This week, a CNN insider will blow the whistle and through Project Veritas will release dozens of recordings made of officials at the highest levels of CNN, revealing a political agenda, bias and misconduct hidden from public view.

This series of tapes — which we think will be the biggest story of the year for Project Veritas — blends two extraordinary series of events; a brave insider secretly recording at work. This is a hard-hitting piece of hidden camera muckraking into one of the supposed “most trusted names in news.”

A major aspect of this story is the heroic actions of an insider.

By far, the most often asked question (and most important) is “What can I do?” There is a new genre of answer—you can wear a hidden camera and blow the whistle on your employer through Project Veritas. This new movement, which we are calling “Be Brave. Do Something” is enabling citizens to become catalysts for reform. It is the modern incarnation of what Jack Anderson once described as “the sirens of Greek mythology, who, by their seductive singing, enticed unknowing wayfarers to abandon the cramped boredom of safe passage for a hazardous try at strange excitements and gratifications.”

If Project Veritas is the siren, the wayfarers this year have included two Google employees, a Facebook subcontractor and a Pinterest engineer who gave up their salaries and careers for the public’s right to know. We’ve had the privilege to entice these angels, knowing full well an army of grateful citizens are behind them. Project Veritas supporters have their backs no matter what as long as they stand up for what is true and important for the public to know.

“This was an act of atonement. An attempt to make my conscience clear,” said Zach Vorhies, who leaked us the “Algorithmic Unfairness’ document inside Google.
“Are we going to just let the biggest tech companies decide who wins every election from now on?” said Greg Coppola, who lost his job inside Google speaking out.
“I felt the public had a right to know,” said the Facebook insider who was fired for taking screenshots of them “Deboosting” videos for political reasons.
“For me there was no other option. I could go through the comforts of life, but what are we saving our ammo for,” said Eric Cochran, the Pinterest engineer, who was escorted out the building. “They can stop one man, but they can’t stop all of us.

And so it was destiny that the CNN wayfarer met me in the Spring by a happenstance, inspired by the actions of the others who came before him, I received a simple answer as to why: “I started at CNN with a dream to work in media, but my dream had become a nightmare,” With that, a hidden camera began to record…well…everything.

In our current media landscape, people are famous figures for notoriety. Celebrity is a big name. Hero is a big man. So there is a new breed of heroes – the sort that Daniel Boorstin spoke about in his book The Image: “In our world of big names, our true heroes tend to be anonymous. In this life of illusion and quasi-illusion, the person of solid virtues who can be admired for something more substantial than his well-knowness often proves to be the unsung hero: the teacher, the nurse, the mother, the honest cop, the hard worker at lonely, underpaid, unglamorous, unpublicized jobs.

And then there is the act of investigating the media itself. Critics and political marketing industry operatives will rush to condemn this series of tapes with broad platitudes on how any efforts are “anti-journalist.” We’ve heard “The truth is more important than ever,” “Democracy Dies in Darkness,” and so forth. But behind the veneer of “holier than thou” sanctimonious attitudes are some ugly truths about the 4th estate.

But they are not new gathering. And our press isn’t truly free.

In fact, based upon what the people in these tapes say, it’s no longer even doing legitimate news gathering.

The media has become an industrial system of production that manufactures consent. This is true whether said by Noam Chomsky, James O’Keefe, or Glenn Greenwald. Political implications aside, the media has become an organ of propaganda that is only about commercialism, clicks, ratings, power and influence and political advocacy. All the while, the press evades scrutiny by appealing to rights afforded by the 1st amendment, while adhering to none the accompanying duties.

Big Tech and Big Media Corporations have more power than all three branches of government, but who holds them accountable? Who watches the watchmen? And why is it so important somebody holds them to account? Because doing their jobs is required in a Democracy.

The public’s right to know make all other rights in our society possible, because our government exists with the consent of the governed, and this consent must be informed. People will make their own decisions when they are properly informed.
Real journalism shouldn’t only be discourse, moral judgments, and conclusions. It shouldn’t have to engage in relentless speculation, punditry and stenography, opining to the masses. It should not abuse participation in advocacy work for anonymous leakers where sources in government get to set the agenda.

Investigative reporters (the real ones) have the duty to go beyond what somebody wants us to publish. What journalists ought to do is simply engage in the empirical method — to a degree so real — that the resulting truths transfix and anesthetize. When people are able to see what is happening, it becomes more real. We show that transgressions are in fact transgressions. The way to achieve proper reforms is to precisely capture reality.

On the Economic side, there is no question that much of corruption is due to economic pressures. Real truth finding often is a loss-leader in any business sense, and that’s why it is almost completely extinct from commercial news gathering. Being “the tip of the spear” often puts us in an exposed position where the results of our work reverberates into embarrassment, resignations, deeply penetrates the fabric of people’s lives and violates social boundaries. That means litigation, retaliation and economic pressures. “Many of the large media companies are fully integrated into the market, and for the others, too. The pressures of stockholders, directors, and bankers to focus on the bottom line are powerful.”

The first step towards reforming the system is accurately reporting reality that shakes people awake with moral indignation. But in the digital era, with streaming visuals, hard to refute, we’re able to cut through propaganda like a hot knife through butter, trusting the power of free people to make the best policy decisions if they are equipped with the truth. We break down the barrier between the realms of how public officials behave in public and private, and therefore tackle the great lie.

It seems like most of the people who are supposed to govern are busy staring into a TV camera. As paraphrase as it was once said, one cameraman has more power than us senators. They are protected from any public scrutiny. They demonstrate Sanctimonious, holier-than-thou smugness. Journalists are no longer about public service, and in private, they will change the subject if you talk about democracy dying in darkness. It’s really about commercialism, clicks, ratings, power and influence.

It’s not just politicians who kowtow to the cable news order and to the power it yields, it’s the wealthiest man in the world saying that his most proud accomplishment was purchasing his woke, clickbait farm.

Jeff Bezos wrote on the Medium: “Even though The Post is a complexifier for me, I do not at all regret my investment. The Post is a critical institution with a critical mission. My stewardship of The Post and my support of its mission, which will remain unswerving, is something I will be most proud of.”

This man who has built the most powerful company on earth is most proud of the fact he bought a newspaper which isn’t going to earn him any money.
But make no mistake: for Bezos, this isn’t about informing the masses, it’s about power and influence.

So, in a country governed by public opinion, and where public opinion is largely governed by the press, isn’t it critical to understand what governs the press?
And this is why Project Veritas will be exposing CNN this week.

CNN is East Coast establishment, CIA, as were most former dems and republicans. Note no president in the past has been smeared quite like Trump, who represents the military Christian part of the "deep state," whether he is aware of that fact of even cares. Fox news respresents or represented the military. I heard it was recently purchased by Disney so don't know where that's at currently.

Anyway, would like to take a steamroller to the whole lot of them. They ALL have behind the scenes controllers with agendas.

My name is Cary Poarch and I am the insider who blew the whistle from within CNN. As you might expect, this was not a decision I made lightly. I considered quitting and just looking for a new place to work, but that seemed like the easy way out when exposed to what concerned me.

I was inspired to wear a hidden camera after I saw and heard information I believed the American people deserved to know, and saw the Facebook whistleblower from earlier this year. I reached out to Project Veritas and was provided a camera with which I recorded firsthand evidence of rampant bias across the network, and President of CNN Jeff Zucker’s personal vendetta against the President of the United States. I also recorded a number of longtime CNN employees, many of whom truly want to do their journalistic best, confessing that they are bothered by the bias and relentless drive for ratings that rule the network.

Other networks own their bias, but CNN portrays itself as middle of the road. I believe the American people deserve to know the true agenda of President Jeff Zucker so they understand what’s really going on behind the scenes at CNN and can make informed choices as consumers of media.

As a Bernie supporter in 2016, my goal in blowing the whistle was not to score a win for one side or the other. In fact, it was driven by disappointment. I landed what to me was a dream job as a contracted satellite uplink technician for CNN’s Washington, DC, bureau. Instead, I found myself bothered by one-sided coverage, a relentless drive for ratings over meaningful content, and the skewed judgment of a network president who prevents other stories from overtaking his vendetta against Trump.

At the same time that I embarked on this journey, I am starting another one. In a few months, I’ll become a father for the first time and am settling in a new state far from the Capitol. I hope to be able to continue the work that I enjoy doing, but I’m not sure if that will be the case or when. My concern now that I’ve fulfilled what I saw as my duty, is how I will care for and support the people that I love.

I’m asking for your help as I stare into a vast unknown and what it will entail, from the small things like basic moving costs to the potential for having one of the most powerful media corporations in the world coming after me. I did what I believed was the right thing to do.

If you create a giant, you gain extraordinary visibility, and if the giant develops an unsightly and grotesque case of fungal disease, that's a problem.

CNN was born in 1980. At the time, it was the first television network offering 24/7 news, and it was the first network offering nothing but news in the US.

In 1991, CNN's coverage of the Gulf War reached a billion viewers worldwide.

Today, CNN International reaches 200 countries.

That's a giant.

But from the beginning, back in 1980, there was a major question: how was CNN going to fill up all that time every day with news? Face it, television networks, without bells and whistles, could boil down their coverage of a day's events in four minutes. That's because their analysis is so thin. It's all surface.

When you assiduously avoid looking into WHO REALLY RUNS THINGS, the well runs dry quickly. When you avoid detailing the role of mega-banks and mega-corporations and groups like the Trilateral Commission and CFR and Bilderberg, and when you never define Globalism and reveal its true agenda; when you discover nothing of value about the CIA; when you never broach the subject of American Empire; when you refuse to examine the horrendous effects of the medical system; when you fail to expose the ongoing collaboration between establishment Democrats and Republicans, and the influence of lobbyists (e.g., Israeli fronts); when you intentionally remain blind to the destruction of the American Republic and the Constitution; when you ultimately side with National Security and the Surveillance State; when you manage to sidestep actual ongoing environmental pollution flowing poisonously from a number of sources; when you refuse to reveal the full effects of open borders; when you never connect the dots and instead rely on limited hangouts...

What are you left with? What do you do, for 24 hours of every single day?

Mainly, you wait for "big events," and then you launch wall to wall coverage for as long as your viewers can stand it. The Gulf War; the first black president; the worst president and the worst human being in history (Trump).

You develop bloated panel shows, during which pundits babble across each other like meth addicts in a rubber room.

You call "the news" The Situation Room, as if you're breaking vital stories every 30 seconds.

You plow the same ground over and over, until not even weeds can grow in the soil.

You fill your basket with the eggs of the "progressive agenda." You go all in.

You fake stories.

You do a bizarre version of affirmative action with your on-air talent, as if this will result in "fairer" coverage.

And day by day, the public realizes you're crazy.

You can't hide, because you aren't just laying on three fake newscasts a day; you're ON all the time.

You're hoping against hope for a new terror attack or a natural disaster, so you can flood the airwaves with live reports, but in the meantime, you'll stick with 24/7 Trump, because he's "the most interesting man in the world." He's creating your ratings, such as they are. You're the tabloid at the checkout counter in the supermarket, and he's always on the cover. You love him. You need him. It doesn't matter whether he's done what you say he's done.

That's never been the issue.

Without his presence, you'd be raking leaves outside a nursing home. You're the self-appointed Pope, and he's Satan, and that means dollars.

As a bonus, you're doing what you're supposed to be doing, on behalf of Globalism and the "interdependent world." The risk of Trump speaking words of Nationalism against Globalism (whether or not he meant them) is too great to go unchallenged. The international system (aka technocracy) that has been under construction since the dawn of the 20th century must not be derailed.

So whether it's the way Trump sips water from a bottle, or scratches his nose, or treats one of your so-called reporters, you're the National Enquirer blowing it up into a scandal of the moment. You're leaking leaks from pipes that don't even exist. Maybe he has a love child; look into that. Maybe he has another wife he never divorced. Maybe he's an alien from Venus.

Keep those ad revenues flowing, no matter what. Face it, you've got nothing else going for you. Connect Trump to the latest news from Tibet if you have to. Or Madagascar. Or Tierra del Fuego. He caused the cold snap across America, because he didn't sign the Paris Climate Accords.

You're CNN, "the most trusted name in news."

Ride that horse all the way to the end of the road.

If you end up ****hole broke, somebody will bail you out. Warts and all, you're too big to fail. Not just because of your work against Trump, but because The News, as the public knows it, must survive.

Otherwise, the people will find out what's really going on in this world and who runs things. And that must never happen.

That's the prime situation in The Situation Room.

Who could have guessed, say, 15 years ago, that the following exchange would occur on CNN, in March of 2014?

As reported by New York Magazine, CNN host Don Lemon, discussing the disappearance of Malaysia Airlines Flight 370, said:

"People are saying to me, why aren't you talking about the possibility - and I'm just putting it out there - that something odd happened to this plane, something beyond our understanding? What if it was something fully that we don't really understand? A lot of people have been asking about that, about black holes and on, and on, and on, and all of these conspiracy theories...That's what people are saying. I know it's preposterous - but is it preposterous, you think, Mary?"

To which, Mary Schiavo, ex-Department of Transportation inspector general, replied:


"Well, it is. A small black hole would suck in our entire universe so we know it's not that."

Maybe it WAS a black hole, and we all disappeared, and resurfaced in an alternate universe, where we got the CNN we know today.

Let's look at Jeff Zucker, CNN's boss.

In April 2017, Zucker baldly told the New York Times, "The idea that politics is sport is undeniable, and we understood that and approached it that way." The "it" was certainly the 2016 presidential campaign.

Zucker always has understood political news in this corrupt fashion---and in the process, he helped elect a US president and a California governor.

Zucker was the man who launched The Apprentice, starring Donald Trump, at NBC, in 2004.

In other words, Zucker happened to play a major role in electing Donald Trump. There is no getting around it.

If you're looking for a person who embodies that fake version of reality most purely, you need look no further than Jeff Zucker.

Despite his network's present hatred of Trump, Zucker would give Trump his own show right now if he wanted one.

For ratings and ad revenues.

Consider another event, one which I've analyzed in great detail. It took place on NBC in 2003, when Zucker was the head of the network's entertainment division. The Tonight Show, with Jeno Leno, was a prime piece of that division then. What Leno pulled off in 2003 had to have the OK from Zucker, because it was a highly unusual move, a distinctly unethical move.

An actor wanted to launch a political career and become a governor. The whole news division of a major network surrendered itself, for one ratings-busting night, to a talk show.

This is how Arnold Schwarzenegger won the California governor's race. It all came down to his famous appearance on The Tonight Show with Jay Leno, where he announced that he was going to run.

The Arnold interview was a global event. It was pre-hyped to the sky, and after three red hot six-minute segments, with a studio audience screaming in approval, the election was virtually over.

POLITICS IS TELEVISION. TELEVISION IS POLITICS.

Here are a few of CNN's "black-hole" gaffes, just refresh your memory---

Because Trump was attacking CNN and other media as fake, CNN claimed THAT was making life more physically dangerous for journalists in war zones and at home. Wow. I guess the takeaway is: don't criticize mainstream news, keep your mouth shut and stay hypnotized...

Independent journalist, James O'Keefe, released two undercover sting videos which revealed CNN medical producer, John Bonifield, remarking that the whole Trump-Russia scandal is "mostly bull**** right now, like, we don't have any giant proof"; and Van Jones, CNN political commentator, stating that "the Russia thing is just a big nothing burger." Of course, CNN relentlessly pursues the Trump-Russia story as if God and a choir of angels have certified it as the truest, most important event of our time.

June 2017: CNN dumped Reza Aslan, the host of their network documentary series called Believer. Why? Because Aslan tweeted, "This piece of **** [Donald Trump] is not just an embarrassment to America and a stain on the presidency. He's an embarrassment to humankind."

October 2016: CNN contributor Donna Brazile was dumped, because she passed along questions that would be asked in an upcoming presidential debate, sponsored by CNN. Brazile passed those questions to the Hillary Clinton camp.

CNN reporter-dunce Chris Cuomo, during the 2016 election campaign, preposterously told the viewing audience that accessing Wikileaks' treasure trove of John Podesta emails was a crime---for any member of the public. Only "the media" were permitted to perform that delicate operation and then decide what to report. Put a picture of Cuomo on your wall and pray to it every night.

On June 13, 2015, CNN host Fredricka Whitfield talked about the attack on the Dallas police headquarters. She said the shooter, James Boulware, was "courageous and brave, if not crazy." Who's crazy, Fredricka?

The 2016 Milwaukee riots. CNN aired a woman named Sherelle Smith telling the rioters, "Don't bring that violence here." She was calling for peace. Well, not exactly. The network failed to broadcast the rest of Smith's advice: "Burning down **** ain't going to help nobody! Y'all burning down **** we need in our community. Take that **** to the suburbs! Burn that **** down!"

CNN: the most trusted name in news.

The pack of losers at CNN are always trying to save their operation. They obviously need to hire Jerry Springer as news director. The network is already a reality show; they just don't know how to put one on. They require help.

Publishing fake news and airing talk-show hosts who spout venom doesn't make it. It doesn't go far enough. On camera, they need women breaking into the studio claiming their babies were fathered by CNN journalists; they need burly security guards tackling the intruders and bringing them to the floor. They need live audiences who hoot and holler and boo and applaud.

CNN is a reality show. But it doesn't go far enough. If the network's boss Jeff Zucker applied his talents, he could stage flame-outs and scandals that would rock the house. Go big. Go wild. Hire a few dyed in the wool terrorists and put them on in prime time and let them talk. Bring Glenn Beck back, build him a studio that looks like a chapel with stain glass windows, and let him tell the audience what God wants him to do. Lure Scott Pelley and Megyn Kelly to CNN and team them together in a show called The Sadism Hour. Set up Michael Moore in a Burger King for 24 hours straight every weekend and have him talk non-stop (while he eats and slurps) about why he hates Donald Trump. How about an investment show hosted by George Soros called How to Kill the West?

The president says the cable news outlet is violating the Lanham Act.
Donald Trump has sent CNN an extraordinary four-page letter that pledges legal action.


The missive from Trump attorney Charles Harder references recent videos from Project Veritas purporting to have a CNN "whistle-blower" discussing direction from the cable news network's president Jeff Zucker.


"Your own employees appear to state that CNN is focused on trying to 'take down President Trump,' driven by a 'personal vendetta' that Mr. Zucker purportedly has against him, rather than reporting the news in an objective manner," writes Harder. "In the Footage, your employees appear to state that CNN attempts to make its reporting appear neutral and unbiased, when in fact its reporting is far from neutral and highly biased against the President."


The letter contrasts aspirational ethical standards promulgated by media groups with supposed evidence that Trump says he has accumulated about CNN's bias.
"The aforementioned examples are merely the tip of the iceberg of the evidence my clients have accumulated over recent years," continues Harder. "We also expect substantial additional information about CNN’s wrongful practices to become known in the coming days and weeks. Never in the history of this country has a President been the subject of such a sustained barrage of unfair, unfounded, unethical and unlawful attacks by so-called 'mainstream' news, as the current situation."


Harder claims that CNN — now a subsidiary of AT&T— is violating the Lanham Act for making misrepresentations to the public and advertisers.


The letter adds, "Accordingly, my clients intend to file legal action against you, to seek compensatory damages, treble damages, punitive damages, injunctive relief, reimbursement of legal costs, and all other available legal and equitable remedies, to the maximum extent permitted by law."


The Lanham Act does have a provision against false advertising, though it's dubious whether Trump can demonstrate the type of commercial injury that would confer him with standing to pursue such a case over what may also be argued to be opinions (e.g. what constitutes bias). In any event, a suit would likely bring a fulsome First Amendment defense. Given how courts have treated speech and the media throughout American history, Trump's odds would seem enormously long, and while Trump was known for being litigious during his business days, he's also become infamous for being a paper tiger, repeatedly threatening litigation against media outlets without following up.


Harder is inviting a negotiation, but writes that a resolution would have to include a "substantial payment of damages."


CNN responds, "This is nothing more than a desperate PR stunt and doesn't merit a response."

Project Veritas released an undercover video Tuesday in which ABC News anchor Amy Robach is seen alleging the corporate news network spiked a bombshell report on Jeffrey Epstein three years ago.

Robach, co-anchor of Good Morning America, is seen on video expressing frustration to an ABC News producer that a witness brought forth damning information regarding Epstein, but the network opted against airing the report.

"I've had this interview with Virginia [Guiffre]," Robach is seen explaining of the alleged Epstein victim. "We would not put it on the air. I was told 'Who's Jeffrey Epstein. No one knows who that is. This is a stupid story.'"

"The Palace found out that we had her whole allegations about Prince Andrew and threatened us a million different ways," the anchor continues.

Guiffre has long alleged she was delivered to Britain's Prince Andrew for paid sex as a teenager.

Among them is Virginia Roberts Giuffre. She has said she was a 15-year-old working at President Donald Trump's Mar-a-Lago club when she was recruited to perform sex acts on Epstein.

Giuffre said in a sworn affidavit (https://apnews.com/e339d24fd74c45d295a8554604d2f435) that she was flown on Epstein's private planes to his properties in New Mexico, the U.S. Virgin Islands, Paris, and New York, and said meetings were also arranged for sex in London and elsewhere with Prince Andrew.

Buckingham Palace officials previously denied that Andrew had any sexual involvement with Giuffre. The palace said it had no additional comment.

CBS News has fired a female staffer believed to have had access to the tape of Amy Robach raging against ABC News, Page Six understands.

We reported on Wednesday that ABC News chiefs discovered a former employee could be behind the leak of the damning footage of Robach slamming the network for shelving her interview with Jeffrey Epstein’s “sex slave” Virginia Roberts Giuffre. Sources told Page Six that a former staffer had access to the footage of Robach as she aired her frustrations over a hot mike — and that employee was now believed to be working at CBS.

A TV source told us later on Wednesday that the woman was let go from CBS, after ABC execs alerted the rival network.

As we reported, it is not known whether the woman leaked the tape, which was recorded in July, to the Web site Project Veritas, or may have showed it to others who passed it on.

A CBS spokesperson declined to comment on the matter.

An ABC source had told us earlier Wednesday that the network was considering its options — but added that it was more difficult because the person no longer works there, but they did, the leak would be a “fireable offense.”

An ABC rep commented: “We take violations of company policy very seriously, and we’re pursuing all avenues to determine the source of the leak.”

In the leaked footage, Robach says Giuffre — who claims she was forced to have sex with Prince Andrew by Epstein — “told me everything.” But that ABC “would not put [the interview] on the air.” The network said the report didn’t meet its standards, and on Tuesday a top ABC producer told NPR: “We would never run away from that … We would never kill a story about Prince Andrew. That’s what’s ridiculous on its face. That’s a great story. So if we could do that story, we would have done it!”

Prince Andrew has denied all Giuffre’s allegations.

Positive Indications for the First Amendment in Court

"Yesterday, Project Veritas Action Fund had oral arguments in the United States First Circuit Court of Appeals challenging the Constitutionality of Massachusetts’ anti-undercover recording laws (Project Veritas Action Fund v. Rollins).

Recall, a year ago, when PVA got the Federal District Court in Boston to rule unconstitutional a Massachusetts law prohibiting secret recordings; “[T]he Court holds that [Massachusetts law] may not Constitutionally prohibit the secret audio recording of government officials…”

Undercover recording is the sort of activity that is protected by the very essence of the First Amendment.

Yesterday, PVA sought an extension of the District Court Judge Patti Sarris’ decree so that it applies to private citizens when secretly recording in public.

This is not a left or right issue. This is a Constitutional issue about the public’s right to know.

After these oral arguments, PVA is confident that the case will be won, if not now, then at the United States Supreme Court.

The courtroom was a wild experience.

In an extraordinary series of events, the ACLU filed a sister complaint, with some of their arguments dovetailing PVA’s.

The ACLU advocated in favor of affirming the District Court’s order regarding the ability to record police officers. ACLU’s staff filled up the courtroom.

Even Boston College law students crammed into the courtroom as they, or their professor, recognized the historic nature of the case as a tutorial of Constitutional law in practice.

Law360 summarized the environment in the court yesterday:

“Inside a jam-packed seventh-floor courtroom, the panel seemed sympathetic to the solution crafted by U.S. District Judge Patti B. Saris, who in December 2018 declared Massachusetts' blanket recording ban to be unconstitutional, allowing citizens to record government officials or police officers when they perform their duties in public.”

“U.S. Circuit Judges David J. Barron and Bruce M. Selya, along with retired U.S. Supreme Court Justice David H. Souter, sat on the panel.”

The Assistant Attorney General for the Commonwealth of Massachusetts was up against a panel of judges who were skeptical of the Commonwealth’s their inherently unconstitutional arguments:

“Boston's district attorney, Rachael Rollins, has argued the ban should be restored and surreptitious recording of police and other officials could harm unwitting third parties. Judge Saris' ruling is also problematic in that it leaves the definition of what constitutes a "government official" or "public space" to be determined in future cases, Rollins said."

"Why isn't that a sensible way to approach this type of problem?" U.S. Circuit Judge Bruce Selya asked. "You have a statute which sweeps very broadly, the district court finds, in certain of its important applications, it is unconstitutionally overbroad, so it attempts to set out some general benchmarks and recognizes, at the margins, there will have to be litigation."

"I don’t know how you can expect a court to be more exact or precise in its decree," Judge Selya told Assistant Attorney General Eric Haskell. "That’s what's puzzling me.""

“Haskell said the police are currently running the risk of being recorded doing things in public that are of a more private nature, such as meeting with a confidential informant.”

"A meeting with a confidential informant, if it's done in public, what's wrong with that being recorded?" Judge Selya replied. "If the police officer wants that meeting to be truly confidential, it's easy enough to hold it in private."

Where the ACLU lawyer in oral arguments focused merely on the recording of police officers, whereas PVA was focused on the greater principles at stake, seeking an extension for the ability to record private citizens in the absence of an expectation of privacy, in furtherance of the public’s right to know and a more transparent society.

Arguing opposite the state were two unusual bedfellows: The Project Veritas Action Fund, founded by conservative provocateur James O'Keefe, and the American Civil Liberties Union of Massachusetts. Judge Saris chose to rule on both of their cases at once.


Here are a few exciting exchanges between PVA Attorney Ben Barr and Judges Barron and Selya, MA Assistant AG Eric Haskell, and former Associate Justice of the United States Supreme Court, David Souter, in yesterday's historic proceedings:

Ben Barr: Massachusetts makes a mockery of the most effective form of newsgathering, undercover journalism, by denying citizens the right to be able to go out into public, and to be able to gather information in the most effective way possible, that is, secret audio recording.

Judge Barron: What do you mean by “public?”

Ben Barr: I mean a place in particular where there is no reasonable expectation of privacy. It brings me to the truly exceptional nature of Section 99.

Judge Barron: Just so I get it straight with the idea that everybody in this courtroom right now would have a First Amendment right to record these proceedings?

Ben Barr: Yes.

Judge Barron: That’s your position?

Ben Barr: Yes.

Judge Barron: Do you have a narrower position?

Judge Selya to MA Assistant Attorney General Eric Haskell: Meeting with a confidential informant, if it’s done in public, what’s wrong with that being recorded? If the police officer wants that meeting to be truly confidential, the police officer can control where the meeting is held. Easy enough to hold it in private.

Judge Selya to MA Assistant Attorney General Eric Haskell: You’re saying that if John Doe comes along, sees a police officer conversing with a politician, for example, they both have their backs turned to him, he holds out, in plain view of everybody, a tape recorder and turns it on, or a cell phone, and turns on the recording function, alright? They have their backs turned, but it’s in plain view to anyone who wants to walk. Everyone in the Boston Common sees it, except maybe the two people who were talking, and you’re saying that is, or isn’t, a violation of the statute?

There were also conversations about the Constitutionality of prohibiting filming in public places when at least one person consents to being recorded:

Judge Selya: The Commonwealth has an interest in protecting the privacy of conversations. Everyone has some sort of right to the privacy of their conversations, full stop. And you can disagree with that as a matter of policy, but you’ve got to figure out why that’s wrong as a matter of Constitutional law…

Ben Barr: Primarily, it amounts to the tailoring and overbreadth issue, Judge Selya, while there is a legitimate governmental interest in protecting conversational privacy and 11 states have worked out test to do that. On the other end of the Constitutional equation is a right to be able to acquire information in public and report on that to the American people. So, being able to record a bribe occurring with a police officer on a…

Judge Selya: But Massachusetts is talking not only about governmental privacy, they’re talking about the privacy of all participants in these conversations, which typically take place between a government official and a private citizen.

Ben Barr: Yes, and actually as was noted by Judge Barron earlier, it is entirely capable that government officials and individuals are able to safeguard their own privacy. If they have a confidential conversation, or an informant, they’re able meet in a private place. We are not alleging the right to be able to invade doctors’ offices or police stations…

Judge Barron: Yeah, but you are saying that if I think that I’ve taken precautions, that I sometimes might sit on a bench in the park and speak in what I think is in pretty confidential tones with someone else, and you’re saying but I’m at risk of someone having a recording device, and if I didn’t notice it, that can then be sent all over the place, right?

Judge Selya: I want you to note that even in his hypotheticals, Judge Barron sees himself sitting on a bench.

PVA argues that two-party consent laws prohibiting secretly recording people in public are outdated, unconstitutional, and prohibit/criminalize investigative reporting.

Think about it – recording devices are just sophisticated note-taking equipment. You have the right to write down what someone says after they’ve said it and broadcast it.

So, if an individual is in a public place, and they know they are being spoken to, PVA argues recordings should be allowed. Surely society would not consider reasonable an expectation of privacy which would result in a more inaccurate version of the events in question.

A concealed tape recorder used by one party to record a conversation with who is present is not immoral, it’s not invasive, it’s not eavesdropping.


Unlike forty-nine other states, Massachusetts’ law simply bans all secret audio recording.

Thirty-nine states believe that the individual has the ability to secure the privacy of their own conversations while also protecting First Amendment rights.

Eleven states believe it is the legislature’s responsibility to provide some level of privacy. These eleven states have figured out standards that respect both the First Amendment and privacy concerns—so Massachusetts shouldn’t be allowed to simply disregard news-gathering rights protected by the First Amendment and make it a crime to conduct all undercover recording.

And this is why PVA has asked that the First Circuit Court of Appeals strike down the law ‘facially’, (to declaring it entirely void.)

According to Courthouse News, “Benjamin T. Barr, special counsel for Project Veritas, told the Boston-based First Circuit on Wednesday that the law in Massachusetts is the most restrictive in the country. Some 38 states have few if any limits on secret recordings and the rest have carefully tailored restrictions, he said.”

From PVA’s attorney, Ben Barr’s, observation of the oral argument, it appeared that all of the judges (including former US Supreme Court Associate Justice, David Souter) expressed real skepticism about the Constitutionality of the Massachusetts law—referring to it as “sweeping too broadly” in several of their questions.

Their lines of questioning examined the state’s interest in securing privacy against the means the state employs to secure that privacy. In this case, an outright ban is simply too suppressive of speech and narrower tools could be used to protect truly private conversations.

The judges also hinted that individuals were free to guard their own privacy—such as removing a discussion to a truly private place—instead of needing a law that simply prohibits news-gathering of items disclosed in public.

After the hearing, PVA’s attorney Ben Barr said:

“We were pleased that the court held the Commonwealth of Massachusetts to accountability. This law is an outright ban on the most effective form of newsgathering—undercover journalism—and deprives the public of important information. It is difficult to imagine it surviving today’s review before the First Circuit.”

“If the First Amendment means anything, it means that citizens possess the power to hold accountable those in power. In 2020, using smartphones and digital recording devices to uncover political hypocrisy and self-dealing is the most effective means to do so and should be protected by the First Amendment.”

A ruling is anticipated by mid-Summer.

PVA has fought the law in front of a panel of three and after yesterday, there is confidence that a victory will be achieved.

It may be a while and it may sometimes feel like we may not have many allies. But we’re going to continue fighting these anti-secret recording laws on principle because it’s the right and just thing to do, even if it means being first and even if it means fighting alone.

[NEW YORK – Apr. 14, 2021] Project Veritas released the second installment of a new #ExposeCNN series today, featuring Technical Director Charlie Chester - who described how the network uses “manipulation” to shape public opinion and garner higher ratings.

[WASHINGTON, D.C. – Feb. 15, 2022] Food and Drug Administration [FDA] Executive Officer, Christopher Cole, inadvertently revealed that his agency will eventually announce that annual COVID-19 vaccinations will become policy.

Cole is an Executive Officer heading up the agency’s Countermeasures Initiatives, which plays a critical role in ensuring that drugs, vaccines, and other measures to counter infectious diseases and viruses are safe. He made the revelations on a hidden camera to an undercover Project Veritas reporter.

Cole indicates that annual COVID-19 shots isn’t probable -- but certain. When pushed on how he knows an annual shot will become policy, Cole states, “Just from everything I’ve heard, they [FDA] are not going to not approve it.”

The footage, which is part one of a two-part series on the FDA, also contains soundbites from Cole about the financial incentives pharmaceutical companies like Pfizer have to get the vaccine approved for annual usage.

“It’ll be recurring fountain of revenue,” Cole said in the hidden camera footage. “It might not be that much initially, but it’ll recurring -- if they can -- if they can get every person required at an annual vaccine, that is a recurring return of money going into their company.”

Perhaps the most explosive part of the footage is the moment where Cole brazenly talks about the impact that an Emergency Use Authorization has on overcoming the regulatory concerns of mandating vaccines on children.

“They’re all approved under an emergency just because it’s not as impactful as some of the other approvals,” Cole said when asked if he thought there was “really an emergency for kids.”

They want to hire a safe person that can do the job but doesn’t necessarily- is a great hire.”

[WASHINGTON, D.C. – Feb. 16, 2022] Project Veritas published Part Two of its series on the FDA on Wednesday night which featured FDA Executive Officer, Christopher Cole, speaking about the inner workings of the agency including the FDA’s conflicts of interest, overspending, and why it’s hard for those within the agency to speak out on such abuses.

In the footage, Cole talks about the impact that pharmaceutical companies have on the agency including the process for approving drugs.

“A long time ago, Congress approved user fees for [the] FDA. Basically, we charge the industry millions of dollars in order to hire more drug reviewers and vaccine reviewers, which will speed up the approval process, so they make more money,” Cole says in the hidden camera footage.

He then reveals that the FDA tones down the impact that these user fees have on the agency’s operations because, “they’re dependent on the drug companies, and the vaccine companies and these other companies for their agency to operate.”

The incendiary footage, which features Cole talking about how the additional money the FDA brings in “gets banked” to be spent on “whatever you can, whether it’s right or wrong,’’ also features Cole discussing reasons why it’s difficult for anyone in government to speak out about practices he sees as “probably excessive.”

“I don’t think there’s enough people saying -- they’re, like, ‘Look, that’s fine, but that’s not right. So, we’re not going to charge that.’ You don’t want to be that person. You’re not going to have a long shelf life in the agency if you’re always that person,” Cole said.

“There’s not an incentive to speak out in government, surprisingly. You would think there would be, but there’s not. It’s better just to just not say anything and just ignore it. The whistleblower, well, it’s high-profile whistleblower statutes and everything, that’s kind of ridiculous,” Cole said before adding “it’s better to just stay quiet and accept.”

Cole’s LinkedIn page lists him as an Executive Officer within the agency’s Countermeasures Initiatives, which plays a critical role in ensuring that drugs, vaccines, and other measures to counter infectious diseases and viruses are safe. He made these revelations on a hidden camera to an undercover Project Veritas reporter.

A spokesperson for FDA issued a statement yesterday saying, “The person purportedly in the video does not work on vaccine matters and does not represent the views of the FDA.”

This statement appears to contradict a phone call released Wednesday afternoon by Project Veritas wherein Cole reiterated, during the conversation with Project Veritas Founder and CEO, James O’Keefe, that he is “a manager in the office that helps oversee the approval of the COVID vaccines for emergency approval.” "

[ORLANDO, FL. – Feb. 24, 2022] On stage during the opening of the annual Conservative Political Action Conference, James O’Keefe announced that former CNN Field Operations Manager Patrick Davis has joined the nonprofit as its Executive Producer.

Davis joined O’Keefe on stage for the announcement and discussed his new role at Project Veritas including his motivations for joining the non-profit.

Davis sat down for an interview with O’Keefe before his appearance on stage at CPAC where he spoke candidly about his previous career.

The reality is I was there for twenty-five years, therefore, half my life. I gave blood, sweat, and tears to that company. I love the company. I love the people there. I still do. There’s some amazing journalists that still work there, in the office and out in the field, especially. It got to a point where what we were doing, it seemed like, out in the field and gather news- how it was being translated on air, wasn’t what CNN was meant to be.

Davis, whose time at CNN’s Washington bureau spanned four presidents, also discussed his thoughts on former CNN President Jeff Zucker, what happened inside CNN during Project Veritas’ investigation into the network and his opinion of Project Veritas now that he’s a part of the organization.

Davis disclosed that the FBI raid on the homes of Project Veritas journalists was a catalyst for him joining the organization. “I thought it was the biggest abridgment to the First Amendment in maybe the history of this country,” Davis said. “For the FBI to go blowing into the doors of journalists, it was unheard of.”

With a smile on his face, Davis added that he hopes to accomplish “bigger and better” stories with Project Veritas:

This is the thing that I’ve learned in the months of being here. Everyone’s very dedicated, one hundred per cent buy-in. But the beauty of it is, we can save a little girl one night, or do a Pentagon Papers one night, and twenty-four hours later we’re doing, you know, dry Ramen noodles going after Rachel Maddow. What I’m doing right now is either brilliant, or it’s crazy, or maybe it’s a little bit of both, right?
Davis has earned a litany of awards during his journalism career including four Emmy Awards and three Peabody Awards."
