Christof Lehmann (nsnbc) : Turkey’s Constitutional Court annulled legislation that prohibits all sexual acts with minors under the age of 15 as sexual abuse. The Court’s ruling caused outrage among rights activists and academics. A study conducted by researchers at Gaziantep University revealed that one in every three marriages in Turkey is a child marriage.
CHILD_BRIDE_TURKEYThe Constitutional Court ruled on the issue after a district court complained that the current law does not discriminate between age groups in cases of child sex abuse. In practice, the law makes no difference regardless whether an adult has sex with a 14-year old or a 4-year old.
The district court noted that the law does not provide legal consequences for the “consent” of victims in cases where the child victim is from 12 to 15 years of age and able to understand the meaning of the sexual act.
The District Court added that: “This creates an imbalance between legal benefits and sanctions that should be preserved in crime and punishment”. In a 7 – 6 decision the judges at the Constitutional Court agreed with the District Court and annulled the provision. The new (old) rules will come into effect on January 13, 2017.
The ruling prompted protests from women’s rights activist, child rights activists as well as from prominent academics who stress that all persons under the age of 18, under international conventions to which Turkey is a party, are children.
Nazan Moroğlu, the coordinator od the Istanbul Women’s Association and lawyer criticized the Constitutional Court for even considering the District Court’s application in the first place. Moroğlu stressed that the ruling will lead to children being vulnerable to sexual abuse and rape and will lead to more female children getting married at an early age without getting an education.
She added that the problem with child brides is already acute in Turkey, noting that there are some 3.5 million of them already and that the ruling guaranteed that their numbers will increase.
Sabit Aktas, the head of the Child Rights Center of the Ankara Bar Association, warned that many children will be affected and suffer due to the Constitutional Court’s decision. Aktas said:
“We can foresee what this decision will bring about. Those jurists who are distant from society in their ivory towers should go to courtrooms to see and hear what those children go through when describing their experiences. They should only make a ruling on this issue after doing that”.
In 2013 the Turkish AKP government under the then Prime Minister R. Tayyip Erdogan adopted the so-called 4+4+4 educational system for Turkey. A large number of Turkish experts in social sciences and education stressed that this new educational law especially encourages young Turkish girls to leave school at a very early age rather than seeking education.
Statistics from 2013 showed that 853 women were murdered in the last four years; 15% of them were killed because they wanted to divorce, 66% were killed by their ex-husbands or boyfriends. 12.5% were killed by their husbands, even though they filed a complaint and were provided with protection by the state. Violence against women in Turkey is more prevalent in the countryside where girls more often are taken out of school at an earlier age and where child marriages are more common.

In January 2014 one 14-year-old teenage girl died from “several” allegedly self-inflicted gunshot wounds in what was declared a suicide. Police investigations suggested that the girl may have been as young as ten or eleven years when she was married away to a significantly older man. In July 2014 the 15-year-old Seter Aslan succumbed to a gunshot wound in what was declared a suicide.

This is almost worse than when catholic churches disallow birth control to try and make more catholics.
What's going on here really, I wonder? Are they trying to encourage kids to have kids? :(

In new Hampshire USA the legal age for a girl to marry is 13 (and thereby fully legalizing sex at that age). This isn't new though - it's always been this way.
In Canada (for sex) it's technically 14, but a statute that went in to place in 2008 (which I don't think has been active the entire time since then) raises it to 16 for most cases where an adult is involved. A 14yr old can have sex with a 16 year old or a 15 year old, but not a 17 year old -- a two year difference is max from 14 until 18; this system seems to make good sense.

I suppose the truth of it is that children have sex--they always have--some start early some don't.
Females are probably at their most fertile around the age of 14, if I recall correctly.
Hormones hormones hormones.---male and female.
Its a wonder anyone gets to the age of 18a virgin.
In some countries and eras life expectancy was so low it made sense to have children at a young age and as many as possible.
Taking advantage of a young child is a different thing altogether.

At 12 or 13, most of the time, the body is not ready yet to have sex, and certainly not to have children, while it is almost always around 16 for girls. But who cares hey!!

And, I know of NO GIRL, NONE, I MEAN NONE, who had sex at 13 or less and enjoyed any part of it. Most of the time they hated it, but won't tell to look cool, and are somewhat traumatised. This is substantially less frequent at 16 (I spoke openly with most teenagers when my daughter grew up, and believe me, this is the picture).
As for boys, it may be quite different.

I agree Flash I am not condoning I hi lighted the qualifier.
I supose I should have said young teen rather than child---which is what I really meant----I was virgin till I was 18. boys in the same class at age 14 boasted that they had done ir--I did not believe them--but thats just me.

ooooof this is a polarising subject! Everyone reaches puberty at different ages; for some it may be as early as 7 and for others it may be as late as 17-18 - the average is around 12-13 yrs. Physical maturity is one thing, what about emotional maturity?
If we were honest about this tho, many start experimenting with sex at around puberty, or even earlier (just not usually with adults!)
In some Pacific Island, Asian and tribal cultures, it's considered quite "normal" for an older family member to "physically teach" a younger family member about the "birds and the bees" (altho this is rarely talked about to outsiders); this is usually determined when that person reaches puberty.
The ancient Samurai of Japan also taught their "young trainees" (some very young) in ahem,... more than just martial arts and sword play, shall we say?
(In all of the above it is generally consenting).
According to the first 2 post's links, this was quite common practise globally until about a Century ago.
But no age limit??? No way!

There is a grey area around sexual activity , primary children must be protected.
Also teenagers and young adults from grooming and abuse from older adults.
The grey area is peer pressure and natural inquisitive exploration between
underage adults themselves. Teenage pregnancies and sexual contact is
and always has been unavoidable for some. The years from puberty to
16/17/18yrs when various things become legal can be traumatic , confusing
and embarrassing for many while others take it in their stride , its all part
of growing up.
Its a difficult area especially between different cultural groups. But the
protection of children and the understanding of teenage awakening
is always going to bring it problems.

Every culture has differenct approaches on minimum age, but as a turkey citizen, i can say that we have lots of black propaganda since the failed coup attempt which has been led by Gulen/Cia movement.
As you can see, the more turkey moves away from europe we will see more news like that.
Turkish laws say that minimum age for marriage and other things is 18 for both women and men, and there is no ongoing process aobut lowering that age.

Turkey and Sweden have found themselves on the brink of a diplomatic debacle, after Sweden's Foreign Minister triggered a storm with a tweet that accused Ankara of "legalizing sex with underage children."
Following a bitter diplomatic row on the web, Sweden's ambassador was summoned to the Turkish Foreign Ministry, Swedish national broadcaster SVT (http://www.svt.se/nyheter/utrikes/turkisk-protest-mot-wallstrom) reported. "It is scandalous for a foreign minister to post such a tweet based on false information or speculation," Turkey's Foreign Minister Mevlut Cavusoglu said in televised comments, explaining the decision to summon the Swedish envoy.
Earlier, Swedish Foreign Minister Margot Wallström had used her official Twitter account to call on Turkey to reverse its "decision to allow sex with children under 15." The tweet was later lambasted by her Turkish colleague Cavusoglu as "unacceptable." He also slammed Wallström for irresponsible behavior, as well as spreading lies and slander.
In the follow-up to the Twitter squabble, Turkey's Deputy Prime Minister Mehmet Simsek told Wallström: "You are clearly misinformed. There is no such stupid thing in Turkey. Please get your facts right."

Remarkably, this is not the first time veteran diplomat Margot Wallström, arguably Sweden's best-known politician and former EU commissioner, has landed in hot water. In 2014, her very first step in office as Sweden's foreign minister was to recognize Palestine as a state and immediately soured Stockholm's relations with Israel. Subsequently, Wallström was pronounced persona non grata.
In 2015, Wallström's outspoken criticism of Saudi Arabia's human rights record as "medieval" led to another diplomatic row, whereupon Riyadh recalled its ambassador in Stockholm. The Saudi-Swedish quarrel is estimated to have cost Swedish arms manufacturers millions in lost contracts.
Wallström's overtly "feminist" stance caused anxiety in Swedish business circles.
Also, tensions ran high with Morocco after Swedish parliament voted to recognize Western Sahara as an independent republic, which was a former Spanish province under Moroccan control since 1976. However, the Swedish government later reversed the recognition, following political and economic pressure from Rabat.

Something to think about that for all those people bashing the Turkish courts for their decision to draft a more sensible law. How sensible that new law will actually be, however, remains to be seen.

I just recently read that Obama signed some law to make age of consent is 13 in USA, and I believed it, and then found out it was false from Snopes! *shame*
Way to give me a heart attack :)
