Home help: British Secretary of State for Justice, Kenneth Clarke, says those who kill or injury intruders in their home will be afforded additional rights.

UK HOME-OWNERS who kill or injure intruders will be given more rights despite calls it could promote vigilantism.

The Ministry of Justice is set to overhaul the law "to put beyond doubt" that individuals and small businesses can use "reasonable force" to defend themselves, The (London) Times reported.

The move will reassure homeowners, who have complained that law-abiding citizens who use force to protect their properties are criminalised.

But it will set Kenneth Clarke, the justice secretary, on a collision course with prosecutors, police and defence lawyers who have warned the change could become a "license to kill."

Vincent Cooke, 39, arrested after a burglar was stabbed to death at his house in Bramhall, Stockport, northwest England, was told on Friday by the Crown Prosecution Service that he would not be charged.

It is the third case in three months in Greater Manchester in which self-defence has been accepted after a suspected intruder was killed and there is a growing sense that the legal system is taking greater account of the rights of homeowners over those of intruders.

However, many feel the law should urgently be changed to enshrine the rights of householders over intruders to provide a significant deterrent against break-ins.

Mr Clarke told the Conservative Party conference this week, "We have policies underway to ... resolve public doubts on the law of self-defense by victims of crime."

A Ministry of Justice spokesperson added, "The coalition agreement contained a commitment to ensure that people have the protection they need to defend themselves from intruders, prevent crime or apprehend offenders. We will announce details of our plans shortly."

People anywhere should have the "right" to defend themselves and their families from someone breaking into their own homes.

Utter nonsense to impose laws otherwise.

At last - fair reciprocation! No longer afraid to defend ourselves without being jailed for it! If someone breaks in here - despite all of our security shutters/alarms etc - they are certainly not welcome and will dealt with accordingly, as they are invading our private space, and obviously wish to remove that which is ours - if they resist our arrest and attack us - whatever happens after that on their own heads be it!

I think in NZ and Australia homeowners are able to use resonable force against an intruder - i.e same type of weapon but recently an intruder was killed in Australia but was the homeowner suppose to say "hey wait a minute, I'll just go and get my stun gun"...

It should be their right to defend their family and home against intruders.

In Australia, if someone breaks into our home - wether it be with intent to kill us, or steal, if we try to fight back, we get slugged by the law as well, as the people whom broke into our home have the right to sue us for assault, damages, etc etc as well, even tho it was them that forced us into said situation by breaking into our home.

We're to "Retreat and call the Authorities" - as the police say anyway.



An example of how stupid the laws are over here....


A burglar climbed onto someones house and started pulling away roof tiles with the intent of getting into the house thru the roof. They are clumbsy, and step where they should not, and fall thru the roof of the house, but not all the way. They're stuck, feet dangling from the cieling, torso and up still in the roof.

The home owners come home, call the police, the police / fire bregade go rescue him then take him away.

The burglar then sues the home owner, and wins in court, for the injuries he sustained while trying to break into the house.

The system over here protescts the corrupts, and the people whom wish to harm you.

I agree there is no sense in the laws and how they are interpreted, If someone has entered your property with the desire to do you harm, that person has waived their rights to be protected by the law. it could also be a sign that the government are very concerned about public-disorder and social breakdown and are trying to let the recent spate of rioters know that if they choose to loot, the wider public will be supported in assisting the system to control things.

Let's hope that Fred259 reads this thread since during the chemtrails discussion he mentioned he had to take I think a fire extinguisher to a culprit trying to steal his car. As I remember he got charged for this. Sounds like this new law will put the culprits in their place and give Fred259 the law on his side to defend his rights and property.
Go get them Fred259! We are all cheering for You and hope that everything comes out in your favor and not the villians.

What the heck kind of laws do you have in Australia anyway? Why is it so back a**wards? To any logical person, that burglar was caught in the act and is guilty.

Here in the US, things aren't much better, but there are ways around the laws....Believe it or not, my mother was told by the sheriff that if she shot anyone to 1) make sure they fell inside the house, or drag him in; 2) make sure he's dead so he can't sue later on....Now how's that for advice from someone who upholds the law?

There was a case in Brisbane, where a burglar injured himself while trying to enter a house... the homeowner was sued and had to pay the burglar for the time he could not work!!!!

Why don't all burglars move to Australia, it is an official profession there....

The law should be simple, give people the right to defend what they worked hard for with any means...

just the knowledge that one can defend ones self will deter most burglars...

But is this what your government really wants? if there are no burglaries, what would we do with all the police? all the insurance companies? all the prisons? many jobs would be lost...

I am sure you can work out the true reasons why we cannot defend our own properties...

my brother told me that in Carolina if you shoot an intruder it is only self defense if you empty the whole magazine into them.....

of course this is all for our own safety...
