families' is similarly unavailing because plaintiffs do not have a fundamental right to obtain any food they wish."

    FDA has even participated in armed raids on small-scale co-ops and membership organizations. This agency should not be given any additional power.

    2. FDA has adequate powers under existing law to ensure food safety and effectively deal with foodborne illness outbreaks. FDA has power to inspect, power to detain product and can readily obtain court orders to seize adulterated or misbranded food products or enjoin them from being sold. The problem isn't that FDA needs more power; it's that FDA does not effectively use the power it currently has. The agency has power to inspect imported food yet inspects only 1% of food coming into this country from outside our borders.

    3. S.510 does nothing to address many significant food safety problems in this country, such as those resulting from confined animal feeding operations (CAFOs), genetically modified organisms (GMOs), and various contaminants (e.g., BPA, pesticides, herbicides, etc.).

    4. FDA has used its existing power to benefit the pharmaceutical and biotechnology industries at the expense of public health (e.g., allowing the overuse of antibiotics in confined animal feeding operations and refusing to require labeling for genetically-modified foods). This bill does not address the fundamental problems at this agency in order to truly protect public health.

    5. S.510 will expand FDA's involvement in regulating food in intra-state commerce, further interfering with local communities. State and local governments are more than capable of handling any problems related to food in intrastate commerce. All the major outbreaks of foodborne illness involve either imported food or food in inter-state commerce.

    6. S.510 will hurt our ability as a nation to be self-sufficient in food production because it has more lenient inspection requirements for foreign than domestic producers creating an unfair advantage for food imports. Giving an advantage to foreign producers will only increase the amount of food imported into this country that does not meet our domestic standards. S.510 does not address food security -- the ability of a country to produce enough food to meet its own needs.

    Today will go down in history as a dark day for the Mass of Humanity.

    The 'Food Safety Modernization Act' which passed Congress today at 4:50 pm with a 216 to 144 majority will 'harmonize' all food standards with Codex Alimentarius. What? You've never heard of that? Well, I think it's about time you go look it up, if you don't know what that is.

    What does Codex do? Well, Codex wants to make all vitamin and mineral supplements "drugs."

    Like to take high doses of vitamin C when you're not feeling well? Forget it.... After this bill becomes law, vitamin manufacturers will only be able to sell you 15mg doses.

    You want your food labeled if it's genetically modified? No worries, because everything will be required to be genetically modified. Isn't that GREAT?

    Like to buy 'organic'? You won't be able to. All food from now on must contain just the right amount of pesticides and chemicals.

    So.... Where were you when the call was going-out to put a stop to this attack on our last freedom - our food? What will you tell your children when they ask?

    Those reptiles are very clever at what they do....

    Incidentally, quite a number of reports have gotten many of these details wrong.

    The House bill, which began life as the “Cash for Clunkers Temporary Vehicle Trade-in Program” (very fitting given this basket case of a “food safety” bill), had been on the Senate’s legislative calendar since June of 2009. Suddenly, in a flurry of activity, the text of the old S. 510 was repackaged as Senate Amendment 4830. This was then proposed “in the nature of a substitute” for the House bill, which means the text of the Senate amendment was completely substituted for the original text of the House bill. This was agreed to in the Senate by unanimous consent. The title of the bill was then amended, renaming it—you guessed it—the FDA Food Safety Modernization Act!

    By the way, there were several different “Cash for Clunkers” bills that were sent back and forth between the Senate and the House, and one of those was passed into law. This one simply languished on the legislative junk pile until it could be resurrected—that is, until its shell could prove itself useful in a profoundly devious maneuver.

    The reason the Senate took a bill already passed by the House and completely replaced its language with the food safety bill language was to get around the constitutionality issue that had been the bill’s downfall a few weeks ago. So now, technically, the Senate’s bill, with its tax provision, actually did originate in the House, even though it actually was drafted by and inserted by the Senate. An absolute end-run around the rules.

    All at 10 p.m. on a Sunday night, when they thought no one would be watching. Our senators should be ashamed of themselves for acting so dishonorably.

    The swift approval by unanimous consent caught some aides and lobbyists working on it by surprise. Sen. Tom Coburn (R-OK) had promised to block the legislation, but he inexplicably lifted his objection at the final moment. Reid announced he would send the legislation—this time properly attached to a House-originated measure—back to the lower chamber for final approval.

    Tuesday morning, the House voted on the Rules Committee’s “closed rule,” meaning that no amendments are allowed. It then went to the House floor, and after less than an hour of debate, the bill passed, 215 to 144.

    NaturalNews) The U.S. House of Representatives passed H.R. 2751 yesterday with a 216 to 144 vote (yes, many members of the House did not even vote). The so-called Food Safety Modernization Act now heads to the President to be signed into law.

    When witnessing such a moment in history when the federal government greatly expands its power over an entire industry, it's important to understand the Law of Unintended Consequences. Virtually everything bad that happens after a bill gets passed is due to this Law of Unintended Consequences.

    On the surface, the intention behind the food safety bill seems innocent enough: Let's all protect the food supply and prevent people from getting sick due to e.coli and salmonella exposure. But the reality of the result that emerges from the law is quite different.

    Get ready for more dangerous, pesticide-ridden food from south of the border
    Because the S.510 / HR 2751 food safety bill places an enormous new burden on U.S. farmers -- yes, even small farms that are supposedly "exempt" -- it's going to drive many farmers out of business.

    It will also erect new barriers to farmers entering the food production business, and this is especially true for the small local farmers who grow food for local co-ops, farmers' markets and CSA organizations (Community Supported Agriculture). What we're going to see from all this, then, is the following:

    • A reduction in the available SUPPLY of fresh local produce.
    • A loss of local farming know-how and food sustainability.
    • The financial failure of CSAs, food co-ops and small local markets.
    • The loss of countless jobs that were related to local food production.
    • An INCREASE in the price of local food, especially organic food.

    Food safety bill does nothing to address food imports
    At the same time these huge regulatory burdens are thrust upon U.S. farmers, there are no new regulations required for food grown outside the United States.

    This means that food coming into the USA from Mexico, Chile, Peru or anywhere else does not have to meet S.510 food safety regulations at all. The FDA, after all, doesn't inspect greenhouses in Mexico or grape farms in Chile which export their products to the United States.

    Furthermore, many dangerous chemical pesticides that have been banned in the USA are legal to use elsewhere, and foods treated with those pesticides are perfectly legal to import into the United States. So instead of buying food grown in the United States on small, organic farms, more U.S. consumers are going to be buying food grown elsewhere that's treated with extremely toxic pesticides.

    Here are some of the unintended consequences of all this:

    • An INCREASE in the importation of fresh produce from other countries.

    • A worsening of the agricultural trade imbalance between the U.S. and other nations.

    • An INCREASE in the pesticide contamination of fresh produce sold at U.S. grocery stores.

    • An INCREASE in agriculture jobs in Mexico, Chile, Peru and elsewhere, even while agriculture jobs are lost in the USA.

    • A DECREASE in the overall safety of the food supply because now the proportion of foods imported from foreign countries with little or no regulatory oversight will greatly expand compared to U.S. grown foods.

    In effect, then, what Congress has done is impaired the competitiveness of U.S. farms, shifted farming jobs out of the country, increased the pesticide residues in fresh produce sold in U.S. grocery stores and harmed local food security and sustainability by driving small, local farmers out of business.

    Such is the nature of the Law of Unintended Consequences. And such is the nature of just about everything that Big Government tries to do when it threatens to "solve problems" by expanding its regulatory control over almost any industry.

    We need food security in America
    What Congress fails to understand is that we need food security far more than we need more FDA regulations. The knowledge base of local farmers who know how to grow, harvest and distribute food is far more valuable to the security of our nation than preventing a relatively small number of people from getting sick from e.coli each year (even if such a trade-off were a simplistic equation, which it isn't). Because if we lose food security, then we become slaves to the big corporate food producers who are attempting to centralize food production and place food, seeds and crops under their absolute control.

    A cynic might even suggest that was the whole purpose of the food safety bill in the first place: To destroy small farmers and centralize food production power in the hands of a few wealthy corporations. Whether that was the intent or not, it is certainly going to be the effect.

    What Congress has done with this food safety bill, in effect, is to cripple America's food production know-how and poison the population with far more dangerous pesticide-ridden produce that will now be imported from other countries instead. This bill should have been called the "Mexico Farming Jobs Act" because it's going to shift countless jobs south of the border as farms in the USA realize they simply can't operate under the immense burden of FDA regulatory tyranny.

    What's the definition of insanity?
    It all makes you wonder what the members of Congress are really thinking. Don't they ever step back and attempt to consider the real-world ramifications of their actions?

    Time and time again, the U.S. government seems to do the opposite of what would reasonably be required to solve problems. Think about it: When the U.S. government wanted to stop Wall Street bankers and investment firms from wasting money, it simply handed them a few trillion dollars in new money so they could waste more.

    When the government wanted to end debt spending, it spent more debt money out of the foolish belief that you can somehow end your debt by going deeper into it.

    When the government claimed it would reduce your health care costs and cover everyone with health insurance, it passed a sick-care law that has only seen health care costs spiraling out of control while insurers cancel policies and end coverage for many children.

    And now, the government claims to be making your food safer even though the real impact of the new law will be to make your food far more dangerous while destroying U.S. farming jobs.

    This is why those who really know government also know that they who govern best govern the least. Instead of trying to "fix" all the nation's problems by meddling with the actions of hard-working people trying to make a living (such as organic farmers), the government needs to simply get out of the way and let farmers produce their food without the heavy regulatory burden of the FDA -- an agency that we know is frequently engaged in actions that can only be called criminal in nature (http://www.naturalnews.com/030461_S...).

    Get ready for skyrocketing food prices in 2011 - 2013
    With the passage of this food safety bill, I am now publicly predicting skyrocketing food prices over the next two years. We will see fresh, local produce become increasingly more expensive and more difficult to acquire. Many local farmers will shutter their businesses, and farming know-how will be lost for perhaps a generation. The damage that will be done to America's food security and agricultural base is incalculable.

    Such is the price we shall all pay for allowing our representatives in Washington to once again violate our Natural Right to grow food and exchange it for goods or cash with our neighbors. The reason this Natural Right was never even mentioned in the US Constitution, by the way, is because the right to grow your own food without government interference is such an obvious "Natural Right" (a God-given right, or a right that is self-evident) that our forefathers never imagined such a right would be infringed by the federal government.

    Or if a right were ever infringed by the federal government, our forefathers were certain that the citizens of the United States of America would exercise their other Constitutional rights to nullify the attempted overreaching authority of the federal government and thereby restore their freedoms. Sadly, such a solution does not work when the majority of the population is lulled into a false sense of freedom by a government that deliberately lies to them on a daily basis. Freedom does not exist with the vast majority of the population has no interest in defending it.

    Vegetable gardeners can learn something from marijuana growers
    Better buy yourself some heirloom seeds while you have the chance. Plant your stealth garden and cover it with camouflage so the government can't see it and order you to destroy it. Soon, backyard vegetable gardeners will need to operate like marijuana growers and start hiding their food from government's prying eyes.

    No doubt the U.S. federal government will start using spy satellites to identify "unregistered gardens" that will be targeted for termination. Soon, small farmers may even be raided by armed FDA agents who terrorize their operations and seize cabbages. Seriously.

    It sounds crazy today, I know. But a decade ago, no one thought the government would ever outlaw raw cow's milk and arrest ranchers for selling milk to their neighbors, and that's now happening on a regular basis.

    In five years, FDA farm raids may be routine. That is, if there's anything left of the federal government (as we know it) in five years. I'm not sure how long they can keep up the financial house of cards, frankly. Always remember this enlightening fact: The entire federal government is just one paycheck away from collapse. I wonder how long FDA inspectors will keep harassing farmers if their paychecks stop? Remember, FDA employees have no loyalty to anything other than their paychecks. Once the money from Washington stops, the army of FDA mercenaries collapses virtually overnight.

    And the resilient farmers of America will win in the end, I have no doubt. If I had to choose to live on a deserted island with either ten North Carolina farmers or ten FDA bureaucrats, the choice would be a no-brainer. Farmers can keep you alive. FDA bureaucrats will only stab you in the back, steal your coconuts, and refuse to do any actual work on their own.

    They are, after all, parasites who feed on taxpayer dollars and lend nothing of value to society. If the FDA actually did anything useful at all, it would have banned mercury fillings to protect the public from mercury toxicity (http://www.naturalnews.com/030741_m...).

    HR.2751 [S.510] Food Control Bill Reguations

    "Dear Michelle, please intervene..."

    Natural Solutions Foundation is an international NGO (nongovernmental organization) that seeks to educate decision makers about the benefits of natural solutions to many societal issues. Wtih the help of YOU, our "Mouse Warriors" we express our views to those decision makers. Together, we sent over six million emails to them regarding the fake "food safety" (really "food control") bill S.510/HR.2751 which just passed the Lame Duck Congress on December 21, 2010.

    While we ultimately may not have stopped this new law in the Congress, the law that was adopted is a different creature than we would have faced had we not opposed it every step of the way. Recall, the first version of the bill that passed the House in July ‘09 had severe penalties and no significant exemption for local production and distribution. The version that passed the Senate at the end of November 2010 not only had no such severe penalties, but did have a rather weak exemption for some local production and distribution.

    It also did not have, as it might have, without our Push Back, two draconian bills that had been introduced in the Senate to prepare the way to add their terms to the final “food safety” bill; these were Sen. McCain’s discredited S.3002 which would have brought Dietary Supplements under even greater Federal control and the “criminalization of speech about food claims” bill, S.3767, introduced by the majority party “leadership” late in the session. The criminal penalty bill, while remaining a future risk, went nowhere, after over a hundred thousand messages of opposition. Opposition to McCain’s attempt to legislate Codex compliance was so great that he withdrew his own support from his own bill a month and a day after introducing it in February 2010. And the final "FDA Food Safety Modernization Act" as adopted has a somewhat stronger local food exemption, with a limited inflation escalation clause, so the exemption may become somewhat meaningful, depending on how the final regulations are written.

    The Action Item to the White House, below, is the first step in educating decision makers regarding those regulations.

    1. We are starting a campaign asking Michelle Obama, as an organic gardener, to support the vetoing of the bill -- and for the White House to intervene in the FDA regulation-making process to make sure that certain concerns get addressed:

    a. Implementing the exemption for local production and distribution in the least burdensome way.

    b. Assuring that Section 104’s “in the interest of national security” clause is not used to create secret regulations favoring Big AgBiz and,

    c. No “back-door” HARMonization of our food freedoms with international Codex Alimentarius restrictions.

    2. We will seek to prevent any funding for this increase in Federal power in the new Congress.

    There is much to be concerned about in the bill as adopted by the Congress, including the potential for secret regulations in violation of due process that section 104 seems to allow, the convoluted procedure for local food production exemptions, and the "road map" the new law provides for rapid "HARMonization" of our food freedoms with international Codex restrictions...

    By now you've probably heard that yesterday the House of Representatives passed the S. 510, The FDA Food Safety Modernization Act. It now goes to the president to be signed into law.

    This is a serious blow for all of us that toiled relentlessly to stop this dangerous legislation, and you may be tempted to just pack it in. We can't give in - that's just what they want!

    The swift passage of the bill, given the machinations the bill's supporters engaged in throughout the process, really doesn't come as much of a surprise. What is surprising is that it was passed despite the objections voiced by millions of Americans that responded to alerts from Citizens for Health and its allies in the health freedom movement. Also surprising is that even though Sen. Tom Coburn (R-OK) promised to block the legislation, he suddenly lifted his objection in time to allow passage of the bill.

    Tuesday morning the House voted to allow no amendments, after which the bill went to the House floor and was passed after less than an hour of debate.

    The legislation that includes S. 510 will be touted as a bi-partisan victory for the White House, and, most likely, signed by the President. However, we cannot sit idly by and fail to let the President know that he is flouting the will of millions of Americans if he signs it.

    Let the President know he is ignoring millions of Americans if he signs H.R. 2751!

    Finally, this is not the end of our opposition to this power-grab by big Agribusiness. The Citizens for Health team is conferring on next steps as you read this. Possible options under consideration are efforts to repeal the bill or to draft our own bill that would strip the objectionable S. 510 language from the bill passed by the House.

    After reading over the quote you have included in your comment, and going to the Huffington link you provided I find it very confusing regarding the legislation it is reporting on. After perusing the link, I couldn't even find your quote. I have to conclude the entire report is an 'apologist' summery of a very dangerous piece of legislation.

    Are you suggesting this Food Safety Moderization Act is a good thing? If this is the case, I must assume you are in here as a debunker.

    When this legislation becomes law the citizens of the US will be loosing a very fundimental freedon....

    observer I know you aren't new to forums or the web, if you go to the link I provided it shows pictures and below each picture is the quotes I posted showing what the media says this bill is about...

    I'm in California and we really don't care what the Feds think anyways, we re-write anything they mess up and go by the laws of our state, not the feds...

    being 25% of the national economy has its advantages.

    Here's just a tidbit to show you how the media is misrepresenting this legislation....

    From the text of the legislation, Under TITLE IV--MISCELLANEOUS PROVISIONS:

    SEC. 404. COMPLIANCE WITH INTERNATIONAL AGREEMENTS.

    "Nothing in this Act (or an amendment made by this Act) shall be construed in a manner inconsistent with the agreement establishing the World Trade Organization or any other treaty or international agreement to which the United States is a party."

    In layman's terms this paragraph is giving the FDA authority to comply with the United Nations treaty that includes Codex Alimentarius - a World Trade Organization treaty. Codex limits the potency of all vitamins and dietary supplements.

    The citizens of the U.S. have just given-up their rights to choose what they consume....

    well the pictures really had no meaning so I took the time to condense it down to a single quote to save everyone time.

    sorry if it was confusing, I'm still digging through info trying to figure out if it really will affect me at all.

    I don't buy from farmer's market's and I don't have a garden...

    I'm thinking of planting a bunch of Peppermint now that Europe is having their's on the verge of restrictions...

    The latest figures on world saffron production: Iran 150/170 Mt., Greece 5/7 Mt., Morocco 2/3 Mt., Kashmir 2/3., Spain 1Mt. or less, Italy 100 kilos or less. just imagine how many people have jobs picking this herb just so we have a special spice for meals...

    now at 21 it won't replace opium, but take it away from the public by making it illegal and the price would sky rocket...

    you'd have the big ol fat and happy French chef down on the corner scoring some fresh herb...

    at $250 an ounce...

    The more I study the bill the more I think it is about the money it will create for Government...

    if you export cheap produce to America, it will affect your future...
