RIVERSIDE, California (Reuters) - A lawyer for a California boy accused of murdering his neo-Nazi father urged a judge on Wednesday to convict his client of a lesser charge of voluntary manslaughter, citing what he termed an abusive upbringing.

But a prosecutor told the court that Joseph Hall, who both sides agree shot his father at point blank range in May 2011 when he was 10 years old, knew at the time his actions were wrong, and that abuse allegations cited by the defense were a diversion.

"Joseph was not raised in the home described by the defense here," Riverside County Deputy District Attorney Michael Soccio said during his closing remarks in the high-profile trial. "It doesn't exist. It's fiction, a smoke screen, a red herring."

Defense lawyers concede that Hall, now 12, shot his 32-year-old father, a regional director of the National Socialist Movement, with his own gun, but argue that the boy should not be held criminally responsible.

The case in Riverside, 60 miles east of Los Angeles, has made headlines because of Jeffrey Hall's neo-Nazi associations and the rarity of a parent being killed by a child so young.

Kathleen Heide, a criminologist who specializes in juvenile offenders, has said that 8,000 murder victims over the past 32 years were slain by their offspring, but only 16 of those crimes were committed by defendants aged 10 or younger.

Let US pray for God's mercy and judgement under such abuse and maladjusted upbringing of supremacy. i told them a long time ago, Martin Luther King spoke of humans, not mankindalikeaman people. This poor son needs our prayer, if just to help him achieve merciful justice because of his age. He will need mental counceling throughout his life because of his act, but also the correction and seeing that God knows all his deeds and his heart. If this child at the time was in fear, and was taught to use a gun at an early age, as I have seen on the Youtube videos, then no wonder there are Columbine, Virginia Tech, and Sandy Hook massacres. The planting and raising of the seed, is just as important as teaching it to eat, be responsible, and love in it's life. This guy/father/fuerer was off the nut, and the child shouldn't suffer because his heart wasn't into the lying and hatefilled life. Sesame street kids don't teach hate.
I listened to a "Earth Song" which is just as powerful as "Free Willy" theme song, but the truth was ringing through the soul. I recommend WE pick up OUR cross and finish prosecuting those who inflict harm on economies, children, and ban them from ever returing to the population, by isolation, NOT murder. I would rather pay taxes to "keep the dangerous" criminals in isolation on an island of their peers, than lock up post smokers and its cheaper, because there aren't as many monsters in the world, as there are pot smokers, so the tax payers save on the cost of incarceration. The children need love, and not hate, guidance and persuasion with thought out examples of what happened to others through experience, so the child will know. It appears the father being of this child, did not have that, and it backfired on him. If you kick a mule long enough he'll kick back, but fear of being kicked will cause people to react to protect themselves or others they love. I am praying for healing of the mind, soil throughout this ordeal/experience, and that he has a mother that will comfort him when he has questions of why. A lot of our children have that question now, because they are "told" not explained to. It's a little tedious teaching a new soul to live in this world, but they must also teach it to exist in other worlds/cultures/nations. PHT Poor Home Training has always been a focus in our communities, even if it meant sending the children in a more positive environment, like camping, summer field trips and other fun focused childhood stuff. They are under a lot of pressure just learning this. Imagine the pressure of learning to hate and being expected to act it, talk it, and live it day in and day out, as your friends go play baseball, football or hockey. Michael lost his childhood, but understood the children around the world needed someone who wouldn't just talk about them, but put the money where his mouth was. A few points that I found interesting. There was originally an insanity defense that was withdrawn. The defense is determining whether they may put a 12 year old on the stand? I highly doubt that.
Most of all, I found it odd that this is not a trial by jury, but a bench trial. I would think that the defense would have preferred a jury in order to use emotions of others in his favor. So now it will come down to whether or not the judge determines if the boy was responsible and knew what he was doing.

I don't know enough about the case to opine about the level guilt, but it will be interesting to see the verdict.

(CNN) -- A California judge ruled Monday that a then 10-year-old boy committed second-degree murder -- and knew what he was doing was wrong -- when he fatally shot his father, a local neo-Nazi leader.
Jeffrey Hall was asleep on a couch in his family's Riverside home when his son killed him on May 1, 2011, according to authorities. CNN is not naming the boy, who is now 12, because he is a juvenile.
Hall had been the Southwestern states regional director for the National Socialist Movement, according to an online tribute to him from the group's leader, Jeff Schoep. One of the nation's biggest, most well-known neo-Nazi organizations, the National Socialist Movement idolizes Adolf Hitler and touts virulent rhetoric against those who are Jewish, immigrants and not "pure-blood whites," according to the Southern Poverty Law Center civil rights group.
Prosecutors contend the victim's neo-Nazi background is not linked to his death, saying the young killer's concerns about abuse and his family being split up were more significant factors.
"It was our belief that this would have happened even if (Hall) was not part of the National Socialist Movement," said John Hall, a spokesman for the Riverside County district attorney's office. "This was done more on a domestic level."
