When it comes to the elections, state's rights supercede the federal government. The electoral college is all about supporting democracy through a republic. It may be a weird, uneven system, but it was designed within that framework. Trying to throw a monkey wrench into the powers of the state versus the federal govt. through appeals to the supreme court, wouldn't work. It would trigger a greater legal problem.
It's a federal election, you are very incorrect here.
The SCOTUS passed judgement on Florida's procedures in 2000 (Bush v Gore), and many other times....
Quote:
Bush v. Gore, case in which, on December 12, 2000, the Supreme Court of the United States reversed a Florida Supreme Court request for a selective manual recount of that state’s U.S. presidential election ballots. The 5–4 decision effectively awarded Florida’s 25 votes in the electoral college—and thus the election itself—to Republican candidate George W. Bush.
The constitution out lines and restricts the federal powers per the 10th amendment, reserving all powers not described in the constitution to the states.
The federal election process and electoral college are described in the constitution and the SCOTUS has already voted on elections before, there is precident... so I don't know where you got this very wrong information from.
