The moves comes more than two years after US President Barack Obama halted the case in an ultimately failed effort to prosecute them in a civilian court.

A Department of Defence legal official, known as the convening authority, has approved trying the five together on capital charges that include terrorism and murder, making them eligible for the death penalty if convicted. They are expected to be arraigned in May before a military judge at the US base in Cuba.

Prosecutors had filed the charges last May and there was little doubt that the convening authority would refer the case to a military tribunal for trial. But lawyers had hoped that two of the men would be tried separately on non-capital charges because they are accused of relatively minor roles in the plot.

The five being charged include Khalid Sheikh Mohammed, who admitted during a military hearing to being the "mastermind" of the terrorist attacks that sent hijacked planes slamming into New York's World Trade Centre, the Pentagon and a field in Pennsylvania, killing nearly 3,000 people in 2001.

Mohammed had said at the start of his first trial that he intended to plead guilty and his four co-defendants indicated they would abandon their defence as well. But after a series of pretrial hearings the case was put on hold when the administration decided it wanted to try them in civilian court in the US.

Congress fought the administration's effort to transfer Guantanamo prisoners to the US, forcing Mr Obama to reverse course on trying prisoners in civilian courts and preventing him from closing the prison. Defence lawyers and human rights groups say the system favours the prosecution.

"The Obama administration is making a terrible mistake by prosecuting the most important terrorism trials of our time in a second-tier system of justice," said Anthony Romero of the American Civil Liberties Union. "The military commissions were set up to achieve easy convictions and hide the reality of torture, not to provide a fair trial."

The other four prisoners are Waleed bin Attash, who allegedly ran an al Qaida training camp in Afghanistan and researched flight simulators and timetables, and Ramzi Binalshibh, who allegedly helped find flight schools for the hijackers.

The third is Ali Abd al-Aziz Ali, who is accused of helping nine of the hijackers travel to the United States and sending them 120,000 US dollars for expenses and flight training; the fourth Mustafa Ahmad al-Hawsawi, who is accused of helping the hijackers get money and western clothing.

What a joke. Without names like Cheney, Silverstein, and Chertoff as a start, (there are many more) this trial is a joke, sham and a lie. This must be the Dominionist zioloving part of the military trying to bring more distraction to the news cycle. Unless, they decide to call some special people in and they include some of the names above and feature a no BS prosecutor who has a clue as to who the real perpetrators are. At best the names mentioned above are accomplices. We all know if they flew any planes into the towers it had nothing to do with their coming down. Especially building #7.

They'd better include Bush, Cheney, Rumsfeldt, Ashcroft, the Mossad..... It was an inside job and many scumbags at the top were involved. These five are only the scapegoats being used to deceive us AGAIN! The real criminals were at the top, including a few at the Pentagon. This trial will be a miscarriage of justice and a joke, my friends....

It is probably hoped that it will distract them from the economic crisis. It will definitely work on some. There is a fair amount of junk DNA walking around the USA.

I think after the raid on Bin Ladins compound, they are tying up loose ends if they can convict and kill these last few 'puppets', TPTB will have wiped the slate clean.
They know the mainstream press will do nothing, and the alternate press is still unable to get thru to the masses...With this neatly tied up they are free for the
next false flag.....and also as you say distract people from going after the 'Banksters' !!!

We, oldsters have seen this time and time again; by drawing your attention away from a critical matter using a lesser one. Then they'll stop reporting on the critical one so you forget about it. Lame Stream has much to answer for, too.... Heck, I'm still waiting for an explanation as to why Billy Clinton got away with his treachery when he sold the Chinese the guidance systems. But it seems that Lame stream and people were more concerned over his "non-sex" with "that woman" than a potentially dangerous matter.....

So, please forgive me for saying that this will become another magic slight-of-hand trick by clever conmen who have been doing this for a long time.

Be a dupe and watch the hand they want you to see. These five people are not the planners or the ones who had the money, means or the manpower to pull off this great deception.
This was clearly an inside job and that's a truth that refuses to be kept buried. WHEN it comes out, there won't be any place on Earth for the perpetrators to hide. And Lame Stream and the Pentagon will be blasted for their part in it, too.
