Federal agents subjected a farmer to harassment and warrantless searches simply for producing raw milk, but a county sheriff took the farmer’s side and blocked federal agents from the property – and the sheriff is now speaking out.

The US Food & Drug Administration (FDA) and Department of Justice (DOJ) took the actions four years ago simply because the farmer was providing raw milk to an organic food co-op. The story is receiving renewed coverage because the Indiana sheriff, Elkhart County’s Brad Rogers, wrote a 600-word explanation for a local newspaper as part of his “Ask The Sheriff” series. Off The Grid News previously reported on the dispute.

Participants paid money into the co-op and, in return, received raw milk.
“It appeared to be harassment by the FDA and the DOJ, and making unconstitutional searches, in my opinion,” Rogers wrote of Uncle Sam’s treatment of the farmer in a column for the Goshen News.

Rogers said he became involved in the case in 2011 when the farmer complained to him.
“Specifically, the FDA was inspecting his farm without a warrant as much as every two weeks,” Rogers wrote. “Typical inspections occur annually. The Department of Justice (DOJ) had subpoenaed him for a grand jury in Michigan in which he was to bring his production documents. The Feds wanted to make this farmer an example.

“My research,” Rogers added, “concluded that no one was getting sick from this distribution of this raw milk. It appeared to be harassment by the FDA and the DOJ, and making unconstitutional searches, in my opinion. The farmer told me that he no longer wished to cooperate with the inspections of his property.”
Sheriff Confronts Feds

The sheriff then emailed a lawyer at the Department of Justice, writing:
“I understand that you have made recent requests to (the farmer) for documents and to appear before a grand jury, and he has had a number of inspections and attempted inspections on his farm within Elkhart County. This is notice that any further attempts to inspect this farm without a warrant signed by a judge, based on probable cause, will result in federal inspectors’ removal or arrest for trespassing by my officers or I. In addition, if any further action is taken by the federal government on (the farmer), while he is in Elkhart County, I will expect that you or federal authorities contact my office prior to such action. I will expect you to forward this information to your federal associates, including the FDA.”

Shortly after the email was sent, the farmer received a certified letter from the DOJ that said his grand jury subpoena had been cancelled. No federal inspectors have visited the farm since 2011.
“Your local elected officials … can stem the tide of federal overreach if they apply just a little backbone in supporting and defending the Constitution. Expect it! Demand it!,” Rogers wrote. “Some bloggers and natural food writers have hailed me as a hero. I’m no hero. I’m just doing my job.

“Whether you are conservative or liberal, I will be a guardian of the Constitution for you, and will not stand idly by while the rights of citizens of my county are trampled, whether by criminals or an overreaching government.”
Rogers also said the government has no business preventing people from drinking raw milk.

“Many of our parents/grandparents drank raw milk and survived,” he wrote. “There are risks with raw milk, but careful handling and storage will mitigate the risk. Many people believe that raw milk is healthier to drink than the pasteurized version. There is no law in Indiana that prohibits the distribution of raw milk in this fashion. In short, I don’t believe the government should be our nanny and telling us what we can or cannot drink/eat.”

Sheriffs just happen to be the most powerful and independent locally elected official, and can be a bulwark for resistance to federal encroachment.

If they can be stopped here, they can be stopped elsewhere, too, and freedom can return to the lives of Americans.

The feds cannot take over if the people educate themselves and stand up – peacefully, but with a firm defensive posture – and take no guff from a bully.

Althena, thanks for showing me that I have become to jaded in my position of "all things government". It is refreshing to see someone actually stand up for the citizens and do the righteous thing.

It is my understanding that the local sheriff is the most powerful person, legally, in the given area. Over that of FEDs or state.

This is due to the origins of the situation, it is called 'the UNITED states'. ie, 50 separate states. United.

In the given jurisdiction, the feds and the state have to gain permissions and/or assistance from the local sheriff before attempting any form of legal action or act that involves physicality in the given area of potential dispute.

Anything else can result in a case which can be dismissed by a court of law as being faulted from the get-go. Ie, potentially enough for a court dismissal of charges.

My writings here are not entirely 100% correct, but you get the idea.

The dropping of the pursuit of the farmer, due to intervention by the local sheriff, this illustrates the heart of the legal matter, directly. It is not one that the feds want spoken of, nor understood by anyone.

The federal government was created, originally, for the ability of the group of united states to have representation on the international front. which is why they have unbridled secretive executive power invested in the president, and who also has no jurisdiction over legal matters on the 50 state landmass. this is to protect the people from a given hydra and oligarchy or fascism that may attempt to arise from and in the federal offices.

The Federal controllers and incumbents... have had to be content for the past 250 years, in using the 50 state stolen energies and resource... as a method of attacking the rest of the world, via the federal arms, ie, army, navy, air-force, CIA/OSS, and so on.

That's it. That's all it was for. After that, it slowly came to being a multi-headed hydra, as it attempted to take over all the independence of the people in the separate but individual united states.

Note clearly - the constant, constant, constant.. forced attempts to have the federal offices take over the 50 states entirely, and be a single executive oligarchy/fascist/rulership of all of the lands, people, and resources of the 50 state co-operative.

The executive offices of the president, as tied to the oligarchy who put the given president into office and controls that given individual.... those groups are always attempting to find ways to create or hold onto declared states of emergency for the united states, as this gives them, by law, total secrecy and no oversight of any kind, along with unbridled dictatorial powers within the united states. This state of emergency declaration, has forced unbreakable time limits, before it has to be renewed by a specific set of rules and motions. This is designed to prevent the rise of dictatorial oligarchy. Over 200 years later, they find ways around it. They inch the system to death, in their efforts to control the USA.

One should spend some time on the net to find out if the USA is in a national 'state of emergency', and they will invariably find that it is almost always in a state of emergency, and as this problem of rising oligarchy and fascism in the USA has moved forward in agenda and intensity, so has the level (number of occasions) of declarations of emergency for the country, by the executive offices of the presidency.

Thanks for posting this story, Althena. It's really nice to see some sheriffs standing up to the unconstitutional jurisdictional violations of the fedgov, which Cliven Bundy has repeatedly pointed out by citing Article 1, Section 8, Clause 17 (http://press-pubs.uchicago.edu/founders/tocs/a1_8_17.html) of the united States' Constitution.

However, it appears that some constitutional sheriffs are being attacked like Grant County Oregon Sheriff Glenn Palmer (http://oregonsheriffs.org/oregon-sheriffs-by-county/grant-county/) who was the sheriff that LaVoy Finicum was trying to drive to.

I grew up on raw milk even though I was born and raised in New York City. My mother had certified raw milk delivered to our house from a New Jersey farm every day until I was 8 years old. I will never forget how awful regular milk tasted when she decided to economize and stopped ordering the real deal. Althena thanks for posting this story. It is important to know the power of local sheriffs.

I've been searching for real milk for a couple of weeks now and found that the only people that sell it are 70 miles away from here. Sigh...

We need more Sheriff like Brad, and support our farmers, I'm sure to drink raw milk is healthy , But processed milk from cows feed with gmo's pellets and gmo pasture must be very dangerous.

In my state, Alabama, raw milk can be purchased, but it must be labeled for pet consumption only. Absurd!

My first taste of raw milk was weird. As a city boy I loved whole milk, which my country granny called Sweet Milk. We visited grannie's relatives on the farm and I was offered milk to drink. It was warm and had the fat separated. It didn't look like milk to me! haha. The next time my great-aunt chilled it and stirred it up. I learned to love it.

Sadly processed diary is no longer true food. Pasteurization and homogenization ruin it completely.

What we all need to realize is that these agencies/organizations like the FDA overstep their bounds, telling us what we can and can't do. They do it because they can. We think that they can. Really, all they can do from their research is "recommend" or "suggest" what we should do. The rest is our decision. We need to put them in their places.... quickly.
