EU President Demands More Government Control To Counter 'Misinformation'

The European Commission’s pursuit of digital ID on a global scale became none more apparent than during President Ursula von der Leyen’s remarks to the globalist elite at the World Economic Forum (WEF) (https://projectavalon.net/forum4/showthread.php?118748-Top-10-Creepiest-Most-Dystopian-Things-Pushed-By-The-World-Economic-Forum).

"The World Economic Forum’s Global Risk Report puts Artificial Intelligence as one of the top potential risks of the next decade," she continued. "Tackling disinformation and misinformation has been our focus since the beginning of my mandate."

At the G20 Summit last September, the Commission president called for a global regulatory body to oversee Artificial Intelligence (AI) and digital ID systems, akin to the regulations for vaccine passports. She underscored the need to harness and guide this technology 'responsibly.'

In 2020, the European Union (EU) presented the first-ever law on AI in a bid to facilitate innovation while building trust.

"But we need more," she said, "What the world does now will shape our future. I believe that Europe — and its partners — should develop a new global framework for AI risks."

A free speech advocacy group in Ireland has launched a new campaign in an effort to fight back against a proposed “hate speech” bill which would limit public discourse around political issues. Free Speech Ireland is labeling the law “onerous anti-free speech legislation.”

The grassroots campaign shared their petition on social media, along with a video warning Irish citizens of the danger the bill poses to freedom of expression which is meant to be protected under both the Irish constitution and the European Convention on Human Rights.

“The Irish government wants to pass a law that could see you or your loved ones jailed for possession of memes, cartoons or any content that could be deemed ‘hateful,'” Free Speech Ireland stated. “The bill includes no definition of hate and is wide open to abuse by bad actors.”

The Hate Speech Bill, formally known as the Criminal Justice (Incitement to Violence or Hatred and Hate Offences) Bill 2022 covers hate crimes and hate speech. Some sections of the legislation outline 12 offenses which are already illegal but could now result in a harsher punishment if the motive for the crime is found to be “hateful.” The bill also introduces the new offense (https://www.irishtimes.com/politics/2023/12/05/qa-what-are-the-proposed-new-hate-crime-laws-and-why-the-delay/) of incitement to violence or hatred in Section 7 which criminalizes certain speech.

In their petition, which was launched this week, Free Speech Ireland outlined that the provision in Section 7 “sets a troubling precedent” by establishing that an individual could be deemed guilty of an offense through the act of “communicating material to the public or a section of the public.”

Due to its far-reaching implications, the bill has been highly criticized internationally. Vocal opponents of the bill include Tesla CEO Elon Musk and Donald Trump Jr.
Musk took to X (formerly Twitter) to call the proposed legislation a “massive attack against freedom of speech.” He has also announced plans to file a legal action to try and stem the law.

Yesterday, Musk shared Free Speech Ireland petition on X writing, “Destroying freedom of speech means destroying democracy.”

Donald Trump Jr. also criticized the proposed legislation, writing: “It’s insane what’s happening in the “free world (https://twitter.com/DonaldJTrumpJr/status/1652777674962612229).”

A spokesperson from the Irish Ministry of Justice has claimed that the true purpose of the bill is to “protect those who are most vulnerable” to hate crime and hate speech.
The bill is currently at the third stage of the Irish Senate. It was expected to be enacted by the end of 2023, but was delayed earlier in the year as it had come under heavy scrutiny in the Senate, particularly because the bill does not include clear definitions of either “hate” or “gender.”

The definition of gender in the bill is vaguely defined as “the gender of a person or the gender which a person expresses as the person’s preferred gender.”
The bill includes gender identity and gender expression as protected characteristics, and seeks to protect individuals who identify as non-binary or any other new gender identity label from “hate speech.”

Many have expressed concerns that the bill will criminalize people for expressing criticism of gender ideology or for using the correct-sex pronouns for transgender individuals. But despite the controversy, Irish Green Party Senator Pauline O’Reilly defended the bill.

Speaking in June at a hearing, she said: “If a person’s views on other people’s identities make their lives unsafe and insecure, and cause them such deep discomfort that they cannot live in peace, our job as legislators is to restrict those freedoms for the common good.”

But Senator Rónán Mullen of the Human Dignity Alliance criticized the bill.
“There are about 105 genders listed on the Internet, including agender, acegender, androgyne, apogender, astronomique, cookie gender, gendercat, fluid queer, one that I cannot politely render here, hyperfluid, etc,” he said.

“All of this is now being landed in the middle of a criminal law bill where somebody could be attacked for being a hater for stating in robust, but necessarily robust, terms that not only is this nonsense but it is dangerous nonsense that puts children at risk when it is imported into the curriculum of schools (https://www.foxnews.com/media/elementary-school-used-planned-parenthood-sex-ed-materials-included-puberty-blockers-pubic-hair-art).”

Free Speech Ireland’s petition currently has 2,278 signatures at the time of writing, with a goal of 10,000 signatures.

Let’s take a look at how T-Mobile is surveilling the people and justifying this AND their censorship.

In a Terms of Service update of November 2020, T-Mobile quietly announced that, in order to “protect its Customers and provide a supportive environment for messaging services,” Direct Connection Aggregators (DCAs) who signed an agreement with
T-Mobile to provide messaging services… are expected to ensure that each Messaging Campaign is completely compliant with all legal requirements.”

With “these policies and best practices, T-Mobile strives to protect subscribers from unwanted messaging…and empower consumer choice.”

[Best Practices is a World Economic Forum (WEF) term that ALWAYS carries a deadly United Nations agenda. Beware of this term in government documents!]

T-Mobile, how can we have the choice if you block them from coming through? How can we decide what we want to see if you decide for us? This is Censorship, but don’t worry, “T-Mobile reserves the right to protect [their] consumers by turning down a messaging campaign on a case-by-case basis,” so they surely will respect the 1st Amendment rights of companies to share a stance on certain issues, along with the rights of private citizens who wish to have free and open communications. Remember, the Supreme Court decided years ago that Companies are entities and therefore also have rights like citizens.

T-Mobile is ensuring that the Direct Connection Aggregators (DCAs) keep their end of the bargain by spying on our text messages. DCAs are required to keep track of who opts in, when, where, how, and at any given moment, provide such information to T-Mobile. The Code of Conduct states:

At any time, T-Mobile may request proof of consumer opt-in. It is the DCA and their content provider requirement to pride [provide] opt-in consent records along with the method of how opt-in was obtained (i.e. Shortcode keyword, website URL, etc.). Below are examples of documented opt-in consent data acceptable by T-Mobile.

• The timestamp of consent acquisition;

• Consent acquisition medium (e.g., cell-submit form, physical sign-up form, SMS keyword, etc.);

• The capture of experience (e.g., language and action) used to secure consent;

• Specific campaign for which the opt-in was provided;

• IP address used to grant consent;

• The consumer phone number for which consent to receive messaging was granted; and

• Identity of the individual who consented (name of the individual or other identifier (e.g., online username, session ID, etc.)). (emphasis ours)

They require the private information of ALL who sign up for the business texts. They’re taking your data whether you like it or not, and they’ll use it as they wish.

If T-Mobile doesn’t get this information as soon as it asks for it, if they don’t like the content of a business’s messages, or if they decide a company sent messages to people who didn’t want them, according to their Code of Conduct, “T-Mobile may, at its discretion, review content for compliance with these policies and best practices may result in the following:

• Non-compliance could result in the suspension of sending rights for a provisioned shortcode, longcode or Toll-Free numbers;

• Restriction daily quota message buckets for 10DLC services;

• Suspension of provisioning rights for new phone numbers; and/or

• Suspension of all network services.

What kinds of messages could potentially be deemed inappropriate? Congress designates what is appropriate in the Telephone Consumer Protection Act. This is a legal means of government and private entities spying on your phone. 10DLC.org is a website for a program introduced by phone carriers to implement laws regarding phone usage. Bing AI was asked to explain what 10DLC is, and it provided:

10DLC stands for 10-digit long code, and it is a program introduced by US carriers to prevent spam/fraud and unwanted messaging 12. It is mandatory for businesses to register their 10DLC numbers with a third-party organization called The Campaign Registry (TCR) 1. The registration process is designed to ensure a positive and secure consumer experience and protect the performance of text campaigns 1. Upon registration, TCR verifies that your business is legitimate, then assigns each number in its registry a trust score which carriers then use to prioritize text message delivery 1. The registration process requires a one-time registration fee as well as a monthly campaign fee 1. To get your registration approved, your business information all needs to be verified and you must adhere to industry best practices as outlined by the Telephone Consumer Protection Act (TCPA) 1. According to 10DLC, the following message categories are prohibited for SMS and MMS:

• High-risk financial service

• Third-party lead generation

• Debt collection and forgiveness

• “Get rich quick” schemes or Multi-level marketing

• Illegal substances

• Gambling

• Sex, hate, alcohol, firearms, and tobacco (SHAFT)

Who decides what is hateful? What about companies that sell firearms? What if a company wants to discuss its support for, or opposition to, something like abortion or the 2nd Amendment? What if a company wants to discuss crimes against humanity? Why can’t we talk about gambling? Churches may want to send messages to their congregation regarding several of these things, but they are not allowed. Is this religious discrimination, barring churches from using these messaging systems?

One interesting part of T-Mobile’s Code of Conduct is “programs must be legal across all 50 states.” This means companies that wish to discuss the legal use of marijuana or the legality of abortion should be very careful what they say. If it’s not legal everywhere, companies are not allowed to discuss it. Isn’t this discrimination against state and local campaigns and businesses? Isn’t it censoring their voice to the local communities? Isn’t it illegal to censor speech REGARDLESS of where it is? When did it become legal to tell people and businesses what we’re allowed to say in a private message? Apparently in 2020. Interesting timing.

Bing’s AI was asked if a telephone company could bar someone from using its towers, and its response was:

If T-Mobile can bar a number from using its towers, it can ban ANY user from ANY company, not just T- Mobile’s customers. If a company was banned by T-Mobile and decided to use another company, if that company has agreements with T-Mobile to use their towers, the business cannot use them. This means T-Mobile has the ability to ban any phone number, and it’s just banned.

While on the surface, T-Mobile (and Congress) claim this is for our safety, yet the implications are enormous. They’re constantly in the business of protecting us from ourselves. No, thanks. They have obliterated the 4th Amendment right to privacy, as they readily search our phones without warrants. They openly and expressly dissolve the 1st Amendment when they ban free speech. Companies, entities with rights, have the right to free speech, according to SCOTUS.

Interestingly, we have another Presidential Election coming up this November. The last time we had one, in 2020, they implemented this policy. Any bets on why it’s coming to the forefront again?

A Congressional select committee is investigating BlackRock, the world’s largest asset manager, and MSCI, one of the biggest providers of index funds, to determine whether they are investing Americans’ savings in Chinese companies blacklisted by the US government for security and human rights issues.

The Select Committee on the Chinese Communist Party of the US House of Representatives sent letters to BlackRock (BLK) CEO Larry Fink and MSCI CEO Henry Fernandez on Monday notifying both parties that it is investigating their investments in certain Chinese companies, according to documents reviewed by CNN.

It’s been said that these predator investment companies operate like a cartel. We can definitely see that, too.

Internet censorship, like all censorship, can take multiple forms, from filtering and blocking content to monitoring and penalizing users who access certain content. Digital Kill Switches: How Tyrannical Governments Stifle Political Dissent

Communications kill switches have become tyrannical tools of domination and oppression to stifle political dissent, shut down resistance, forestall election losses, reinforce military coups, and keep the populace isolated, disconnected and in the dark, literally and figuratively.

Digital authoritarianism, as the Center for Strategic and International Studies cautions, involves the use of information technology to surveil, repress, and manipulate the populace, endangering human rights and civil liberties, and co-opting and corrupting the foundational principles of democratic and open societies, “including freedom of movement, the right to speak freely and express political dissent, and the right to personal privacy, online and off.”

This particular kill switch can be traced back to the Communications Act of 1934. Signed into law by President Franklin D. Roosevelt, the Act empowers the president to suspend wireless radio and phone services “if he deems it necessary in the interest of national security or defense” during a time of “war or a threat of war, or a state of public peril or disaster or other national emergency, or in order to preserve the neutrality of the United States.”

In closing, we can see things have gotten out of control with our country’s federal government. Our text messages as well as our phone and banking records are now under heavy surveillance. Censorship is conducted daily. Tyranny is upon us, folks!

And even our own state government, including our Arkansas Governor, Sarah Huckabee Sanders, has turned against our right to inquire by denying us complete access to government meetings and records. The Freedom of Information Act is under threat here in Arkansas! Forget transparency, our governor insists upon more secrecy, and especially when it comes to her travel records. She is continually looking for many more exemptions of our FOIA, too. Sadly, this RINO governor wants to eliminate the ability to hold our government accountable.

State legislatures need to band together and pass protective legislation regarding intrusive surveillance and improper censoring of our First Amendment Rights (free speech) while they still can, before totalitarianism takes over our government completely. It's quite some wonder that here on the forum we've not completely lost our collective temper with "censorship" in all its abhorrent manifestations - we should get a medal really :)

Here Simplicius excoriates the gatekeepers in his typically erudite fashion, and with customary wit this time focusing on the overt attempts by certain actors to blogicide Substack. I will very occasionally post his quite wonderful posts in full where they may just be too good to cherrypick from but also appreciate that they are often very detailed and lengthy, although seldom ever taking more than about 15-20 minutes to read which, in my view, isn't terribly much time really. FYI: People who have Creator endowed rights (life, liberty, private property, etc) that are protected by governments are mutually exclusive with subject citizens who have surrendered endowed rights in exchange for government privileges (i.e. "constitutional rights", political rights, civil rights).

The Supreme Court announced Monday that it will hear arguments on March 18, 2024 in Murthy v. Missouri, a major case involving free speech, government agencies, and social media that could have monumental implications for content moderation.

The case deals with whether or not federal agencies indirectly encouraged social media platforms such as Facebook and X, formerly Twitter, to take down posts on the basis that they contained false information about COVID-19. The case could set a significant precedent around social media and how much communication is allowed between federal agencies and tech companies before the speech becomes coercive.

It's obviously important that we figure out how to apply pressure on the Court so that it doesn't rule improperly.

I feel scared. Very scared. Internet-wide surveillance and censorship, enabled by the unimaginably vast computational power of Artificial Intelligence (A.I.) (https://projectavalon.net/forum4/showthread.php?102409-A.I.-is-Progressing-Faster-Than-You-Think-), is here.

This is not a futuristic dystopia. It’s happening now.

Government agencies are working with universities and nonprofits to use AI tools to surveil and censor content on the Internet.

This is not political or partisan. This is not about any particular opinion or idea.

What’s happening is that a tool powerful enough to surveil everything that’s said and done on the Internet (or large portions of it) is becoming available to the government to monitor all of us, all the time. And, based on that monitoring, the government – and any organization or company the government partners with – can then use the same tool to suppress, silence, and shut down whatever speech it doesn’t like.

But that’s not all. Using the same tool, the government and its public-private, “non-governmental” partners (think, for example: the World Health Organization (https://projectavalon.net/forum4/showthread.php?118331-Global-WHO-Treaty-for-Pandemics-with-Digital-ID-and-Digital-Currency), or Monsanto) can also shut down any activity that is linked to the Internet. Banking, buying, selling, teaching, learning, entertaining, connecting to each other – if the government-controlled A.I. does not like what you (or your kids!) say in a tweet or an email, it can shut down all of that for you.

Yes, we’ve seen this on a very local and politicized scale with, for example, the Canadian truckers (https://brownstone.org/articles/and-now-its-economic-warfare/).

But if we thought this type of activity could not, or would not, happen on a national (or even scarier – global) scale, we need to wake up right now and realize it’s happening, and it might not be stoppable.

New Documents Show Government-Funded A.I. Intended for Online Censorship

The US House Select Subcommittee on the Weaponization of the Federal Government (https://www.congress.gov/bill/118th-congress/house-resolution/12) was formed in January 2023 “to investigate matters related to the collection, analysis, dissemination, and use of information on US citizens by executive branch agencies, including whether such efforts are illegal, unconstitutional, or otherwise unethical.”
Unfortunately, the work of the committee is viewed, even by its own members, as largely political: Conservative lawmakers are investigating what they perceive to be the silencing of conservative voices by liberal-leaning government agencies.

Nevertheless, in its investigations, this committee has uncovered some astonishing documents related to government attempts to censor the speech of American citizens.

These documents have crucial and terrifying all-of-society implications.

In the Subcommittee’s interim report, dated February 5, 2024 (https://judiciary.house.gov/sites/evo-subsites/republicans-judiciary.house.gov/files/evo-media-document/NSF-Staff-Report_Appendix.pdf), documents show that academic and nonprofit groups are pitching a government agency on a plan to use A.I. (https://projectavalon.net/forum4/showthread.php?102409-A.I.-is-Progressing-Faster-Than-You-Think-) “misinformation services” to censor content on internet platforms.

Specifically, the University of Michigan is explaining to the National Science Foundation (NSF) that the A.I (https://projectavalon.net/forum4/showthread.php?102409-A.I.-is-Progressing-Faster-Than-You-Think-).-powered tools funded by the NSF can be used to help social media platforms perform censorship (https://projectavalon.net/forum4/showthread.php?80790-Internet-Censorship-So-it-began...) activities without having to actually make the decisions on what should be censored.

Here’s how the relationship is visualized in the Subcommittee’s report:

Here’s a specific quote presented in the Subcommittee’s report. It comes from “Speaker’s notes from the University of Michigan’s first pitch to the National Science Foundation (NSF) about its NSF-funded, A.I.-powered WiseDex tool.” The notes are on file with the committee.
Our misinformation service helps policy makers at platforms who want to…push responsibility for difficult judgments to someone outside the company…by externalizing the difficult responsibility of censorship.
This is an extraordinary statement on so many levels:

It explicitly equates “misinformation service” with censorship.

This is a crucial equation, because governments worldwide are pretending to combat harmful misinformation when in fact they are passing massive censorship bills (https://brownstone.org/articles/internet-censorship-everywhere-all-at-once/). The WEF declared (https://www.linkedin.com/posts/world-economic-forum_risks24-wef24-activity) “misinformation and disinformation” the “most severe global risks” in the next two years, which presumably means their biggest efforts will go toward censorship (https://projectavalon.net/forum4/showthread.php?80790-Internet-Censorship-So-it-began...).

When a government contractor explicitly states that it is selling a “misinformation service” that helps online platforms “externalize censorship” – the two terms are acknowledged as being interchangeable.

It refers to censorship (https://projectavalon.net/forum4/showthread.php?80790-Internet-Censorship-So-it-began...) as a “responsibility.”

In other words, it assumes that part of what the platforms should be doing is censorship. Not protecting children from sex predators or innocent citizens from misinformation – just plain and simple, unadulterated censorship.

It states that the role of A.I. (https://projectavalon.net/forum4/showthread.php?102409-A.I.-is-Progressing-Faster-Than-You-Think-) is to “externalize” the responsibility for censorship.

The Tech platforms do not want to make censorship (https://projectavalon.net/forum4/showthread.php?80790-Internet-Censorship-So-it-began...) decisions. The government wants to make those decisions but does not want to be seen as censoring. The A.I. tools allow the platforms to “externalize” the censorship decisions and the government to hide its censorship activities.

All of this should end the illusion that what governments around the world are calling “countering misinformation and hate speech” is not straight-up censorship.

What Happens When A.I. Censorship (https://projectavalon.net/forum4/showthread.php?80790-Internet-Censorship-So-it-began...) is Fully Implemented?

Knowing that the government is already paying for AI censorship tools, we have to wrap our minds around what this entails.

No manpower limits: As the Subcommittee report points out, the limits to government online censorship have, up to now, involved the large numbers of humans required to go through endless files and make censorship decisions. With A.I., barely any humans need to be involved, and the amount of data that can be surveilled can be as vast as everything anyone says on a particular platform. That amount of data is incomprehensible to an individual human brain.

No one is responsible: One of the most frightening aspects of A.I. censorship (https://projectavalon.net/forum4/showthread.php?80790-Internet-Censorship-So-it-began...) is that when AI does it, there is no human being or organization – be it the government, the platforms, or the university/nonprofits – who is actually responsible for the censorship. Initially, humans feed the A.I. (https://projectavalon.net/forum4/showthread.php?102409-A.I.-is-Progressing-Faster-Than-You-Think-) tool instructions for what categories or types of language to censor, but then the machine goes ahead and makes the case-by-case decisions all by itself.

No recourse for grievances: Once A.I. is unleashed with a set of censorship instructions, it will sweep up gazillions of online data points and apply censorship actions. If you want to contest an A.I. censorship (https://projectavalon.net/forum4/showthread.php?80790-Internet-Censorship-So-it-began...) action, you will have to talk to the machine. Maybe the platforms will employ humans to respond to appeals. But why would they do that, when they have A.I. that can automate those responses?

No protection for young people: One of the claims made by government censors is that we need to protect our children from harmful online information, like content that makes them anorexic, encourages them to commit suicide, turns them into ISIS terrorists, and so on. Also from sexual exploitation. These are all serious issues that deserve attention. But they are not nearly as dangerous to vast numbers of young people as A.I. censorship (https://projectavalon.net/forum4/showthread.php?80790-Internet-Censorship-So-it-began...) is.

The danger posed by A.I. censorship (https://projectavalon.net/forum4/showthread.php?80790-Internet-Censorship-So-it-began...) applies to all young people who spend a lot of time online, because it means their online activities and language can be monitored and used against them – maybe not now, but whenever the government decides to go after a particular type of language or behavior. This is a much greater danger to a much greater number of children than the danger posed by any specific content, because it encompasses all the activity they conduct online, touching on nearly every aspect of their lives.

Here’s an example to illustrate this danger: Let’s say your teenager plays lots of interactive video games online. Let’s say he happens to favor games designed by Chinese companies. Maybe he also watches others play those games, and participates in chats and discussion groups about those games, in which a lot of Chinese nationals also participate.

The government may decide next month, or next year, that anyone heavily engaged in Chinese-designed video games is a danger to democracy. This might result in shutting down your son’s social media accounts or denying him access to financial tools, like college loans. It might also involve flagging him on employment or dating websites as dangerous or undesirable. It might mean he is denied a passport or put on a watchlist.

Your teenager’s life just got a lot more difficult. Much more difficult than if he was exposed to an ISIS recruitment video or suicide-glorifying TikTok post. And this would happen on a much larger scale than the sexual exploitation the censors are using (https://www.reuters.com/technology/meta-tiktok-x-ceos-face-tough-questions-child-safety-us-senate-hearing-2024-01-31/) as a Trojan Horse for normalizing the idea of online government censorship.

Monetize-able censorship (https://projectavalon.net/forum4/showthread.php?80790-Internet-Censorship-So-it-began...) services: An A.I. tool owned by the government can theoretically be used by a non-governmental entity with the government’s permission, and with the blessing of the platforms that want to “externalize” the “responsibility” for censorship. So while the government might be using A.I. (https://projectavalon.net/forum4/showthread.php?102409-A.I.-is-Progressing-Faster-Than-You-Think-) to monitor and suppress, let’s say as an example, anti-war sentiment – a company could use it to monitor and suppress, let’s say as an example, anti-fast food sentiment. The government could make a lot of money selling the services of the A.I. tools to 3rd parties. The platforms could also conceivably ask for a cut. Thus, A.I. censorship (https://projectavalon.net/forum4/showthread.php?80790-Internet-Censorship-So-it-began...) tools can potentially benefit the government, tech platforms, and private corporations. The incentives are so powerful, it’s almost impossible to imagine that they will not be exploited.

Can We Reverse Course?

I do not know how many government agencies and how many platforms are using A.I. (https://projectavalon.net/forum4/showthread.php?102409-A.I.-is-Progressing-Faster-Than-You-Think-) censorship tools. I do not know how quickly they can scale up.

I do not know what tools we have at our disposal – other than raising awareness and trying to lobby politicians and file lawsuits to prevent government censorship and regulate the use of A.I. tools on the internet.

If anyone has any other ideas, now would be the time to implement them.

‘Stunning Act of Scientific Censorship’: Journal Retracts Peer-Reviewed Study Critiquing COVID-19 Vaccine

The journal Cureus on Monday retracted the first peer-reviewed paper to provide an extensive analysis of COVID-19 mRNA vaccine trial data and post-injection injuries. The authors of the paper also called for a global moratorium on the vaccines.

The journal Cureus on Monday retracted the first peer-reviewed paper (https://www.cureus.com/articles/203052-covid-19-mrna-vaccines-lessons-learned-from-the-registrational-trials-and-global-vaccination-campaign/retraction#!/) to provide an extensive analysis of COVID-19 mRNA vaccine trial data and post-injection injuries. Dr. Peter McCullough (https://www.radcliffecardiology.com/authors/peter-mccullough), one of the paper’s authors, called the retraction “a stunning act of scientific censorship.” He told The Defender:

“The journal and its editors had the right to reject the paper at any time during the review process. Once published, it is a violation of the Committee on Publication Ethics (COPE) Guidelines (https://publicationethics.org/news/copes-retraction-guidelines-2019) to retract a paper without adequate justification.”

The paper (https://www.cureus.com/articles/203052-covid-19-mrna-vaccines-lessons-learned-from-the-registrational-trials-and-global-vaccination-campaign#!/), published last month, detailed the vaccines’ potential serious harms to humans, vaccine control and processing issues, the mechanisms behind adverse events, the immunological reasons for vaccine inefficacy and the mortality data from the registrational trials.

The authors concluded:

“Federal agency approval of the COVID-19 (https://childrenshealthdefense.org/defender_category/covid/) mRNA injectable products on a blanket-coverage population-wide basis had no support from an honest assessment of all relevant registrational data and commensurate consideration of risks versus benefits.”

They also called for the vaccines to be immediately removed from the Centers for Disease Control and Prevention’s (CDC) childhood immunization schedule (https://childrenshealthdefense.org/defender/cdc-expand-vaccine-schedule-children-pregnant-women/) and for the boosters to be suspended.

The paper was read more than 350,000 times (https://www.cureus.com/articles/203052-covid-19-mrna-vaccines-lessons-learned-from-the-registrational-trials-and-global-vaccination-campaign#!/metrics) in the month after it was posted. An average Cureus paper has only approximately 2,700 views in an entire year.

McCullough said research integrity staffer Tim Kersjes (https://www.springernature.com/gp/tim-kersjes/16338950) at Springer Nature, which publishes Cureus, last week informed the authors that the journal was retracting the paper. Kersjes raised eight points of concern, which McCullough said the authors had previously addressed in an exhaustive peer-review process.

Dr. McCullough told The Defender:

“I am suspicious that Kersjes and Springer Nature were pressured by the powerful Bio-Pharmaceutical Complex (https://childrenshealthdefense.org/defender_category/big-pharma/) of coordinated public health organizations, vaccine manufacturers, and regulatory agencies to censor our paper to keep critical vaccine safety information from getting to the medical community.

“We rejected the retraction, fully appealed and will report this unethical action to all relevant authorities as we move on to publish elsewhere.”

M. Nathaniel Mead, the paper’s lead author, told The Defender he had been concerned from day one that the journal would be pressured to retract the article.
“I knew as soon as I hit the Cureus ‘publish’ button on January 24, following the extensive review process and multiple re-submissions, that we were dealing with a ticking time bomb,” Mead said.

“By citing solid evidence and exposing how the industry-sponsored trials misled the public, our evidence-informed paper was an all-out indictment of the COVID-19 vaccine enterprise.”

‘Predatory retractions’ benefit Big Pharma

Dr. John Adler (https://profiles.stanford.edu/john-adler) at Stanford University and Dr. Alexander Muacevic (https://www.cureus.com/users/19-alexander-muacevic) at the University of Munich founded Cureus in 2009 as a web-based peer-reviewed open-access general medical journal with low cost barriers to publication.

The academic publishing giant Springer Nature bought Cureus (https://group.springernature.com/gp/group/media/press-releases/springer-nature-acquires-cureus/23793592) in December 2022.
Springer Nature is a publishing conglomerate founded in 2015 through a merger of Nature Publishing Group, Palgrave Macmillian, Macmillan Education and Springer Science+Business Media.

The publisher generated 1.8 billion euros in 2022 (https://www.thebookseller.com/news/springer-nature-hails-growth-in-annual-progress-report-after-weathering-volatile-year), showing continuous year-over-year growth since 2020.

Springer Nature has an in-house Research Integrity Group (https://www.springernature.com/gp/editors/research-integrity) dedicated to ensuring the company’s scientific content is “rigorously assessed (https://www.springernature.com/gp/researchers/the-source/blog/blogposts-research-integrity/what-is-research-integrity-and-what-is-all-about/16735706).” When issues arise that require the input of “research integrity experts,” the Resolutions Team, headed by Kersjes, steps in.

Kersjes notified the authors on Feb. 16 that the journal editors planned to retract the article, noting the journal “was recently made aware of several concerns regarding the validity of the work.”

According to the email text, posted on Substack by Steve Kirsch (https://kirschsubstack.com/p/our-paper-critical-of-the-covid-vaccines), another of the paper’s co-authors, those concerns “in our view can’t be remedied with a correction.”

Kersjes told the authors they had the option to agree or disagree with the retraction, which would be noted on the website.

They disagreed. “We vigorously reject this opinionated, ex post facto, arbitrary, and capricious decision on the part of Kersjes and his Springer superiors,” they wrote.

The letter from Kersjes specified concerns with claims the authors made about all-cause mortality data (https://childrenshealthdefense.org/defender/covid-vaccine-rollouts-all-cause-mortality/), Vaccine Adverse Event Reporting System (VAERS) data (https://childrenshealthdefense.org/defender/vaers-covid-vaccine-injury-reports-analysis-et/), the number of deaths from vaccination versus lives saved, possible vaccine contamination (https://childrenshealthdefense.org/defender/kevin-mckernan-pfizer-sv40-contamination-covid-vaccines/), their assertion that the vaccines did not undergo proper safety and efficacy testing, the “incorrect” statement that spike proteins linger in the body (https://childrenshealthdefense.org/defender/cdc-spike-protein-mrna-covid-vaccine/) and can cause adverse effects and that the vaccines are gene therapy (https://childrenshealthdefense.org/defender/covid-vaccines-gene-therapy-media-fact-checkers-cola/) products.

In their rebuttal (https://prd-tsn-main-api.s3.amazonaws.com/article/95e5609f-b48f-4646-b49e-f63a0b6bede1.pdf), the authors responded to each criticism, explaining their argument and providing supporting citations. They noted the article’s eight reviewers and journal editors had found their responses satisfactory.

A few days after the initial publication, Adler, who is Cureus editor-in-chief, told the industry-friendly website Retraction Watch (https://retractionwatch.com/2024/02/19/paper-claiming-extensive-harms-of-covid-19-vaccines-to-be-retracted/#more-128774), “Our editorial response was extra vigilance during the peer review process with 8 different reviewers weighing in on publication or not, including a few with strong statistics knowledge. Therefore, a credible peer review process was followed and the chips fell where they may.”

Adler also said the journal would reevaluate if “fatal flaws” were identified. “The decision process Cureus made contrasts sharply with Elsevier’s seeming editorial decision to just censor the article using ad hominem concerns.”

However, a spokesperson for Cereus told The Defender today, “Following publication, concerns were raised regarding a number of claims made in the article and an investigation by Cureus and Springer Nature’s Research Integrity team identified several issues with the article which warranted a retraction.”

The spokesperson added, “It is preferable that such issues are caught during peer review but unfortunately that is not always the case. What is therefore important, is that, as happened in this case, when issues are raised post-publication, they are dealt with swiftly so that the integrity of the academic record is preserved.”

R (https://www.amazon.com/Vax-Unvax-Childrens-Health-Defense-Kennedy/dp/1510766960/)The authors contend (https://prd-tsn-main-api.s3.amazonaws.com/article/95e5609f-b48f-4646-b49e-f63a0b6bede1.pdf) in their rebuttal that most concerns “appear to be adapted, either directly or indirectly, from the numerous comments made by the well-known vaccine industry social media trolls, Jonathan Laxton (https://twitter.com/dr_jon_l?lang=en) and Matthew Dopler,” who commented frequently (https://www.cureus.com/articles/203052-covid-19-mrna-vaccines-lessons-learned-from-the-registrational-trials-and-global-vaccination-campaign#!/) on the article on Cureus’ website.

Mead told The Defender he was also suspicious the editors and publisher had been pressured by industry:

“At least four of the retraction points appear to be position statements issued directly by the vaccine industry — a concerted attempt to declare, for example, that the mRNA vaccines are not gene therapy products, that these products are not contaminated with high levels of DNA, that they do not linger in the body and cause adverse effects, and finally, most incredibly, that the mRNA products underwent adequate safety and efficacy testing.”

Mead added, “Once a major counter-narrative paper gets published and its findings begin to garner lots of attention, the Bio-Pharma stakeholders exert immense pressure on the publisher to retract the paper.”

The retraction has implications that extend beyond the article, Mead said. These kinds of “predatory retractions” benefit the Bio-Pharmaceutical enterprise, he said, by concealing information about vaccine risks, undermining the credibility of the research and of the authors themselves.

“This is going to force scientists who are interested in the truth to seek out alternate publishing venues and strategies, perhaps even alternate peer-review systems,” he added.

Springer Nature did not respond to a request for comment.

Scientific publishing as a crossroads

In a recent op-ed published in JAMA (https://jamanetwork.com/journals/jama/fullarticle/2809861), Stanford epidemiologist Dr. John P.A. Ioannidis (https://med.stanford.edu/profiles/john-ioannidis) argued that peer review and scientific publication are at a “crossroads” and called for research on the topic for an upcoming conference.

“Scientific publishing is a huge market with one of the highest profit margins among all business enterprises, and it supports a massive biomedical and broader science economy,” Ioannidis wrote. “Many stakeholders try to profit from or influence the scientific literature in ways that do not necessarily serve science or enhance its benefits to society.”

Ioannidis is best known for his seminal 2005 paper, “Why Most Published Research Findings Are False (https://journals.plos.org/plosmedicine/article?id=10.1371/journal.pmed.0020124),” where he argued that scientists “may be prejudiced purely because of their belief in a scientific theory or commitment to their own findings.”

In that paper, he wrote, “Prestigious investigators may suppress via the peer review process the appearance and dissemination of findings that refute their findings, thus condemning their field to perpetuate false dogma.”

The Wall Street Journal’s Allysia Finley recently noted (https://www.wsj.com/articles/how-preapproved-narratives-corrupt-science-false-studies-covid-climate-change-5bee0844) these dynamics have been particularly pronounced in research on COVID-19, where flawed research supporting the dominant narrative is often published because it reinforces the peer reviewers’ existing biases, while other scientists “struggle to publish against-the-grain research.”

Even preprint servers — which post scientific papers while they go through peer review and have no peer review process themselves — are being used to censor scholarly papers critical of the CDC and policy errors made by the Biden administration, according to Vinay Prasad, M.D., MPH (https://childrenshealthdefense.org/authors/vinay-prasad-m-d-mph/).

Prasad found that 38% of his lab’s submissions to preprint servers were rejected or removed — even though those same articles eventually were published in journals and extensively downloaded.

The Lancet preprint server similarly removed Hulscher and others’ controversial systematic review of autopsy findings (https://papers.ssrn.com/sol3/papers.cfm?abstract_id=4496137) in post-COVID-19 vaccine deaths.

Some top publishers like Taylor & Francis (https://disinformationchronicle.substack.com/p/publisher-taylor-and-francis-joins), and top journals like Science Magazine (https://disinformationchronicle.substack.com/p/science-magazines-paper-advocating), have published articles about COVID-19 origins, for example, that “violated their own ethical policies and flouted their own norms for peer review” — by obscuring the names of major contributors such as Wuhan collaborator and University of North Carolina virologist Ralph Baric, Ph.D. (https://childrenshealthdefense.org/defender/covid-pandemic-nih-unc-fauci-baric/), or greenlighting papers with “basically no peer-review.”

Yet even when those editorial decisions are exposed publicly, the publishers have taken no action, investigative journalist Paul D. Thacker reported (https://disinformationchronicle.substack.com/p/why-do-people-not-trust-the-science).

Those examples, Thacker wrote (https://disinformationchronicle.substack.com/p/publisher-taylor-and-francis-joins), are part of “a long list of essays, studies, and analyses that began littering the scientific literature with dubious (at best) conclusions during the COVID pandemic.”

A familiar playbook?

There is also a long history of coordinated efforts to silence and discredit science and scientists who challenge prevailing narratives that benefit Big Pharma (https://childrenshealthdefense.org/defender_category/big-pharma/) and Big Chemical (https://childrenshealthdefense.org/defender_category/big-chemical/).

For example, in 2013 a technical chemical journal run by Elsevier, another major global science publisher, retracted an article about a group of rats fed Monsanto’s genetically modified (GM) corn (https://childrenshealthdefense.org/defender/the-whole-truth-about-the-monsanto-papers-gilles-eric-seralini-jerome-douzelet-roundup/) and some of the company’s flagship herbicide, Roundup (https://childrenshealthdefense.org/defender/roundup-weedkiller-disrupts-gut-microbiome-new-study/).

Lead author Gilles-Éric Seralini studied the effects of GM corn and herbicide over two years, rather than for the short-term — 90 trials studying just GMOs or the herbicide — that Monsanto had used to market the products as non-carcinogenic.

In response, Monsanto ran a series of covert suppression programs through which internal corporate documents later revealed the company “manipulated peer reviews (https://www.baumhedlundlaw.com/documents/pdf/monsanto-documents-2/monsanto-personnel-celebrating-the-fact-that-the-seralini-publication-was-rejected.pdf), engaged in ghostwriting articles (https://www.baumhedlundlaw.com/documents/pdf/monsanto-documents/5-monsanto-involvement-with-scientific-studies-without-disclosing-conflicts-of-interest.pdf) that whitewashed Roundup’s genotoxicity, suppressed an independent scientist’s genotoxicity analysis (https://www.baumhedlundlaw.com/documents/pdf/monsanto-documents/email-from-william-heydens-monsanto-vulnerable-on-gene-tox-after-parry.pdf) and fed pre-written stories (https://www.baumhedlundlaw.com/documents/pdf/monsanto-documents-2/monsanto-sam-murphey-sends-anti-iarc-and-anti-aaron-blair-message-to-kate-to-use-in-her-article.pdf) for reporters to ‘independently’ publish (https://www.baumhedlundlaw.com/documents/pdf/monsanto-documents/22-internal-email-demonstrating-monsanto-ghostwriting-article-criticizing-iarc-for-press.pdf). Monsanto even had the editor of the journal under a financial contract (https://www.baumhedlundlaw.com/documents/pdf/monsanto-documents/10-monsanto-consulting-agreement-with-food-and-chemical-toxicology-editor.pdf) at the time the two-year study was retracted,” according to attorney Michael Baum (https://childrenshealthdefense.org/defender/the-whole-truth-about-the-monsanto-papers-gilles-eric-seralini-jerome-douzelet-roundup/).

The company also coordinated the letters-to-the-editor campaign (https://www.baumhedlundlaw.com/documents/pdf/monsanto-documents/8-monsanto-scientist-admits-to-leveraging-relationship-with-food-and-chemical-toxicology-journal.pdf), with scripted talking points.

Seralini was “tarred and feathered out of science town,” Baum wrote (https://childrenshealthdefense.org/defender/the-whole-truth-about-the-monsanto-papers-gilles-eric-seralini-jerome-douzelet-roundup/) in the foreword to “The Monsanto Papers (https://www.amazon.com/Monsanto-Papers-Corruption-Misrepresentation-Childrens/dp/1510767630/).”

However, through a legal loophole, thousands of pages of the company’s internal confidential documents were released, exposing the details of Monsanto’s actions.
Seralini’s paper was later republished (https://pubmed.ncbi.nlm.nih.gov/27752412/).

Just a few years later, the World Health Organization’s International Agency for Research on Cancer (https://iarc.who.int/) analyzed glyphosate, the key ingredient in Monsanto’s weedkiller, and found it to be a probable human carcinogen (https://www.iarc.who.int/news-events/glyphosate-monograph-now-available/).

Bayer (https://www.bayer.com/media/en-us/bayer-closes-monsanto-acquisition/), which acquired Monsanto in 2018, has paid out over $11 billion in settlements (https://www.forbes.com/advisor/legal/product-liability/roundup-lawsuit-update/) as of May 2022 for cancer claims, has had over two billion more in judgments against it since then, and is facing over 30,000 additional lawsuits.

The report looking into the National Science Foundation (NSF) is the latest addition to a growing body of evidence that critics claim shows federal officials—especially at the FBI and the CIA—are creating a “censorship-industrial complex” to monitor American public expression and suppress speech disfavored by the government.

“In the name of combatting alleged misinformation regarding COVID-19 and the 2020 election, NSF has been issuing multimillion-dollar grants to university and nonprofit research teams,” states the report by the House Judiciary Committee and its Select Subcommittee on the Weaponization of the Federal Government.

“The purpose of these taxpayer-funded projects is to develop AI-powered censorship and propaganda tools that can be used by governments and Big Tech to shape public opinion by restricting certain viewpoints or promoting others.”

The report also described, based on previously unknown documents, elaborate efforts by NSF officials to cover up the true purposes of the research.

The efforts included tracking public criticism of the foundation’s work by conservative journalists and legal scholars.

The NSF also developed a media strategy “that considered blacklisting certain American media outlets because they were scrutinizing NSF’s funding of censorship and propaganda tools,” the report said.

US Army Enlists University of Arkansas at Little Rock To Fight Online “Misinformation” :facepalm:

The US Army has announced (https://ualr.edu/news/2023/11/27/agarwal-army/) a “combat” partnership (effective through 2025) with the publicly-funded University of Arkansas at Little Rock – and what they plan to “combat” together is none other than whatever is deemed to be online disinformation, but also, something defined as “cognitive threats.”

And by that, they don’t mean all manner of government and formally or otherwise government-associated entities falling over themselves trying to pass off various forms of speech suppression and censorship as fighting “disinformation.”

But there’s no denying that this, too, could fall under the definition of misinformation and cognitive threats offered here – namely, the goal is “to detect and combat bad actors online who are trying to manipulate how and what populations think.”

But if an actor is perceived as “good” – does manipulating how and what populations (note the plural) think, then magically become a good thing?

Sarcasm aside – the new initiative is backed with a grant worth $5 million. What the deal reveals is that more and more universities in the US are getting “hired” – whether by non-profits, or, again, the government – to work toward this goal via various dedicated research hubs.

In UA Little Rock’s case it’s called the Collaboration for Social Media and Online Behavioral Studies (COSMOS) Research Center. Beside the US Army’s own Research Office, another key player in putting this project together was Senator John Boozman.

“War is on the social media platforms,” is one of the comments cited in reports about this development, but curiously, it doesn’t come from a military representative but a budding academic with the COSMOS Research Center, graduate assistant Mano Har.

UA Little Rock’s specific task here will be to develop a tool that will detect bots active on social media, and this tool will be web-based – but also based on the school apparently already using “A.I. (https://projectavalon.net/forum4/showthread.php?102409-A.I.-is-Progressing-Faster-Than-You-Think-)” to harvest troves of data from social networks.

It’s not exactly explained who’s responsible for the omnipresent algorithms’ biases being there in the first place – but now the new tool’s job will not be to get rid of them, rather, it is to “prevent those who would exploit the biases in algorithms to further narratives and agendas.”

(Obviously, if they are classified as “bad” actors. “Good” actors may or may not be given a pass trying to accomplish that same task.)

Did they tell you the part about giving the president sweeping new powers?

It’s funny how things work.

Last year at this time, Americans overwhelmingly supported a ban on TikTok.

Polls showed a 50-22% overall margin in support of a ban and 70-14% among conservatives. But Congress couldn’t get the RESTRICT Act passed.

As the public learned more about provisions in the bill, and particularly since the outbreak of hostilities in Gaza, the legislative plan grew less popular. Polls dropped to 38-27% in favor by December, and they’re at 35-31% against now.

Yet the House just passed the “Protecting Americans from Foreign Adversary Controlled Applications Act” by a ridiculous 352-64 margin, with an even more absurd 50-0 unanimous push from the House Energy and Commerce Committee.

What gives?

As discussed on the new America This Week, passage of the TikTok ban represents a perfect storm of unpleasant political developments, putting congress back fully in line with the national security establishment on speech. After years of public championing of the First Amendment, congressional Republicans have suddenly and dramatically been brought back into the fold. Meanwhile Democrats, who stand to lose a lot from the bill politically — it’s opposed by 73% of TikTok users, precisely the young voters whose defections since October put Joe Biden’s campaign into a tailspin — are spinning passage of the legislation to its base by suggesting it’s not really happening.

“This is not an attempt to ban TikTok, it’s an attempt to make TikTok better,” is how Nancy Pelosi put it. Congress, the theory goes, will force TikTok to divest, some kindly Wall Street consortium will gobble it up (“It’s a great business and I’m going to put together a group to buy TikTok,” Steve Mnuchin told CNBC), and life will go on. All good, right?

Not exactly. The bill passed in the House that’s likely to win the Senate and be swiftly signed into law by the White House’s dynamic Biden hologram is at best tangentially about TikTok.

You’ll find the real issue in the fine print. There, the “technical assistance” the drafters of the bill reportedly received from the White House shines through, Look particularly at the first highlighted portion, and sections (i) and (ii) of (3)B:

As written, any “website, desktop application, mobile application, or augmented or immersive technology application” that is “determined by the President to present a significant threat to the National Security of the United States” is covered.

Currently, the definition of “foreign adversary” includes Russia, Iran, North Korea, and China.

The definition of “controlled,” meanwhile, turns out to be a word salad, applying to:

(A) a foreign person that is domiciled in, is headquartered in, has its principal place of business in, or is organized under the laws of a foreign adversary country;

(B) an entity with respect to which a foreign person or combination of foreign persons described in subparagraph (A) directly or indirectly own at least a 20 percent stake; or

(C) a person subject to the direction or control of a foreign person or entity described in subparagraph (A) or (B).

A “foreign adversary controlled application,” in other words, can be any company founded or run by someone living at the wrong foreign address, or containing a small minority ownership stake. Or it can be any company run by someone “subject to the direction” of either of those entities. Or, it’s anything the president says it is. Vague enough?

As Newsweek reported, the bill was fast-tracked after a secret “intelligence community briefing” of Congress led by the FBI, Department of Justice, and the Office of the Director of National Intelligence (ODNI). The magazine noted that if everything goes as planned, the bill will give Biden the authority to shut down an app used by 150 million Americans just in time for the November elections.

Say you’re a Democrat, however, and that scenario doesn’t worry you. As America This Week co-host Walter Kirn notes, the bill would give a potential future President Donald Trump “unprecedented powers to censor and control the internet.” If that still doesn’t bother you, you’re either not worried about the election, or you’ve been overstating your fear of “dictatorial” Trump.

We have two decades of data showing how national security measures in the 9-11 era evolve. In 2004 the George W. Bush administration defined “enemy combatant” as “an individual who was part of or supporting Taliban or al Qaeda forces, or associated forces that are engaged in hostilities against the United States.” Yet in oral arguments of Rosul et al v Bush later that year, the government conceded an enemy combatant could be a “little old lady in Switzerland” who “wrote a check” to what she thought was an orphanage.

Eventually, every element of the requirement that an enemy combatant be connected to “hostilities against the United States” was dropped, including the United States part. Though Barack Obama eliminated the term “enemy combatant” in 2009, the government retained (and retains) a claim of authority to do basically whatever it wants, when it comes to capturing and detaining people deemed national security threats. You can expect a similar progression with speech controls.

Just ahead of Monday’s oral arguments in Murtha v. Missouri, formerly Missouri v. Biden — the case so many of us hoped would see the First Amendment reinvigorated by the Supreme Court — this TikTok bill has allowed the intelligence community to re-capture the legislative branch. Just a few principled speech defenders are left now. Fifty Democrats voted against the bill, which is heartening, although virtually none argued against it on First Amendment grounds, whis is infurating. Pramila Jayapal had a typical take, saying the ban would “harm users who rely on TikTok for their livelihoods, many of whom are people of color.”

Contrast that with Kentucky Senator Rand Paul, who went after members of his own party, singling out Republicans encouraging a governmental power grab after years of fighting big tech abuses not just at TikTok but other platforms. These people claim to be horrified, he said, but actions speak louder than words.

“Look at their legislative proposals,” he said, noting many want to “set up government agencies and panels” on speech, effectively saying “If you’re not putting enough conservatives on there, by golly we’re going to have a government commission that’s going to determine what kind of content gets on there.”

He’s right, and shame on papers like the New York Post that are going after Paul for having donors connected to TikTok. Paul has been consistent in his defense of speech throughout his career, so the idea that his opinion on this matter is bought is ludicrous. It’s a relief to be able to expect at least some adherence to principle on this topic from him or fellow Kentuckian Thomas Massie, just as we once could expect it from Democrats like Paul Wellstone or Dennis Kucinich.

I don’t often do this, but as Walter pointed out in today’s podcast, this bill is so dangerous, the moment so suddenly and unexpectedly grave, that we both recommend anyone who can find the time to call or write their Senators to express opposition to any coming Senate vote. It might help. Yes, collection of personal information and content manipulation by the Chinese government (or Russia’s, or ours) are serious problems, but the wider view is the speech emergency. As the cliché goes, forget the furniture. The house is on fire. Let’s hope we’re not too late.

For example, Google has been investing in DNA repositories for quite a long time, and are adding DNA information to our profiles. According to Epstein, Google has taken over the national DNA repository, but articles about that — which he has cited in his own writings — have all vanished.

Jackson warned that without censorship, vast numbers of American teenagers could perish by jumping out of high windows in a social-media “challenge.”

She repeatedly invoked the peril of an epidemic of crazed window-jumpers to canonize preemptive federal censorship of online media.

Monday’s wrangling focused on the peril of disinformation and misinformation — as defined by Uncle Sam.

There was no recognition that government censorship was to blame for some of the biggest follies of the COVID pandemic.

Schools would not have been shut down for so long if the government hadn’t suppressed experts and others who correctly explained that COVID posed scant risk to young children and padlocking schools would not keep kids immune from infection.

Some of the justices sounded like they learned all they knew about this controversy from recent overheated pieces on the perils of disinformation in The Washington Post and New York Times.

This was especially problematic since some of those articles could have been written by the most voracious censors in the land.

This power, wielded without stringent checks and balances, leads to excessive censorship and suppression of dissenting voices, which is antithetical to the principles of a democratic society.

Guterres highlighted the historic and ongoing damage caused by hate speech, citing devastating examples such as Nazi Germany, Rwanda, and Bosnia to suggest that speech leads to violence and even crimes against humanity.

“Hate speech is a marker of discrimination, abuse, violence, conflict, and even crimes against humanity. We have time and again seen this play out from Nazi Germany to Rwanda, Bosnia and beyond. There is no acceptable level of hate speech; we must all work to eradicate it completely,” Guterres said.

Guterres also noted what he suggested are the worrying rise of antisemitic and anti-Muslim sentiments, which are being propagated both online and by prominent figures.

Guterres argued that countries are legally bound by international law to combat incitement to hatred while simultaneously fostering diversity and mutual respect. He urged nations to uphold these legal commitments and to take action that both prevents hate speech and safeguards free expression.

The UN General Assembly marked June 18 as the “International Day for Countering Hate Speech” in 2021.

The totalitarianism we warned of is happening.

The European Union is at this moment forcing big tech companies to secretly engage in mass censorship. Google and Facebook are, apparently, going along with it.

Only Elon Musk’s X, among the major platforms, is resisting.

A few hours ago, Musk said, “The European Commission offered 𝕏 an illegal secret deal: if we quietly censored speech without telling anyone, they would not fine us. The other platforms accepted that deal. 𝕏 did not.”

And so now, the EU is preparing to punish X with massive fines — up to 6% of total global revenue.

I can't imagine a more egregious form of foreign interference in our domestic affairs than foreign governments demanding mass secret censorship for ideological and political purposes.

Most terrifying is the apparently direct involvement of government intelligence and security agencies, and their intermediaries, in demanding censorship.

This is all happening at the very moment that the same governments, including our own, warn of Russian disinformation through spam accounts that hardly anybody ever sees.

Don’t be fooled by what is happening. Governments and former intelligence officials in Europe, Australia, Israel, Brazil, and Ukraine and other nations are not only demanding censorship but also often spreading their own disinformation.

For example, the EU claims that there is more false information on X than on other platforms, and more censorship would reduce it.

This is false. Only X has the open-source Community Notes system, which allows for real-time corrections to false information. A recent study in JAMA, the Journal of American Medicine, found that 97.5% of the Community Notes were entirely accurate, 2%, partially accurate, and 0.5%, inaccurate.

It’s not perfect. I myself sometimes disagree with them. And of course, science is never standing still, so what appears accurate today might not be accurate in the future.

However, X’s Community Notes uses more speech, not censorship, to provide context to controversial content. You can still agree or disagree with the content, even with a Community Note attached.

What the EU wants is for its committees of experts, not Community Notes, to secretly decide what we can read and say online. This is unethical and unconstitutional.

Another key part of the EU’s disinformation is that “researchers” should have access to X’s internal data, which Musk cut off when he bought Twitter. But those people who want the data aren’t researchers. They’re censorship activists, many of whom have deep relationships with governments in general and intelligence agencies in particular.

If the EU succeeds in censoring X, Facebook, Google, and every other major Internet platform, then there is no free speech. There is only government-controlled speech.

Many people rightly worry about the implications of a single man, Elon Musk, being all that stands between us and foreign governments’ totalitarian censorship plans. I worry about that, too. Our speech is inalienable. It is not something governments give to us.

We need to fight back. While we should be grateful to Musk for standing up to the totalitarians in Europe, Brazil, and Australia, we must build a citizen’s movement to fight back.

Elon’s post came after EC commissioner Thierry Breton announced the Commission's preliminary findings that pre-Elon, blue checkmarks "used to mean trustworthy sources of information," but now violate the Digital Services Act because, today, "anyone can subscribe to obtain such a 'verified' status," therefore the commission may "impose fines & require significant changes."

The EC wanted 𝕏 to hire a team of people in the EU that could number in the hundreds to remove 'misinformation' from the platform, a person with knowledge of the issue told PW Editor-in-Chief @micsolana. 𝕏 would have no recourse in these removal decisions, the person said.

"The objective of the Digital Services Act is to ensure a safe and fair online environment for European citizens that is respectful of their rights, in particular freedom of expression," EC spokesperson Thomas Regnier told Pirate Wires over email. "The DSA requires a fair and transparent complaint mechanism for users. If an account is suspended, the user has the right to contest the decision. This means that decisions must not be arbitrary, and users are empowered to protect their online presence... When an account is restricted, the user must be informed and has the right to appeal the decision."

Shortly after his post about the secret deal, Elon posted that he plans to take the Commission to court if its preliminary findings are confirmed and it pursues an enforcement action against 𝕏.

The Digital Services Act (DSA) is a new legislative regulatory bundle by the EC that only became fully applicable this February, and seeks to fine companies like 𝕏, Meta, and Google up to 6% of their annual revenue for violations, which include failure to remove "illegal" content once it’s reported. What’s considered illegal can vary depending on the specific national laws of EU member states, provided these laws are compatible with EU law. For example, content that’s illegal in Germany must be removed for users in Germany, even if it is not illegal in another member state.

The EC also accused 𝕏 of failure to "comply with the required transparency on advertising, as it does not provide a searchable and reliable advertisement repository," and prohibiting "eligible researchers from independently accessing its public data," both of which are in violation of its DSA.

In April, Elon publicly feuded with Brazilian lawmakers after he refused to comply with their demands to remove accounts without explanation to account owners or the public. Brazilian lawmakers had previously asked 𝕏 to remove accounts critical of its regime under these conditions.

"We do not know the reasons these blocking orders have been issued. We do not know which posts are alleged to violate the law. We are prohibited from saying which court or judge issued the order, or on what grounds. We are prohibited from saying which accounts are impacted. We are threatened with daily fines if we fail to comply," posted 𝕏’s Global Government Affairs team about Brazil’s demands. 𝕏 ultimately reversed course, and announced it would comply with the Brazilian government’s requests.

Today, the EC's findings are "preliminary," but per the EC, "if the Commission's preliminary views were to be ultimately confirmed... [it] could entail fines of up to 6% of the total worldwide annual turnover of [𝕏], and order [it] to take measures to address the breach."

Next Democratic president and vice president may implement sweeping plan for "fighting misinformation" and "hate speech"

Brazil’s banning and blocking of the social media platform X is far more extreme than anything being proposed in the United States, social media regulation experts are telling the New York Times, Washington Post, and other publications. One implication is that we need not be concerned that Brazil-style censorship will ever happen in the US.

In fact, Democratic presidential candidate Kamala Harris and vice presidential candidate Tim Walz both repeatedly endorsed the three main censorship tactics used by the Brazilian government: censorship of election “misinformation,” de-platforming political opponents, and cross-platform bans, which ban a person not just from one social media platform but from many or even all of them.

Harris repeatedly called for the US government to deplatform then-President Donald Trump. In an October 2019 debate, Harris said, “His Twitter account should be shut down.” After the debate she said, “You can't say that you have one rule for Facebook and you have a different rule for Twitter. The same rule has to apply. There has to be a responsibility that is placed on these social media sites…They are directly speaking to millions and millions of people without any level of oversight or regulation. And that has to stop.”

When Walz in 2022 called for censorship of election misinformation, he claimed, falsely, that the First Amendment does not protect hate speech and misinformation. “There's no guarantee to free speech on misinformation or hate speech,” said Walz on MSNBC, “and especially around our democracy.” In fact, the US Supreme Court has consistently ruled that hate speech, misinformation, disinformation, or deliberate lying are allowed in most circumstances. First Amendment scholar Jeff Koseff last year published a book, Liar In A Crowded Theater, documenting this history.

It’s true that Harris and Walz have not recently repeated their calls for government censorship and that what they called for was not as extreme as what Brazil is doing. They made their statements two to five years ago. And neither Harris nor Walz called for completely banning and blocking social media platforms as the Brazilian government did.

But none of that takes away from the severity of their calls for industry-wide, cross-platform deplatforming through government regulation of social media platforms. Before the Brazilian Supreme Court Judge Alexandre de Moraes banned and blocked X in Brazil, he sought cross-platform deplatforming of opposition politicians and independent journalists. Indeed, it was precisely his demands for such cross-platform bans that X owner Elon Musk rejected, which led to Moraes’ decision to block the whole platform.

For years, Democrats have sought to regulate social media platforms both directly through the executive branch and through Congress. In 2021 and 2022, Democrats in the House and Senate introduced the “Justice Against Malicious Algorithms Act,” “Algorithmic Justice Act,” and the “Social Media NUDGE Act” to require social media companies to censor content that could cause “emotional injury,” ban algorithms that result in “discrimination or similar harms,” and impose “limits on account creation and content sharing” of disfavored individuals and their views. While some of these bills have good goals, including protecting privacy, preventing harassment, and increasing transparency, they all give the government far too much power to censor disfavored speech.

In the spring of 2022, the Biden Administration’s Department of Homeland Security (DHS) announced a “Disinformation Governance Board.” One week prior, former President Barack Obama advocated for sweeping US government censorship of social media platforms in a major speech at Stanford University, which appeared timed to support the Disinformation Governance Board and advocate for Congress to regulate social media content for disfavored content.

Obama’s speech gave a clear picture of the censorship a Harris-Walz administration may impose. He claimed that “social media platforms tend not to wanna do anything,” and “a regulatory structure, a smart one, needs to be in place” for “slowing the spread of harmful content.” Obama stressed that government “regulation has to be part of the answer.” In his speech, Obama praised the aggressive social censorship that the European Union is currently pursuing through its Digital Services Act (DSA).

For decades, the Democrats were the party of free speech in the United States. What changed? How did Harris, Walz, Obama, and dozens of Democratic Senators and members of Congress come to support Brazil-style censorship?

We have previously discussed the anti-free speech views of Clinton’s former Labor Secretary, Robert Reich, who has tried to sell citizens on the perfectly Orwellian view that more freedom means tyranny when it comes to the freedom of expression. He also demanded (https://jonathanturley.org/2023/04/27/destroying-a-democracy-to-save-it-robert-reich-calls-for-blocking-trump-from-ballots-as-a-traitor/)that former president Donald Trump be banned from ballots as a “traitor” — all in the name of protecting democracy from itself. Last week, Reich wrote (https://www.theguardian.com/commentisfree/article/2024/aug/30/elon-musk-wealth-power)a column declaring Elon Musk “out of control” in his refusal to censor citizens and appeared to call for his arrest.

Reich has long been a prominent voice in the anti-free speech movement discussed in my recent book, The Indispensable Right: Free Speech in an Age of Rage (https://www.amazon.com/exec/obidos/ASIN/1668047047?tag=simonsayscom). Indeed, he has given a voice to the rage in calling for others to be silenced or arrested.

Elon Musk has long been the primary target of Reich and his allies after dismantling the censorship system at Twitter, now X. Reich called Musk’s purchase of Twitter with a pledge to reduce censorship to be “dangerous nonsense.” (https://www.foxnews.com/media/robert-reich-guardian-elon-musk-twitter-dangerous-nonsense)

Notably, Reich’s friend, Hillary Clinton, was one of the first to call for a crackdown on Musk after his purchase of Twitter. Hillary Clinton and other Democratic figures (https://x.com/HillaryClinton/status/1517247388716613634)turned to Europe and called upon them to use their Digital Services Act to force censorship against Americans.

Reich has always shown a chilling fluidity in how free speech is protected and argued that public interest should be able to trump the right of any citizens in espousing views that he believes are dangerous.

In denouncing Musk, Reich encouraged a campaign to counter his efforts to resist censorship. He wrote that Musk “may be the richest man in the world. He may own one of the world’s most influential social media platforms. But that doesn’t mean we’re powerless to stop him.”

Like Hillary Clinton, Reich is calling on foreign governments and censors to silence American citizens including Musk: “Regulators around the world should threaten Musk with arrest if he doesn’t stop disseminating lies and hate on X.”

He even appears willing to undermine national security programs to stop unfettered free speech. He called for the U.S. government to cut off contracts with his companies despite their critical role in various national security efforts, including the possible rescue of the stranded two astronauts currently in space. None of that matters to Reich who appears to view free speech as a greater threat to our nation: “Why is the US government allowing Musk’s satellites and rocket launchers to become crucial to the nation’s security when he’s shown utter disregard for the public interest? Why give Musk more economic power when he repeatedly abuses it and demonstrates contempt for the public good?”

Reich’s call to regulate speech in the public interest is the Siren’s Call of every authoritarian regime in history. He will presumably tell us what speech is no longer tolerable for public policy reasons.

Our “Indispensable Right” will, according to Reich, be safely in the hands of the European censors who can protect us from errant and dangerous thoughts.

As he explained earlier, “the kinds of things that we do about this is, focus less on thinking about free speech, but thinking about how the times have changed.” In this way, speech regulations can keep us “moving towards how we recommend content and … how we direct people’s attention is leading to a healthy public conversation that is most participatory.”

The “healthy public conversation” with Robert Reich increasingly appears to be his talking and the rest of us listening.

Facebook Gave CDC ‘Backdoor’ Access to Help Remove Millions of Social Media Posts

"Documents obtained by America First Legal show Facebook “was operating as the de facto enforcement arm of the U.S. government’s thought control initiative,” Reclaim the Net reported.
A bill introduced late last week in the U.S. House of Representatives would end the liability protections Congress gave vaccine makers under the 1986 Childhood Vaccine Injury Act.

Thirty Republican lawmakers signed on as co-sponsors to House Bill 9828, End the Vaccine Carveout Act. The proposed legislation would end the broad protection from liability for injuries resulting from vaccines listed on the Centers for Disease Control and Prevention’s (CDC) Childhood Immunization Schedule.

“The … vaccine makers are criminal enterprises that have paid tens of billions in criminal penalties over the past decade,” Children’s Health Defense (CHD) founder and chairman on leave Robert F. Kennedy Jr. said in a statement on the bill.

Kennedy, who has long advocated for eliminating liability protection for vaccine manufacturers, added, “By freeing them from liability for negligence, the 1986 statute removed any incentive for these companies to make safe products. If we want safe and effective vaccines we need to end the liability shield.”

CHD, React19 and The American Family Project also supported the development of the bill, the press release said.

REACT19 founder Brianne Dressen, who experienced a debilitating COVID-19 vaccine injury as a volunteer in AstraZeneca’s clinical trial, announced the bill and its co-sponsors in a post on X, formerly Twitter.

“People harmed are long overdue for a compensation process that actually works, and it’s time for the drug companies to pick up the tab,” she said.

‘Complex sham compensation program’ in place since 1986 act

Congress passed the 1986 National Childhood Vaccine Injury Act to address the risks of vaccines — which Congress and vaccine makers acknowledged had “unavoidable” side effects.

The act set up a “no-fault” system whereby instead of suing the manufacturers, people injured by vaccines can file a claim with the National Vaccine Injury Compensation Program (VICP), which adjudicates the claims.

The VICP was meant to insulate vaccine makers from lawsuits that could bankrupt them while ensuring that injury victims had a straightforward, non-adversarial and fair path to compensation.

The program is funded by a 75-cent-per-dose tax, paid by vaccine makers, for every vaccine included in the program.

The U.S. Department of Health and Human Services administers the VICP, also known as the “vaccine court.” Court-appointed “special masters” — typically lawyers who previously represented the U.S. government — manage and decide the individual claims.

The proceedings are more informal than a typical courtroom. There is no judge or jury, and the rules of evidence, civil procedure and discovery do not apply.

In practice, getting compensation through the VICP has been notoriously difficult. Critics say the program has devolved to protect government agencies and corporations rather than the health of vaccinated children.

CHD CEO Mary Holland said the 1986 Childhood Vaccine Injury Act effectively left parents and children injured by vaccines with no substantive way to get any compensation while giving vaccine makers a free pass.

“For over 35 years, parents of children injured and killed by government-recommended vaccines have been left with no meaningful redress — only a complex, sham compensation program that pits grieving families against the government, while Big Pharma enjoys no liability,” she said.

“During that same time, chronic health conditions in children — autism, ADHD [attention-deficit/hyperactivity disorder], severe allergies, asthma — have skyrocketed,” Holland said.

In some cases, people who are dissatisfied with the outcome of their case in the VICP, or who don’t get a timely decision, can sue the manufacturer for limited causes of action, such as fraud — as is the case in many of the over 200 gardasil injury lawsuits currently being argued against Merck in federal court.

Special protections for COVID drugmakers

Vaccines administered under emergency use authorization (EUA), such as the COVID-19 mRNA vaccines, aren’t covered by the VICP.

Instead, COVID-19 vaccine makers are protected from all liability by the Public Readiness and Emergency Preparedness (PREP) Act, which grants producers of vaccines, medications and medical devices total freedom from liability for any injuries arising from “countermeasures” used to address a public health or national security threat.

The PREP Act directs such “countermeasures” to be covered by the Countermeasures Injury Compensation Program (CICP).

While the FDA fully licensed versions of the Pfizer and Moderna COVID-19 vaccines for people ages 12 and up, it’s unclear if the fully licensed formulations are being administered, or if some people are still receiving EUA formulations.

COVID-19 vaccines for infants and children ages 6 months through age 11 have not yet been fully licensed — however, they were added to the childhood schedule.

Still, all COVID-19 vaccine injuries — whether from a fully licensed or EUA formulation — remain covered only through the CICP.

However, for the tens of thousands of people injured by the COVID-19 vaccine, compensation through this program has proven nearly impossible.

To date, the CICP has paid only 16 claims for COVID-19 vaccine injuries, totaling $425,301.55. Except for one payment, all of the claims resulted in compensation of $8,962 or less.

The Pfizer and Moderna COVID-19 vaccines were fully approved by the U.S. Food and Drug Administration (FDA) for people ages 12 and up, however those vaccines contin , and added to the childhood schedule, they are still not even included in the VICP process.

During the pandemic, Pfizer and Moderna generated the largest profits in history for a drug from their COVID-19 mRNA vaccines. Pfizer made $37 billion in 2021, and slightly more in 2023 from the COVID-19 vaccine alone. Moderna generated over $18 billion in profits in 2021 and $19 billion in 2022.

The most current data from the Vaccine Adverse Event Reporting System (VAERS) show that between Dec. 14, 2020, and Aug. 30, 2024, a total of 1,602,516 total adverse events related to the COVID-19 vaccine were reported to VAERS, including 37,390 deaths. There were 311,544 serious injuries reported.

Research also shows that VAERS tends to provide an underestimation of vaccine injuries. Most people don’t report their vaccine injuries to VAERS. Research also has shown that many VAERS reports are delayed or deleted from public view for reasons that are not transparent.

Several lawsuits are currently challenging the constitutionality of the PREP Act, and others have made legal arguments that the PREP Act doesn’t apply in particular cases. However, recently many of these cases have been dismissed in state and federal courts.

Last week, after the Nevada Supreme Court dismissed a case against a man injured by remdesivir, a drug covered by the Prep Act, Kim Mack Rosenberg, general counsel for CHD, told The Defender the decision highlighted “that we need legislative action to undo the damage created by acts such as PREP and the 1986 National Childhood Vaccine Injury Act.”

What the ‘urgently needed’ legislation will do

Holland said the End the Vaccine Carveout Act is “urgently needed”:

“This legislation will help end Big Pharma’s reign over government. The corrupt public-private partnership of the 1986 National Childhood Vaccine Injury Act has suppressed science, stacked the deck against families, subverted the democratic marketplace of checks and balances, and removed citizens’ rights to a trial by jury.

“Americans deserve better.”

The bill proposes to remove the requirement for vaccine-injured people to pursue compensation in the vaccine court. Under the law, someone injured by a vaccine would be able to pursue civil action against a vaccine maker, and to seek compensation through the VICP or both.

However, once a person is awarded compensation in civil court, they will no longer be eligible for compensation through the VICP.

The 1986 law also set a short statute of limitations for seeking injury compensation to two or three years of the death or injury, respectively. However, it often takes longer than that for people to realize that a vaccine caused their injury or illness.

The proposed law would allow anyone injured since the program became effective in 1988 to file a lawsuit.

Finally, the bill would end the protection from liability for the COVID-19 vaccines, allowing people injured by the vaccine to sue the vaccine makers in court.

“COVID-19 vaccines must be redefined as vaccines and not ‘countermeasures,’ so that the PREP Act’s liability carveout can no longer apply,” according to a white paper that provided justification for the bill.

"ICAN has obtained emails showing that, in 2019, Facebook was collaborating with CDC on combating so-called “vaccine misinformation.” In the emails, Facebook sends CDC language on vaccines and requests that CDC add it to its website so that Facebook could cite CDC as the source! Worse yet, the emails reveal a Facebook employee actively trying to avoid disclosure of their scheme under FOIA.
Lead Counsel, Aaron Siri, Esq., lays out the details here:
In 2019, ICAN, through its attorneys, submitted a FOIA request for CDC’s communications with Facebook. Nearly four years later, CDC has finally produced them.
In a March 2019 communication titled, “Vaccine Misinfo,” a leader of Facebook’s public policy team, Payton Iheme, asks CDC to collaborate on combatting purported health misinformation, writing: “Facebook has been working on an effort to combat health misinformation which we take very seriously…we’ll be announcing the first stage of this process which involves establishing new policies and action we’re taking against misinformation about vaccines.”
This Facebook leader also highlighting that Facebook “plan[ned] to reference the CDC along with other health organizations,” and requested a meeting to discuss the CDC’s “thoughts around our longer term goals.” CDC responded enthusiastically.
As an example of that apparent collaboration, in one incredible exchange, a public policy manager at Facebook, Jason Hirsh, emails CDC proposed language that Facebook wanted to add to its website. Hirsh noted, however, that, to cite CDC as its source, CDC had to actually add the language to CDC’s website:
[W]e have also been considering this language: “According to the CDC, ‘the benefits of vaccines are much greater than the risks associated with them. Vaccines can protect you, your family, and your community by preventing the spread of serious illness.’” Any thoughts you have about this option would be very helpful. It zooms the focus out to include single people and adults without children. For this language, we would need to add the sentences to your website. On our last call you thought that would not be an issue, but I want to confirm that this is the case. [emphasis added]
“We would need to add the sentences to your website…” Facebook incredibly sees itself as part of CDC’s “we.” When CDC’s Digital Media folks responded saying that they would send over some proposed language, Hirsh followed up, again asking: “If we all like language that generally flows from your site but is not specifically on there, do you still think it is possible to get one of the web pages modified slightly?”
CDC ultimately proposes a few language options, one of which essentially adopted Facebook’s proposed language: “Safe, effective vaccinations are the best way to protect you, your family, and your community from the serious effects of certain diseases.”
At that point CDC and Facebook have another call to “align on final language.” Even more astonishingly, Hirsh sends another email acknowledging an attempt to avoid FOIA:
In addition to the invite, given FOIA and other sensitivities, I also sent a separate note without context including our current finalist options for the inform treatment.
ICAN’s attorneys sent an additional FOIA request specifically for this “separate note” meant to avoid FOIA, which turned out to be yet more language options for CDC to choose from regarding Facebook’s communication on vaccines.
This is all incredible on many levels and ICAN will, as it always does, continue to see how deep this incredible level of collusion between Facebook and the CDC runs.

"A three-judge panel late Tuesday heard oral arguments in the landmark censorship case, Kennedy et al. v. Biden et al. The judges must decide if Robert F. Kennedy Jr. and Children’s Health Defense have standing to sue the Biden administration for colluding with social media companies to censor constitutionally protected speech.
The 5th Circuit U.S. Court of Appeals late Tuesday heard oral arguments in the landmark censorship case, Kennedy et al. v. Biden et al.

The hearing focused on two points, Kim Mack Rosenberg, Children’s Health Defense (CHD) general counsel, told The Defender. First, the 5th Circuit is considering whether to uphold a lower court’s August decision that two of the three plaintiffs — Robert F. Kennedy Jr. and CHD — have legal standing to bring the suit.

Second, it’s considering whether to uphold the Lousiana court’s injunction, which would prohibit the Biden administration from coordinating with social media companies to censor Kennedy and CHD’s social media posts until the lawsuit is settled.

The case — brought by Kennedy, CHD and news consumer Connie Sampognaro — alleges that President Joe Biden, Dr. Anthony Fauci and other top administration officials and federal agencies “waged a systematic, concerted campaign” to compel the nation’s three largest social media companies to censor constitutionally protected speech.

During Tuesday’s hearing, Jed Rubenfeld — Yale law professor and attorney for the plaintiffs — told judges, “District court called this the most massive attack on free speech in this nation’s history, and it would be shocking if no plaintiff in the country had standing to challenge it.”

Standing is the legal doctrine that requires plaintiffs to be able to show they have suffered direct and concrete injuries and that those injuries could be resolved in court.

The issue of standing shut down another related government censorship case, Murthy v. Missouri. The plaintiffs in Murthy v. Missouri — the states of Missouri and Arkansas, Drs. Jay Bhattacharya, Martin Kulldorff and Aaron Kheriaty, The Gateway Pundit’s Jim Hoft and health activist Jill Hines — argued that the censorship they experienced on social media could be tied to government action and that they were likely to be censored in the future. In June, the U.S. Supreme Court ruled the plaintiffs didn’t have standing to bring their case.

The Murthy — originally Missouri et al. v. Biden et al. — and Kennedy v. Biden cases were consolidated because they shared common legal and factual issues. This allowed them to share processes, such as discovery of evidence. However, they continued to be heard and ruled on separately.

The plaintiffs in Kennedy v. Biden are much more likely to be able to prove standing than the Murthy v. Missouri plaintiffs, Mack Rosenberg said:

“With the Supreme Court’s decision in Murthy v. Missouri in the forefront on the issue of standing, we believe that the plaintiffs in our action have clearly demonstrated standing more than sufficient to meet the requirements the Supreme Court described in Murthy in June.”

Mack Rosenberg said there is clear evidence that plaintiffs Kennedy and CHD were specific targets of censorship and that they continue to be censored. “CHD in particular continues to be deplatformed from major social media sites with no end in sight.”

She said the facts “demonstrate that the injunction issued by Judge Doughty was appropriate given the circumstances and the government’s continued actions.”

Legal battle has dragged on for over a year

Tuesday’s hearing was the latest development in a class action lawsuit brought by Kennedy, CHD and Sampognaro on behalf of more than 80% of U.S. adults who access news from online news aggregators and social media companies, primarily Facebook, YouTube and Twitter.

The suit was filed on March 24, 2023, in the U.S. District Court for the Western District of Louisiana.

The case alleged that key officials and federal agencies in the Biden administration violated the plaintiffs’ First Amendment rights by censoring online speech disfavored by the government.

According to the complaint, “the federal government’s censorship campaign has repeatedly, systematically, and very successfully targeted constitutionally protected speech on the basis of its content and viewpoint.”

Nearly a year later, U.S. District Judge Terry Doughty issued a preliminary injunction prohibiting key Biden administration officials and agencies from coercing or significantly encouraging social media platforms to suppress or censor online content containing protected free speech.

However, Doughty stayed the injunction until the U.S. Supreme Court ruled on a similar injunction in the Murthy v. Missouri case.

After the Supreme Court on June 26 ruled in favor of the Biden administration in Murthy v. Missouri, Doughty on July 9 denied two motions by lawyers for the Biden administration seeking to overturn the preliminary injunction, which was set to take effect July 7.

Less than 24 hours later, Biden administration lawyers filed an emergency motion with the 5th Circuit, seeking to block the injunction.

The 5th Circuit on July 25 sent the case back to the Louisiana District Court to decide if Kennedy, CHD and Sampognaro have standing to bring the suit. The 5th Circuit also stayed the injunction while the case was being revisited by the District Court.

The District Court on Aug. 20 gave the plaintiffs the green light to bring their suit, ruling that Kennedy and CHD had standing. Doughty concluded that plaintiff Sampognaro does not have standing.

Lawyers disagree on whether plaintiffs have standing

In Tuesday’s hearing, U.S. Department of Justice (DOJ) attorney Daniel Tenny argued on behalf of the defendants, saying that the Murthy v. Missouri decision “foreclosed” the plaintiffs’ theories on why the plaintiffs have standing.

Rubenfeld disagreed, saying that Kennedy v. Biden plaintiffs differ in key ways from the Murthy plaintiffs. First, unlike the Murthy plaintiffs, the Kennedy v. Biden plaintiffs have a “specific causation finding,” meaning there is clear evidence that “government defendants, through threats, caused the deplatforming and censorship that they suffered.”

Second, the Kennedy v. Biden plaintiffs have evidence of ongoing injury, not just past injury:

“CHD’s deplatforming — which happened a couple of years ago — is exactly the same right now, unchanged in status as it was then. In other words, the government defendants are directly responsible for the injury that CHD is currently suffering.”

“Number three,” Rubenfeld said, “we have specific evidence of, in the event of a favorable ruling from this court, a significant increase in the likelihood of our plaintiffs receiving relief.”

“That’s the established test for redressability,” he said. Redressability means that the plaintiffs’ alleged injuries are likely to be redressed if the court grants the relief the plaintiffs are seeking.

Right now there is zero likelihood that CHD will get relief, Rubenfeld said. “CHD has been litigating against Facebook for years. They have not reinstated them.”

If the 5th Circuit issues a ruling that Facebook’s actions were likely unconstitutional and that will likely be unconstitutional if Facebook keeps on doing it, “that changes [Facebook’s] incentive and that increases the likelihood that [CHD] will be reinstated.”

In their brief, plaintiffs’ attorneys also argued that Sampognaro, who is potentially immunocompromised, has what’s called “right-to-listen standing” because she needs access to accurate information about COVID-19 and possible treatments, and the censorship has obstructed that access.

Tenny urged the court to continue blocking the District Court’s injunction. Rubenfeld argued the injunction is needed because U.S. governmental agencies are “still today” trying to influence social media platforms “to suppress speech that they deem, they call misinformation.”

He added, “But we have seen over and over again that what they call misinformation often doesn’t turn out to be misinformation and turns out to be protected speech.”

The DOJ declined The Defender’s request for comment on Tuesday’s arguments.

David Icke banned from the Netherlands 🇳🇱 for another 2 years: 'Totally absurd, insane, bizarre':

The Dutch 🇳🇱 government has announced plans to ban speaker and author David Icke from entering our country for another two years, because he has not revised his ideas. Wrongthink. Only when he changes his ideas will the ban be lifted. Icke speaks on X of an extreme ban and extreme censorship. This includes 'conspiracy theories' (which ironically are confirmed in this way) that the world is run by a network of secret societies. Furthermore, the government notes that Icke called Covid a hoax. "It was," he says. They can go to hell, said Icke.

The Dutch 🇳🇱 government has announced plans to ban me from nearly 30 Euro countries for ANOTHER TWO YEARS because he has ‘NOT CHANGED HIS VIEWS’. The first two-year ban ends in November. I wonder if the mainstream hijack of the ‘alternative’ media might at last have something to say about this having virtually ignored the first ban. Even Toby Young and his ‘Free Speech Union’ tittered not a word.

And yet what we have here is the most extreme of bans and censorship with the implication that I must ‘change my views’ before the ban is lifted or it will be indefinite. These views include any ‘conspiracy theories’ (which have proved to be true as this ban ironically confirms) and that the world is controlled by a network of secret societies that I call the Global Cult. The government missive also notes that I have called ‘Covid’ a hoax which it was.

They demand that I change my views on this and so much more, but they can stick it where the sun never shines – especially when the Netherlands 🇳🇱 is among the European centres of the Cult. The government – of course – presents no evidence that what I say is not true.

I am banned from all countries of the Schengen border group on the basis of banned from one means banned from all and as many other countries use the Schengen criteria for allowing entry I am actually banned from many more.

The first ban was imposed in 2022 when I accepted an invitation from a Jewish friend in the Netherlands to speak for 20 minutes at PEACE RALLY in Amsterdam. Exception to this was taken by the Dutch-based Center for Information and Documentation Israel (CIDI) which claims to be ‘dedicated to combating antisemitism and spreading awareness of the Israeli-Palestinian conflict’ (very balanced ‘awareness’ naturally). CIDI’s ‘mission’ is to ‘safeguard the rights of Jewish people to a peaceful and secure existence, in Israel and around the world’.

To get the drift of ‘CIDI’ see the US Anti-Defamation League (ADL) and the Australian Anti-Defamation Commission which led the campaign to impose my ongoing ban from Australia. The ‘Commission’ was founded by the infamous B'nai B'rith that also founded the ADL. You get the picture. B'nai B'rith was founded in New York in 1843 by German Jewish immigrants and claims a ‘backstage role’ in the Rothschild-driven Balfour Declaration that led to the establishment of Israel.

The biggest party in the Dutch government is headed by fake ‘alternative’ hero and Israel-firster Geert Wilders (who blocked me on Twitter/X) and the Prime Minister installed by Wilders is the UNELECTED Dutch intelligence chief Dick Schoof. Until he became PM in July, Schoof was secretary-general of the Ministry of Justice and Security which was directly responsible for the first ban and for the planned extension.

The then hilariously termed ‘Minister of Justice and Security’, the Turkey-born Dilan Yeşilgöz, used parliamentary privilege to dub me a ‘Jew hater’ as part of an extraordinary and coordinated campaign of demonisation in which the Dutch media played a central and predictably disgraceful part.

How telling it is that while I have been banned from most of Europe the mainstream hijack of the ‘alternative’ media – including Carlson, Rogan, Brand, Owens, Musk, Oliver, etc, etc. – remained silent and while these ‘defenders of freedom’ are banned from nothing and nowhere I face another two years – indefinite in truth – banned from basically Western Europe, plus Australia and more besides.

It might be worth asking what I am saying that they are not saying which makes governments so terrified of a bloke from the Isle of Wight that they go to these lengths of what can only be described as fascism.
