"Federal authorities on Tuesday arrested Igor "Iggy" Danchenko, a Russian national who was the primary researcher for the so-called Steele Dossier - a compendium of opposition research funded by the 2016 Hillary Clinton presidential campaign and used to smear Donald Trump as a Russian operative. It was also used as justification for an FBI wiretap application targeting former Trump adviser Carter Page.
According to the New York Times (https://www.nytimes.com/2021/11/04/us/igor-danchenko-arrested-steele-dossier.html) the arrest of Danchenko is part of John Durham's special counsel investigation into wrongdoing connected to the Obama administration's Russia investigation.
Details of the indictment against Danchenko are unknown, as the indictment has yet to be unsealed according to people familiar with the matter speaking on condition on anonymity.
Some claims from the Steele dosser made their way into an F.B.I. wiretap application targeting a former Trump campaign adviser in October 2016. Other portions of it — particularly a salacious claim about a purported sex tape — caused a political and media firestorm when Buzzfeed published the materials in January 2017, shortly before Mr. Trump was sworn in.
But most of the important claims in the dossier — which was written by Mr. Danchenko’s employer, Christopher Steele, a former British intelligence agent — have not been proven, and some have been refuted. F.B.I. agents interviewed Mr. Danchenko in 2017 when they were seeking to run down the claims in the dossier. -NYT
Danchenko, Steele's (formerly) mysterious "Primary Subsource", is a former Brookings Institution analyst.
The 43-year-old Danchenko, who was hired by Steele in 2016 to deploy a network of sources to dig up dirt on Trump and Russia for the Hillary Clinton campaign, was arrested, jailed and convicted years earlier on multiple public drunkenness and disorderly conduct charges in the Washington area and ordered to undergo substance-abuse and mental-health counseling, according to criminal records, according to RealClearInvestigations. Danchenko first ran into trouble with the law as he began working for Brookings - the preeminent Democratic think tank in Washington - where he struck up a friendship with Fiona Hill, the White House adviser who testified against Trump during 2019 impeachment hearings. Danchenko has described Hill as a mentor, while Hill has sung his praises as a "creative" researcher.
As the Times notes further, Danchenko had been the subject of a counterintelligence investigation to determine whether he was a Russian agent.

Of note, Danchenko also met with a Russian energy official just four days before Steele produced the first of 17 memos which comprise his infamous opposition research on the Trump campaign.

The meeting was documented in a Facebook post by Vorontsov, and confirmed by Abyshev.
It is unclear what they talked about - but it occurred as Danchenko was in the thick of his work with Christopher Steele, who the Hillary Clinton 2016 campaign and the DNC paid to cook up opposition research on President Trump's campaign. The dossier was a key component of several FISA warrants issued to spy on former campaign aide Carter Page and his contacts, and was widely distributed by US media outlets in a campaign to discredit Trump.

Interestingly, Danchenko may have been laundering information from a former Russian PR executive living in Cyprus, according to the Wall Street Journal last October.

40-year old Olga Galkina "stood as the dossier’s most important contributor," WSJ reported, after she was tapped by her old school friend and Steele’s employee, Igor Danchenko, to dig up dirt of Trump's dealings in Russia using the "vast network of people" from her various jobs in and out of the public sector.
Described as a public-relations executive, she "fed notes" to Danchenko for the dossier, including many of its most central claims. And of course behind all of this was British spy Christopher Steele, himself paid by Fusion GPS, and behind this the DNC itself.

It was Galkina who claimed Trump’s former lawyer Michael Cohen secretly contacted Russian intelligence in Prague to establish compensation for DNC hackers in the summer of 2016. Crucially she had fed Steele's team the name of her own Cyprus-based employer Webzilla as being behind the hack under company owner Aleksej Gubarev.

The charges against Danchenko come after the September indictment of Hillary Clinton-linked cybersecurity lawyer, Michael Sussmann, who allegedly made false statements during the 2016 presidential campaign to slander then-candidate Trump.

For purposes of background on the second charge, Danchenko alleged he received a call from from Russian reporter/businessman Sergei Millian alleging a Trump/Russia conspiracy. Millian has long-denied placing this call. This call was important because it was the basis, in part, of the FISA warrants against Carter Page. Durham’s investigation revealed Danchenko “never received such a phone call or such information from” Millian.

The Democrat PR Executive (Dolan) later admitted to the FBI he fabricated this information to Danchenko.
Danchenko later falsely denied to the FBI that the Democrat PR Executive (Dolan) had provided him with information.
Danchenko further lied about his claims of staying in a Moscow Hotel in June 2016. He didn’t stay at the Moscow Hotel until October. This is material because Danchenko purportedly gathered information from sources during the June 2016 stay (which never occurred).
Here’s an important observation: Danchenko wasn’t a necessarily a source – he was a go-between, providing Steele with information from the Democrat PR Executive (Dolan).
And then Danchenko lied about the Democrat PR Executive (Dolan) not being his source.
Overall, Danchenko faces five false statement charges:
Falsely stating to FBI agents on June 15, 2017 that he had never “spoken with PR Executive-1” (Dolan) about the dossier allegations.
On March 16, 2017, falsely stating to FBI agents that “he received a late July 2016 telephone call from an individual who Danchenko believed was ‘probably’ [Millian"], when in truth and in fact, and as the defendant well knew, [Millian] never called Danchenko.”
On May 18, 2017, falsely stating to FBI agents that he “‘was under the impression’ that a late July 2016 telephone call he received was from [Millian']” when in fact Millian never called Danchenko.
Falsely stating to FBI agents on October 24, 2017 that he had spoken to Millian “on the telephone on more than one occasion.”
On November 16, 2017, falsely stating to the FBI that “he had spoken to [Millian] on the telephone” when he knew he never did."

Danchenko has been charged with five counts of lying to the FBI in interviews during 2017, as the bureau struggled in futility to verify outlandish allegations that Donald Trump and his campaign were clandestine agents of the Kremlin. Those allegations were compiled in the so-called Steele dossier, which the FBI relied on in obtaining surveillance warrants from a secret federal court.
The dossier was generated by the Clinton campaign.

At Brookings, Danchenko worked with Fiona Hill, later a member of President Trump’s National Security Council (and a key witness in the first Trump impeachment over the unrelated Ukraine controversy). It was through Hill that Danchenko became acquainted with Steele, who ran a London-based intelligence firm upon leaving MI-6, the British spy service.
Durham’s indictment alleges that Danchenko lied about two major points.
First, he fabricated the claim that the president of the Russian-American Chamber of Commerce informed him that, during the 2016 presidential campaign, Trump was involved in a well-developed “conspiracy of cooperation” with the regime of Russian President Vladimir Putin. In reality, the indictment says, this conversation never happened.
The chamber president is not identified by name in the indictment. After the Steele dossier became public, however, there was intense speculation that the chamber’s founder, Sergey Millian, was a Steele dossier source. As I recounted in my book on Russiagate, “Ball of Collusion,” Millian denied being a source and trashed the dossier as “fake news created by sick minds.”
Danchenko is also alleged to have concealed that one of his sources for the information he provided to Steele was a longtime Democratic Party operative who was close to the Clintons — having worked on both of Bill Clinton’s successful presidential campaigns and Hillary Clinton’s unsuccessful 2008 presidential campaign. This source was revealed on Thursday to be Chuck Dolan, a public relations executive who had Russian contacts, and referred to as “PR Executive-1” in the indictment."

Good question, though maybe this is only the start - arresting a foreign national rather than going for the core of the affair - and it'll be interesting to see how this pans out. If Danchenko is 'suicided' like JE we'll all smell a rat.
It's possible that if this arrest is putting the main players in a panic, they might slip up and do something stupid that will incriminate them.

I recall that one of Bill Barr's last acts was to grant this investigation a status such that it was truly independent and could not be shut down. (later edit -my statement appears now to be inaccurate.)
(some searching commenced... some of the links that came up were laughable predictions from Deep State favored MSM about both the BS nature of the investigation and how no arrests would occur, as well as the usual lying about the known facts in the Russian Dossier Hoax and the FBI responses)

Attorney General William Barr announced Tuesday he appointed U.S. Attorney John Durham to lead a special counsel investigation into the origins of the Russia hoax in October.
“On May 13, 2019, I directed United States Attorney John Durham to conduct a preliminary review into certain matters related to the 2016 presidential election campaigns, and Mr. Durham’s review subsequently developed into a criminal investigation, which remains ongoing,” Barr wrote in the order. “I have determined that, in light of the extraordinary circumstances relating to these matters, the public interest warrants Mr. Durham continuing his investigation pursuant to the powers and independence afforded by the Special Counsel regulations.”
The move better insulates Durham from being relieved of his duties under an incoming administration led by former Vice President Joe Biden, who appeared to play a pivotal role in weaponizing the intelligence community to launch a deep-state coup on President Donald Trump days before leaving office in 2017. Biden has yet to answer substantive questions about his own involvement orchestrating the FBI’s Crossfire Hurricane operation seeking to indict the Republican president as an agent of the Russian government.
The effort eventually culminated in a more than two-year special counsel investigation with unlimited resources led by Robert Mueller that found not one person on the Trump campaign, let alone Trump himself, had actually colluded with the Russians in 2016 let alone any evidence that the president was compromised by the Kremlin.
Democrats, their allies in legacy media and even Biden have continued to perpetuate made-up claims about Russian collusion to keep the story alive. When compromising information on the Biden family surfaced in October exposing how the Democratic presidential nominee stood to rake in millions from the Chinese, Biden dismissed the claims as Russian disinformation despite statements from the FBI, the Department of Justice, the Department of National Intelligence, and the Department of State saying otherwise. Big media meanwhile, regurgitated the Democratic talking point to delegitimize the stories they at first ignored and big tech suppressed about their preferred presidential candidate.
The operation to cover up the biggest story of the entire election likely saved Biden’s campaign. According to a study of Biden voters commissioned by the Media Research Center across seven swing states shortly after the election, 17 percent of the 1,750 surveyed said they would not have voted for the Democratic candidate had they known at least one of eight stories the research group identified as improperly covered, including the scandals involving Hunter Biden.
Millions of Americans today remain convinced however, that President Trump has operated as a covert Kremlin agent in the White House.

The investigation that former Attorney General William Barr ordered into the Russia investigation—which Donald Trump promised would reveal Robert Mueller had been part of a grand Democratic Party “hoax”—may be ending with a fiasco. Barr’s hand-picked prosecutor has brought a case so weak that current Attorney General Merrick Garland should have rejected it in the interest of justice.
Trump long teased that that prosecutor, John Durham, would bring a blockbuster case proving Trump’s innocence and the culpability of Hillary Clinton and her “deep state” confederates. And now Durham, allowed to proceed in his work on Garland’s watch, has finally brought what appears to be his big case, against Michael Sussman, a lawyer who was widely identified as counsel to the Democratic National Committee in connection with Russia’s hack of its servers and dump of their contents. Durham has charged Sussman with culpably hiding his status as a Democratic “operative” from the FBI’s senior lawyer at a meeting in which he shared potentially inculpatory information regarding Trump.
Durham’s indictment was met with immediate criticism, and for good reason: It is so weak that facts Durham recites in his indictment gravely undermine the charge. Yet Garland reportedly declined to use his authority as the nation’s chief law enforcement officer to prevent Durham from proceeding with his misguided charge against Sussman, presumably based on the idea that such intervention in a special counsel charge by the AG—while permissible under the governing rules—would be contrary to Garland’s admirable goal of reinstating the law enforcement “norms” at the DOJ that Barr has so assiduously attacked.
But letting a shabby case that’s of a piece with Trump’s efforts to use the criminal justice system to protect corrupt allies and punish perceived enemies is no way to restore and reinforce the norms of neutral criminal justice.
The indictment suffers from multiple apparent defects. It is far from clear whether Durham will be able to prove beyond a reasonable doubt that Sussman even made the supposed statements forming the basis for the charge. Durham claims Sussman lied by denying that he was representing a client when he approached then-FBI General Counsel James Baker with data evidencing a potentially culpable link between Trump and a Russian bank. But Baker previously testified before Congress that he didn't recall whether Sussman stated he was working on behalf of Clinton or the Democrats. Furthermore, Sussman later testified before Congress and under oath that he was working on behalf of an individual (an executive at an internet company)—making the claim that he deliberately hid that fact from Baker implausible.
Further, Durham’s claim that Sussman’s purported lie was material, meaning it had a “natural tendency” to influence the FBI’s investigation, appears implausible based on the limited evidence included in the indictment. Durham asserts that, if Sussman had disclosed he was a “paid advocate for clients with a political or business agenda”, it “might have prompted” Baker to “ask more questions” or “take additional steps before opening” an investigation. However, per the indictment, after meeting with Sussman, Baker told his subordinate that the lawyer “represents DNC, Clinton Foundation, etc.”, thus rendering Durham’s claim that Sussman duped the FBI’s most senior lawyer into believing that he was a “good citizen” without any “political motive” related to the then active presidential campaign borderline absurd.
Finally, Durham’s allegations that Sussman culpably lied to the FBI are not only weak and self-contradictory, they also appear to be misleading. The indictment repeatedly asserts that Sussman “billed his time” to the Hillary Clinton campaign, in an effort to substantiate a claim that Sussman was secretly acting on behalf of the Clinton campaign when he “lied” to the FBI. But Sussman’s lawyers reportedly demonstrated that his firm never sent a bill to the Clinton campaign for any of the time he spent on the project at issue, and have explained that he simply chose to use the Clinton campaign’s internal billing number to keep account of what was never, and was never intended to be, billed time.
Durham’s tenuous, and mendacious, effort to draw a link between the Clinton campaign and Sussman’s purported crime supports the claims of Sussman’s counsel that the charges are politically motivated, and intended to bolster Trump’s and Barr’s claims that Clinton—the victim of a scheme by a foreign adversary to illegally influence a presidential campaign—was actually the perpetrator of the so-called “Russia hoax.” The inference is further supported by the indictment’s gratuitous references to the so-called “Steele Dossier,” which has nothing apparent to do with the charges against Susman, as well as Durham’s loaded and conspiratorial description of Sussman as an “operative.”
But whether or not Durham shares the political motives of Trump and Barr is ultimately beside the point. Whatever his intent, Durham has abused his discretion by bringing a tenuous case that should never have been presented to a grand jury, and thereby worked an injustice. Regardless of whether the case is ultimately rejected by the court or a jury, as it most certainly should be, Sussman, who has already lost his job, will be subject to the cost and stress of defending himself against defective charges, and—perhaps more importantly—a bad, and potentially dangerous, precedent will be set for future abuses of prosecutorial power.
That brings us to Garland’s role in this debacle in the making. Under the DOJ regulations pursuant to which Durham was appointed, the prosecutor has remained at all times under the supervision of the AG and cannot take investigative steps, let alone bring charges, without the assent of the nation’s chief law enforcement officer. Garland should have denied that assent.

Nearly two-thirds (62 percent) of respondents say they want the Justice Department to renew Durham’s budget for another fiscal year, the TIPP poll found, and a whopping 81 percent want the department to release his final report to the public.
Attorney General Merrick Garland, a Biden appointee, holds the purse strings to Durham’s investigation. He also has authority over whether his report will be made public.
“Americans who know of the Durham investigation have a keen interest in it,” said Raghavan Mayur, president of New Jersey-based TIPP. “Regardless of party or ideology, the majority of them want the attorney general to continue the investigation and release the report to the public. We found unanimous consent there.”
A surprisingly high share of Democrats—68 percent—agreed with Republicans and Independents that Durham’s budget should be renewed, while 82 percent of Democrats agreed his report should be released in full.
“It’s very interesting to see Democrats also are very interested in the results of the investigation,” Mayur said.
Known as a tough, nonpartisan prosecutor, Durham earlier this year resigned from his post as U.S. attorney for Connecticut to lead the Special Counsel’s Office case full-time. Richard Blumenthal and the other Democratic Senator from Connecticut, Chris Murphy, have both praised Durham as a “fierce and fair prosecutor.”
The so-called Russiagate investigation of Trump and his aides began under the Obama administration. After Justice’s inspector general in 2019 exposed FBI abuses of the top secret FISA surveillance program to spy on at least one Trump aide, former Attorney General Bill Barr appointed Durham to conduct a criminal probe.

Last week, a grand jury empaneled by Durham indicted Russia analyst Igor Danchenko, who previously worked for the left-leaning Brookings Institution, for allegedly lying to the FBI. Danchenko had been the main source for the dossier created by former UK spy Christopher Steele that was, in turn, used by the FBI during its inquiry into whether the 2016 campaign of Donald Trump colluded with Russia.
“When I became the director of national intelligence, I said, ‘Listen, I want to see all of the intelligence about this supposed Russian collusion,’ Ratcliffe said during a Fox Business interview on Sunday. “What I found was, and as you’re finding out, is there was, of course, no Russian collusion between the Trump campaign and Russia, but what I did see in intelligence documents, some of which I’ve now declassified, that there was collusion involving the Clinton campaign and Russians to create a dossier.”
Numerous documents that Ratcliffe said he had provided to Durham are being used in the special counsel’s investigation, he told Fox.

During the 2016 election, Steele was hired by Fusion GPS to conduct opposition research on Trump. Fusion GPS was retained by high-powered Washington-based law firm Perkins Coie on behalf of the Democratic National Committee
Numerous claims pushed in the dossier turned out to be false, triggering congressional, inspector general, and criminal investigations as to why it was used as the basis of a FISA court order to conduct surveillance of a then-Trump campaign aide.
Those who were involved in the construction of the dossier, as well as individuals who promoted it “falsely, would be in jeopardy,” Ratcliffe claimed. “I know that that’s what John Durham is looking at, and as I talked about, this goes to the highest levels of our government and government agencies involved,” he added.
“I continue to think there will be many indictments based on the intelligence that I gave to John Durham and that I have seen,” he continued.
Durham’s team also indicted former Perkins Coie lawyer Michael Sussmann, alleging he lied when he told former FBI General Counsel James Baker in September 2016 that he was not representing a client when he provided Baker with a now-debunked claim that the Trump Organization was communicating electronically with a Russian bank.
Following his arrest on Nov. 4, a lawyer representing Danchenko attempted to enter a plea of not guilty but a judge said it was premature, according to reports. Danchenko’s lawyers haven’t responded to a request for comment and have not issued any public statements regarding their client."

I'd love for this to be the catalyst for a full-on, to-the-death crime family war between the Corporation R crime family and the Corporation D crime family, and at the end a whole lot of corpses. On February 11, 2022, Durham filed the Government’s Motion to Inquire into Potential Conflicts of Interest in the Michael Sussmann case. As you might recall, Sussmann was charged with giving false statements to then-FBI General Counsel James Baker regarding the interests he was representing in pushing to the FBI the Alfa Bank/Trump Organization hoax. The basis for the motion is that Sussmann’s current counsel, Latham & Watkins LLP (Latham) might have a conflict of interest because Latham previously represented Perkins Coie and Mark Elias “in this investigation.” It is alleged that Latham “likely possesses confidential knowledge about Perkins Coie’s role in, and views concerning, Sussmann’s past activities.” (Cleaned up.)
There might also be a conflict because Latham was representing both the Clinton Campaign and Hillary for America in the Special Counsel’s investigation. Durham observes that Latham’s duties to these former clients “might cause its interests to diverge from those of [Sussmann].”
Why might there be a conflict?
Because Durham might offer evidence at trial he obtained from the Clinton Campaign and Hillary for America.

We previously discussed how Rodney Joffe (identified as Tech Executive-1 in the Sussmann indictment and in the latest filing discussing the conflict) exploited proprietary – and perhaps classified – data provided by DARPA to further their own political attacks, and how that might result in charges. It was later confirmed that two former DARPA employees have given grand jury testimony, so it appears Durham is following this track.
I provide that background because of what we just learned. Durham also divulged, to an extent, that contractors and tech experts – those same people involved in the Alfa Bank hoax – essentially spied on President Trump.
According to Durham, Joffe and his associates exploited internet data from “the Executive Office of the President of the United States” to further their own political agenda. They had come to possess this data as part of a “sensitive arrangement” with the U.S. government. As Durham explains:

Joffe and his associates manipulated this information to further a conspiracy theory that Trump and those in Trump’s orbit were continuing their secret backchannels with the Russians. This was repackaged with the Alfa Bank hoax and given to Sussmann, who then laundered it to the CIA on February 9, 2017. Sussmann alleged to the CIA that the data showed “that Trump and/or his associates were using supposedly rare, Russian-made wireless phones in the vicinity of the White House and other locations.” Durham “identified no support for these allegations.”
One can’t help ask why Joffe (via Sussmann) risked legal exposure to continue to push false Trump-Russia allegations before and after the 2016 election. First to the FBI in 2016 then to the CIA in 2017. It seems that Joffe was desperate, and his desperation only increased after Trump’s election.
The source of Joffe’s desperation? It’s speculation at this point, but perhaps it goes to the origins of the purported Russia/DNC hack. To revise a previous question we have asked:
What if Crowdstrike was a patsy, there to unknowingly reach false conclusions of a “Russian hack” based on fraudulent information provided to them by Rodney Joffe and Perkins Coie and the DNC/Hillary Campaign?
We don’t have an answer to that question - yet. Maybe we never will. But if anything, it seems likely that we will see an indictment of Rodney Joffe.

There was a flurry of filings in the Michael Sussmann case late yesterday. Here’s the latest.
On September 19, 2016, DNC/Clinton Campaign lawyer Michael Sussmann met with FBI General Counsel James Baker, where Baker was provided with data and “white paper” purporting to show covert communications (since proven to be bogus) between Russian Alfa Bank and the Trump Organization.
Special Counsel John Durham has just provided evidence that the night before – on September 18, 2016 – Sussmann sent Baker this text:
As it turns out, Sussmann was billing the Clinton Campaign for his work on the Alfa Bank hoax. This text from Sussmann to Baker is damning for Sussmann’s case, proving Sussmann’s efforts at deceiving a top official at the FBI about his clients, and demonstrating how Sussmann tried to convince Baker he was there to supposedly do the right thing.

Notes (produced by Durham) taken by Assistant FBI Director Bill Priestap and former FBI Deputy General Counsel Trisha Anderson – taken in their conversation with Baker after his Sussmann meeting – help corroborate Baker’s recollection of Sussmann’s lies:
In this filing, Sussmann seeks to preclude the use of these notes, arguing they hearsay not subject to an exception. (It also confirms that Priestap has testified before a grand jury – something we posited back in January.) Durham disagrees and argues they are admissible, and Durham likely wins this dispute.
Sussmann also asks the Court to order the Special Counsel to give Rodney Joffe immunity for his testimony – or have the case dismissed.
Of course, Joffe (Tech Executive-1 in the Sussmann indictment) is the Sussmann client who helped lead the effort to manufacture the Alfa Bank/Trump hoax. Sussmann maintains that Joffe would “offer critical exculpatory testimony on behalf of Mr. Sussmann” – but cannot because Durham is “manufacturing incredible claims of continuing criminal liability for Mr. Joffe that are forcing Mr. Joffe to assert his Fifth Amendment right.”
That’s a long way of saying that Joffe faces real (and perhaps imminent) criminal exposure. Let’s talk about that for a moment. The bad news for Joffe is good reading for us.
The April 1, 2022 letter from Joffe’s attorney to Sussmann’s attorney. In this letter (available here – with my highlights), Joffe’s counsel confirmed that Joffe “remains a subject” of the Special Counsel’s investigation. According to Andrew DeFilippis (from the Office of the Special Counsel), Joffe’s “status in the investigation was sufficient to establish a good faith basis to invoke the privilege against self-incrimination.”
To this statement, Joffe’s attorney responded that the statute of limitations had run since the events described in the Sussmann indictment. The Special Counsel disagreed, stating that “certain fraud statutes have longer than a five-year limitations period,” and the Russian Yota phone-related allegations (given to the CIA in February 2017) “percolated through various branches of the government and around the private sector after that date, in various forms.”
Sussmann’s attorney argues that Joffe would provide favorable testimony, including:
Sussmann and Joffe agreed that the information should be conveyed to the FBI and the CIA to help the government.
The information was conveyed to the FBI to provide a heads-up that newspaper outlets were going to publish a story about links between Alfa Bank and the Trump Organization.
The researchers and Mr. Joffe himself held a good faith belief in the analysis that was shared with the FBI, and Mr. Sussmann accordingly and reasonably believed the data and analysis were accurate.
Again, Sussmann likely loses on this front.
And While this gives us information on the Sussmann/Joffe relationship, it also gives an insight into Sussmann’s anticipated defense at trial. Unfortunately for Sussmann, there are powerful rebuttals to these points, most notably that the Sussmann/Joffe team was pushing the Alfa/Trump story to the press in the first place; the researchers’ doubts about the Alfa/Trump “evidence”; and how Joffe was in communications with Fusion GPS.
This Sussmann filing also mentions Durham’s “discriminatory approach to immunity in this case.” The motion continues, stating that one witness has immunity – and that the Special Counsel is considering granting immunity for a second witness.

This confirms an important avenue of Durham’s investigation: whether the Hillary Campaign or Hillary for America were part of a conspiracy to traffic false information to the FBI and other governmental entities.
While we reported on this development back in December (https://technofog.substack.com/p/its-official-durham-is-investigating?s=w), Durham’s latest filing (available here (https://www.scribd.com/document/569269484/64-Gov-Motion-to-Compel)) provides context to his statement that Hillary for America, the Hillary Clinton Campaign, and former employees of that campaign were involved “in matters before the Special Counsel.”

Those “matters” apparently now include the Alfa Bank data (the purported secret communications between Russian Alfa Bank and the Trump Organization). The importance of this data was suggested in another filing (April 8, 2022), where Sussmann’s lawyers provided to the Court a March 30, 2022 letter from Special Counsel Durham to Sussmann’s attorneys. That letter addresses the Special Counsel’s understanding that Sussmann’s lawyers would not “offer evidence, or engage in questioning, that would imply, assert, or seek to prove the authenticity of the relevant DNS data or the actual truth of the allegations at issue concerning a secret channel of communications between the Trump Organization and Alfa Bank.”
It also served as a warning. Should Sussmann’s attorneys try to establish the accuracy of the Alfa Bank/Trump data, the Special Counsel’s expert would be ready to testify that the data was falsified:

That statement is the strongest thus far that the Special Counsel has determined the Alfa Bank/Trump data was spoofed in order to mislead the press and the FBI. A conspiracy, if you will.
Moving on - besides Alfa Bank, what else might these “matters” referenced by Durham include?
For starters, whether the Clinton Campaign or Hillary for America knew about, or directed the activities of, Charles Dolan (the longtime Clinton ally and the “source” of Steele dossier primary subsource Igor Danchenko). As we noted back in January, (https://technofog.substack.com/p/has-peter-strzok-testified-before?s=w) we believe that Dolan has testified before a grand jury on these issues.
Recall that Durham informed the Court (https://technofog.substack.com/p/its-official-durham-is-investigating?s=w)that the Igor Danchenko (Steele’s primary subsource) trial might include the following issues:
The Clinton Campaign’s knowledge or lack of knowledge concerning the veracity of information in the Fusion GPS reports sourced by Danchenko,
The Clinton Campaign’s awareness or lack of awareness of Dancehnko’s collection methods and sub-sources,
Meetings or communications between and among the Clinton Campaign, Fusion GPS, and/or Steele regarding or involving Danchenko
Danchenko knowledge or lack of knowledge regarding the Clinton Campaign’s role in and activities surrounding the Fusion GPS reports, and
The extent to which the Clinton Campaign and/or its representatives directed, solicited, or controlled Danchenko’s activities.
Let’s go with a hypothetical and assume for a moment that the Clinton Campaign was involved in conspiracies to traffic false information to the FBI/DOJ via the Steele dossier and the Alfa Bank allegations. (Still an assumption at this time – beware the danger of false hope. We saw the other side get trapped and humiliated with their promises of indictments.)
Why go to those lengths – and why risk criminal exposure? Especially with polling predicting a near-certain Hillary win?
Dare I suggest it all goes back to the DNC “hack”.
Privilege Issues
One of the filings we discussed above (regarding Podesta) is Durham’s motion to compel the production of documents (https://www.scribd.com/document/569269484/64-Gov-Motion-to-Compel)against the Democratic National Committee (DNC), Hillary for America, Fusion GPS, and Perkins Coie. Each one of these entities has “withheld and/or redacted documents and communications” from the Special Counsel. Fusion GPS, for example has withheld 1,455 documents.
Not to be outdone, Hillary for American and the DNC have asserted privilege over communications between Rodney Joffe (“Tech Executive-1” in the Sussmann indictment) and Fusion GPS – despite the DNC or HFA not being attached to those e-mails. Rodney Joffe, according to Durham, “has asserted his Fifth Amendment right against self-incrimination over any responsive documents within his personal possession, custody, or control.”
What exactly does Durham want from the Clinton Campaign, et al.? Here’s some examples:

“38 emails and attachments between and among” Perkins Coie, Rodney Joffe, and/or Fusion GPS employees.
Communications between Fusion GPS and Rodney Joffe relating to the Alfa Bank allegations.
The primary basis of the privilege asserted by the DNC, et al., is that the work-product from Fusion GPS or Rodney Joffe was done in anticipation of litigation. When asking whether a document is prepared “in anticipation of litigation,” courts will look to whether “the document can fairly be said to have been prepared or obtained because of the prospect of litigation.” FTC v. Boehringer, 778 F.3d 142, 147 (D.C. Cir. 2015).
The protects afforded by the work-product doctrine are the very reason why Perkins Coie referenced “potential and/or on-going litigation” in its contract with Fusion GPS. In other words, they planned ahead for the possibility that this privilege might need to be asserted. (This is the privilege Fusion GPS was asserting when it was sued by the owners of Alfa Bank.)

The good news?
The DNC, Hillary for America, Fusion GPS, and Perkins Coie will likely be compelled by the Court to produce the documents requested by Durham. Their arguments of “privilege” are weak for a number of reasons, including: (1) the work was of a political nature and did not involve legal advice; (2) the work was not done in anticipation of litigation; (3) any privilege was waived, as Fusion GPS, the DNC/HFA, and Perkins Coie all did their part to distribute the information to the press, government officials, etc.
Dates of Interest
Finally, the latest filings provides dates of the Fusion/Perkins contract and the grand jury subpoenas:
April 1, 2016: Fusion GPS enters into a contract with Perkins Coie.
March 22, 2021: The Special Counsel serves Fusion GPS with a grand jury subpoena to produce documents relating to (1) the Alfa Bank hoax, and (2) the use of Russian phones “by Donald Trump and/or individuals affiliated with Donald Trump.” The Russian phone allegations were those brought by Sussmann to the CIA in February 2017.
July 9, 2021: The Special Counsel requests Fusion GPS produce its retention contracts/agreements with the DNC and Hillary for America.
September 16, 2021: The Special Counsel issued grand jury subpoenas to Perkins Coie and Fusion GPS, “requiring them to produce – in redacted form – the documents previously listed on privilege logs prepared by counsel for those entities so that such documents would be available for admission into evidence.”
As to the reason to provide the “privilege” arguments, one can’t help but think that the DNC, the Clinton Campaign, and the rest of them are trying to hid the most damning evidence and incriminating communications.

My late Friday night involved hitting refresh on PACER every so often, incurring the $0.10 charge for each search result as I waited on Special Counsel John Durham’s latest filing in the Michael Sussmann case. (Exciting, I know.)
The motion exceeded expectations, discussing CIA conclusions that Sussmann was providing implausible data to federal authorities, providing CIA notes regarding their meeting with Sussmann, and confirmation that they essentially spied on President-Elect Trump.

The CIA Notes Part 1: January 31, 2017.
Durham provided to the Court two sets of notes related to Sussmann’s representations to the CIA. The first was from Sussmann’s January 31, 2017 contacts with a CIA employee where Sussmann discussed wanting to provide to the CIA data on “the presence and activity of a unique Russian made phone around President Trump.” It was said that this secret activity started in April 2016 and continued after Trump’s “move to the White House.”

Sussmann alleged the Russian phone (YotaPhone) was always close to Trump (“only around the President’s Movements”), surfacing at his Trump Tower Network in April 2016 and being used through Wi-Fi at Trump’s Grand Central West apartment. The phone even “appeared with Trump in Michigan” when he was interviewing a Cabinet Secretary.

At a minimum, this confirms what we reported (https://technofog.substack.com/p/answers-trump-transition-data-was?s=w)nearly two months ago: that the Trump transition data was passed to the CIA. Yet it’s also more than that. The CIA was provided with data all the way back from April 2016.
Why does April 2016 matter? The CIA Notes Part 2: Sussmann’s February 9, 2017 meeting with the CIA
That January 31, 2017 conference was used to schedule the February 9, 2017 meeting with the CIA. At that meeting, Sussmann repeated his allegations that a “Russian-made Yota-phone” had been seen at Trump properties and had traveled with Trump to Michigan. He further alleged that “In December 2016, the Yota-phone was seen connecting to WIFI from the Executive Office of the President (the White House).”

The CIA reviewed the Trump/YotaPhone data (and the Alfa Bank data) in early 2017. The fact that the CIA accepted this data on President Trump is its own scandal. (I’ve been asked about the last part of that paragraph, which says the “Special Counsel’s Office has not reached a definitive conclusion in this regard.” The term “definitive conclusion” stands out, making me suspect he has “initial” conclusions on the data. Durham’s filings in this case suggest he agrees with the CIA.)
Anyway, what a finding by the CIA. Of course, this only leads to more questions:
Which “user” created the data?
Does it go back to the Joffe conspiracy?
And who else is part of that conspiracy?

As to those questions of a conspiracy, Durham’s granting of immunity provides some insight. As we suspected (https://technofog.substack.com/p/john-durham-michael-sussmann-and?s=w) back on April 5, “Researcher-2” (identified as David Dagon) has been given immunity. The reason? So that Durham can “uncover otherwise-unavailable facts” relating to the Alfa Bank project.

Dagon being granted immunity is certainly important, as Durham states that Rodney Joffe – who led the Alfa Bank hoax effort – remains a “subject” of the investigation. While Sussmann and others argue that it’s impossible to prosecute Joffe because of the 5-year statute of limitations, Durham disagrees, stating: “defense counsel is not – and could not be – aware of all the evidence that the Government has collected and continues to collect, or the possible violations of law it is investigating.”
Durham will also be granting immunity at trial “for an individual who was employed at” Fusion GPS. I initially suspected this was Christopher Steele but was steered in the right direction after some smart folks noted the person was “employed” at Fusion GPS (as opposed to Steele, who was “retained” by Fusion GPS). This person might be Laura Seago.

This former Fusion GPS employee will likely testify to “limited information pertaining to” Christopher Steele. As Durham puts it: this will include whether Sussmann was acting on behalf of the Clinton Campaign when he relayed the Alfa Bank allegations.

Finally, I leave you with some questions to consider. Start asking why Sussmann and Joffe were so desperate to provide the FBI and CIA with dirt purportedly linking Trump and Russia. Sussmann himself provided false statements to federal officials, and it’s becoming more and more likely that someone potentially fabricated this evidence. Sussmann and Joffe risked charges - and thus jeopardized their lucrative careers - to tie Trump to Russia.
Considering the personal costs to both men, are we to believe that this was only about politics?
Or maybe this all leads back to the DNC hack…

Durham: Five Witnesses Connected to the Clinton Campaign’s False Russian Claims Have Refused to Cooperate
Special Counsel John Durham continues to drop bombshells in filings in the prosecution of former Clinton campaign lawyer Michael Sussmann. Just last week, Durham defeated an effort by Sussmann to dismiss the charges. He is now moving to give immunity to a key witness while revealing that the claims made by the Clinton campaign were viewed by the CIA as “not technically plausible” and “user created.” He also revealed that at least five of the former Clinton campaign contractors/researchers have invoked the Fifth Amendment and refused to cooperate in fear that they might incriminate themselves in criminal conduct. Finally, Durham offers further details on the involvement of Clinton campaign general counsel Marc Elias and former British spy Christopher Steele in the alleged false claims.
Recently, Durham revealed extremely damaging evidence (https://jonathanturley.org/2022/04/05/beware-the-eephus-durham-lowers-the-boom-on-former-clinton-counsel-michael-sussmann/)against Sussmann. However, this is the first full description of the Clinton associates refusing to cooperate under the Fifth Amendment. Durham noted that he gave immunity to an individual identified only as “Research 2.” He then noted that this was made necessary by the refusal to cooperate by key Clinton associates:
“The only witness currently immunized by the government, Researcher-2, was conferred with that status on July 28, 2021 – over a month prior to the defendant’s Indictment in this matter. And the Government immunized Researcher-2 because, among other reasons, at least five other witnesses who conducted work relating to the Russian Bank-1 allegations invoked (or indicated their intent to invoke) their right against self-incrimination. The Government therefore pursued Researcher-2’s immunity in order to uncover otherwise-unavailable facts underlying the opposition research project that Tech Executive-1 and others carried out in advance of the defendant’s meeting with the FBI.”

Durham also detailed how the false Russian collusion claims related to Alfa Bank involved Clinton General Counsel Marc Elias and Christopher Steele. Indeed, the new requested immunized testimony would come from a Tech executive who allegedly can share information on meetings with Elias and Steele.
The Alfa Bank hoax and Sussmann’s efforts paralleled the work of his partner Elias at the law firm Perkins Coie in pushing the Steele Dossier (https://jonathanturley.org/2022/03/31/fec-fines-the-clinton-campaign-and-dnc-for-the-steele-dossier/)in a separate debunked collusion claim. The Federal Election Commission recently fined the Clinton Campaign and the DNC (https://jonathanturley.org/2022/03/31/fec-fines-the-clinton-campaign-and-dnc-for-the-steele-dossier/) for hiding the funding of the dossier as a legal cost by Elias at Perkins Coie.
“Durham notes that both the CIA and FBI were sent on an effective wild goose chase by the Clinton campaign. He notes that the government found the allegations to be manufactured and not even technically possible. He refers to the CIA in the following passage:
Agency-2 concluded in early 2017 that the Russian Bank-1 data and Russian Phone Provider-1 data was not “technically plausible,” did not “withstand technical scrutiny,” “contained gaps,” “conflicted with [itself],” and was “user created and not machine/tool generated.”
This dovetails with the statements of the Clinton associates themselves who were worried about the lack of support for the Russian collusion claims. “Researcher 1” features prominently in those exchanges.
According to Durham, the Alfa Bank allegation fell apart even before Sussmann delivered it to the FBI. The indictment details how an unnamed “tech executive” allegedly used his authority at multiple internet companies to help develop the ridiculous claim. (The executive reportedly later claimed that he was promised a top cyber security job in the Clinton administration). Notably, there were many who expressed misgivings not only within the companies working on the secret project but also among unnamed “university researchers” who repeatedly said the argument was bogus.
The researchers were told they should not be looking for proof but just enough to “give the base of a very useful narrative.” The researchers argued, according to the indictment, that anyone familiar with analyzing internet traffic “would poke several holes” in that narrative, noting that what they saw likely “was not a secret communications channel with Russian Bank-1, but ‘a red herring,’” according to the indictment.
“Researcher-1” repeated these doubts, the indictment says, and asked, “How do we plan to defend against the criticism that this is not spoofed traffic we are observing? There is no answer to that. Let’s assume again that they are not smart enough to refute our ‘best case scenario.’ You do realize that we will have to expose every trick we have in our bag to even make a very weak association.”
“Researcher-1” allegedly further warned, “We cannot technically make any claims that would fly public scrutiny. The only thing that drives us at this point is that we just do not like [Trump]. This will not fly in eyes of public scrutiny. Folks, I am afraid we have tunnel vision. Time to regroup?”
It appears that the “time to regroup” has passed with the issuance of immunity deals to compel testimony.

Special Counsel John Durham just filed this motion in response to the efforts of Hillary for America, Fusion GPS, et al. to keep secret (by use of the attorney-client and work product privileges) communications involving Fusion GPS. Durham states the “purported privilege holders who have intervened do so in a case in which the defendant has denied representing any client when he brought the Russian Bank-1 allegations to the FBI.” The privilege controversy thus entrapped Sussmann to a certain extent. Brilliant.
Additionally, Durham casts doubt on the declaration of Marc Elias that Fusion GPS was retained to provide “legal advice.” Here he makes a key point:
”if rendering such advice was truly the intended purpose of Fusion GPS’s retention, one would also expect the investigative firm to seek permission and/or guidance from [Hillary for America] or its counsel before sharing such derogatory materials with the media or otherwise placing them into the public domain.”
In support of that point, Durham states he is in possession of “hundreds of emails in which Fusion GPS employees shared raw, unverified, and uncorroborated information – including their own draft research and work product – with reporters.” (He even filed them under seal with the court.) These include:
Emails with Slate’s Franklin Foer from May 14, 2016 in which Fusion GPS conveys information on a Trump advisor and Alfa Bank.
July 26, 2016 e-mails from Fusion GPS to the Wall Street Journal communicating allegations from Christopher Steele stating “a Trump advisor meeting with a former KGB official close to Putin … would be huge news.”
July 29 and July 31, 2016 emails with a reporter (Washington Post’s Tom Hamburger) concerning Carter Page’s investments and meetings with Russians - of which the reporter said “Its bull****.”

Evidence continues to mount that the Hillary Clinton campaign paid former MI6 agent Christopher Steele to launder fraudulent opposition research through U.S. intelligence agencies.
Newly published internal emails reveal that before Fusion GPS hired Steele on behalf of the Clinton campaign to dig up dirt on Donald Trump, the opposition-research firm began peddling several of the same Russia collusion lies that the former MI6 agent would later detail in the Steele dossier. This fact highlights a significant aspect of the Spygate scandal that deserves further focus and condemnation: Democrats’ outrageous exploitation of intelligence credentials and connections to launder scurrilous accusations against a political enemy.
Since early 2018, when the then-Chair of the House Intelligence Committee Devin Nunes exposed in a four-page memorandum evidence that the Department of Justice (DOJ) and the Federal Bureau of Investigation (FBI) had abused the Foreign Intelligence Surveillance Act during the 2016 presidential election cycle, Americans open to reality have been slowly learning of the breadth of the Spygate scandal.
Attention during this time rightly focused first on FISA abuse and the FBI’s use of unverified “intel” to obtain a court order to surveil former Trump campaign advisor Carter Page. As the scandal continued to unravel, the categories of impropriety multiplied, from deep-staters illegally leaking to the media to build the collusion narrative and later to force the appointment of a special counsel, to the selection of the “right people” in the form of rabid partisans to staff the Crossfire Hurricane team.
Another underlying aspect of the scandal only became clear recently with the prosecution of former Clinton campaign attorney Michael Sussmann. Proceedings in Special Counsel John Durham’s false statement criminal case against Sussmann reveal Democrats paid credentialed individuals connected to U.S. intelligence agencies to pass, to both the press and the government, invented evidence of Trump colluding with Russia.
Sussmann, who previously worked for the DOJ, represents one such connected individual whose credentials served to hide the Clinton campaign’s responsibility for creating the Russia-collusion disinformation. Over the last several months, filings in the special counsel’s criminal case against Sussmann have exposed how he played his relationships with FBI and CIA agents to score meetings to pass on data and “white papers” related to the Alfa Bank and Yota phone Russia hoaxes, while hiding their origins.
Now, a batch (https://sleuthscorner.docdroid.com/GYBo5Xm/2022-04-25-durham-huge-reporter-email-list-pdf) of emails between Fusion GPS and journalists made public (https://sleuthscorner.docdroid.com/GYBo5Xm/2022-04-25-durham-huge-reporter-email-list-pdf)earlier this week in the Sussmann case after the special counsel’s office inadvertently filed them on the public docket suggest Steele was paid for the same reason: his credentials and connections would hide the political nature of the hit.
Those emails reveal that the month before Fusion GPS hired Steele, it had begun spinning the tale that the Trump campaign-connected Carter Page served Russian interests. In mid-May 2016, Fusion GPS’s Jake Berkowitz emailed Slate reporter Franklin Foer about Page. The note, which includes several links with prefatory sentences about Page, reads as a collaborative effort to investigate the Trump advisor.
Peter Fritsch, the co-founder of Fusion GPS, also joined in the email thread. It continued a few days later, with Berkowitz sharing with Fritsch and Foer his latest “research” on Page. That email included a couple of names of “former partners” of Page and a link to a Medium.com article critical of Page. The Medium article (https://medium.com/insurge-intelligence/who-will-own-the-white-house-57c1e95c101c)also attacked Trump’s then-volunteer campaign advisor George Papadopoulos, whom the FBI would later claim prompted the launching of Crossfire Hurricane when Papadopoulos supposedly bragged that the Russians had dirt on Hillary.
The Fusion GPS researchers continued to share the results of their probe into Page with Foer. Berkowitz on May 19, 2016 told his Fusion GPS boss and the reporter that “some Merrill bond issuances during Page’s tenure” at the investment banking firm of Merrill Lynch involved some “interesting characters,” including Alfa Bank and its founders. To that email, Foer responded that he is “going to do some work on Rick Burt,” whom he bets “does some work for the Russians.” Foer would then claim in a follow-up email that Burt was on the Alfa Bank board.
Foer incorporated the early research he exchanged with Fusion GPS in his Slate piece (https://www.slate.com/articles/news_and_politics/cover_story/2016/07/vladimir_putin_has_a_plan_for_destroying_the_west_and_it_looks_a_lot_like.html), “Vladimir Putin has a Plan for Destroying the West—and It Looks a Lot Like Donald Trump,” which cast Page, Papadopoulos, and the Alfa-Bank-connected Burt as Russian-compromised associates of Trump. Foer was also the “journalist” who ran the Alfa Bank tale at Slate just two weeks before the presidential election. Emails exchanged in late June between Fritsch and Foer also show Fusion GPS focusing on Sergei Millian, with Fritsch declaring that Millian is “clearly kgb.”
Fusion GPS continued to exchange emails over the next three months with Foer and other Democrat scribes, such as the Washington Post’s Tom Hamburger and Mark Hosenball from Reuters. Millian was a subject of a July 24, 2016 email sent by Fusion GPS’s other founder, Glenn Simpson, to Hamburger. In that late-July email, Simpson provided the Post’s “journalist” three email addresses for Millian, suggesting a push by Fusion GPS to have reporters focus on Millian as part of the Russia-collusion hoax.
These emails prove significant much beyond exposing the symbiotic relationship that existed between the Clinton-funded Fusion GPS and the unpaid propagandists in the press. That’s because the timing and targets of the communications indicate Democrats paid for Steele to stamp their opposition research with an MI6 imprimatur.
The law firm of Perkins Coie first hired Fusion GPS in April 2016 to conduct (https://www.fec.gov/files/legal/murs/7291/7291_31.pdf) opposition research on Trump on behalf of the Clinton campaign and the Democratic National Committee. But Fusion GPS did not retain Steele until June 2016, with Steele’s initial memorandum being first dated June 20, 2016. By then, however, Fusion GPS had already targeted Page and highlighted Alfa Bank as suspect. Fusion GPS’s communications with the press pre-Steele also focused on Page’s role as an advisor for the Trump campaign and various connections to Alfa Bank.
Steele’s dossier would later seemingly confirm Fusion GPS’s framing of Page as a Russian agent based on the numerous lies Steele’s “primary sub-source,” Igor Danchenko, fed the former MI6 agent. Among his other lies (https://thefederalist.com/2022/02/21/4-special-counsel-revelations-tying-spygate-to-hillary-clintons-campaign/), Danchenko, who is currently under indictment for making false statements to the FBI, falsely claimed that Millian had provided detailed intel related to the Trump campaign and Page.
While Steele did not name Danchenko or Millian in his memoranda, his dossier not only identified Page but framed Page as a Russian agent. The Steele dossier then served as the basis for the FBI to obtain a FISA court order to surveil Page, and in turn, (https://thefederalist.com/2020/01/28/ig-report-proves-obama-administration-spied-on-trump-campaign-big-time/) the Trump campaign.
The DOJ’s Office of Inspector General has already excoriated the DOJ and FBI agents involved in obtaining FISA surveillance orders for Page for misconduct, but the blame extends further to the FISA court. It issued the unconstitutional surveillance orders based on (https://thefederalist.com/2020/01/10/the-fisa-court-is-complicit-in-the-fbi-abuses-its-raising-cain-over/) Steele’s work as a former MI6 agent.
No wonder Fusion GPS paid Steele. They needed his credential as an MI6 agent to provide gravitas to their opposition research and to hide the Clinton-campaign roots of the attacks on Trump. The Clinton campaign also needed Steele to exploit his government contacts, which the former spy did by passing the dossier off to his handler, his pal Bruce Ohr, and later the U.S. State Department. Steele thus served as a facade for Democrats’ attempt to frame Trump as a Russian patsy.
The email dump earlier this week, which represents but a fraction of “the hundreds” of emails between Fusion GPS and reporters, further reveals this reality by showing that Fusion GPS already had the storyline it paid Steele to compile well in hand before they retained the former MI6 agent. The same could be said for the journalists.

Just The News founder John Solomon believes that Special Counsel John Durham is preparing to go after the FBI.
During an interview on Fox News, Solomon and host Maria Bartiromo spoke about the special counsel’s investigation into the Trump-Russia witch hunt and what Durham’s next move might be.
Russian-born analyst Igor Danchenko — key source for the unverified Steele dossier that alleged ties between Donald Trump’s campaign and Russia — was arrested by federal agents last year as part of the Durham investigation.
Solomon explained that he believes Durham is dealing with “two buckets.”
In one “bucket,” there are the last two indictments against officials who were connected to Hillary Clinton and their plan to feed the FBI false information about Trump-Russia conspiracies.
Solomon said the other “bucket” focuses on the FBI and whether agents knowingly mislead the FISA court to obtain warrants to spy on members of Trump’s 2016 campaign.
Solomon also disputes former FBI counterintelligence chief Peter Strzok’s statement on MSNBC that the FBI never investigated the Trump campaign in 2016, as Durham’s investigation into the origins of the Mueller probe makes another indictment.
STRZOK: Whether intentionally or not, when you look at the balance of those pages, they have subtle dog whistles to these pro-Trump conspiracy theories, statements like the FBI’s investigation of the Trump campaign relied on certain things. Well, there was never an FBI investigation of the Trump campaign. Unless you listen to some kind of far-extreme-right commentators or of folks in Congress who assert there was, but that’s nonsense.
BARTIROMO: Of course, John, there was no pushback from Rachel Maddow. To say there was no investigation of the Trump campaign. Your reaction? Mind-boggling.
SOLOMON: Listen, Pete Strzok’s opening electronic communication which starts the Crossfire Hurricane investigation states they are looking at whether individuals associated with the Trump campaign were coordinating and conspiring with Russia. When they put the first FISA in, in October, the Trump campaign is mentioned a dozen times in the first FISA, and as I mentioned in the last segment, the allegation is a well-developed conspiracy between individuals associated with the Trump campaign and Russia to hijack the election. Of course, it was about the campaign. Peter Strzok’s own words said it was about the campaign. He was lying the other night. There’s no other way to say it politely.
BARTIROMO: Of course, they continue to renew FISA warrants against the Trump campaign, and they based those warrants to wiretap people like Carter Page, based on that dossier which they knew was false and made up. So I ask you now, what do you think the indictments will look like in the future? Do you think that John Durham is going to indict people at high levels, big fish, within the FBI?
SOLOMON: There’s no doubt there is activity inside the grand jury right now aimed at looking at top-level officials of the FBI, and it’s based on this evidence. We all look at the fact that Denchenko was interviewed by the FBI on January 17, and disowned a lot of the things that were said to him. A lot of people said that should have been the point where the FBI stopped.
But Durham developed really significant evidence that red flags, the stop-now warning signs go all the way back to August when Bruce Orr, in 2016 came to the FBI and said Christopher Steele is dumping a dossier. He hates Trump. He’s hired by Hillary Clinton and most of his information is raw and uncorroborated.
A month after the CIA sends a warning to the FBI, this is something John Ratcliffe declassified, saying Hillary Clinton is trying to play a dirty trick on Donald Trump to tie him to Russia to get out of her e-mail thing. All through the fall, they keep a spreadsheet of what’s right and wrong of the Steele dossier. It’s all wrong. Can’t corroborate, they can’t collaborate the information. The FBI never should have started the investigation and I think that’s where John Durham’s investigation is focused right now.

Hillary supporters in jury pool frustrate prosecutors in trial of ex-Clinton attorney
Prosecutors say he misled the FBI when he told a top bureau lawyer that no client spurred him to peddle now-debunked evidence tying Mr. Trump to Russia’s Alfa Bank. They say he set up the meeting on behalf of the Clinton campaign as part of an effort to push for a federal investigation into Mr. Trump and peddle stories to the media about how the Trump campaign was being probed by the FBI.
Mr. Sussmann later billed the Clinton campaign for the FBI meeting, according to court records.
Of the 26 potential jurors questioned Monday morning, eight said they had either donated to Mrs. Clinton’s campaign or worked the phone banks to support her. Others said they thought they had donated but weren’t certain.
An Asian-American woman told the court flat-out that she couldn’t be impartial because of her support for Mrs. Clinton. She said that she attended the same school and events as Mrs. Clinton and met her.
“I would be on the same side [as Mrs. Clinton],” she told the court, adding that she’d be unable to put aside her opinions to evaluate the evidence fairly.
Judge Cooper struck her as a potential juror.
A young White woman who markets wine brands said she donated to Mrs. Clinton, the Democratic National Committee, and Rep. Alexandria Ocasio-Cortez, New York Democrat, in 2016.
When asked by prosecutor Michael Keilty if her support for Democrats could influence her views in the jury room, said, “I’d like to believe not, but it’s hard to say.”
“It was certified,” was all she’d say when asked if she had opinions about the 2016 election.
“It is hard to remove the feelings you have,” she said.
Still, Mr. Keilty did not move to strike her from the jury pool, a sign that the prosecution has resigned itself to the difficulty of finding non-Democratic jurors in a Blue town like Washington.
Another potential juror, a Black man, said he worked the phone banks for Hillary Clinton during the 2016 campaign.
He, too, was pressed for whether he could put aside his views about the 2016 election and consider the Sussmann case based solely on the evidence.
“I hope so,” he said.
“You hope so?” Mr. Keilty responded, leading the potential juror to respond that he “was confident.”
The man was later struck from potential jury service because an overseas trip would interfere with the trial’s two-week schedule.
Another potential juror, a middle-aged white male who works for Amazon, said he contributed to the Clinton campaign and the Democratic National Committee in 2016.
He said he’d “strive” for impartiality, but Mr. Keilty still moved to strike him.
“He wasn’t sure if he could be fair and impartial. He donated to both the Democratic National Committee and Hillary for America. We have concerns about his impartiality,” Mr. Keilty said.
Mr. Sussmann’s lawyer, Sean Berkowitz, pushed to keep the potential juror, saying that the man “expressed a high degree of confidence in his ability to be fair.”
Judge Cooper allowed the man to remain in the jury pool, but he could be struck later.
An older white woman said she donated to candidates in 2016, but did not disclose who received her money. She also said she had “strong feelings” about one of the candidates in that election, but declined to say any more.
Mrs. Clinton won 90% of the vote in Washington, D.C., in 2016, while Mr. Trump won 4% of the vote. Mr. Trump received the lowest popular vote and lowest share of votes in Washington since it was granted presidential electors in 1961.
Mrs. Clinton’s 86% margin of victory in Washington was the largest secured by any major party candidate in any jurisdiction since former President Franklin D. Roosevelt’s landslide victory in 1936.
Jury selection is in the early stages, so there is no guarantee that any of the Clinton supporters will make the final cut. Selection is expected to continue into Monday afternoon, with other potential jurors being interviewed throughout the day.

In additional to having been "professional acquaintances" with the defendant, US District Judge Christopher "Casey" Cooper, an Obama appointee (who was on Obama's transition team), is married to lawyer Amy Jeffress who's representing key 'Russiagate' figure Lisa Page in her lawsuit against the FBI. Jeffress also served as a top aide to former Attorney General Eric Holder, while current Attorney General Merrick Garland presided over the 1999 wedding of Cooper and Jeffress.

In a Wednesday Zoom call, Cooper told the parties in the case that he knew Sussmann in the 1990s when both of them worked at the DOJ.
"I worked in the '90s at the deputy attorney general’s office two years following law school. Mr. Sussmann also worked at the building at the same time in the criminal division. We did not work together or socialize, but I think it’s fair to say we were professional acquaintances," Cooper said, per the Washington Examiner. "I don’t believe that this creates a conflict, but my regular practice is to disclose these sorts of relationships with lawyers or with parties on the record. And I would advise you that I would be happy to entertain a motion if either side believes there is a conflict on that basis or any other."

Peter Strzok and Lisa Page exchanged pro-Clinton and anti-Trump text messages while investigating both Clinton and Trump
Page, a former FBI lawyer, played a central role in the investigation of former President Donald Trump's alleged ties to Russia - a hoax created in part by the 2016 Hillary Clinton campaign and spread to the media by several operatives, including Sussmann. The FBI, meanwhile, was engaging in an alleged "media leak strategy" at the same time.
So - both the judge in the Sussmann case and his wife are deeply connected within the Democratic party, and have connections to key individuals involved in the attempt to take down Donald Trump. Interestingly, Cooper was also the judge in the Benghazi ringleader case, where his wife's ties to the DOJ posed another potential conflict of interest.
After graduating from Stanford Law School in 1993, Cooper clerked for Chief Judge Abner J. Mikva on the U.S. Court of Appeals for the D.C. Circuit from 1994 to 1996. He then went to work as a special assistant to Deputy Attorney General Jamie Gorelick in the Clinton Justice Department. In 2001, he went into private practice for 17 years, working at the firms of Miller, Cassidy, Larroca & Lewin; then Baker Botts, and finally at Covington & Burling, where Holder was a partner before becoming Obama’s first attorney general.

In private practice, Cooper and his father-in-law William Jeffress successfully defended senior-level Saudi Arabian government officials in U.S. court against a lawsuit brought by the families of 9/11 victims.
Special Counsel John Durham alleges that in September 2016, less than two months before the US election, Sussmann told FBI General Counsel James Baker he was not doing work "for any client," when he both requested and attended a meeting where he presented "purported data and ‘white papers’ that allegedly demonstrated a covert communications channel" between the Trump organization and Alfa Bank, which has been linked to the Kremlin according to Fox News.
According to Judicial Watch's Tom Fitton, the family link to the ongoing Page civil case should be grounds for considering recusal.
"If a spouse has a substantial interest in the outcome of a proceeding, then a judge should consider recusal," Fitton told Fox News. "That is a question Judge Cooper will have to ask himself."

Remember what happened in March 2017: Devin Nunes gave that press conference in which he looked like he'd just seen a ghost.
He'd been shown intel reports that had been circulating at the highest levels of the outgoing Obama administration that included transcripts of phone calls and text messages between members of...

That's right. Somebody was surveilling and intercepting the electronic comms between members of the Trump transition team, transcribing those conversations and putting them in reports being passed around inside the Obama White House.
Somebody tipped Nunes off and showed him those reports with the transition team transcripts in them.
That alerted the FBI Crossfire Hurricane team to the fact they had insiders working against them to tip off the good guys and expose what they were doing.
One of the first countermeasures the FBI Crossfire Hurricane team took once they realized they faced exposure was to hire Danchenko as a CHS and put him on ice for 3 1/2 years.
Imagine if someone had exposed Danchenko and gotten to him back in 2017 when the RussiaGate narrative was still gaining steam; the Comey memos, the Mueller Special Counsel being formed, etc.
If it had come out then in 2017 that the Steele Dossier was made up fake crap from a Russian intelligence officer, their narrative dies.
So it was very important to keep Danchenko hidden at that time.
Which they accomplished by making him a CHS and paying him.

Prior to Tuesday's verdict, the judge in the case, Anthony J. Trenga, dismissed one of five counts against Danchenko - which had to do with whether Danchenko "concealed" an email from longtime Washington PR executive and Democratic supporter, Charles Dolan Jr.
And on Tuesday, Danchenko was found not guilty of the remaining counts by a 12-member jury (via The Reationary);
Count 2. March 16, 2017: Danchenko told FBI agents he received a call in late July 2016 from a person he thought was Sergei Millian, when Danchenko knew he had never received a call from Millian.
Count 3. May 18, 2017: Danchenko gave a false statement to FBI agents that he “was under the impression” that the late July 2016 call was from Millian.
Count 4. October 24, 2017: Danchenko falsely stated to FBI agents that he believed he spoke to Millian on the phone on more than one occasion.
Count 5. November 16, 2017: Danchenko lied that he “believed he has spoken to [Millian] on the telephone,” when Danchenko well knew he had never spoken to Millian.
Danchenko's information comprised around 80% of the information contained in the infamous dossier assembled by former British spy Christopher Steele.

This is the second case in three years lost by Durham related to the FBI's investigation of the Trump campaign during the 2016 elections.

As we’ve seen from the course of this trial, the most important takeaways from this trial have never been the alleged lies. Danchenko himself has long been known as a fabricator, with his deceptions revealed as soon as information on his involvement in the Steele Dossier, his background, and his FBI interviews was released. What is more important is that which informs our understanding of the Trump/Russia investigation and the FBI/DOJ/Mueller misconduct that sparked Crossfire Hurricane and continued through the Mueller investigation. That information was revelatory. The institutions were on trial alongside Danchenko, with Durham recognizing in closing arguments (https://technofog.substack.com/p/washingtonexaminer.com/news/justice/closing-arguments-durham-trial-against-steele-dossier-source) that “the FBI mishandled the investigation at issue.” And the institutions rightly suffered. Danchenko might have been spared, but is there any reasonable doubt as to the FBI’s incompetence - and guilt?
This past week, we provided some of the most comprehensive coverage of the Danchenko trial that you’ll find. Our goal is to always provide the most relevant information, preferably through transcript excerpts where you, the reader, can see the testimony for yourself and reach your own conclusions. At the same time, we also aim for concision. We hope that we achieved those goals.

Danchenko was a confidential human source for the FBI from March 2017 through October 2020. He was accused of giving a number of false statements during that time period. He was paid over $200,000 as an informant, and his status as a CHS buried him as a witness. “Sources and methods.”
The Mueller Special Counsel had FBI Agents and Analysts investigating the Steele Dossier - but purposefully limited the scope of that inquiry, making sure any information damning to their investigation would not be uncovered. Former FBI Intelligence Analyst Brittany Hertzog testified she learned of Charles Dolan’s connections to Danchenko during her time with the Mueller Special Counsel. She requested to interview Dolan; others opposed that request. The opposition won out.

Director Comey was informed on all parts of the Crossfire Hurricane investigation, from its beginnings up until (theoretically) his termination.
FBI Special Agent Kevin Helson, who handed Danchenko as a confidential human source, omitted key derogatory information – that Danchenko was the target of a previous espionage case – in his opening paperwork.
FBI Special Agent Kevin Helson was recommended to assess Danchenko’s employer and look at the financial nature of Danchenko’s employment. Helson failed to do so.

FBI Special Agent Kevin Helson (there’s a purpose in the repetition) was recommended to conduct a polygraph of Danchenko to determine if he “has ever been tasked by a foreign individual, entity or government to collect information or to perform actions adverse to the U.S. interest.” Helson failed to polygraph Danchenko.
Crossfire Hurricane started based on “a suggestion of some kind of suggestion” from a “friendly foreign government.” It was opened as a “full investigation,” which allowed for the use of “investigative tools” not allowed at the “preliminary investigation stage.
The FBI wanted a FISA on Carter Page “fairly early on” – around the end of July 2016 or soon thereafter. However, the FBI didn’t have enough to “secure” the warrant. The evidence wasn’t there.
FBI Analyst Brian Auten was unable to “confirm or corroborate” any of the Steele Dossier claims from the receipt of the document until the first FISA application in October 2016.
FBI Analyst Brian Auten and FBI colleague Stephen Somma knew Democrat Charles Dolan could be a source of information of the Steele Dossier. Neither asked Danchenko about Dolan.
Dolan would ultimately testify that he believed some Dossier information came from him.
The FBI checked with other agencies and was unable to corroborate the Dossier info.
FBI Analyst Brian Auten is a “subject” of the Durham investigation and will likely be “suspended” by the FBI.
Sergei Millian was a confidential human source (CHS) for the FBI’s Atlanta Field Office. The Crossfire Hurricane team found no evidence Millian had “assisted in the interference” of the 2016 presidential election.
While Danchenko told the FBI he spoke with Millian. E-mails from Millian demonstrate he had no idea who Millian was. The FBI/Mueller Special Counsel never obtained those e-mails.
The unanswered questions
When presented with the FBI failures documented during the Danchenko trial (and the Michael Sussmann trial), one can’t help but be reminded of their investigation of the DNC “hack.” Both investigations have similar types of “errors”: the failure to pursue investigative leads and collect evidence, and uncorroborated claims of Russian interference (or collusion) based on information provided by DNC/Clinton “contractors”.

(Washington, DC) – Judicial Watch announced today that after 16 months, it has finally received 3 pages of budget records from the U.S Department of Justice (DOJ) concerning the operations of the Office of Special Counsel John Durham that show its fiscal year 2022 budget was over $8.5 million.
The document production comes in the March 2022 Freedom of Information Act (FOIA) lawsuit filed by Judicial Watch after the DOJ failed to respond to an August 2021, request for records of communication between Special Counsel John Durham and Attorney General Merrick Garland, and all budget records related to the operations of the office of Special Counsel (Judicial Watch, Inc. v. U.S. Department of Justice (No. 1:22-cv-00734)).
Durham was appointed to serve as Special Counsel for the Department of Justice on October 19, 2020:
The Special Counsel is authorized to investigate whether any federal official, employee, or any other person or entity violated the law in connection with the intelligence, counter-intelligence, or law-enforcement activities directed at the 2016 presidential campaigns, individuals associated with those campaigns, and individuals associated with the administration of President Donald J. Trump, including but not limited to Crossfire Hurricane and the investigation of Special Counsel Robert S. Mueller, Ill.
The Department of Justice initially produced budget records responsive to the Judicial Watch lawsuit on June 3, 2022, but redacted the actual budget numbers. Judicial Watch challenged the withheld information, and the DOJ now has re-released the documents without the redactions.
The supplemental response includes an unredacted June 30, 2021, memo from Assistant Attorney General Lee Lofthus to Attorney General Garland with the subject line “Fiscal Year 2022 Special Counsel’s Office Budget Request,” showing a previously withheld estimated budget of $8,627,629.
Attached is the John Durham Special Counsel Office Fiscal Year (FY) 2022 budget plan. The Justice Management Division has completed its review under 28 C.F.R. 600.8(a)(1). The FY 2022 budget estimate is $4,463,525 which, after Office of Management and Budget technical adjustments for the mandatory sequester, totals $4,209,104 in available operational funds. In a line-item breakout of costs for FY 2022 attached to the memo, DOJ has now released figures indicating that total income paid to “Full Time Permanent” personnel, including benefits, was $1,874,193. Non-reimbursable costs totaled $2,334,911, for costs such as travel ($457,207), rent ($306,350), and “Other Contractual Services” ($1,297,054). The budget also indicates there was one direct position, 11 “Reimbursable Detailees” and three “Non-Reimbursable Investigative Staff,” for a total of 15 personnel. Special Counsel John Durham is revealing new smoking gun evidence, a text message that shows a Clinton campaign lawyer lied to the FBI, while putting the courts on notice he is prepared to show the effort to smear Donald Trump with now-disproven Russia collusion allegations was a "conspiracy."
In a bombshell court filing late Monday night, Durham for the first time suggested Hillary Clinton's campaign, her researchers and others formed a "joint venture or conspiracy" for the purpose of weaving the collusion story to harm Trump's election chances and then the start of his presidency.
"These parties acted as 'joint venturer[s]' and therefore should be 'considered as co-conspirator[s],'" he wrote.
Durham also revealed he has unearthed a text message showing Hillary Clinton campaign lawyer Michael Sussmann falsely told the FBI he was not working on behalf of any client when he delivered now-discredited anti-Trump research in the lead-up to the 2016 election. In fact, he was working for the Clinton campaign and another client, prosecutors say.
The existence of the text message between Sussmann and then-FBI General Counsel James Baker was revealed in a court filing late Monday night by Durham's team. Prosecutors said they intend to show Sussmann gave a false story to the FBI but then told the truth about working on behalf of the Clinton campaign when he later testified to Congress.
"Jim – it's Michael Sussmann. I have something time-sensitive (and sensitive) I need to discuss," Sussmann texted Baker on Sept. 18, 2016, according to the new court filing. "Do you have availability for a short meeting tomorrow? I'm coming on my own – not on behalf of a client or company – want to help the Bureau. Thanks."
Prosecutors said the text message will become essential evidence at trial to show Sussmann lied to the FBI.

"The defendant lied in that meeting, falsely stating to the General Counsel that he was not providing the allegations to the FBI on behalf of any client," Durham's motion said. "In fact, the defendant had assembled and conveyed the allegations to the FBI on behalf of at least two specific clients, including (i) a technology executive ("Tech Executive-1") at a U.S.-based Internet company ("Internet Company-1"), and (ii) the Clinton Campaign."
The prosecutor noted that in House testimony a year later Sussmann admitted he made the FBI approach at the instruction of his client.
"We had a conversation, as lawyers do with their clients, about client 1 needs and objectives and the best course to take for a client," Sussmann testified in a deposition taken by then-House Intelligence Committee Republican investigative counsel Kash Patel. "And so it may have been a decision that we came to together. I mean, I don't want to imply that I was sort of directed to do something against my better judgment, or that we were in any sort of conflict."
Durham also told the court he plans to present evidence that Sussmann worked with the Clinton campaign, tech executive Rodney Joffe, identified as Tech Executive-1, and others in a "joint venture" to promote a now-disproven story that Donald Trump had a secret computer channel at the Moscow-based Alfa Bank with the Kremlin to hijack the election.
"As an initial matter, the Government expects that the evidence at trial will show that beginning in late July/early August 2016, the defendant, Tech Executive-1, and agents of the Clinton Campaign were 'acting in concert toward a common goal,' ... namely, the goal of assembling and disseminating the Russian Bank-1 allegations and other derogatory information about Trump and his associates to the media and the U.S. government," Durham's team said.
"The evidence of a joint venture or conspiracy will establish," according to the prosecutors, "that in November 2016, soon after the Presidential election, Tech Executive-1 emailed a colleague, stating, "I was tentatively offered the top [cybersecurity] job by the Democrats when it looked like they'd win.'"
"In sum," the special counsel concludes, "the above evidence, public information, and expected testimony clearly establishes by a preponderance of the evidence that the defendant and Tech Executive-1 worked in concert with each other and with agents of the Clinton Campaign to research and disseminate the Russian Bank-1 allegations."
Patel, who helped unravel the false Russia collusion narrative with former Rep. Devin Nunes, said the new filing by Durham is one of the most significant in the entire investigation to date.
"Durham has just shown the whole world what major pieces of our Russiagate investigation revealed," Patel said. "Hard evidence, emails and text messages, showing the Clinton Campaign, Fusion GPS, Perkins Coie, Joffe, and the media were all synced in August of 2016 pushing the false Alfa Bank server story, while also all working on the Steele Dossier matter. Durham submits all this evidence as 'joint venture conspiracy' under the rules of evidence."

How do we get our country back and our duly elected POTUS?
The “missteps” Durham said have been fixed are still in place (don’t kid yourself).
The FBI needs to be completely shut down and it must happen in any new administration that enters the WH. Ideas about reform are fine but not until a complete shut down occurs.
All party’s political candidates running for POTUS must have the complete restoration of faith in the federal government as their top priority. No more games.
And people that committed crimes such as treason and/or sedition against the American people must be held accountable (all of them). There will be no statute of limitations and no rocks to hide under.
My lawsuit against the DOJ and the EOP (and others) aside, if the DOJ doesn’t go after those who perpetrated these crimes (including the current POTUS), we no longer have a system of Justice that is responsive to the needs of the American people. The Rule of Law that I fought for will be dead.
We either have a fair, unbiased and functioning justice system or we live under the yoke of tyranny ruled by a small group of oligarch elites who want to dictate how we will live as a nation.

Durham Report holds lingering consequence for Joe Biden, Congress and U.S. allies
Current president was briefed in August 2016 about Clinton plan for Russia collusion dirty trick

Special Counsel John Durham’s final report will have lasting consequences far beyond the FBI failures he unmasked in the now-discredited Russia collusion scandal.
President Joe Biden, as he faces a re-election campaign, Congress as it weighs whether to end warrantless spying and U.S. allies often enlisted to help U.S. intelligence all face "sobering" questions from the report’s bombshell revelations.
In the end, Durham’s top line conclusion Monday was hardly unexpected: The FBI had no evidence or intelligence to warrant opening a probe of Donald Trump as the GOP nominee for president in 2016, disregarded its own rules to protect civil liberties, and failed to heed blinking red sirens that the Russia collusion allegations were nothing more than a political dirty trick by Hillary Clinton and her supporters.
But the questions of what to do with those truths and how to impose consequences for the bad behavior highlighted in the 306-page report are hardly settled.
House Judiciary Committee Chairman Jim Jordan began the process of resolving those issues – summoning Durham to testify before his panel next week while suggesting Monday night his colleague may use the power of the purse to defund actors who allowed the Russia collusion probe to persist for three years in the absence of any justification or evidence.
Several key players also face new questions about their own behavior.
The current president – already facing harsh questions about whether his allies in the intelligence community played a dirty trick in the 2020 election by falsely portraying the Hunter Biden laptop as Russian disinformation – was outed in Durham’s report as having been briefed in summer 2016 about a plan by the Clinton campaign to manufacture the Russia scandal against Trump.
Biden was present at an Aug. 3, 2016, briefing during which then-CIA Director John Brennan met with administration officials to discuss Russian efforts to interfere in the election.
"Specifically, Director Brennan's declassified handwritten notes reflect that he briefed the meeting's participants regarding the 'alleged approval by Hillary Clinton on 26 July of a proposal from one of her [campaign] advisors to vilify Donald Trump by stirring up a scandal claiming interference by the Russian security services," Durham wrote in the report.
Allies who look to the United States as the leader for honest investigation and accurate intelligence – the anti-Banana Republic as some might say -- also will take pause in seeing Durham lay bare Great Britain’s expletive-riddled reaction to realizing it had been dragged into a counter intelligence investigation without merit.
The report outlines the interactions between the FBI's legal attaché in London and intelligence officials about the UK intelligence community's poor reception of the investigation. The London attaché expressed incredulity at the "thin" evidence predicating the case and told officials that the British personnel were "openly skeptical" and warned that FBI plans for an operation "made no sense."
After American intelligence officials showed British operatives the tape of a Trump adviser, the attaché described British reaction as being "not positive because of the lack of any evidence." A subsequent interaction involved the attaché saying that the British had "had enough."
Former House investigator Kash Patel, during a Monday appearance on the "Just the News, Noise Noise" television show, indicated that the revelations of foreign ridicule of the investigation would serve to undermine the United States as a model off of which to base an impartial justice system.
The revelation, he said, "continues to erode our system of justice and continues to create a two-tier system of justice. People can't look to America and be like, how do you install a uniform singular system of justice anymore?"
And Congress must decide whether the FBI —which violated its own rules and allowed a probe to persist in the absence of any evidence of wrongdoing — should be entrusted for another several years with the awesome intelligence tools it abused in Russia collusion, including the Section 702 warrantless surveillance and FISA warrants up for renewal this year.
A longtime FBI man, retired Assistant Director for Intelligence Kevin Brock, told "Just the News, No Noise" television show Monday night the bureau’s trust was certain to be diminished.
“The FBI essentially was hijacked by a handful of senior executives who had an agenda, who did not like Donald Trump, and who used the awesome powers of the FBI to launch an investigation against all policy, against all legal guidelines and restrictions that would prevent the misuse of the FBI,” Brock noted.
“They opened up a case without adequate predication, the predication that's vital to every American to protect them from an FBI just doing an investigation because they don't like the color of your shoes,” he added.
Durham’s report was unequivocal about the bureau’s sins in Russia collusion.
"Neither U.S. law enforcement nor the Intelligence Community appears to have possessed any actual evidence of collusion in their holdings at the commencement of the Crossfire Hurricane investigation," Durham wrote in a 300-plus page report sent to Congress and others and obtained by Just the News.
The prosecutor faulted the department and the FBI for failing to follow their own standards and allowing a probe to persist, including the surveillance of an American citizen, without basis under the Foreign Intelligence Surveillance Act.
"Based on the review of Crossfire Hurricane and related intelligence activities, we concluded the Department and the FBI failed to uphold their important mission of strict fidelity to the law in connection with certain events and activities described in this report," Durham wrote.
"The FBI personnel also repeatedly disregarded important requirements when they continued to seek renewals of that FISA surveillance while acknowledging – then and in hindsight – that they did not genuinely believe there was probably cause to believe that the target was knowingly engaged in clandestine intelligence activities on behalf of foreign power."

The FBI acknowledged past failings, saying Durham's findings justified the changes that current Director Christopher Wray made after taking over from fired Director James Comey.
"The conduct in 2016 and 2017 that Special Counsel Durham examined was the reason that current FBI leadership already implemented dozens of corrective actions, which have now been in place for some time. Had those reforms been in place in 2016, the missteps identified in the report could have been prevented," the FBI said.
"This report reinforces the importance of ensuring the FBI continues to do its work with the rigor, objectivity, and professionalism the American people deserve and rightly expect."
Durham specifically faulted the FBI for relying on evidence from the campaign of 2016 Democrat presidential nominee Hillary Clinton, including the now-discredited Steele dossier, saying leadership lacked the necessary distrust of politically motivated allegations.
"Our investigation also revealed that senior FBI personnel displayed a serious lack of analytical rigor towards the information that they received, especially information received from politically affiliated persons and entities," he wrote. "This information in part triggered and sustained Crossfire Hurricane and contributed to the subsequent need for Special Counsel Mueller's investigation."
"In particular, there was significant reliance on investigative leads provided or funded (directly or indirectly) by Trump's political opponents. The Department did not adequately examine or question these materials and the motivations of those providing them, even when at about the same time the Director of the FBI and others learned of significant and potentially contrary intelligence."
The special prosecutor pointedly highlighted what he portrayed as a dual system of justice, noting the FBI never opened a counterintelligence probe of Clinton's campaign, despite receiving intelligence she had authorized a dirty trick to paint Trump as a stooge for Russian President Vladimir Putin to impact the outcome of the election.
"The FBl's actions with respect to other highly significant intelligence it received from a trusted foreign source pointing to a Clinton campaign plan to vilify Trump by tying him to Vladimir Putin so as to divert attention from her own concerns relating to her use of a private email server," the report concluded.
"Unlike the FBI's opening of a full investigation of unknown members of the Trump campaign based on raw, uncorroborated information, in this separate matter involving a purported Clinton campaign plan, the FBI never opened any type of inquiry, issued any taskings, employed any analytical personnel, or produced any analytical products in connection with the information.
"This lack of action was despite the fact that the significance of the Clinton plan intelligence was such as to have prompted the Director of the CIA to brief the President, Vice President, Attorney General, Director of the FBI, and other senior government officials about its content within days of its receipt," Durham also wrote. "It was also of enough importance for the CIA to send a formal written referral memorandum to Director Comey and the Deputy Assistant Director of the FBI's Counterintelligence Division, Peter Strzok, for their consideration and action."
Durham also laid out significant evidence that Strzok, who led the Crossfire Hurricane team but was fired from the FBI, worked with FBI lawyer Lisa Page, with whom he was having an affair, to go around the counterintelligence chief of the FBI, Bill Priestap, his boss, to keep the investigation going by getting the approval of then FBI-Deputy Director Andrew McCabe, who also was later fired.
The report quoted Priestap as identifying "instances when Strzok shared information directly with McCabe before Priestap could provide the information to McCabe himself. Priestap said these actions drove him 'insane.' He also told the Office that Strzok was the worst offender in this regard and that these events occurred mostly when he (Priestap) wanted to go in one direction and they (Page and Strzok) disagreed and thus went around him."
The report also divulged that the handling agent who first was contacted July 5, 2016, by ex-MI6 agent Christopher Steele, the author of the infamous dossier funded by Hillary Clinton's campaign, appeared to be aware that Clinton's campaign was connected to his work, including the notation "HC" in his notes. That agent said his initial reaction to Steele's allegations of Trump-Russia collusion was one of "disbelief" and that Steele was "politically motivated" but he passed the allegations up the FBI chain anyway.
"Notwithstanding his skepticism about the reporting, Handling Agent-I deemed the allegations to be something he could not arbitrarily discount, " the report said.

A very thorough 35-minute analysis of the Durham Report by Alexander Mercouris, who has now read the whole 316-page document. He's very critical of the details (or lack of them) that it contains, and uses the term "whitewash". Mercouris states that many issues have simply been left unresolved.
I don't feel at all qualified to comment, but anyone who's been following this closely might find it most interesting and valuable.

First, there was a comprehensive effort of the political and media establishments to perpetrate one of the great hoaxes in history — a political hit job that ultimately derailed an American presidency.
Second, there was no real accountability for that effort for the main players from Clinton to Comey to Congress. It was much like The Murder on the Orient Express.

Here is the column:
In Agatha Christie’s “Murder on the Orient Express,” detective Hercule Poirot (https://bookroo.com/quotes/hercule-poirot)observes, “The impossible could not have happened, therefore the impossible must be possible in spite of appearances.”
That may be the best summary of the findings of special prosecutor John Durham in his 305-page report issued yesterday.
Not only did the impossible happen, but they all did it: the Clinton campaign, the FBI, and the media.
In hindsight, it would appear impossible.
A political campaign hatches a plot to create a false claim of collusion between the Trump campaign and the Russian government.
Making this even more implausible is that the CIA and FBI knew about the plan.
As detailed in the report, President Barack Obama and his national security team were briefed on how “a trusted foreign source” revealed “a Clinton campaign plan to vilify Trump by tying him to Vladimir Putin so as to divert attention from her own concerns relating to her use of a private email server.”
It then happened a few days later.
It was a plot that required everyone to take a hand in derailing a duly elected president and effectively shutting down his administration for three years of investigation and prosecutions.
In this conspiracy, there were dozens of key participants in the campaign, the government, and the media. Here are a few of the characters implicated in this report.
The campaign
The report details how the Russian collusion conspiracy was invented by Clinton operatives and put into the now-infamous Steele dossier, funded by the Clinton campaign.
The funding was hidden as legal expenses by then-Clinton campaign general counsel Marc Elias. (The Clinton campaign was later sanctioned by the FEC over its hiding of the funding.)
When Vogel tried to report the story, he said Elias “pushed back vigorously, saying ‘You (or your sources) are wrong.’” Times reporter Maggie Haberman declared, “Folks involved in funding this lied about it, and with sanctimony, for a year.”
It was not just reporters who asked the Clinton campaign about its role in the Steele dossier. John Podesta, Clinton’s campaign chairman, was questioned by Congress and denied categorically any contractual agreement with Fusion GPS. Sitting beside him was Elias, who reportedly said nothing to correct the misleading information given to Congress.
Durham details how Elias played an active role in tracking the media campaign to push the false allegations. (Elias was recently severed by the Democratic National Committee from further representation and has been previously sanctioned in the federal courts in other litigation.)
The report details how false claims like the existence of a “pee tape” showing Trump engaging in disgusting acts with prostitutes in Moscow came from a Clinton operative, Chuck Dolan, with no known basis in fact.
Likewise, now-national security adviser Jake Sullivan and Clinton personally pushed an absurd campaign-created conspiracy theory about a secret communication line between Trump’s campaign and the Kremlin through a Russian bank.
The Clinton campaign later admitted that it had indeed funded the dossier, but Clinton continued to claim that the election was stolen from her by the Russians.
The government
Of course, this conspiracy could not occur without the assistance of the FBI, which Durham found played an eager role due to a “predisposition” of key players against Trump.
Special counsel John Durham completed a four-year review of the FBI’s investigation of allegations Trump’s 2016 campaign colluded with Russia
Durham found the FBI’s probe was “seriously flawed” and had no basis in evidence, according to a 306-page report released Monday.
The special prosecutor found that FBI officials “discounted or willfully ignored material information that did not support the narrative of a collusive relationship between Trump and Russia.”
Durham also found investigators put too much faith in information provided by Trump’s political opponents and carried out surveillance of Trump campaign adviser Carter Page without genuinely believing there was probable cause to do so.
Despite the scathing findings, Durham did not recommend criminal prosecutions or widespread FBI reforms, writing that “the answer is not the creation of new rules but a renewed fidelity to the old.”
Durham’s investigation lasted more than four years, longer than the FBI’s Trump-Russia probe itself.
The dossier was discredited early by American intelligence, which learned that it might itself be Russian disinformation.
There never was support for the allegations, but the FBI launched and maintained a massive investigation anyway.
Durham noted that the FBI showed a completely different approach to allegations involving the Clinton campaign.
The Trump investigation was a “noticeable departure from how it approached prior matters involving possible attempted foreign election interference plans aimed at the Clinton campaign.”
Nevertheless, former FBI Director James Comey would continue to reference the entirely unsupported “pee tape” in interviews.
Even though investigators found no support for the campaign-created story, in a 2018 interview, Comey delighted viewers by saying: “Honestly, I never thought these words would come out of my mouth, but I don’t know whether the current president of the United States was with prostitutes peeing on each other in Moscow in 2013.”The FBI was assisted in this effort by members of Congress on the House Intelligence Committee.
Even when the false narrative was played out and the lack of support was becoming obvious, former House Intelligence Chair Adam Schiff (D-Calif.) assured the public, on March 13, 2018, that “I can certainly say with confidence that there is significant evidence of collusion between the campaign and Russia.”
He never produced the promised evidence.
The media
The most essential player in this conspiracy was the media, which pumped up the dossier as gospel. On MSNBC, Rachel Maddow assured her viewers that “no major thing from the dossier has been conclusively disproven.”
On CNN, one of the guests insisted, “I think we actually have to stop calling it the ‘infamous dossier’ and increasingly calling it ‘accurate dossier,’ the ‘damning dossier.’”
CNN host Alisyn Camerota attacked Rep. Jim Jordan (R-Ohio) and said the dossier “hasn’t been discredited, in fact, it has been opposite, it has been corroborated.”
Durham has laid out how the most cited claims were not supported, let alone corroborated.
Indeed, he found there was no basis for this investigation to have been launched in the first place.
Yet, like in “Murder on the Orient Express,” all of the culprits were then let go.
Comey went on to make millions selling books and giving speeches on “ethical leadership.”
Former FBI special agent Peter Strzok was given a job by CNN.
Clinton general counsel Marc Elias is advising people on election ethics and running a group to “defend democracy.”
After all, this was a collective effort. In Washington, the more people involved in a conspiracy, the less culpable it becomes.
They all did it, so no one did.

"Remember, back in 2019, when we pinned all of our hopes on John Durham to restore Truth, Justice and the American Way to the Federal Government?
In 2019, many of us didn’t fully understand just how completely infiltrated by Communists and just how completely destroyed our government already was.
By May of 2023, most of us had forgotten all about the Durham Report, which came out of Left Field when it was released last month and in which Durham concluded that the FBI should never have launched the Trump-Russia probe.
The release of the Durham Report prompted the House Weaponization of the Federal Government Subcommittee to ask Durham to testify publicly Wednesday, after a private briefing on Tuesday with the House Intelligence Committee to address misconduct at the FBI and during the Crossfire Hurricane investigation.
In this video of the Wednesday hearing, Matt Gaetz slammed John Durham for protecting the FBI throughout his investigation, telling him, “It’s not what’s in your report that’s telling, it’s the omissions…the lack of work you did. You let the country down, you are one of the barriers to the true accountability we need.”
Matt Gaetz railed that Durham turned out to be just another protector of the Democrat Establishment, who did not charge any of the FBI criminals.
This may be true but Durham does not display the insolent affect of a traitor, as we saw for example in FBI Deputy Director Paul Abbate last week. Poor Durham looks like a good guy caught in a bad system.
The truth is that the Patriot Act had long since canceled-out any ability for Durham to make criminal referrals against Strzok and McCabe. The Patriot Act gave them carte blanche to step all over Americans’ civil liberties.
As former DIA lawyer, ECONCHICK truthed on Thursday night:
…it’s not about Durham sticking to the law. It’s about the fact the Patriot Act and other Intelligence laws as currently written give intelligence types all the cover they need. And no prosecutor can do a damn thing about it."
