just got flagged down by a nice little old lady outside of yates. Thought it was car trouble but she asked me how to get supplies to the "big camp." i told her just keep going straight and it will be on the other side of the bridge just outside of cannonball. Then she asked if the bridge was going to give her any problems i said no its a little bridge. Then she whispered but what about the sheriff and the national guard? She didnt want to get shot or arrested for helping the camp. I told her she'd be fine that's farther up north... She thanked me and went on her way. Said she felt better now. Good job north dakota. Your 1800 style responce to "those indians" and bull**** press releases have little white ladies afraid to do what their heart tells them is right. This lady drove all the way around to enter from the south and flagged down a huge indian for help rather than deal with the people who are supposed to protect and serve? This isn't an anti cop post. It's just a post about a department who doesn't know how to do they job unbiased and the bull**** it's causing.

Construction on a contested portion of the Dakota Access pipeline can move forward after a federal court dissolved an administrative injunction and refused to grant an emergency request to continue freezing work on part of the project.

The U.S. Court of Appeals for the District of Columbia Circuit today issued a short order denying a request from the Standing Rock Sioux Tribe, joined by the Cheyenne River Sioux Tribe, to continue a pause on the oil pipeline.

The order also dissolved an existing temporary work freeze, meaning Dakota Access LLC can continue work on a section of the pipeline west of Lake Oahe in North Dakota (Greenwire, Sept. 16).

But the judges appeared sympathetic on the merits of the case, noting that their denial was a narrow decision and "not the final word" on the tribe's complaints about consultation.

Lake Oahe and its shorelines remain off-limits while the Army Corps of Engineers considers whether to issue an easement there.

The appeals court now will consider whether to uphold an order from a lower court that denied a broader injunction on the length of the pipeline. The tribe says the corps failed to adequately consider their concerns when it approved water crossings for the project.

In its order today, the three-judge panel of the appeals court seemed to take the tribe's complaints to heart.

"Although the tribe has not met the narrow and stringent standard governing this extraordinary form of relief, we recognize Section 106 of the National Historic Preservation Act was intended to mediate precisely the disparate perspectives involved in a case such as this one," the order said.

"Its consultative process — designed to be inclusive and facilitate consensus — ensures competing interests are appropriately considered and adequately addressed," it continued. "But ours is not the final word. A necessary easement still awaits government approval — a decision corps' counsel predicts is likely weeks away; meanwhile, intervenor DAPL has rights of access to the limited portion of pipeline corridor not yet cleared — where the tribe alleges additional historic sites are at risk. We can only hope the spirit of Section 106 may yet prevail."

BISMARCK, N.D. — The U.S. Army Corps of Engineers won’t yet authorize construction of the $3.8 billion, four-state Dakota Access oil pipeline on federal land in southern North Dakota, it said Monday, along with reiterating its earlier request that the pipeline company voluntarily stop work on private land in the area.

The corps’ statement came in the wake of a federal appeals court ruling Sunday that allowed construction to resume on the pipeline within 20 miles of Lake Oahe. That ruling sparked a large protest Monday in North Dakota that led to the arrest of 27 people, including “Divergent” actress Shailene Woodley, who is known for her activism.

A joint statement from the Justice Department, Interior Department and the corps said it was not ready to allow pipeline work to continue on its land bordering and under Lake Oahe, a reservoir that the agency manages on the Missouri River and the water supply for the Standing Rock Sioux Tribe. It also called on pipeline owner Dallas-based Energy Transfer Partners to voluntarily stop work in the area; ETP didn’t respond to a request from The Associated Press for comment Sunday or Monday.

The Standing Rock Sioux tribe believes the pipeline, which will cross through North Dakota, South Dakota, Iowa and Illinois, will destroy cultural artifacts and could pollute drinking water. The tribe had asked the appeals court to continue blocking work on the section of pipeline while it appeals a lower-court ruling from September that let work on the entire pipeline go forward.

Standing Rock Chairman Dave Archambault II said in a statement Sunday that the tribe “is not backing down from this fight.”

Been to the lee county pipe line protest area a couple times now since back from standing rock...they need more people...don't wanna draw att while there cause me and M short/county attorny and police have a some what negative view of each other and jail isn't the goal.funny I new short and some of them lacky back in the day when there corrupt ass were doing things that shoulda had em disbarred at the very least...and got away with it...I digress....lee county needs help and with the to few people showing up they are still doing a wonderfull job slowing down DAPL... considering thee odds.

The show of force by North Dakota is nothing short of 7th Cavalry mentality!

How can the state justify its draconian actions, over saturating a venue far smaller in area and population than Bismarck?

The population of Bismarck is about 60,000-70,000 and it covers roughly 31 square miles. Bismarck has 16 police officers per 10,000 residents (total 103). Bismarck’s policing budget for 2015 was approximately $11 million ($7,486,924 for salaries and wages).

The governor has dispatched the National Guard and a horde of law enforcement to a patch of prairie smaller than a square city block and a couple thousand unarmed citizens.

The Department of Emergency Services’ recent request for “up to $6 million borrowing authority” “for providing assistance to local law enforcement” is utterly astonishing! Would the state respond in this same manner if a group of Christian parishioners gathered on the open plains to express their constitutionally protected rights?


Six million dollars? The DES representative, Cecily Fong, said “We plan and evaluate every possible scenario,” and that is “how the $6 million figure was reached.” Surely the average taxpayer can’t accept such a clumsy explanation.

Why have state officials responded in this manner? Statewide coordinated attack by military, law enforcement and private security; coupled with activist judges; lawyers; state agencies and biased media against an unarmed gathering of citizens praying to protect water resources — which we all need.

The state must absorb the total cost associated with its entire “shenanigans” of creating fear and brutalizing an unarmed group of praying citizens.

There is absolutely no justification for the violent actions of the state officials who may also be violating the human rights and civil rights of citizens who have gathered to pray and protect the waters of this country.

Three groups that support the Dakota Access crude-oil pipeline and similar oil and gas transportation projects separately expressed concerns on Oct. 11 after protesters broke into facilities near the Canadian border and elsewhere and tried to close pipeline valves manually.

The activists’ actions were a danger to themselves, workers, and the surrounding communities while also potentially disrupting fuel supplies to refiners and, ultimately, consumers, American Fuel & Petrochemical Manufacturers Pres. Chet Thompson maintained.

Thompson cited reports that activists in Clearbrook, Minn., were caught trespassing and forcing the shutdown of several pipelines.

TransCanada Corp.’s Keystone pipeline in Walhalla, ND, also saw protestors and closed a line near that location.

Spectra Energy’s Express pipeline in Coal Banks Landing, Mont., also closed in the face of protests.

Together, these pipelines supply more than 2.5 million b/d of crude oil to American refineries, Thompson said. “Criminal trespassing, destruction of property, and the creation of potentially unsafe conditions, are not proper forms of protests,” he said. “The belief and politics of a few eco-terrorists do not supersede the rights of millions of consumers who could face increased costs because of reduced supplies of energy.”

Association of Oil Pipe Lines Pres. Andrew J. Black also condemned protesters break-ins and attempts to close pipeline valves manually. “These are industrial facilities that operate under high pressure, and we don’t want anyone to get hurt or cause a release into the environment,” he said.

Black explained that pipeline operators place shutoff valves periodically along the line’s length to help control the flow of product and isolate certain segments of pipe if needed. When operated correctly by trained engineers, pipelines are the safest way to transport the large volumes crude oil and petroleum products US consumers need, he said.

Possibly serious consequences
However, pipelines operate under as much as 1,000 psi of pressure, Black said. Incorrectly closing a valve in the middle of a pipeline without simultaneous control of pumps before and after the valves could cause a pressure surge, rupture the pipeline, and cause a spill that could have a public and environmental impact, he warned.

An industry review of pipeline valve incidents found nine different examples of pressure surge releases, with one resulting in nearly 4,000 bbl of crude oil being spilled, the AOPL president said. For these reasons, pipeline facilities behind lock-and-key are protected for the safety of the public.

Vandalizing, attempting to operate or otherwise tampering with pipeline equipment is dangerous and risks hurting those involved, the public, or the environment, he said.

In Houston, Consumer Energy Alliance Pres. David Holt said protesters’ extreme and illegal actions place US consumers at risk. “Intentionally breaking the law to trespass and shut down critical infrastructure like this can cause serious repercussions and harm. These lines move large volumes of much-needed energy to families and businesses across the nation. Extremists are also putting themselves and the very environment they intend to protect at risk,” he said.

“The steps taken by these individuals to sabotage pipelines—in addition to the threats, intimidation, and cyberbullying tactics they are using—clearly show that their agenda has nothing to do with protecting the environment and everything to do with shutting down the American economy and hurting everyday Americans, families, small business, and our economic way of life,” Holt said.

“Pipelines have proven to be the most effective and environmentally sound method of transporting fuels, which are critical to our modern way of life,” AFPM’s Thompson said. “Eco-terrorists will not win support from consumers or policymakers by disrupting fuel supplies and driving up the costs of products that Americans depend on every day.”

LATEST LOUISIANA OIL PIPELINE RUPTURE, PHOTOS; #NODAPL

Yesterday, I flew over the latest pipeline leak on the Louisiana Gulf Coast and took plenty of footage to document the damage. The scene out there is pretty nasty and reminiscent of the 2010 BP disaster, though much smaller in scale. My flight was sponsored by SouthWings.org and piloted by the incredibly skilled Lance Rydberg.

South Louisiana continues to get ravaged by pipeline and other leaks. The latest came in the form of an estimated 5,250-gallon crude oil leak on Chenier Ronquille, a barrier island on the edge of Bay Long in southern Barataria Bay. The incident was allegedly caused by a contractor working on a restoration project aimed at restoring the effects of, well, the BP disaster. Apparently heavy equipment operated by Great Lakes Dredge & Dock Co. accidentally cut through the pipeline owned by Harvest Pipeline Company, an affiliate of Hilcorp Energy. You may recall that Hilcorp was responsible for another nasty pipeline leak just a few weeks ago in Lake Grande Ecaille, also part of Barataria Bay. It’s now being reported that at least 200 oiled birds have been spotted.

As I was flying over this leak I kept thinking about the struggle going on in North Dakota where the Standing Rock Sioux Tribe is desperately fighting to halt construction of a section of oil pipeline out of fear the pipeline could contaminate its drinking water and sacred lands. Having witnessed and documented countless pipeline and other oil leaks here in the Gulf Region, I stand firmly with the hundreds of protesters in their struggle to prevent this from ever happening on their sacred lands. Over the years and on several occasions, I have been asked by Native American tribes from around the nation to take healing ashes given to me by the tribes and to drop them into the Gulf, which I have done from planes and boats. I’m not sure if this will help in the fight going on now up there, but I offer these images and any footage I have to those tribes currently fighting in North Dakota to use as evidence that oil pipelines are a major threat to our water and every thing we hold sacred.

A little over a month ago, private security guards working on behalf of the Dakota Access pipeline company clashed with Native Americans. They were protesting the bulldozing of land on a Standing Rock Sioux tribal burial site in southern North Dakota.
Guards sprayed protesters with pepper spray and unleashed attack dogs on the crowd – which included children – in a reprehensible example of corporate violence.
Filming the protests in North Dakota that day was a crew from Democracy Now! The show's award-winning anchorwoman Amy Goodman conducted interviews during the protests and covered the dog attacks as they unfolded.
The show's subsequent special report about the incident went viral, with more than 14 million people viewing it on Facebook.
Shortly thereafter, the Obama administration intervened, stopping pipeline construction on Army Corps land and asking the company to "voluntarily pause all construction activity" in the area.
This victory for the Standing Rock Sioux would likely not have been possible without the aggressive independent reporting of Democracy Now!, whose pictures created significant public pressure.
On September 8th, five days after the events, local authorities took the incredible step of filing criminal trespassing charges against Amy.
Prosecutor Ladd Erickson argued publicly that Amy was not acting as a journalist at the time of the protests.
"She's a protester, basically. Everything she reported on was from the position of justifying the protest actions," he said.
Erickson added that he was distressed that Goodman had not mentioned alleged assaults on guards, or trespassing.
A Hawaii-based attorney named Teresa Tico wrote Erickson to complain. She first asked if he had been quoted correctly when he pooh-poohed Goodman's status as a journalist. She also hailed Goodman's career and hastened to reassure Erickson that Amy is, in fact, a reporter.
This, weirdly enough, is where my name comes up in this story. Erickson wrote back to Tico and said:
"One of my favorite writers is Matt Taibbi from Rolling Stone and I try to track his stuff. Ms. Goodman has interviewed him a couple times that I have seen and that is my primary source for knowing who she is."
Democracy Now! passed on this strange note and asked for comment.
I don't normally like to disagree with anyone possessing the excellent judgment to be a regular reader of mine, but Erickson is dead wrong here.....
