Another slap in the face to the average citizen by the federal appellate courts, including the SCOTUS—again.

Discovery is one of the most fundamental rights to litigants in civil lawsuits. All lawyers start with written discovery, including written interrogatories. The answers, or non-answers, to written interrogatories are just one step in the process leading to a deposition. Never, ever, can a litigant avoid being deposed because she answered written interrogatories. (Especially when the answers were given in a different case.) That is unheard of until HRC, Barry Sotero et al. came along.

Answers to interrogatories are always evasive or incomplete. Especially when coming from people hiding something, as is the case here. Depositions, where you sit down stare the person in the eyes and ask questions face to face, are used to dig down on the answers, to follow up and try to get to the truth of the matter.

There is no justice in the US for the 95% of us not privileged by wealth and power, and protected by corruption.

Reminds me of one time a friend in highschool was being bullied terribly by the calculus teacher, that guy was a total bully to a lot of students. So one day my friend had enough and replied back to the teacher, then the guy, who was kind of big and tall stood up from his desk and walked towards my friend and while standing in front of him said "i have you on my sight..." and my friend without skipping a beat looked up and said "and i have you on mine... 'sr'" and his eyes were in fire, total maniac as if ready for anything.

The face of the teacher was hilarious, he returned silently to his desk and did not say another word, then the class continued as if nothing had happened. Don't remember ever seeing that teacher bully my friend again :)

ETA: Perhaps because i'm a bit crazy, but i do derive a bit of enjoyment when i see someone on a power trip that thought they would have it easy, slowly be stripped of their fake power and eventually turn into some simple random, powerless person in a cop uniform cosplay.

Supreme Court Justice Thomas Suggests
Facebook, Twitter Could be Regulated Like Utilities

NTD reports:

"Supreme Court Justice Clarence Thomas appeared to signal that Big Tech firms could be regulated after Facebook and Twitter suspended President Donald Trump earlier this year.

Thomas, considered a conservative on the high court, made the point during a 12-page submission as the Supreme Court issued an order that rejected a lawsuit over Trump’s blocking of certain Twitter users from commenting on his posts before his account was taken down. The Supreme Court said the lawsuit ultimately should be dismissed as Trump isn’t in office anymore and was blocked from using Twitter, coming after the Second Circuit Court of Appeals had ruled against Trump.

“Today’s digital platforms provide avenues for historically unprecedented amounts of speech, including speech by government actors. Also unprecedented, however, is control of so much speech in the hands of a few private parties,” Thomas wrote Monday (pdf). “We will soon have no choice but to address how our legal doctrines apply to highly concentrated, privately owned information infrastructure such as digital platforms.”

Thomas also noted there are arguments suggesting digital platforms such as Twitter or Facebook “are sufficiently akin to common carriers or places of accommodation to be regulated in this manner.”

Thomas made reference to the respective owners of Facebook and Google by name—Mark Zuckerberg, Larry Page, and Sergey Brin.

“Although both companies are public, one person controls Facebook (Mark Zuckerberg), and just two control Google (Larry Page and Sergey Brin),” he wrote.

Thomas agreed that Trump’s Twitter account did “resemble a constitutionally protected public forum” in certain aspects, he noted that “it seems rather odd to say that something is a government forum when a private company has unrestricted authority to do away with it,” possibly referring to Twitter’s ban against Trump following the Jan. 6 incident.

“Any control Mr. Trump exercised over the account greatly paled in comparison to Twitter’s authority, dictated in its terms of service, to remove the account ‘at any time for any or no reason,’” he added. “Twitter exercised its authority to do exactly that.”

Thomas then said that modern technology isn’t easily addressed by existing laws and regulations. But he warned that the Supreme Court may “soon have no choice but to address how our legal doctrines apply to highly concentrated, privately owned information infrastructure such as digital platforms.”

“The Second Circuit feared that then-President Trump cut off speech by using the features that Twitter made available to him,” Thomas said. “But if the aim is to ensure that speech is not smothered, then the more glaring concern must perforce be the dominant digital platforms themselves. As Twitter made clear, the right to cut off speech lies most powerfully in the hands of private digital platforms. The extent to which that power matters for purposes of the First Amendment and the extent to which that power could lawfully be modified raise interesting and important questions.”

Thomas noted that Big Tech firms have a vast amount of power over the flow of information—even books. He said it does not matter that Amazon, Facebook, Twitter, and others are not the only ways in which to distribute speech—as long as their power to do so is unequaled.

“A person always could choose to avoid the toll bridge or train and instead swim the Charles River or hike the Oregon Trail,” he wrote. “But in assessing whether a company exercises substantial market power, what matters is whether the alternatives are comparable. For many of today’s digital platforms, nothing is.”"

NY State Senate Passes Draconian Bill

Passed by New York state senators, draconian NY State Assembly Bill A416 states the following:

“Upon determining by clear and convincing evidence (sic) that the health of others is or may be endangered (sic), the governor may order the removal and/or detention of such…person(s) or group of such persons by issuing a single order (sic).”

“Identifying such persons either by name or by a reasonably specific description of the individuals or group being detained,” they shall be indefinitely be held “in a medical facility or other appropriate private facility.”

The measure targets individuals unwilling to self-inflict harm by hazardous to health covid jabs.

If taken, they risk contraction of the illness they’re supposed to protect against — but don’t.

They also risk possible irreversible harm to health or death if taken as directed.

If New York Governor Cuomo signs this draconian measure into law, and if similar measures are adopted by other states and/or congressional legislation is passed and signed into law on this issue, preserving and protecting health by refusing to be jabbed with experimental, unapproved, toxic drugs could be considered the equivalent of a criminal offense.

Involuntary/indefinite detention if ordered will become de facto concentration camp imprisonment.

Under federal law, experimental drugs cannot be mandated.

The Nuremberg Code requires voluntary consent on matters relating to human health.

It prohibits mandatory participation in medical experiments.

Procedures must yield positive results that benefit individuals and society.

None of the above applies to mass-jabbing with toxic, experimental drugs that don’t protect and risk serious harm to health or death.

Under NY State Assembly Bill A416, healthy individuals and ones they came in contact with can be labeled “disease carriers” — by politicians, their public heath handmaidens, and/or go-along judicial authorities.

Longterm involuntarily detention may follow under draconian conditions able to destroy health.

If in the “opinion of (New York) governor” Cuomo or his minions, anyone considered a public health threat — even when healthy threatening no one — can be forcibly interned against their will.

According to the International Covenant on Civil and Political Rights (ICCPR):

“Everyone has the right to liberty and security of person.”

“No one shall be subjected to arbitrary arrest or detention.”

“No one shall be deprived of his (or her) liberty except on such grounds and in accordance with such procedure as are established by law.”

“Anyone arrested or detained on a criminal charge shall be brought promptly before a judge or other officer authorized by law to exercise judicial power and shall be entitled to trial within a reasonable time or to release.”

“Anyone who is deprived of his liberty by arrest or detention shall be entitled to take proceedings before a court, in order that that court may decide without delay on the lawfulness of his (or her) detention and order his release if the detention is not lawful.

“Anyone who has been the victim of unlawful arrest or detention shall have an enforceable right to compensation.”

Depriving individuals of liberty for refusal to self-inflict harm by jabbing with hazardous drugs is a flagrant breach of international law.

Is that where things are heading in New York?

Is something similar coming in other states, possibly nationwide in the US?

Will rule of law protections no longer apply when conflict with federal, state or local diktats?

Is guilt by accusation the new standard?

If NY State Assembly Bill A416 and similar measures are adopted in the US, rights guaranteed by international law and the Constitution no longer will apply.

Tyranny enforced by police state harshness will be the new standard — including indefinite detention of anyone accused of virtually anything no matter how untrue.

What’s going on in the US and West ominously resembles how the scourge of Nazism imposed tyrannical rule in Germany.

Is that where things are heading?

Fundamental rights are disappearing in plain sight while Americans and others in the West are distracted by bread, circuses, and establishment media propaganda.

I just checked the state Assembly page and they say it is still in committee. It's been in committee since 2015. Read another article that said that it is viewed as a crackpot bill and would never pass, although I think that is saying a lot, as that statement was made in January of this year. The situation will get more dire and perhaps it will move out of committee then. But when it does, I think it will be mainstream news.

Texas Gov. Greg Abbott signed an executive order on Tuesday that bans state government and some private business from requiring coronavirus vaccine passports to access services.

Why it matters:

Texas is the latest state to prohibit coronavirus immunization credentials as Republican governors rally against the proof of vaccination in the name of personal freedom and privacy. Such records could possibly speed international travel and economic reopening plans.

Context:

Florida Gov. Ron DeSantis banned the use of immunization credentials last week, saying they "would create two classes of citizens based on vaccination."

The Texas order prevents state agencies and political subdivisions, as well as public and private organizations that receive public funding in the state from requiring people to show they've been inoculated against the virus to receive services.

How have people forgot that we get colds and flues? They constantly change. That's why there has never been a vaccine, or more acceptable "a cure for the common cold". They are not all engineered bio weapons. But I am sure that is how the new narrative will be put out.
