I have never been a fan of Barack Obama. I voted for him twice because as bad as he was he was marginally more compassionate and life-affirming than his opposition. But on balance I think history is going to see him as a terrible President, not least because it is under his administration that the vampire capitalism that began with Reagan has come into full flower. One of the signs of this is the abject failure of the Obama Administration to really prosecut! e the crooks in the financial industry. This story is amazing because it is one of the few times in my life when a judge has scolded the Administration for its failure to prosecute crooks.


United States District Judge Jed Rakoff has given a scathing rebuke to US Attorney General Eric Holder’s Too Big To Jail rationale for not prosecuting crimes committed by Wall Street banks and executives. Judge Rakoff, in a speech before the New York Bar Association, labeled Holder’s view on Wall Street and rich Wall Street executives as 'disturbing.”

To a federal judge, who takes an oath to apply the law equally to rich and to poor, this excuse - sometimes labeled the `too big to jail’ excuse –- is disturbing, frankly, in what it says about the department’s apparent disregard for equality under the law. In fairness, however, Mr. Holder was referring to the prosecution of financial institutions, rather than their CEOs. But if we are talking about prosecuting individuals, the excuse becomes entirely irrelevant.

Apparent disregard for equality under the law. That is a somewhat breathtaking indictment from a sitting federal judge against the Justice Department. Judge Rakoff is saying, with little in the way of equivocation, that Eric Holder’s Justice Department has a different set of rules for the rich. That Wall Street is above the law.

… if, by contrast, the Great Recession was in material part the product of intentional fraud, the failure to prosecute those responsible must be judged one of the more egregious failures of the criminal justice system in many years. Indeed, it would stand in striking contrast to the increased success that federal prosecutors have had over the past 50 years or so in bringing to justice even the highest level figures who orchestrated mammoth frauds.

As we now know, the crisis was a product of intentional fraud. Something Rakoff is also well aware of as he presided over the Bank of America civil fraud trial where a jury found BofA liable for fraud that led to crashing the housing market.

Something has clearly gone wrong with our justice system when judges are humiliating prosecutors for refusing to prosecute criminals.

Your point is well taken...as is the author...
Since 9/11, a day of numorous crimes , the DOJ has done nothing to get to the bottom of that day, nor have they done anything about the financial meltdown that has been underway for the last 6 years...one could argue that the whole us govt has been compromised from the inside and no longer functions as it was intended. With much sadness we, the awake and aware, watch as each week markets close at new highs, dollar loses a bit more value, another 350,000 people lose their jobs, the press reports "all is well', and those in authority do nothing to stop the destruction...indeed they perpetrate it!
It is good to note there are a few, as the federal judge mentioned above, who have the nerve to point out miscreants ...but to think the DOJ would cleanse itself of these vipers is wishful thinking...IMO.

Eric Holder is the most political Attorney General ever to occupy the office.

The principle job of the Attorney General, and the one the Attorney General swears to execute in his oath of office, is to “support and defend” the Constitution, and thus the law which established the federal system in our country.

By any measure, Eric Holder has not only failed to uphold his oath of office, he has actively broken it by consistently making claims or offering testimony that are demonstrably false and undermining the Constitution.

If Eric Holder’s conduct is not a textbook example of an impeachable offense then there isn't one. It is time for Capitol Hill to get tough and do what should have been done when they caught Holder lying to Congress: impeach an Attorney General who has become not the Nation’s top law enforcement officer, but one of its premier examples of contempt for the law.

Exactly, however those on Capitol Hill who could/ can do something about it won't. This reinterpretation of the Constiution has proceeded full speed since 911, and nothing has been done about it to date. NSA lies to Congress, Holder lies to Congress, the Fed Reserve lies, Wall Street lies ....and Congress does NOTHING. Great that this Judge has spoken out. Now, can he take it a step further so something will actually change?
