    Commentary: Supreme Court Rules Right in Case About Soros-Backed Organization Wanting US Foreign Aid to Go to Anti-American Groups

    The Supreme Court has upheld the right of the United States government to distribute aid to foreign organizations in accordance with American interests. The June 29 decision in Agency for International Development v. Alliance for Open Society International represents a significant win for the protection of American freedoms.

    The case affirms a vital principle of U.S. foreign involvement, one dear to the heart of the American taxpayer—U.S. money spent abroad must support U.S. interests and priorities. If a foreign organization wants our money, it cannot violate American positions.

    The U.S. Agency for International Development, the U.S. federal foreign aid agency, won by a vote of 5-3 over Open Society—an affiliate of billionaire George Soros’ mega-group, Open Society Foundations.

    Open Society argued that the U.S. government cannot withhold funds to foreign groups that contravene U.S. views. The Supreme Court held that it is the prerogative of the government to require foreign organizations to comply with the commitments of the U.S. to receive funding.

    Justice Brett Kavanaugh wrote in the majority opinion that the U.S. “supplies more foreign aid than any other nation in the world … Congress may condition funding on a foreign organization’s ideological commitments … pro-democracy, pro-women’s rights, anti-terrorism, pro-religious freedom, anti-sex trafficking, or the like.”

    Undoubtedly, the ruling will have implications for a vast array of American priorities, as Kavanaugh delineates. Moreover, conditionality, as mandated by Congress, “helps ensure that U.S. foreign aid serves U.S. interests”—a basic precondition for American involvement.

    The U.S. government maintains many definitive foreign policy positions that affect international funding. It was the protection of American interests that resulted in withdrawal from the World Health Organization, which received $900 million in U.S. funding last year alone.

    It also led to a request by USAID that United Nations coronavirus assistance not go toward abortion. Both concerned the fact that American money should not be channeled via international institutions for ends that violate U.S. interests.

    At the risk of an untenable hypocrisy, efforts to hold the international system accountable must go hand in hand with the domestic accountability for ensuring American interests that this ruling upholds. As Justice Clarence Thomas emphasized in his concurring opinion, “The First Amendment does not mandate a viewpoint-neutral government.”

    The American people have every right to ensure that their money goes to the promotion of the global good as determined by this viewpoint.

    The Supreme Court has grappled with this question once before. In 2013, it held that money allocated to organizations via the United States Leadership Against HIV/AIDS, Tuberculosis, and Malaria Act could not be restricted on the basis of an organization’s position on prostitution.

    This ruling pertained specifically to American organizations, which enjoy strict protections for freedom of speech under the First Amendment. The Supreme Court ruled against the government, deciding that an American organization could not be denied funds for not aligning with the U.S. government’s commitment to eradicating prostitution.

    The current case concerns the same act as it relates to foreign organizations, and here the majority clearly states that, “Congress required foreign organizations to oppose prostitution in return for American funding. And plaintiffs cannot export their own First Amendment rights to shield foreign organizations from Congress’s funding conditions.”

    Open Society’s argument that foreign entities merited the same rights as affiliates of their American counterparts was rejected by the Supreme Court.

    Kavanaugh further states that, “we see no constitutional justification for the federal judiciary to interfere in that fashion with American foreign policy.”

    As he notes, forcing the government to fund noncompliant foreign programs would have the effect of either violating U.S. commitments or cutting off funding altogether—both unacceptable alternatives.

    The Leadership Act, around which the case revolves, is considered one of the most successful U.S. aid programs, credited with the saving of an estimated 17 million lives.

    U.S. aid conditionalities are designed not only to enhance American interests, but also to hinge assistance on the promotion of human rights abroad—a process which may be imperfect in its execution, but by no means need be mutually exclusive.

    Although the dissenting justices are correct to emphasize the vital importance of free speech—a rarity in a time of increasing censorship—their claim that this ruling “will seriously impede the countless American speakers who communicate overseas” does not ring true. American free speech protections remain untouched. Foreign organizations likewise are free to oppose American views, they just cannot benefit from our money at the same time.

    Far from curtailing speech, this ruling preserves the longstanding ability of the U.S. government to leverage its influence for its interests—a basic goal in any transactional interchange. That the U.S. seeks to benefit domestically from the conferral of vast sums of aid is a reality entirely befitting of a sovereign state.

    Efforts to encourage global human rights protections via this aid are a crucial corollary of American international engagement that must be vigilantly protected and encouraged.

    Open Society Condemns Supreme Court Ruling that Denies First Amendment Rights and Hurts Fight against HIV/AIDS

    In a blow to free speech and public health, Alliance for Open Society International condemns the U.S. government’s Anti-Prostitution Pledge as it applies to American organizations’ foreign affiliates, despite a prior ruling that the Pledge itself violates American organizations’ First Amendment rights. This policy requires organizations and their foreign affiliates that receive U.S. government funding to fight HIV internationally to “explicitly oppose prostitution.” 

    Alliance for Open Society International, part of the Open Society Foundations, has been involved in a nearly 16-year battle on the constitutionality of the Anti-Prostitution Pledge. This is the second time the Supreme Court considered it, and marks a departure from previous rulings that determined the rule was unconstitutional.

    The Anti-Prostitution Pledge demonstrates how the U.S. government plays politics with public health at the expense of organizations that are providing critical HIV services and the vulnerable groups they reach. Now, American organizations and their foreign affiliates must pledge allegiance to the U.S. government’s political goal of eradicating sex work.

    In 2013, the Supreme Court defended U.S. organizations’ right to free speech, including the right to speak freely about sex work, declaring the policy requirement unconstitutional.

    The Anti-Prostitution Pledge, or “policy requirement,” compels domestic public health organizations and their foreign affiliates to condemn prostitution, regardless of whether they have a position—going far beyond saying how government money must be spent, and forcing organizations to adopt the government’s viewpoint.

    “The Supreme Court upheld the U.S. government’s quest to impose its harmful ideological agenda on U.S. organizations and restrict their right to free speech,” said Patrick Gaspard, president of the Open Society Foundations. “The Anti-Prostitution Pledge compromises the fight against HIV by impeding and stigmatizing efforts to deliver health services. Condemnation of marginalized groups is not a public health strategy.”

    Research has repeatedly found that moral rejection and criminalization of sex work creates an environment where sex workers are more vulnerable to violence and abuse, and consequently at greater risk of contracting HIV.

    These issues are heightened in the context of COVID-19, when sex workers face financial devastation that further contributes to these disproportionate health and safety risks. The Supreme Court’s ruling will prohibit critical organizations from providing services and support to sex workers who are too often left out of—or are antagonized by—government responses to the pandemic.

    Open Society Foundations, along with several other organizations, were plaintiffs in the case challenging the Pledge, arguing that it amounted to unconstitutional forced speech. The Pledge also harms collaboration with critical stakeholders in the HIV/AIDS movement, in particular sex workers.

    George Soros: The Face Behind the Caravans? (full series)
    Summary: Three U.S.-based organizations—Pueblo Sin Fronteras, La Familia Latina Unida, and the Centro Sin Fronteras—appear to have played key roles in organizing and otherwise assisting the “caravans” of immigrants. Following the money trail appears to lead back to George Soros’s well-funded Open Society Foundations, which are trying to advance his Open Society ideas throughout the world. Much is unknown and uncertain about their involvement, but it deserves thorough investigation.

    The Soros Nexus

    Enter George Soros, the Hungarian-American billionaire with his own distinct view of how the world should operate. Growing up in Nazi-occupied Hungary and behind the Iron Curtain, he developed a hatred for totalitarian governments, bureaucracy, and government control in general. Along the way to earning his billions he developed his open society philosophy—which is far too involved a discussion for here—and has donated most of his wealth (at least $18 billion) to his Open Society Foundations (OSF) to advance his open society philosophy.


    Soros is not the Bond villain that some critics see—he is too intelligent and too complex a character to fit into such a limited role. Nor is he the evil capitalist counterrevolutionary that Vladimir Putin has caricatured, nor is he necessarily a friend of Western liberal democracy.


    Soros and his foundations have clearly been disruptive influences on political systems. Soros is generally credited with playing a significant role in the “color revolutions” of 2004–2005 that toppled governments in the former Soviet republics of Georgia, Kyrgyzstan, and Ukraine and threatened neighboring governments, not least the Putin regime in the Russian Federation. OSF activities have also incurred the wrath of the Hungarian government, which expelled them. More recently, the Open Society network has influenced elections throughout Europe, possibly by leveraging U.S. government funding.


    Open borders (unrestricted immigration) is a key component of George Soros’s open society philosophy and the Open Society network of nonprofit foundations.
    In Europe, Soros and his foundations have effectively sought to erase national borders and identities and appear to have facilitated the European refugee crisis (2015–2017). He personally called on the European Union to deal with the crisis by opening its borders even more and going further into debt to finance “Marshall Plan for Africa.”
    Interestingly, a leaked internal OSF document indicate that OSF’s International Migration Initiative provided 40 grants totaling more than $8 million to 22 organizations during 2014–2016. Almost half ($3.7 million) went to organizations working on migrant and refugee issues in the “Asia/Middle East corridor” and the “Central America/Mexico corridor.” (Note: This document and the leaked memorandum cited below were released through DC Leaks, which is accused of being a front for Russian military intelligence. Nevertheless, despite their dubious provenances, they appear genuine and reliable.)


    Closer to his adopted home country, Soros’s involvement in “opposing laws limiting legal and illegal immigration” began at least as early as 1996, when he provided $50 million to create the Emma Lazarus Fund. The Lazarus Fund, later folded into his OSF network, funded directly and indirectly many other groups supporting illegal immigration into the U.S. and elsewhere ever since, according to Rachel Ehrenheld of the American Center for Democracy.


    In recent years, OSF has given millions of dollars to other organizations that directly assisted the caravans with fundraising, legal assistance, and media support. These organizations included the American Constitution Society, Centro para la Acción Legal en Derechos Humanos (Center for Legal Action in Human Rights), Lawyers Committee for Civil Rights, Amnesty International, National Immigration Project of the National Lawyers Guild, Center for Constitutional Rights, Human Rights First, and Church World Service.


    And U.S.-based OSF components have money to burn thanks to Soros. A leaked memorandum to the Open Society U.S. Programs Board dated August 29, 2013, proposed a programmatic budget of $100 million plus a reserve fund of $25 million. It’s good to be a billionaire’s nonprofit.


    While the linkages between OSF and Pueblo Sin Fronteras, La Familia Latina Unida, and Centro Sin Fronteras are still nebulous, using illegal immigrants as pawns to overwhelm national borders and agitate for open borders is of a piece with Soros’s initiatives to create a global open society.

    I think you are letting your feelings regarding Soros, the Democrats and the Clinton’s colour your thinking. There is a place for tying aid to values but we need to be very careful which values we decide to adhere to. This is a scary decision. We’ve seen already that funding has been pulled from organisations who support the right to choose or don’t actively decry prostitution. This is a slippery slope and we should be letting common sense prevail, not enshrining something in law.

    As to the above, I’m not convinced Soros is a bad actor. I had never heard of him until a few months ago and the only information I’ve seen about him as come from truth websites and videos and nothing there has convinced me.

    Even my relatives who are 70yrs old and above have talked about him, since... about 22years ago??? He is blamed for the asian financial crisis.

    Ahhh, we can’t have it both ways! If you believe in capitalism then Soros’ business actions are within his rights. If you watch his 60 minutes interview in full, those quotes are not accurate. He was asked about working with his caregiver to strip Jews of their assets, they went house to house, not sending them to the gas chamber. He also said he was only 14 at the time and didn’t fully understand or appreciate what he was participating in and so it didn’t leave him psychologically harmed.

    He also said in that same interview that there needs to be more regulation in order to stop people like him from doing exactly what he does.

    So what does this leave us with?

    -he believes the US is harmful to the peace of the world
    -he supports the Democrats
    -he doesn’t support Trump
    -he funds a variety of humanitarian efforts in some cases donating more than the US
    -he believes in open borders

    I don’t support his business practices or the Democrats and I don’t believe open borders are the answer to the world’s humanitarian problems, other than that, I have no issue with what he has supported.

    People like Soros shouldn’t be allowed to amass such money and power but that’s the world we live in.

    Re abolishing the nuclear family. The nuclear family and white picket fence ideal was a propaganda campaign during the 1950s to get women out of the workforce so that returning soldiers would have jobs. Prior to that, unless you were rich, women worked and families lived in both multi generational and side generational living arrangements. This is what Open Society, BLM and other movements are suggesting.

    The Open Society article rightly suggests that the nuclear family is NOT a safe space for everyone and family alternatives can be as solution to that. Family becomes what we make it. It sure how anyone could disagree with this.

    As to the single parent debate, those statistics are also false. A meta study conducted a few years ago found that once parents with drug and alcohol abuse, mental health issues, disability and other factors that could affect their parenting were removed factors like education level and class were accounted for, children had the same outcomes.

    Pretty sure that Soros article you’re defending Jane is actually satire as well.

    Look at all the propoganda they’re pushing about ‘ending private property’ and abolishing, not just families but ‘family values’ as well. OpenDemocracy wants everyone to live in empty (uncommodified = no commodities) communal (stolen) housing that you’ll get to share with other villagers (the released rapists, violent thugs and murderers who’ve been freshly released from prison).

    We already have a couple threads on CHAZ or Antifastan. Which seems to be the end goal of what the author of the article envisions a world without a nuclear family should be like.

    the time of writing, humankind has well and truly entered the time of corona.

    In the hopes of ‘flattening the curve’ of the pandemic, vast swathes of society have adopted contagion-slowing practices (be they mandatory, voluntary or semi-voluntary, depending on the local legislature) known as ‘social distancing’ and ‘sheltering in place.’

    Media platforms are flooded with chronicles of these practices, many of them understandably anxious, shell-shocked and despairing, due to loss of income or fear for the ill-health of loved ones. Yet many of them, on the contrary, humorous, horny, happy to be off work, and full of the comic creativity of the unexpectedly house-bound (genres here include: playing tic-tac-toe with your goldfish; DJ-ing with the hobs on your stove-top; and strap-hanging off your shower-rail on a simulated subway commute).

    Certainly, there have been eco-fascist sentiments, and calls for authoritarian state control over the situation, but mutual aid has also proliferated: grocery runs and disinfection supplies for the immunocompromised; childcare and safe injection kits for sex workers and substance users; co-pay waivers; eviction moratoriums; rent strikes; and efforts to secure shelter for the houseless. The latter, in particular, exposes the unspoken and mostly unquestioned crux of the prescribed response to the pandemic: private homes.

    Nuclear households, it seems, are where we are all intuitively expected to retreat in order to prevent widespread ill-health. ‘Staying home’ is what is somehow self-evidently supposed to keep us well. But there are several problems with this, as anyone inclined to think about it critically (even for a moment) might figure out – problems one might summarize as the mystification of the couple-form; the romanticisation of kinship; and the sanitization of the fundamentally unsafe space that is private property.

    How can a zone defined by the power asymmetries of housework (reproductive labor being so gendered), of renting and mortgage debt, land and deed ownership, of patriarchal parenting and (often) the institution of marriage, benefit health? Such standard homes are where, after all, everyone secretly knows the majority of earthly violence goes down: the W.H.O. calls domestic violence “the most widespread, but among the least reported human rights abuses.”

    Queer and feminized people, especially very old and very young ones, are definitionally not safe there: their flourishing in the capitalist home is the exception, not the rule. It follows that, upon closer inspection, both terms – ‘social distancing’ and ‘sheltering in place’ – appear remarkable as much for what they don’t say (that is, what they presume and naturalize) as what they do. Sheltering in what place… and in whose? Distance from whom… or everyone but whom?

    But the first and starkest problem with the directive to stay home is simply this: not everybody possesses access to a private dwelling. As the Oakland-based Moms 4 Housing put it: “how do you #ShelterInPlace when you don’t have a place?” It turns out there are at least a couple of different ways: sharing and occupying. In ethical defiance of state directives, relatively immune neighbors in many cities have been voluntarily opening their homes to the exposed and sick, judging the duty of neighborly solidarity with the unhoused more pressing than the imperative to avoid contagion.

    Meanwhile, by taking vacant properties without permission, and living in them (“self-quarantine in progress,” reads one mom’s window-sign), Moms 4 Housing is leading the way in beating back gentrification in California and enacting an understanding of comfortable housing as a basic human birthright.

    Unfortunately, there are still many other populations whose response to the pandemic could not be ‘stay home,’ even if they wanted it to be, besides the houseless: for instance, people warehoused in prisons, detention centers, refugee camps or factory dormitories, people stuck in overcrowded retirement homes, or those held against their will in medical and/or psychiatric facilities. If COVID-19 is incompatible with these institutions, in the sense that a humane response to the pandemic is impossible in such undemocratic spaces, then it will have demonstrated by the same token that they are incompatible with human dignity.

    In L.A., state officials are providing individual trailers and pop-up isolation cabins for the houseless. But a far more logical response might be: open all the hotels and private palaces on the basis of airy and light-filled, sanitary (uncommodified) housing for all. Free all prisoners and detainees now, remake the care facilities as spacious self-led villages, and dismiss all the workers with full pay so they can leave their bunks forever, move in with their friends, and pursue laziness for at least the next decade.

    Secondly, among those of us who do have private homes, a huge proportion are not safe there; and being unable to leave only multiplies the threat. A quarantine is, in effect, an abuser’s dream – a situation that hands near-infinite power to those with the upper hand over a home. Accordingly, early on in China’s epidemic, women’s rights NGOs published guides to surviving coronavirus-specific domestic abuse. Police stations throughout the country reportedly saw a threefold increase in cases of domestic violence; on March 21, 2020, The Guardian quoted the founder of a Chinese women’s not-for-profit as saying: “According to our statistics, 90% of the causes of violence are related to the Covid-19 epidemic.”

    And as the virus spreads through America, we would do well to heed this. Already, the CEO of the national domestic violence hotline in the United States has noted: “Perpetrators are threatening to throw their victims out on the street so they get sick… We’ve heard of some withholding financial resources or medical assistance.”

    In short, the pandemic is no time to forget about family abolition. In the words of feminist theorist and mother Madeline Lane-McKinley; “Households are capitalism’s pressure cookers. This crisis will see a surge in housework – cleaning, cooking, caretaking, but also child abuse, molestation, intimate partner rape, psychological torture, and more.” Far from a time to acquiesce to ‘family values’ ideology, then, the pandemic is an acutely important time to provision, evacuate and generally empower survivors of – and refugees from – the nuclear household.

    And thirdly, even when the private nuclear household poses no direct physical or mental threat to one’s person – no spouse-battering, no child rape, and no queer-bashing – the private family qua mode of social reproduction still, frankly, sucks. It genders, nationalizes and races us. It norms us for productive work. It makes us believe we are ‘individuals.’ It minimizes costs for capital while maximizing human beings’ life-making labor (across billions of tiny boxes, each kitted out – absurdly – with its own kitchen, micro-crèche and laundry). It blackmails us into mistaking the only sources of love and care we have for the extent of what is possible.

    We deserve better than the family. And the time of corona is an excellent time to practice abolishing it. In the always lucent words of Anne Boyer: “We must learn to do good for the good of the stranger now. We now have to live as daily evidence that we believe there is value in the lives of the cancer patient, the elderly person, the disabled one, the ones in unthinkable living conditions, crowded and at risk.”

    We do not know yet if we will be able to wrench something better than capitalism from the wreckage of this Plague and the coming Depression. I would only posit with some certainty that, in 2020, the dialectic of families against the family, of real homes against the home, shall intensify.
