"A U.S. attorney issued a grand jury subpoena for the bank records of President Joe Biden’s son and brother in 2019, according to documents released to the public for the first time in January.

David Weiss, the U.S. attorney for the District of Delaware, passed the subpoena onto JP Morgan Chase Bank for the bank records of Hunter Biden, James Biden, and two other individuals, according to the set of papers.

The records requested corresponded to transactions between Chase and the Bank of China.

The documents are dated May 15, 2019.

They were obtained by Marco Polo, a nonprofit started by Garrett Ziegler, who worked in the White House’s Office of Trade and Manufacturing Policy during the Trump administration.

Ziegler told The Epoch Times in an email that a whistleblower who was a party to the subpoena provided the documents.“This wide-ranging grand jury subpoena confirms that Joe’s son and brother received transfers from an account with the Bank of China,” Ziegler said.

Wire transfers involving at least one Bank of China account were listed on a laptop computer that was said to be dropped off by Hunter Biden at a computer repair store in Delaware in 2019, “but it helps the public to see independent corroboration,” he added.

The subpoena also demanded records concerning Eric Schwerin and Devon Archer, two former business associates of Hunter Biden.

Archer, who has been convicted of conspiracy to commit fraud, and Hunter Biden founded an investment firm, Rosemont Seneca Partners, with Christopher Heinz in 2009 and went on to serve together on the board of Burisma, a Ukrainian energy company, while Joe Biden was vice president. All three have connections with Chinese nationals, including some linked to the Chinese Communist Party.

Matthew Schwartz, an attorney for Archer, said that his client was not aware of the 2019 subpoena.

“But Mr. Archer has cooperated completely with the Delaware U.S. Attorney’s Office investigation from the moment he became aware of it,” he told The Epoch Times via email.

A lawyer representing Hunter Biden and a White House spokesman did not respond to requests for comment. White House press secretary Jen Psaki was not asked about the document during a briefing on Jan. 31. Biden has said he’s confident his son did nothing wrong. A query sent to Schwerin’s company wasn’t returned.

Spokespersons for the U.S. attorney’s office and Chase did not dispute the authenticity of the documents but declined to comment.

Little is known about the federal investigation into Hunter Biden, which he described in late 2020 as dealing with “tax affairs” but was reportedly examining the younger Biden’s business dealings with China.

Shortly after Hunter Biden announced he was being probed, the U.S. attorney’s office said it could not comment on an ongoing investigation.

The new documents show that the investigation, which was shielded from the public until after the 2020 election, was likely going on in 2019.

“The question that remains is why Bill Barr directly intervened to ensure that the U.S. Attorney in Delaware’s investigation into Joe’s family was kept from the public for over 17 months until after the election, as previous reporting has confirmed. David Weiss and Bill Barr—or someone with a conscience inside the Justice Department—should answer that question for the American people,” Ziegler said.

Weiss, a Trump nominee, was one of the few U.S. attorneys not removed by Biden after taking office. Barr was attorney general for part of former President Donald Trump’s presidency.

Barr, asked about the matter shortly before leaving office, said a Department of Justice rule against publicly confirming probes that involve candidates for office was the reason behind keeping the investigation secret."

According to Schweizer, there aren’t any clear business services that Hunter Biden performed for his deals with people tied to Chinese intelligence.

Schweizer said, “What worries me most is we first broke the story on these commercial deals with the Biden family in China back in 2018. What we’ve done is taken the new material and tried to figure out who made those deals happen in China. And in every one of the cases, those are businessmen that have ties to the highest levels of Chinese intelligence. What do I mean by that? Well, the private equity deal, where Hunter Biden was put on board of this private equity company financed by the Chinese government. That deal was done by a Chinese businessman named Che Feng. When he was doing that deal with Hunter Biden, he was business partners with the Vice Minister for the Ministry of State Security in China, a guy named Ma Jian. Ma Jian’s responsibility was the recruitment of foreign nationals to spy on behalf of China. Another one of the businessmen that was involved in that deal who also transferred $5 million to another one of Hunter Biden’s businesses is a guy named Mr. Zhao. His business partner at the time was the family of the former minister of state security who ran the entire spy apparatus of China.”

He continued, “So, the question is, why did these businessmen hand this money over to the Biden family? And I don’t think it’s philanthropy. I don’t think it’s business. There [are] no discernible business services that Hunter Biden performed for this money. A former business partner of Hunter Biden was sentenced Monday to more than a year in prison for his role in a scheme to defraud a Native American tribe of some $60 million in bonds.

The defendant, Devon Archer, was sentenced to one year and one day in federal prison by Manhattan Judge Ronnie Abrams, who said the crime was “too serious” to let him just walk.

“There’s no dispute about the harm caused to real people,” Abrams said, noting that the defrauded tribe, the Oglala Sioux, is one of the poorest in the nation.

Archer will also have to pay more than $15 million in forfeiture by himself and more than $43 million in restitution with his co-defendants in the case.

The convicted fraudster has maintained his innocence and intends to appeal the conviction and sentence, his attorney, Matthew Schwartz, said in court Monday.

In brief statements to Abrams just before Archer was sentenced, he and Schwartz claimed he was taken advantage of by corrupt businessmen who wanted to use him in the scheme.

“He came under the influence of a person he trusted too much and didn’t ask enough questions,” Schwartz said.

Archer, his voice quivering at times, said it was “nothing less than surreal” that he had been convicted and was facing a prison sentence Monday.

“I was doing too many things at once and not paying enough attention,” Archer said of his involvement in the fraud.

“I have deep remorse for the victims of the crime,” he said, adding that he was also distraught about the pain he had caused his friends and family.

“I’m most sorry for my family and what I’ve put them through,” he said.

Prior to his arrest, Archer served with Hunter Biden on the board of Burisma Holdings, a Ukraine-based energy company.

In a sentencing memo filed earlier this month, Schwartz argued that Archer provided “real value” to Burisma during his time on the board — but he resigned after his arrest in the case in 2016.

Biden had no connection to the fraud scheme Archer was sentenced for Monday.

Archer was convicted by a jury of conspiracy to commit securities fraud and securities fraud after a trial in 2018.

Prosecutors charged that Archer and his co-defendants bought more than $60 million in bonds from the Oglala Sioux, but instead of using them for annuity, they used them to “build a financial services mega-company.”

“Archer became a key player in the scheme, anticipating that, when the scheme succeeded, he would helm the resulting conglomerate and, ultimately, reap massive profits from its sale,” prosecutors wrote in a sentencing memo earlier this month.

After his conviction, Abrams granted Archer’s request for a new trial, but her decision was overruled by a federal appeals court and the conviction was reinstated.

At his sentencing, Abrams acknowledged Archer was not the leader of the scheme and did not attempt to obstruct justice, as a number of his co-defendants had.

Archer did not benefit financially from the fraud — and even lost cash because of it, Abrams said.

Schwartz asked Abrams that Archer be able to remain free pending appeal, which the judge said she would rule on after the defense and prosecution submit briefs on the request.

An attorney for Biden did not return a request for comment.

“Mr. Archer is obviously disappointed with today’s sentence, and intends to appeal. It is unfortunate that the judge, who has previously expressed concern that Mr. Archer is innocent of the crimes charged and reiterated that belief today, felt that she was constrained not to act on her independent assessment of the evidence,” Schwartz said in a statement after the sentencing.
