    "The Senate’s controversial FDA Food Safety Modernization Act (S. 510) now appears to be dead in the water!

    As we reported to you yesterday, the Senate passed its version of the Food Safety bill by a margin of 73 to 25, and sent it on to the House of Representatives for approval. Congressman Henry Waxman (D-CA) had previously agreed to accept the Senate’s bill in place of the House’s version, already approved, so this approval was expected to be pro-forma.

    But it turns out that Section 107 of the Senate bill contains a revenue-raising (i.e., taxing) provision. And such a provision is unconstitutional: “All bills for raising Revenue shall originate in the House of Representatives,” according to Article I, Section 7, of the Constitution. Because the Senate violated the funding origination clause, the House has implemented a procedure known as “blue slipping” to block the bill, keeping it out of consideration and sending it back to the Senate.

    The only possible “quick fix” would be a unanimous consent agreement in the Senate to strike that revenue-raising provision from the bill—but Sen. Tom Coburn (R-OK) has already stated that he will oppose, so unanimity will be impossible. Senate Majority Leader Harry Reid is now faced with some tough choices: spend a huge amount of time all over again to deal with this (which is unlikely in a Lame Duck Congress, especially considering how controversial the bill is); or do nothing, and allow the bill to die at the end of this Congress. This will mean a new Food Safety Bill will be introduced next year—but next year’s Congress will be very different from the current one, so we expect that the bill will look very different, and could be much more favorable to the natural health community.

    why did you start a new thread for this, the other is a sticky and will stay on top for future updates?

    and I'm curious why you say "but next year’s Congress will be very different from the current one, so we expect that the bill will look very different, and could be much more favorable to the natural health community."

    who do you think has been bought by the pharmaceutical industry? do you honestly think they are going to help in allowing production of natural vitamins?
    who do you think is paid by the ones pushing GM crops?

    if a special GM seed is made to maximize production for bio fuel and suddenly it shows up in supermarkets...

    wouldn't you think it would be important to find the source and quickly?

    That more than anything is what this bill should be targeting...

    how many health food companies are putting GM food in their vitamins? absolutely zilch...

    Rocky, none of those words are mine--I just provided a quote from Alliance for Natural Health, who think, as do other organizations (such as Natural Solutions) which are focusing on food freedom, that the more time we have to insist that changes be made to the legislation in question so that individual citizens and small farmers rights are protected, etc, the better chance we have to make it right.

    Perhaps you should address your questions to one of these organizations.

    I started a new thread because something finally happened, and I wanted forum members to take note.

    THE US SENTATE VOTED TO END FOOD FREEDOM IN THE UNITED STATES. TELL THE HOUSE OF REPRESENTATIVES TO ACT NOW TO KILL S. 510

    Roll Call, "The Newspaper of Capital Hill" announced today that S. 510 as passed by the Senate violates the Constitution. Because of that violation, it is possible that the House may "Blue Flag" S. 510, that is, send the bill back to the Senate. It is almost certain to die there.

    That is the outcome we want so it is vitally important for all of us to keep hammering the members of the House to make sure that they understand that we are adamant - and that we are watching who votes how on this Patriot Act for food.

    I do not know how this great good fortune occurred. All I do know is that we, you and I, have been fighting this bill for over a year. We fought it first when it was before the House as HR 2749. We came close, but we did not succeed in killing it.

    We kept it from moving forward for over a year, despite unanamous Senate agreement that it would pass (why not, of course, when the Food Safety Czar and the Secretary of Agriculture were both "Made Men" in the Monsanto Mafia?).

    Earlier this evening I went back into our archives to see just how many emails we have generated on this issue of Food Fascism dressed up as Food Safety. The answer was staggering: You, the most powerful net-roots in the country (the world?) have generated a staggering 5,777,485 emails on this issue through the Natural Solutions Foundation.

    Can we continue to impact and educate Congress to make sure that this "Blue Flag" takes place? I believe so.

    "A food safety bill that has burned up precious days of the Senate’s lame-duck session appears headed back to the chamber because Democrats violated a constitutional provision requiring that tax provisions originate in the House.

    By pre-empting the House’s tax-writing authority, Senate Democrats appear to have touched off a power struggle with members of their own party in the House. The Senate passed the bill Tuesday, sending it to the House, but House Democrats are expected to use a procedure known as “blue slipping” to block the bill, according to House and Senate GOP aides.....

    Section 107 of the bill includes a set of fees that are classified as revenue raisers, which are technically taxes under the Constitution. According to a House GOP leadership aide, that section has ruffled the feathers of Ways and Means Committee Democrats, who are expected to use the blue slip process to block completion of the bill.

    Or he could try to force the issue in the Senate after the House passes a new version of the bill. But in order to do that and still tackle the other issues, he would need a unanimous consent agreement to limit debate.

    According to Senate GOP aides, a unanimous consent agreement is all but certain to be a nonstarter because the bill’s chief opponent, Sen. Tom Coburn (R-Okla.), will not agree to such a deal.

    Coburn “will object and demand changes as [he has] from the get-go,” a GOP aide familiar with the situation said."

    The NY times reported the "lame-duck leadership" in the House will attempt quick passage! This must not happen.

    "Despite unusual bipartisan support on Capitol Hill and a strong push from the Obama administration, though, the bill could still die, because there might not be enough time left in the session for the usual haggling between the Senate and House of Representatives, which passed its own version of the bill last year.     Monday night Sen Coburn said the bill will raise food prices; add $1.5 billion to deficit; add unfunded state mandates. It will not increase food safety one bite.

The only way for the Democratic leadership to get the bill to the President's desk now is for the House to pass a new version of the bill and send it back to the Senate for a final vote. That's only possible with a unanimous consent agreement to limit debate. The bill's chief opponent, Sen. Tom Coburn (R-Okla.), will not agree to such a deal, so the bill is unlikely to become law.

    Six important amendments shepherded by the National Sustainable Agriculture Coalition that protected local, small and organic producers threaten to be lost in this final shuffle if the bill miraculously passes in the final moments of Congress's short lame-duck session.

    It's not beyond Food Inc.'s indentured servants in Congress to create this kind of hullabaloo for the very purpose of substituting a last-minute version of the bill that would help corporate agribusiness avoid meaningful regulation, while hurting their local, small and organic competitors.

    We've all heard that passing legislation is like making sausage, but the safety of our food and the future of small, local and organic food producers is too important to be left to a last-minute process that could give powerful lobbyists the opportunity to perform 12th hour slights of hand.

    Please call your Senator and tell them that the Food Safety Modernization Act is flawed - and, without the small/local/organic amendments, potentially dangerous - legislation. Ask Congress to instead encourage the FDA to fulfill its food safety obligations under existing law. Currently, the FDA only inspects 1% of the imports and 25% of the processing facilities in their charge, but seems to have unlimited resources to harass Amish farmers, raid food clubs and pull over raw milk deliverers.
