The Supreme Court will hear a case Tuesday that could have major implications for hundreds of Jan. 6 defendants — as well as special counsel Jack Smith’s prosecution of former President Donald Trump.

The case, Fischer v. United States, asks the Supreme Court to weigh the scope of an obstruction statute, Section 1512(c)(2), which penalizes anyone who corruptly “obstructs, influences, or impedes any official proceeding” with up to 20 years in prison. Joseph Fischer, who entered the Capitol on Jan. 6, argues that his prosecution under the law for obstructing Congress’ certification of the 2020 election was an “unprecedented expansion” of the statute.

The law, enacted as part of the Corporate Fraud and Accountability Act of 2002, was intended to target evidence tampering, focusing on “deterring fraud and abuse by corporate executives,” Fischer argues.

“Before the January 6 cases, no court had applied Section 1512(c)(2) to conduct not intended to affect the availability or integrity of evidence,” Fischer’s attorneys argued in a brief. “Nor had a defendant ever been convicted of an obstruction-of-Congress offense outside the context of a legislative inquiry or investigation.”

Fischer stated he was in the Capitol for less than four minutes — after Congress had already recessed — and “was not part of the mob that forced the electoral certification to stop.” He was arrested in February 2021 on several charges, including assaulting Capitol police

Should the Supreme Court agree with Fischer, it could impact not just his case, but hundreds of defendants the Department of Justice (DOJ) charged with a felony under the statute. Over 353 of the nearly 1,387 Jan. 6 defendants have been charged with “corruptly obstructing, influencing, or impeding an official proceeding,” according to the DOJ.

Several defendants have already been granted early release ahead of the ruling, including Kevin Seefried, Alexander Sheppard and Thomas B. Adams Jr., according to The Washington Post.

“It takes four justices to grant certiorari and, although this court will not attempt to read tea leaves, the Supreme Court’s decision to review Fischer means, at a minimum, that this case poses a ‘close question,’” District Court Judge Amit P. Mehta wrote in the January decision granting Adams’ release.

The government argues that the text “is not limited to conduct that affects the integrity or availability of evidence.”

“Instead, Congress adopted a traditional catchall clause, reaching all forms of corrupt obstruction of an official proceeding,” it said in a brief.

The D.C. Circuit Court of Appeals favored the government’s interpretation 2-1 in an April 2023 ruling, finding that the “meaning of the statute is unambiguous.”

“Under the most natural reading of the statute, §1512(c)(2) applies to all forms of corrupt obstruction of an official proceeding,” Judge Florence Pan, a Biden appointee, wrote in the majority opinion.

But Judge Gregory Katsas, a Trump appointee, wrote that the government’s interpretation was “mistaken,” making it “implausibly broad and unconstitutional in a significant number of applications.”

“Among other things, that construction would sweep in advocacy, lobbying, and protest—common mechanisms by which citizens attempt to influence official proceedings,” he wrote. “Historically, these activities did not constitute obstruction unless they directly impinged on a proceeding’s truth-seeking function through acts such as bribing a decisionmaker or falsifying evidence presented to it.”

“The government’s reading is also hard to reconcile with the structure and history of section 1512, and with decades of precedent applying section 1512(c) only to acts that affect the integrity or availability of evidence,” he wrote.

Republican Arkansas Sen. Tom Cotton, House Judiciary Committee Chair Rep. Jim Jordan and 21 other members of Congress wrote in an amicus brief filed with the Supreme Court that the lower court’s ruling “will only reward and incentivize politically motivated uses of ill-fitting criminal statutes with harsh penalties.”

While the Supreme Court will weigh Trump’s bid to dismiss his election interference case based on presidential immunity in April, the Fischer case could also jeopardize part of the indictment.

Two of Trump’s charges in his election interference case are centered on the obstruction statute. Smith’s indictment alleges Trump used “knowingly false claims of election fraud to obstruct the federal government function by which those results are collected, counted, and certified.”

New York University law professor Richard A. Epstein wrote for the Hoover Institution in March that a correct reading of the statute “torpedoes a key part of the Smith indictment.”

“Trump never entered the Capitol building, and he never made any statement urging rioters to enter the building,” he wrote. “His despicable conduct consisted of watching the proceedings before asking the rioters and trespassers to leave the premises, which does not count as obstruction under any legal authority of which I am aware.”

Smith addressed this in the footnote of his brief filed this week in Trump’s election interference, claiming the charges would still be valid regardless of the Supreme Court’s decision on how to read the text of Section 1512(c)(2). He wrote that the “use of falsehoods or creation of ‘false’ documents satisfies an evidence-impairment interpretation.”

Trump’s case is currently on hold at the district court pending the justices’ decision. Oral arguments will be held April 25 to consider Trump’s presidential immunity argument.

They fretted to CBS News in a recent piece about a March 18 Trump post on Truth Social that said former Rep. Liz Cheney (R-WY) “should go to Jail along with the rest of the Unselect Committee!”

Rep. Adam Schiff (D-CA), who has consistently fundraised off all Democrat investigations and impeachments of Trump, told the network, “My wife and I have had conversations about what life would look like if the worst happened… . You can’t avoid the conversations about ‘What if?’ And I have to think about my own personal safety.”

House Democratic Caucus Chairman Pete Aguilar (CA) said he took the threat of being jailed seriously, but joked that the jail is close to the Capitol and that his family would visit him “no matter where I am.”

Rep. Zoe Lofgren, another member of the committee that investigated January 6 and another California Democrat, said she believes Trump intends to do what he says he will do.

Former D.C. Police Officer Michael Fanone, who testified in front of the Committee and was subsequently hired by CNN as a law enforcement analyst, told CBS News, “He’s going to weaponize the Department of Justice…and use it to go after people like myself… . He’s telling us exactly what he plans on doing.”

Former U.S. Capitol Police officer Harry Dunn, who is now running for Congress as a Democrat in Maryland, told CBS News, “Anybody who has testified against him, or spoken out in a public capacity, should be worried.” The former police officer and politician-hopeful said the threat of arrest “is a little scary to think about, but you have to continue to do the right thing.”

The ‘pipe bomber’ who I will call “MJ” had indicated there was some ‘panic’ that the devices he was instructed to ‘plant’ in a ‘training exercise’, had not been properly ‘sanitized’ leaving potential latent prints/dna. The J6 ‘pipe bomber’ was a government contractor with a background in Explosive Ordnance Disposal (EOD), an E9 in the Air Force. Their mobile device accessed DOJ/FBI 1,167 times over an approximate 2 year period and also the DC Navy Yard over 200 times during the same period.

The actual ‘pipe bombs’ were used to train bomb sniffing dogs. This is important because their ‘cover story’ if they were to get caught in the act, would have been that they were hired to test security protocols, in addition to munitions disposal, it is something his company contracted to do. Additionally, the ‘pipe bomber’ was actively monitoring law enforcement agencies radio traffic, even restricted channels.

NEW: Records appear to confirm the Secret Service thwarted the internal investigation into the deleted text messages of several USSS officials from Jan 6 and also attempted to withhold documents from IG Joseph Cuffari.

Top DHS officials then demanded that the IG report be fully redacted with the exception of the report's title before being released to the public. DHS also wanted partial redactions in the report sent to Congress.

Further--records also show that DHS wanted Biden's WH general counsel involved in reviewing the final report. This appears to be highly unusual in the inspector general process, which is supposed to be independent from outside influence.

Blaze Media has published possibly groundbreaking footage that shows the suspected J6 pipe bomber seemingly interacting with Capitol Police the night before the Jan. 6, 2021, Capitol Hill uprising.

The footage reportedly comes from Capitol Police CCTV files recently made public by the Committee on House Administration Subcommittee on Oversight. The specific finding was made by the social media user “Armitas,” according to Blaze.


“The alleged bomber emerged onto First Street Southeast from an alley between the Capitol Hill Club and the Republican National Committee at 8:14 p.m. Jan. 5. The suspect walked north past the Capitol Hill Club. As the individual passed under the restaurant’s green awning at 8:14:30 p.m., a Capitol Police SUV turned the corner onto First Street. The alleged bomber waved at the squad car and then pointed — it appeared — at the driver as the vehicle passed by,” Blaze reported.

“…The officer turned on the vehicle’s red and blue emergency lights at 8:15:44 p.m., just as the bomber turned and walked south down the Rumsey alley and disappeared from view,” Blaze added.

“The suspect was hidden from camera view for nearly three minutes behind the blinding strobe headlights and emergency beams of the squad cars. At 8:22:53 p.m., the apparent suspect emerged from the spread of light and crossed the street again. The individual was last seen on the security video at 8:23:08 p.m. as he or she walked down the alley a second time.”

The next day, a civilian purportedly discovered one pipe bomb near the Republican National Committee headquarters at 12:43 p.m., and a plainsclothes Capitol Police officer found another one outside the Democrat National Committee HQ at 1:05 p.m.—just as violence was picking up at the Capitol. Rep. Thomas Massie, R-Ky., and other prominent conservatives have suggested that the pipe bombs were meant to divert law enforcement from Capitol Hill to respond to the bomb threats.

Blaze’s findings come on the heels of footage released earlier this month from investigative reporter Julie Kelly, showing that the DNC pipe bomb might have actually been placed on the day of Jan. 6—after the RNC one was found.

The footage from Kelly showed an apparent law enforcement officer from Vice President-elect Kamala Harris’s security detail exiting a DC Metro Police SUV at 12:51 p.m., and walking towards the area where the pipe bomb was found—with a bag in hand. Minutes later, the same officer walked back to the police vehicle with bag still in hand.

“What exactly was he doing? Did he set the device? And if he was acting on the up-and-up, how in the world did he not see a pipe bomb sitting right there?” Kelly asked.

For Revolver News’s Darren Beattie, who’s broken numerous stories on the pipe bomb case, Kelly’s footage makes it overwhelmingly likely that the FBI surveillance footage is fake and the bombs were actually planted not the evening before, but day of Jan. 6. Beattie has previously analyzed surveillance footage of the J5/6 pipe bomber, showing that the FBI has failed to release footage that would have shown the bomber planting the device.

Dan Bongino has been carefully, slowly, pulling back the curtain on the J6 pipe bomber incident over the last week or two ... and for no particular evident reason (no new Headline Breaking News) that's been evident to me.

Bongino doesn't lead stories like that unless he knows, or at least has damn good reason to suspect, more than he can yet say publicly, with confidence. It's not like he's had any trouble finding other material to talk about in recent weeks.

The only rational conclusion you can reach about all these open DoJ Jan 6, 2021 cases is that they were intentionally not brought to a close so they could be kept in front of the public in an effort to damage Trump during the 2024 election. It is exceptionally clear that the DoJ and the Intel Agencies became politically driven under the Biden regime.

Back in the 60s and early 70s the intel agencies and the DOJ were completely out of control. The beauty of them slowing down the frame rate to 1 per second is they only had to apply the blur bar over the pipe bomber’s eyes for 4 still frames. As opposed to the difficult work of applying a consistent blur across 100+ frames if it were the normal 30+ frames per seconds.

In 2021, I spent literally hundreds of hours on the Jan 6 pipe bomber. One thing I never published until now still bothers me to this day: I believe the FBI, in addition to nuking the frame rate on the DNC security camera, blurred the eyes so no one could ID based on biometrics.

The FBI says it has discovered more than 150 bombs during a raid on a farm in Virginia – thought to be the largest such cache seized by the law-enforcement agency in its history.

Brad Spafford was arrested on 17 December in Isle of Wight County, 180 miles (290km) south of Washington DC, after a tip-off that he was stockpiling weapons and homemade ammunition on the property he shares with his wife and two young children.

Investigators say some of the devices were found in a bedroom in an unsecured backpack labelled "#nolivesmatter" - an apparent reference to a far-right, anti-government movement.

A lawyer for Mr Spafford denied he is a danger to the community and is seeking his client's release from pre-trial detention.

The suspect has so far only been charged with possessing an unregistered short-barrelled rifle, though investigators say more charges are likely.

Investigators said on Tuesday that the bombs were "preliminarily assessed as the largest seizure by number of finished explosive devices in FBI history".

Mr Spafford had allegedly used photos of US President Joe Biden for target practice and expressed hope that Vice-President Kamala Harris would be assassinated.

He had recently sought qualifications in sniper-rifle shooting at a local range, according to the court papers.

The charging document says an unnamed neighbour reported that Mr Spafford had continued to build bombs even after losing three fingers on his right hand in 2021 "while working with a homemade explosive device".

The neighbour, who used to work in law enforcement, wore a recording device during a visit to Mr Spafford's 20-acre farm earlier this year, investigators say.

The evidence gathered by the neighbour led FBI agents to search the property, where they found explosives scattered around a home, according to the charging document.

An initial FBI assessment found the devices to be "pipe bombs". The majority were in a detached garage, and were sorted by colour. Some were labelled "lethal".

Several bombs were found loaded into a wearable vest, said the court papers.

More bombs "were found completely unsecured in a backpack" in the home. The exterior of the backpack was labelled "#nolivesmatter", said the court papers.

Nolivesmatter is a movement that promotes extremist ideology, targeted attacks, mass killings, and criminal activity, and has encouraged members to engage in self-harm and animal abuse, according to the New Jersey Office of Homeland Security and Preparedness.

In addition to the pipe bombs, investigators say they found a jar of a highly volatile explosive called HMTD, which the FBI notes is so unstable it can be exploded merely by a temperature change and does not require a detonator to explode.

The jar of HMTD was labelled "Dangerous" and "Do Not Touch", and was being stored in a freezer next to food that was accessible to the children, according to the court papers.

The neighbour also told investigators that Mr Spafford had discussed fortifying the property with a turret for a 50-calibre firearm on the roof.

Mr Spafford, who worked at a machine shop, had also said that missing children in the news had been taken by the federal government to be trained as school shooters, according to the court papers.

A lawyer for Mr Spafford said on Tuesday that the government's claim he was dangerous was "rank speculation and fear mongering", because the suspect had no criminal record.

"There is not a shred of evidence in the record that Mr Spafford ever threatened anyone and the contention that someone might be in danger because of their political views and comments is nonsensical," the lawyer wrote, external.

The federal judge overseeing the case ordered that Mr Spafford be released with electronic monitoring.

However, that decision is on hold as the government seeks to keep the suspect in pre-trial detention.

Alex said Ed Martin revealed around 30 major stories that he would work together with his news staff to release as soon as possible with supporting documentation and to present in such a way as to hopefully stay out of any more trouble than he is in, already.

Then, Alex teased a brief tidbit about how Ed Martin's team was given access to all of former Special Prosecutor Jack Smith's communications.

Within those communications, they found that January 6th did not go off as planned.

Everybody already knows that pipe bombs planted at both the RNC and RNC headquarters didn't go off.

Something akin to another 9/11 was supposed to happen but it didn't. Nevertheless, the script given to all of the corrupt politicians remained the same, which is why Nancy Pelosi and all of the other clowns continued to claim, superciliously for years that J6 was "worse than 9/11" and "worse than Pearl Harbor", which was observably not the case.

On Monday afternoon (seen here), Alex had collected himself sufficiently to go into more detail about the Jack Smith piece shared with him by Ed Martin.

The Globalist script had called for Jack Smith to be appointed in response to a massive false flag massacre on J6, where he would mount a "UN star chamber tribunal in DC" and put on "North Korea-style show trials", in which "tens of thousands of people [Trump supporters] would be convicted as a class, simultaneously in giant televised show trials, that would have effectively established a DC-run judicial dictatorship".

As Alex Jones recounted on Monday:

Back in 2021, many of us had a clue that something like this was afoot but now, Ed Martin has brought home the receipts.

Remember, when Hillary Clinton called for "formal de-programming" and re-education of Trump supporters on CNN? Remember when they were building FEMA Camps all around Asheville, North Carolina (and all over the country and the world)? Remember when Attorney, Bobbie Anne Cox was able to get New York's Supreme Court to rule that Governor Kathy Hochul's commissioning of "Quarantine Camps" in New York State were Unconstitutional – only to have that decision reversed – thus, allowing the New York Department of Health to pick and choose which New Yorkers they can lock up or lock down, without any proof of illness or of communicable disease?

All of this was part of the original Globalist "pandemic agenda" that called for 10 years of lockdowns, due to ongoing "virus variants", and the postponing of a vaccine, during which time millions of unvaccinated people were to disappear into the quarantine camps.

The initial stages of this "COVID Camp" agenda were boldly unfurled in China, Australia, Canada, New Zealand, Germany and even in Boston, Massachusetts.

And you know why? They've got grand juries up in Pennsylvania, New York, Missouri, Florida, and other places. And they've got real grand juries.

And they've got whistleblowers from inside the Autopen – remember, he said that, a few months ago, and then it came forward, that they have it: A committee told them what to do and what to write, what to do. And they've got witnesses on all that.

And now, they're, this week, next week, the week after, they're going to be in front of those grand juries and they're going to be showing them all that. And so, we all just sit back and bitch and say, "We don't believe it'll ever happen."

Well, Ed Martin will actually be there. Working till midnight, every night.

And what's happened is Trump didn't just create the task forces – the two big ones you know about – they created other ones. And a few months into each one, nobody showed up. Nobody did anything. Nobody took action.

So, Trump just says, "Fine, you're in charge of this task force, this task force, this task force, this task force, this task force. Oh, you want more money? Here."

And he's got to go lie-detector test all these people. He's got to go into all these groups.

Have you ever managed people? What that's like? It's hard to run a 7-Eleven, Folks. Imagine, I got a crew, 40-something people, the best ever, put up with all my crap, can literally read my mind, basically. Still, we have problems.

If they weren't all totally focused just to do this, we couldn't do it. They're all pulling, rowing the same direction, simpatico.

So I get it, for people out there who are used to throwing a TV dinner in the oven and getting it out or whatever, you think like, "Well, this is just snap your fingers, here."

We're not Ceausescu. We don't have helicopters, you know. We just put them on and take them out there – though, don't worry, they start a civil war, that's where it's going.

And at that point, I'm not for martial law and all this, but we didn't start it. See, I'm against the martial law.

And now Flynn's like, "No, I'm feeling good. It's going down."

So the grand juries, for the first time are open. It's all happening. And I told you last week, there's 10 grand juries I know of.

Trump's got at least three task forces operating. Martin's got about 80% of it.

Their original plan was to slow roll a vaccine after 10 years of lockdowns, involuntarily detaining people into quarantine camps. When the vax was finally released, it would’ve been mandatory and dissenters would be detained in the camps.

In 2010, David Crowley was making a film about the impending pandemic induced, NWO depopulation agenda where Americans who refused mandatory vaccinations would have been rounded up into FEMA quarantine death camps

David and his family were found dead before the film was finished
