View Full Version : Habeas Corpus in Brisbane.
Lord Sidious
31st August 2011, 09:30
Greetings avalonuggets.
Uncle Sidious will be in the Supreme Court of Queensland tomorrow, Thursday the first of September at 10am.
The case is
Robert Alfred Halford
v
The State of Queensland
and
The Department of Corrective Services
and
Kelvin Anderson
Corrective Services Commissioner.
This is a habeas corpus application for Mark Pytellek who has been jailed on very shaky grounds.
Anyone in Brisbane is welcome to attend and meet me before I go back.
These type of hearings are very rare and this is my first one.
This could be very interesting because of some of the things I have alleged in my supporting affidavit.

you never told me if you needed a car park when you're in the city?
I live down on Alice st - So 10min walk if that to get to the Roma St court house or the other two down near Turbot St.
Sending you a PM with my mobile number.
I am currently at work, i will be untill 6:30am. I'm good for sleep tho, so dont be afraid/worried about interupting me for access to the car park.
I am offering this because i live right next door to a car park as well - you're up for $30 minamum even if you're only there for two hours :|
Intriegued about the court session tho, my partner will be down the gold coast tomorrow @ the Tech Ed conference, work is paying for him to go - so i wont have anything to do all day other than be harassed by my two furry children :P

Probably over the weekend if my job is done.
If not, then I will re evaluate.
I have to get back onto my workshop prep.

That might be handy, the car park deal.
Come on down to the Supreme Court and watch.
You have the details of the case, just look up the names on the list and see which court.

His incarceration is political and there is a bit to it.
Lucky for him, Uncle Sidious is the most devious of the Sith Lords and has no fear.
We served the docs on the crown law department and they were getting their act together before I got into the lift.
I have studied administrative actions such as prerogative writs before, but never executed habeas corpus.
Lucky for me, it is a show cause action on the respondents, not the applicant, I have to prove nothing.
I don't need standing to bring the action either and in the supporting affidavit, you are allowed to have hearsay.
I will put the text of my affidavit in support up here after we are done.
The reason I put the state first, is to prevent them ''dieseling'' Mark.
This is where they know a habeas corpus is coming and they move him before you get to that jail and serve them.
They did this to him before.
Being the most devious of the Sith Lords, I captured the entire government by making the state the first respondent, so even if they got him out of jail and took him to a police lockup, I still have them.
Thanks for your encouragement Goldie.

As Rob wells knows, by now, I would wager... he's wrangling with the judge's psychology. Nothing more. and that's about all that can be done in a courtroom. The laser pointer and kitten method, or the subtle masturbation method, or the fall into expectation method, or what is the usual case....some combination thereof. (did I miss one?)
The trick is to never be caught at it. Since the judge is almost always a retired lawyer, regarding western legal systems, it is quite the trick to pull off. All the paperwork and law stuff get in the way, but the real battle (even though both sides of the table know it) takes place in those other areas. This sounds like case of interpretation vs presentation, and well, best of luck.
It also depends on the time frame of the case, regarding when the judge has last eaten. Just after lunch is the best time, by far. Or, about 1.5 hours after breakfast, if it can be done.
Satiation of base animal core function has been shown in at least one study, to shift the decision making process in favor of the applicant (of miscarriage) by a factor of 50-55%. This, all due to the state of mind of the given decision maker in the hot seat, in the given system.
I see. 10am is pretty good. You have about an hour to get him over his full tummy hump of favorable forgiveness and benevolence. 1:30 has always been the best bet. If it becomes a two parter, see if you can nail it in the second half with no disturbed lead in from the first inning.
I'm guessing that this would be unusually long for such a case so it's probably going to be a done deal by 11am, one way or another.

10am is when we are told to be there. They will put us in front of a judge to see if it can proceed or be dismissed for any reason, then they will stand it down for another judge to hear it.
This is what I am told.
I am in a city 3000km from mine and they have a totally different set of rules and procedures.

Thanks, Rob, for sharing this with us. Often these days among alternative thinkers, there's to be a (understandable) contempt for the power of the system to prevail on the side of 'justice' as the common understanding would see the meaning of the word. My hopes are with you to show us that the system can work, even if engaging it takes a warrior's spirit and a master's expertise, and that true justice can be served.

Saw him about 9am, i was buggerd so i went back up and crashed.
Now 3:30pm, woken up by hellicopters. Go outside and see TWO army hellicopters lift off from what appeard to be brisbane river. I'm not that high up so i cant see above the trees in the Botanic Gardens - but they lifted off and came up from below the trees (so the other side of the trees = brisbane river - i dont believe there to be hellipads there) - few circles around (can still hear them now) - and alot smaller white hellicopter go follow them too.

1st September 2011, 05:46
Hellicopter noises gone now. Would be incredibly hard to grab pictures of them if i went out into the city - the buildings would block them. No sirens or anything - I can hear them if they're up at central which is a fair distance, should be adequate for the courthouse too.
Went downstairs because im too much of a shortarse to see the carpark from over the balcony - the car is still here.
Because im a worst case senario person - at what point should i take the action of <you're imput neeed here> if their car is still here and no word back from them at say 8-9pm?
Will hold off on calling till at least 6pm incase they're still in there - can only imagine the evil stare i'd get if the phone isnt on silent and i ring mid-court-session.
p.s - i am worried as i thought Said it should be a short cout session - ie acknowledge the case and that should be it - to be taken up with a different judge etc on a different occasion - or did i misread/understand something?

Hi Tiga,
Thanks for the on the spot reports, but don't freak out! There could be thousands of reasons for the army to be hanging around, and downtown lawcourts wouldn't be the smartest of locations to stage an abduction.
If you have Rob's mobile number, SMS him. He would be used to having it on silent mode when in session anyway.

LMAO... you're a crack up Tiga ;)
Brisbane has a festival on this weekend called 'The Riverfire Festival'. Basically, tens of thousands of people gather along the Brisbane River (at Southbank Parklands) to watch a massive fireworks display and an Australian Air Force jet-fighter display where they do what's called a "dump & burn" (huge flames coming out of their afterburners as the fly by really low over the crowds at high speed).
The two helicopters you saw were Blackhawk's and they were doing a check of the area today (at about 3:30 pm) to make sure everything was clear and ready for the show, which I believe happens tomorrow night.
So, everybody can relax... I'm pretty sure Rob hasn't been escorted from the courthouse and choppered out of Brisbane to face the wrath of the PTB in the Pine Gap DUMB.
LOL :)

TigaHawk, thanks, from this side, too, for your reports and concerns. Also as Heyoka wrote, there could be many reasons for the army being around, and because of (y)our love and care for Lord Sidious, it's easy to let the imagination run.
Not to worry, though, my friend; I'm pretty certain our friend is fine. He's a big Coruscanti boy!
Besides, if something had come up, and our friend was in need of a speedy getaway, I'm sure you'd be the first person he'd call to have the car fired up!
It's all fine. Court stuff takes time, and there's no forcing it-- just persuading. It's a mental dance of power and flow, and the courtroom is their ballroom.
( Sometimes I have no idea where this stuff comes from!)
EDIT:
Okaaay, just saw D-DAY's post explaining the reason for all the army activity, I can't stop giggling, even more!
Poor you, TigaHawk! It must've been so intense for you in your mind, with all the helicopters flying about, and explosions, having the army involved.. all happening around the court area. Still, it's 'cuz you caaaare.
Glad it's all figured, now. Cheers, D-Day!
And to you, too, Tiga!

hahahaha, diddnt mean i thought they took him away via hellicopter lol.
Would make an interesting story if they did tho! :P
And i dont think they bring in the fireworks via army hellicopter sorry :P
They seal off the pedestrian entrances for one of the bridges and they load up the fireworks on that, the rest they launch from 2 other barges in the river, one near southbank and not too sure where the other one is.
They got rid of the F1-11's tho i thought, last year was their last run before being decomissioned?
It looked a bit close to the uni - entertainment stage thing too, which is what sparked interest in them being two army hellicopters instead of the daily news choppers that fly waaaaaaaaaay higher.

Nothing to do with me, it is Legacy day today.
I saw uniformed soldiers in the streets and recognised them as ''chooks'' which is slang for RASIGS, the signals corps.
So it would have been PR to do with that.
Ok, so what happened today.
The judge told me fairly quickly that he couldn't issue the writ and he told me why.
I made a few points, which I can't discuss yet and he agreed.
This is now going to a hearing on monday in the magistrates court, not sure which one.
It seems that in the sense of urgency, I failed to check what had been done before now.
We jumped from 1 - 4 in the chain of remedies and we missed 2 and 3.
So, we have to try 2 and 3 before they would issue the habeas.
So, the lesson here is when things are short notice, slow it down and check where you are upto in the game.
We didn't lose, but we didn't win. We do know what to do now.
The crown attempted to hit me with a costs order, to punish me.
I was asked if I opposed it and I told the judge ''I am here on a fee waiver, if they think they can recover costs, I would like to see them try''
The judge refused their costs.
The judge was very honourable, helpful and did the right thing.
When I can fill in the details, I will, but right now, the game is still on.

I would say that ''a meaningful life'' is something that is in the eye of the beholder.
What is meaningful for me, is not for you, and vice versa.
So, I would try to figure out what means the most to you, what you don't wish to lose/give up and then you can see where that steers you.
I have had major changes in my diet, my outlook and my internal world.

ok i'll be honest i just found this post, and didn't read it all, but such am missing work today might as well positively contribute here.
your friend is letting his disappointment about what happened to him, control him. he is being right but not rational if he was unfairly locked up.
i hope he knows that when the other side has no reason to do the harm it does, they will stick to the old strategy in the book...delay delay and delay some more. anything they do will be just to postpone the next step. i hope he realizes this, and has back up plans.
if it is not too late, maybe you can talk to a psychologist or someone who knows a bit more about the human mind who will help you convince him to see it from your and judges point of view. talking to him about what the law says won't work.
i'm sure a fair judge, even if he was released on bail, would have later on acknowledged the injustice caused to him. he should know that.
well anyway just my 2 cents, as i know how sadness, depression, 'the whole world is out to get me' kind of feeling brings about bad decisions.

Sorry to hear the result Rob.
A case of horses and water perhaps.
I have no doubt that you did your best, for which you should be proud.

Ok, got an update.
The magistrates court is refusing to allow an application for bail to be made by legal counsel now.
So, off for the next round now.
