Excellent points brought up...George Orwell here we go! As far as the black boxes not being installed in older cars, I wouldn't put it past the buggers to send you a "recall" notice and install it anyway.

A friend of mine was in an accident a few months ago driving a 2003 Toyota Rav4 and the Cops were able to determine who was at fault, based on the black box.
