    British tribunal recognizes Wikileaks as media organization

    Julian Assange's WikiLeaks has been recognized as a "media organization" by a British tribunal, a ruling which may help Assange's defense against extradition to the United States, on press freedom grounds.

    The UK's information tribunal, which is roughly equivalent to a court, published a ruling on Thursday that stated:
    "WikiLeaks is a media organization which publishes and comments upon censored or restricted official materials involving war, surveillance or corruption, which are leaked to it in a variety of different circumstances."
    The tribunal, headed up judge Andrew Bartlett, QC, made the comment under the heading "Facts," according to the Guardian.

    The US has been seeking to prosecute Assange since 2010, when WikiLeaks published hundreds of thousands of confidential US defense and diplomatic documents. US attorney general Jeff Sessions said in April this year that the arrest of Assange is a priority.

    The US disputes Assange's media credentials, and the issue of whether he is a journalist or a publisher would be one of the main battlegrounds, in the event of the US seeking his extradition from the UK.

    After leaks of emails from the US Democratic party and from Hillary Clinton, CIA director Mike Pompeo described WikiLeaks as "a non-state hostile intelligence service often abetted by state actors like Russia." He added Assange is not covered by the US constitution, which protects journalists.

    Assange remains holed-up in the Ecuadorian embassy in London, where he has been granted diplomatic asylum.

    The tribunal's definition of WikiLeaks comes in a summary into a freedom of information case heard in London in November. An Italian journalist, Stefania Maurizi, is seeking the release of documents relating to Assange, mainly in regard to extradition, and had lodged an appeal with the tribunal.

    While the tribunal dismissed Maurizi's appeal, it acknowledged there are issues weighing in favor of public disclosure in relation to Assange. It added, however, these are outweighed by a need for confidentiality on the matter of extradition.

    The UK Crown Prosecution Service (CPS) and the US justice department have refused to confirm or deny whether they have discussed the extradition of Assange, the Guardian reports.

    The Ecuadorian embassy has spoken out following rampant speculation about the
    health and whereabouts of Julian Assange after his recent cryptic tweet.


    The concern was sparked by the WikiLeaks founder sending a bizarre tweet on New
    Year’s Day which featured a 60 character code and a link to the popular ‘Paper
    Planes’ song by British rapper MIA. Many wondered why the 46 year old had
    tweeted the seemingly random string of letters and numbers.

    Victory for Assange: Court of Human Rights orders safe passage of Wikileaks founder out of embassy

    The Inter-American Court of Human Rights based in Costa Rica is a multinational independent judicial body which handles court cases relating to the human rights of individuals in or effected by the laws of the members states of the Organization of American States (OAS). At present the OAS is comprised of every North American, Central American and South American nation, although Venezuela has expressed a desire to withdraw from the body.

    Today, the Court ruled that it is the duty of nations to allow for the passage of successful asylum seekers from embassies to the mainland territory of the state that has granted an individual asylum. For Julian Assange, this would mean that according to the Court's decision, Britain has a legal obligation to allow Julian Assange to exit the Ecuadorian Embassy in London in peace and allow for his safe transit to an airport from which he would be able to fly to Ecuador, the country that has granted Assange asylum and where he now also holds formal citizenship.

    Relevant portions of the press release from the Court can be read below:
    "The Court interpreted the reach of the protection given under Article 22(7) of the American Convention on Human Rights and Article XXVII of the American Declaration on the Rights and Duties of Man, which recognize the right to seek and receive asylum in a foreign territory. In particular, the Court declared upon the relative issue of whether this human right protects both territorial asylum and diplomatic asylum.

    Similarly, the Court determined the human rights obligations of Member States of the Organization of American States regarding the host country and, in this case, for third States, in virtue of the risk that persons seeking international protection could suffer, which was the reason for the principle of non-refoulement.

    Starting with the inclusion of the term "in a foreign territory" within the instruments, (which clearly refers to the protection derived from territorial asylum as opposed to diplomatic asylum), and in an analysis of the preparatory work of the American Declaration regarding the choice of the States to omit the concept of diplomatic asylum as a protected classification under such human rights norms, the Court held that, given the protections enshrined by Article 22(7) of the American Convention and Article XXVII of the American Declaration, the right to seek and receive asylum can be contemplated as a human right to seek and receive international protection in a foreign territory, including refugee status under the relevant United Nations instruments or corresponding national laws as well as territorial asylum under the different Inter-American conventions on the topic.

    Similarly, the Court concluded that the scope and breadth of diplomatic asylum should be governed by the appropriate interstate conventions and the provisions of internal legislation, considering that the States have the sovereign right to choose whether to grant such asylum.

    In addition, the Court emphasized that the general obligations established by the American Convention are applicable to the conduct of diplomatic agents deployed to the territories of third States, whenever the nexus of personal jurisdiction can be established with the particular person. In this vein, the Court considered that the ambit of protection against refoulement (that is, the prohibition on sending a person back to the territory in which their life, integrity, security, and/or liberty may be at risk due to persecution or threat of persecution, generalized violence, or massive human rights violations, among others, as well as where they run the risk of being subjected to torture or other cruel, degrading, or inhuman treatment, or to a third State from which they could be sent to a territory where they could incur these risks) is not only limited to persons who may be found in the territory of the State, but also obliges States extraterritorially whenever authorities exercise their authority or effective control over such persons, as may happen in legations, that, by their own nature, may be in the territory of another State with that State's consent and authorization.

    The Court added that host States under whose jurisdiction the person falls who had requested protection in diplomatic headquarters have the obligation to adopt positive measures regarding an individualized evaluation of risk, such as the opportunity of a personal interview or a preliminary evaluation of the risk of refoulement, as well as the obligation to adopt adequate means of protection, including those against arbitrary detention.

    Thus, States must arbitrate all the necessary means to protect persons in the event of a real risk to their life, integrity, liberty, or security if they were sent back. Similarly, since the legal status of the person cannot stay in limbo or be prolonged indefinitely, States must adopt measures which expedite suitable safe passage, which is why the Court recalled that the duty of cooperation between States in the promotion and observance of human rights is an erga omnes norm".
    If the UK continues to ignore the court's decision by insisting that local police will arrest Assange for a breach of bail conditions if he leaves the embassy, this means that the British government will have wantonly failed to uphold Assange's rights as a legitimate receiver of asylum by Ecuador.

    While London has yet to respond to the Court's ruling, it is imperative that Assange is allowed to make the safe passage to Ecuador demanded by the Court as his physical and mental health conditions have been described as deteriorating rapidly.

    Craig Murray has very helpfully cleared up an astounding piece of 'fake news' published by the Guardian recently and identified it as such on a recent blog entry.

    Craig has over the years been a close supporter of Julian Assange and was himself, up to a point, privy to as-near-as you can get first hand knowledge that the true source of, or story behind, the Hillary Clinton/John Podesta hacked (sic) emails were in fact that they were not hacked at all, but leaked by a DNC insider.

    UPDATE One reason I was so stunned at the Guardian’s publication of these lies is that I had gone direct from the Ecuadorean Embassy to the Guardian building in Kings Cross to give an in-depth but off the record briefing to Euan MacAskill, perhaps their last journalist of real integrity, on the strategy for Julian. I told Euan that Russia was ruled out. I did not mention this yesterday as I greatly respect Euan and wanted to speak to him first. But on phoning the Guardian I find that Euan “retired” the day the lying article was published. That seems a very large coincidence.

    I am just back from a family funeral – one of a succession – and a combination of circumstances had left me feeling pretty down lately, and not blogging much. But I have to drag myself to the keyboard to denounce a quite extraordinary set of deliberate lies published in the Guardian about a Russian plot to spring Julian Assange last December.

    I was closely involved with Julian and with Fidel Narvaez of the Ecuadorean Embassy at the end of last year in discussing possible future destinations for Julian. It is not only the case that Russia did not figure in those plans, it is a fact that Julian directly ruled out the possibility of going to Russia as undesirable.

    Fidel Narvaez told the Guardian that there was no truth in their story, but the Guardian has instead chosen to run with “four anonymous sources” – about which sources it tells you no more than that.

    I have no idea who the Guardian’s “anonymous sources” are, but I know 100% for certain that the entire story of a Russian plot to extract Julian from the Embassy last Christmas Eve is a complete and utter fabrication. I strongly suspect that, as usual, MI6 tool Luke Harding’s “anonymous sources” are in fact the UK security services, and this piece is entirely black propaganda produced by MI6.

    It is very serious indeed when a newspaper like the Guardian prints a tissue of deliberate lies in order to spread fake news on behalf of the security services. I cannot find words eloquent enough to express the depth of my contempt for Harding and Katherine Viner, who have betrayed completely the values of journalism.

    The aim of the piece is evidently to add a further layer to the fake news of Wikileaks’ (non-existent) relationship to Russia as part of the “Hillary didn’t really lose” narrative. I am, frankly, rather shocked.

    Former Ecuador President Correa Requests Asylum in Belgium - Reports

    Former Ecuador President Rafael Correa who was earlier accused of kidnapping his political opponent, ex-lawmaker Fernando Balda, back in 2012, has requested political asylum in Belgium.

    Rafael Correa, who currently resides in Belgium, asked Brussels to grant him asylum after an Ecuadiorian judge ruled that he and ex-chief of Ecuador's National Intelligence Directorate Pablo Romero should stand trial in the high-profile case of kidnapping of Fernando Balda, former lawmaker and Correa's political opponent.

    Balda was briefly kidnapped in Bogota where he fled after the Ecuadorian authorities accused him of being involved in the 2010 failed coup against Correa. The Ecuadorian prosecutors charged Correa with involvement in the abduction of Balda in late September.

    The ex-president has repeatedly denied the charges, describing the latest court ruling as farce.

    George Webb believes Assange is already in Virginia and he has unknowingly been used as an intercept.

    He shows a tweet from Wikileaks saying that Assange has to be in the national security court complex in Alexandria, VA on Tuesday. (GW then pats himself on the back for being ahead of Q. Note: GW has claimed several times that Q might be taking info from his channel?!?)

    GW feels that it's possible that Corsi and Stone were indicted to deflect media away from Assange and the DS's goal will be to try and loop Corsi/Stone connection to Assange around to get Trump. Hmm, is he right and will it work if he is.
    I would think that potus knows or at least has some idea of what they are up to, if in fact this is true.

    Blessed are the cracked, for they are the ones who let in the light!

    Netflix has done a movie on wikileaks and Assange which I saw yesterday (in bed with an unbreathable cold).

    It left me a bitter taste. Assange is described as a compulsive autistic who had to be controlled in order to save hundreds of agents. Assange wanted to publish all the files without taking off names. His collegue whom he had fired deleted the files on time.

    Seeing what I see now with the high cabal still in control , I am starting to think he was a visionary.

    Anyhow, it left me with the feeling they had him and were building the false rhetoric to have us accept it.

    WikiLeaks founder Julian Assange has been charged under seal by the Trump administration. This has been revealed by a purportedly accidental copy-paste error in an unrelated court document which used Assange’s name, interestingly not long after it was reported to the Wall Street Journal that federal prosecutors “have considered publicly indicting Mr. Assange to try to trigger his removal from the embassy because a detailed explanation of the evidence could give Ecuadorean authorities reason to turn Assange over.”

    Insider sources have reportedly confirmed to the Washington Post that Assange has been charged. Because those charges are sealed, it’s impossible to know what they are or how they’re being justified. If you ask #Resistance Twitter, it’s because it’s #MuellerTime and Assange is about to be arrested under some mysterious charges involving WikiLeaks’ publication of non-government, non-classified emails in 2016.

    If you ask QAnon cultists, it’s because Donald Trump is planning to extradite Assange so as to rescue him and deal a fatal blow to the Deep State. If you ask people who actually know what they’re talking about, however, it’s most likely for WikiLeaks’ Afghanistan and Iraq war logs and/or last year’s CIA leak publications, and most likely using the Espionage Act. This would constitute a deadly blow to press freedoms, and arguably a greater leap in the direction of Orwellian dystopia than the Patriot Act.

    It also proves once again that Julian Assange was completely right.

    I’ve had so, so many arguments with people this year about Assange’s publicly stated rationale for remaining in the Ecuadorian embassy, where he was granted political asylum by Ecuador’s previous government on the basis that the US was seeking his extradition. The refrain that he can “leave whenever he wants” is extremely common, with Assange’s detractors insisting that he’d never be arrested and extradited to the United States, and that he is instead hiding from (non-existent) Swedish rape charges.

    The narrative that Assange couldn’t possibly be hiding from the same government which tortured Chelsea Manning has been aggressively promulgated by mainstream outlets like the The Guardian, as in this article by James Ball from earlier this year titled “The only barrier to Julian Assange leaving Ecuador’s embassy is pride”, claiming that “The WikiLeaks founder is unlikely to face prosecution in the US.”

    Ball’s article includes the following galaxy-brained excerpts: “Visitors, like fish, stink in three days.”

    “There is no public criminal case against Assange or WikiLeaks in the US, though Assange frequently says there is evidence of sealed indictments against him and his associates, and there have been publicly disclosed surveillance warrants against WikiLeaks staff, as well as FBI interest in Assange and his current and former co-workers (including me, as I worked with WikiLeaks for a few months in 2010 and 2011). There is no real reason to believe anything has changed with Assange’s situation in the US.”

    “The problem for both sides is that neither wants to lose face: Assange wants to be a symbol of resistance against an overreaching US state, and does not want to admit his asylum was about his personal actions and not those of WikiLeaks. Ecuador does not want to suggest it made a mistake in granting Assange asylum.”

    Ball was at best completely wrong, and at worst knowingly lying about the very real possibility of secret US charges. We know that the charges are from the US government, so they’ve got nothing to do with any rape or bail violation allegations. But the narrative that Assange is a stinky, stinky weirdo hiding in a cupboard has been so aggressively promulgated by imperial propagandists like Ball it’s (for me at least) literally impossible to talk about Assange’s plight on social media without some stranger coming up and spewing it all over the conversation.

    And it’s no mystery why that is. The alternative to making Assange the creepy rapist hiding from justice would be to acknowledge the possibility of what we now know for certain: that a vast, sprawling superpower, with so many extremely tight alliances that it is effectively the center of a globe-spanning empire, is working to extradite an Australian journalist from an Ecuadorian embassy in the United Kingdom so that it can punish him for publishing facts. Much, much easier to have him be the stinky cupboard man than the center of an assault on speech with implications stretching to all future generations and every corner of the globe.

    Julian Assange founded an innovative leak outlet on the premise that corrupt power can be fought with truth and transparency. Corrupt power responded by silencing, persecuting and smearing him. In so doing they succeeded in slowing down the leaks, minimizing the impact of publications, and nullifying Assange’s ability to defend himself, and in exchange they have publicly proved that his thesis was, and is, absolutely correct. There is a power establishment which uses lies and secrecy to manipulate and deceive us, and it hates having the light of truth shone upon it more than anything. We know that for certain now. There is no doubt whatsoever.

    Julian Assange was never hiding from justice. Julian Assange is, and always has been, hiding from injustice. He has been proven right about his reasons for seeking political asylum from Ecuador, as he has been proven right about so very much before.

    I posted this over on the Q thread.

    George Webb believes Assange is already in Virginia and he has unknowingly been used as an intercept.

    He shows a tweet from Wikileaks saying that Assange has to be in the national security court complex in Alexandria, VA on Tuesday. (GW then pats himself on the back for being ahead of Q. Note: GW has claimed several times that Q might be taking info from his channel?!?)

    GW feels that it's possible that Corsi and Stone were indicted to deflect media away from Assange and the DS's goal will be to try and loop Corsi/Stone connection to Assange around to get Trump. Hmm, is he right and will it work if he is.
    I would think that potus knows or at least has some idea of what they are up to, if in fact this is true.

    Note: I am neither for or against Q and the POTUS. Just searching for thruth. I try to read both sides of most issues.

    But a few minutes later, the reporter tried asking Trump about Assange again. This time, the president claimed that “I don’t know anything about him. Really, I don’t know much about him, I really don’t.”

    Trump may not know Assange personally, but it’s impossible to believe he’s not familiar with his work.

    As ThinkProgress documented, in the final month before the 2016 presidential election, Trump mentioned WikiLeaks and the hacked emails it published at least 164 times during speeches, media appearances, and debates. Trump’s own intelligence officials acknowledge Russian hackers were responsible for obtaining emails from the DNC and Clinton campaign that were later published by WikiLeaks.

    “WikiLeaks, I love WikiLeaks!” Trump professed during a speech on October 10. “And I said write a couple of them down. Let’s see. ‘During a speech crooked Hillary Clinton’ — oh she’s crooked folks. She’s crooked as a three-dollar bill. Okay here’s one. Just came out. ‘Lock her up’ is right.”

    During an interview that aired the next day, Trump told Bill O’Reilly: “The press is hardly even talking about WikiLeaks. You know that. WikiLeaks is amazing. The stuff that’s coming out, it shows she’s a real liar.”

    On October 21, Trump told his audience at a rally that “We love WikiLeaks. WikiLeaks. They have revealed a lot. They’ve revealed that there is a great hostility toward Catholics. They reveal a great hostility toward evangelicals.”

    Four days later, at another rally, Trump said that “a terrible WikiLeaks was just released moments ago, which you’ll go home, you’ll see it, and you’ll be sickened by it and that she can get away with what she’s getting away with.”

    On November 2, Trump claimed that “WikiLeaks just came out with a new one just a little while ago it’s just been shown that a rigged system with more collusion, probably illegal, between the Department of Justice the Clinton campaign and the State Department, you saw that.”

    MSNBC put together a supercut of Trump’s mentions of WikiLeaks during the final month of the campaign.

    I don’t believe for a second that’s Trumps worst lie, which is a big lie btw, since if it wasn’t for WikiLeaks the US would probably have another Clinton president now and Trump promised to “drain the swamp”, something he would actually have a chance of achieving with Assange’s help.

    Note the MSNBC (neoliberal fake news) insertion of the Russian hacker/clinton emails falsehood into the storyline about trump pretending not to know anything about Assange. The unwary and untrained consumers of "news" will count the 164 references, but won't even notice that the "Russia did it!" dnc/cia/deep state BS narrative just got reaffirmed in their subconscious.

    Craig Murray, who knows a thing or a million about Julian's situation (which I have shared elsewhere on the forum in relevant threads) posted this in November 2016 on his blog.
