    Quote BISMARCK — State regulators decided Wednesday, Nov. 2, to draft a complaint against the developer of the Dakota Access Pipeline for failing to notify them right away about a cultural find, possibly the first time the agency has taken such action against a pipeline company.

    Public Service Commission Chairwoman Julie Fedorchak said she was “extremely disappointed” when she learned Dakota Access LLC had discovered American Indian artifacts in the pipeline route but had not notified state regulators.

    The company, a subsidiary of Dallas-based Energy Transfer Partners, did notify the State Historic Preservation Office about four cairns discovered during construction in Morton County, and the pipeline was rerouted to protect the sites in coordination with the state archaeologist.

    The company’s permit requires that the Public Service Commission also will be notified of unanticipated discoveries and give clearance to proceed with construction. The commission learned about the discovery from its third-party inspector and then requested information from the company, which formally notified the commission on Thursday, 10 days after the find.

    Fedorchak said North Dakota’s regulatory approach depends on a level of trust, which is verified by the third-party inspectors.

    “This trust demands an exchange and full and prompt disclosure of key information,” she said.

    Staff for the three-member, all-Republican commission will draft a complaint, likely by the end of the week, and also propose a fine.

    Dakota Access can request a hearing or pay the fine and move on, Fedorchak said.

    The maximum penalty the commission can issue is $10,000 per day per violation, or a maximum of $200,000. Fedorchak said she doesn’t view this issue as warranting the maximum fine.

    The commission has not issued a complaint for a pipeline company since at least 1988.

    The order granting pipeline construction does not specify a timeframe for reporting such discoveries.

    Commissioner Brian Kalk said the “implied intent” is for things to be reported immediately or once the company has enough facts. Kalk noted the company has promptly notified the commission in other instances, such as worker injuries.

    Commissioner Randy Christmann recused himself from the discussion because the pipeline crosses his mother-in-law’s property.

    The company said in an Oct. 27 letter the delay in notifying the PSC about the discovery was “a result of the find occurring simultaneously with Dakota Access officials coordinating an on-site visit for various officials,” including U.S. Rep. Kevin Cramer, R-N.D., Standing Rock Sioux Tribe Chairman Dave Archambault II and the U.S. Army Corps of Engineers’ district commander.

    That tour took place Oct. 20, three days after the find.

    The Standing Rock Sioux Tribe was not notified about the discovery or invited to participate in the evaluation of the site. State archaeologist Paul Picha said notifying the tribe was not a requirement of the unanticipated discovery plan.

    Calvin Grinnell, who works for the Three Affiliated Tribes historic preservation office and is a former chairman of the State Historical Board, attended Wednesday’s meeting at the request of a tribal member.

    Grinnell said he thinks the commission is “following in the right direction” by considering a complaint against the company for the delay in notifying regulators.

    Susan Beehler of Mandan, who also attended the meeting, said she thinks the Public Service Commission can do more to make it easier for the public to participate in the process.

    “I’m wondering if we couldn’t do better as a state?” Beehler said.

    Rattled by Idle No More and Mi’kmaq-led anti-shale gas demonstrations, the RCMP compiled a list of 89 individuals considered “threats” as part of an operation aimed at improving the federal police force’s intelligence capacity when facing Indigenous rights demonstrations, according to an internal intelligence report.

    The operation, dubbed Project SITKA, was launched in early 2014 to identify key individuals “willing and capable of utilizing unlawful tactics” during Indigenous rights demonstrations, according to the RCMP report, obtained under the Access to Information Act by two researchers working on a book about state surveillance of Indigenous peoples. The intelligence report was to provide a “snapshot of individual threats associated to Aboriginal public order events” for that year.



    The report, completed in 2015 by the Mounties’ National Intelligence Coordination Centre, recommended the RCMP remove Indigenous rights activism from the terrorism-extremism umbrella and instead create a new category for intelligence gathering on the issue. The report also recommended the RCMP maintain updated profiles on identified Indigenous rights activists in police databases.

    “I think that this is coming out of the fallout in 2013 with the Idle No More uprising and what happened at the end of the year with Elsipogtog,” said Andy Crosby, the Ottawa-based researcher who obtained the document along with Jeffrey Monaghan, an assistant criminology professor at Carleton University. “This really had an impact on the psyche of the settler state.”

    The researchers obtained the RCMP report in an Access to Information request package from the Canadian Security Intelligence Service (CSIS).

    The RCMP did not provide comment on the report as of this article’s posting.
    CSIS did not respond to a request for comment.

    Efforts to halt the construction of the Dakota Access Pipeline (DAPL) have met with large scale, militarized police operations designed to protect pipeline construction.     #NODAPL Water Protectors Climb into DAPL Pipe in Boone County, Iowa

    PDATE: This morning @2AM in Boone county, IA, 3 of our water protectors climbed into the pipes and put their bodies as obstructions to prevent the construction from completing the pullback process under the Des Moines river. As of now, 7:30AM, they are still in the pipes and will be occupying indefinitely, risking their lives to protect water for us all.

    Have just been looking at the anti trump demos . Think I saw 1 policeman on a bicycle wtf ! Not that i want anyone to be met by mace and violent action just can't get my head round the contrast

    Widespread outrage over both the construction of the Dakota Access Pipeline and violent police crackdowns rages on. That outrage is spreading even to police agencies now returning from deployment to the reservation. Two departments have already refused to return, citing personal and public objections. As if that wasn't enough, an army of sympathizers is re-purposing social media to combat police efforts in Standing Rock.

    Minnesota's Hennepin County Sheriff's Department is among that group. Lawmakers, according to MPR News, found police activities in Standing Rock "inappropriate". It's to the point where they're considering rewriting legislation to avoid future deployments to incidents like the pipeline resistance.

    Smith's comments split the state's government, however, and she was targeted. Minnesota State Rep. Tony Cornish condemned Smith for prioritizing "the rights of protesters over the needs of law enforcement", saying she should apologize to the cops.

    Sheriffs from Wisconsin's Dane County were more empathetic, pulling out and refusing to return. According to the Bismarck Tribune, Sheriff Dave Mahoney made the decision after a "wide cross-section of the community" decried the deployment. "All share the opinion that our deputies should not be involved in this situation", says Mahoney. Dane County's deputies were deployed to Standing Rock for around a week. Sources report Dane County wasn't involved in recent arrests, a string of which scooped up an alderwoman from Madison Wisconsin.

    Ald. Rebecca Kemble traveled to North Dakota as a "legal observer", filming and participating in prayer ceremonies. When Morton County officers - if they cans till be called that - grabbed and arrested her for engaging in a riot. According to Kemble, no riot was happening. Other Wisconsin departments have been recalled, with at least one staying behind for a more couple weeks.

    Many other citizens have been charged for trespassing and participating in non-existent riots, including journalists. One of the most renowned reporters who's faced DAPL (Dakota Access Pipeline)-related charges was Amy Goodman of Democracy Now. Goodman's team filmed dog attacks by DAPL contractors who lacked proper K9 licenses. The contractors have also been accused of unethical surveillance, intimidation, and sabotaging the movement by attempting to make authorities believe the protesters have finally turned violent

    Other journalists, including documentarian Deia Schlosberg, face decades in prison for filming climate activists at a separate oil project. Journalists from the independent outlet Unicorn Riot, who recently reported use of a sound cannon on water protectors, have also been arrested.

    Thousands of opponents to the pipeline have flooded Standing Rock to repel construction and police brutality. More still have taken to the internet, spreading information in the form of writing, video, photography, and art. Among the renegade tactics is using Facebook to "check-in" at Standing Rock. According the Guardian, over a million people - even people I know - have joined the action.

    It began with a Facebook post, disclosing that Morton County sheriffs are allegedly using Facebook check-ins to track protesters. "Checking in" - whether you're at a friend's, restaurant, or escalating resistance - pinpoints your location to a tee. Once you check in, a notification is sent out to, yes, your friends, but theoretically anyone who's capable of watching. It's yet another tool in the bag of tricks authorities have deployed against civilians, and are likely utilizing in Standing Rock.

    Some detractors have dismissed the social media action as a waste of time. An editor at The Fifth Column challenged these in a Facebook post, narrating a debate on the subject he'd had. Editor Justin King pointed out that even if the check-in's wasted two minutes of time, multiplied by hundreds of thousands, that equates to two months of wasted police work. Now imagine how ineffective the surveillance may be with millions continuously checking.

    Morton County Sheriff's, Guardian reports, called claims of police surveillance misguided "rumors". Morton County, by their own account, isn't "monitoring Facebook check-ins for the protest camp or any location for that matter." Before you trust them, consider that Facebook access for water protectors was reported as "blocked' during a military-style raid on a camp.

    Data Collection Nationwide
    Other police departments are similarly sketchy when pressured to speak on their surveillance technologies. Wisconsin's Milwaukee PD hid the use of cell site simulators, or Stingrays, from courts for months. Stingrays mimic cellphone towers, thus tricking phones into providing all manner of user information and data.

    Nearby, the Wauwatosa Police Department, despite having admitting to "collecting and analyzing cell phone data" in its public reports, denied ever even coming close to a Stingray. It took the department 5 weeks to respond to that open records request, which is considered unusually long. It remains unknown how Wauwatosa PD, which has been blasted for lack of transparency before, collects cell phone data.

    The Hand's Fingers In Open Rebellion
    In addition to the general retreat of departments, two officers have already turned in their badges in support of the protesters. North Dakota water protector Redhawk, MintPress reports, disclosed the revelation. The individual also pointed out "you can see it in some of them, that they do not support the police actions." "Some are waking up", they continued, "we must keep reminding them that they are welcome to put down their weapons and badge and take a stand against the pipeline as well." Hints of shame could be seen in the faces of officers who confronted protesters as they blocked them from prayer grounds. As the protesters condemned officers, some of whom looked down or off to the horizon in shame.

    The modern era of internet and technology gifts us with a plethora of ways to express ourselves, and help one another. Standing Rock is quickly becoming a stand out of that fact. Citizens, journalists, and activists are all using the internet to achieve their own goals. Whether that be spreading information being blocked, tracking police movements, sending food and rations or just voicing opinions. Standing Rock's resistance is spreading globally, with protests occurring in Europe and elsewhere. As long as construction doesn't stop, the movement won't rest.

    Police officials, of course, declined to comment on their return from North Dakota or their feelings on what's happening there. It's also made the task of rebuilding trust with the community an even loftier uphill battle. "I do not support Sheriff Stanek's decision to send his deputies to North Dakota", says LT. Governor Tina Smith, "nor did we approve his decision to begin with. I do not have any control over the Sheriff's actions, which I think were wrong, and I believe he should bring his deputies home if he hasn't already."

    Iron Eyes addresses the Dakota Access Pipeline during a sold out TEDx event in Charlottesville, VA. Do not allow the fight for clean water to be racialized. What the Governor, Law Enforcement & Media are engaging in, is villainizing, dehumanizing & trying to preempt the moral & legal authority in this battle. They are creating an other, making people fear an Indian gathering when half the people are not Indian. Fear mongering. Water doesn't care what color your skin is, what language you speak or whether you lean left or right. Let's build bridges not walls.

    Neil Young Celebrates His 71st Birthday By Performing At Standing Rock

    Neil Young celebrated his 71st birthday on Saturday by performing for Dakota Access Pipeline protesters at Standing Rock Reservation.

    “Got my birthday wish today,” Young writes in a Facebook post.  “My girl took me to #StandWithStadingRock.”

    Young traveled to Standing Rock to walk around the protest site and perform music for protesters who have been camped out there in opposition to the pipeline.  The “Heart Of Gold” singer has been outspoken in his support for anti-pipeline protesters and has voiced his concerns about the negative environmental effects of the project.

    In September, Young recorded a song bout the Keystone XL Pipeline called “Indian viGivers” which makes reference to Native American protester Dale American Horse Jr. who chained himself to a digger at a pipeline worksite in North Dakota.

    Current live feed of large attacks upon water protectors. People are being attacked point blank with bean-bag shots, water cannons in below freezing weather, tear gas, and L-RADs on the ready.

    RT Update: 167 water protectors reported injured, 3 in critical condition.

    Quote The Sunday clashes reportedly occurred when several anti-pipeline protesters used a semi truck to remove burnt out military vehicles from the area, which were left over from a protest earlier in November. That allegedly prompted authorities to respond by firing tear gas.

    Demonstrators protesting against Dakota Access Pipeline say they are trapped on a bridge as North Dakota police fire tear gas, water cannon and concussion grenades at them, according to live reports on social media.

    The demonstration is taking place on Highway 1806, just north of the main protest camp against the pipeline.

    Officers have deployed water cannon on the protesters in below-freezing temperatures, and are using LRAD sound devices. Earlier, there were reports of rubber bullets fired. Vehicles which appear to be armored humvees have arrived at the scene.
