    "Here's a story about Hypocrisy and Duplicity: I lawfully received a copy of Joe Biden’s 40 year old daughter’s diary. In it, she alleged horrible things about her father, then a candidate for president of the United States. I didn’t publish the diary or any story about it.

    Nevertheless, for a year a cowardly federal prosecutor in New York named Robert Sobelman secretly stole my emails, spied on my media company, and appears to have lied to federal judges to obtain secret covert spying orders.

    He then appears to have lied again to federal judges to get a search warrant to invade my home and seize my First Amendment-protected reporter’s notes and source information.

    Yesterday, Politico’s Josh Gerstein received a stolen copy of a draft U.S. Supreme Court opinion overturning Roe v. Wade and published it -- and yet he sleeps well in his own bed tonight, with no fear of being rousted at 6AM by short, loud, thuggish FBI agents as I was, and handcuffed.

    It is right that he not fear prosecution. It is wrong that we must.

    Good News! PayPal Backs Down After Outpouring of Support for CN

    "PayPal has retreated after a deluge of support for Consortium News by unfreezing its funds and now saying unspecified steps must be taken to restore the “permanently” shut down account, Joe Lauria reports.

    PayPal has reversed its decision to withhold Consortium News‘ funds after a backlash from social media, news outlets and CN donors.

    PayPal sent Consortium News an email on Tuesday night saying: “Your PayPal funds are now eligible for withdrawal.” CN immediately withdrew the funds. PayPal gave no reasons for its reversal, as it had given no reasons for its initial action. The account remains shut down, though it appears no longer permanently, as PayPal is asking CN to take steps to restore it without saying what those steps are.

    PayPal initially said it had slapped a “permanent limitation” on Consortium News, adding explicitly: “You can’t use PayPal anymore. … We noticed activity in your account that’s inconsistent with our User Agreement and we no longer offer you PayPal services. … Because of potential risk exposure, we’ve permanently limited your account. You’ll no longer be able to use the account for any transactions.”

    Among “restricted activities” in the User Agreement is a ban on providing “false, inaccurate or misleading information” to PayPal, other PayPal customers “or third parties.” Given the political climate it is reasonable to conclude that PayPal was reacting to Consortium News’ coverage of the war in Ukraine, which is not in line with the dominant narrative that is being increasingly enforced. If true, PayPal was allegedly seeking to limit Consortium News’ free speech by depriving it of one of its main vehicles for funding.

    A PayPal customer service agent had told CN that its funds could be kept for six months until a determination was made about what to do with them. “If there was a violation .. it is possible” CN‘s balance of $9,348.14 could be kept as “damages” to PayPal. That would mean awarding itself damages in a completely secret process.

    PayPal apparently has also lifted the “permanent limitation” on CN‘s account. According to its User Agreement, PayPal says there are no steps that can be taken to reverse the permanent ban.But in the Tuesday night email PayPal said there were now steps Consortium News could take. “Access to your account will remain limited until you perform the steps required to lift the limitation.” However, it failed to specify what those steps are and still hasn’t identified what violations were committed to bring the ban in the first place. Strong Reaction

    PayPal’s reversal comes after widespread support on social media for Consortium News and a flood of donations that sent a message to PayPal. CN received $25,354 in donations in the 48-hour period after it announced PayPal’s ban, with $15,632 coming on the first day. They are both record amounts, for which Consortium News is extremely grateful. (Please keep helping us reach our $60,000 Spring Fund Drive goal.)

    Independent media reacted too, with an article by Matt Taibbi on Substack, one by Jacobin magazine and a report on DemocracyNow! The story also hit the mainstream in this segment on The Hills‘ show Rising, which also discuss MintPress News, which was also shut down, having its funding restored as well:

    "PayPal has canceled Consortium News‘ account without any prior notice or due process and with virtually no explanation.

    As Consortium News is today launching its Spring Fund Drive, it has lost one of its most important ways for its viewers and readers to show their support through donations. Clicking on the yellow PayPal donate button on our home page now yields this message:



    PayPal has sent an email to CN that says:

    “You can’t use PayPal anymore. … We noticed activity in your account that’s inconsistent with our User Agreement and we no longer offer you PayPal services. … Because of potential risk exposure, we’ve permanently limited your account. You’ll no longer be able to use the account for any transactions.”
    The message says that “any money in your PayPal balance will be held for up to 180 days,” after which, “if applicable, we’ll email you with information on how to withdraw any remaining money.”

    Consortium’s PayPal account page now shows a similar message:



    No Prior Notice or Explanation

    There was no prior notice sent nor was Consortium News afforded any due process. A PayPal customer service agent confirmed in a telephone call on Sunday that the “back office” gave no specific reason for “permanently limiting” CN‘s account other than that an “investigation and review” of CN‘s “history found some potential risk associated with this account.”

    She said the “potential risk” from CN is “not exactly specified by the back office.” The agent said, “It has something to do with the history of this account.” Asked whether any agency, government or private, or any individual had complained to PayPal about CN, the customer service agent replied, “I don’t see any existing case.”

    The agent could not explain why Consortium News was given no notice or any due process, but promised to ask the “back office” to contact CN to explain.

    Regarding the $9,348.14 balance in CN‘s PayPal account, the agent said that after a 180-day review PayPal would decide whether to return it. “If there was a violation,” she said “it is possible” the money could be kept as “damages” to PayPal. Violations under the Restricted Activities of the User Agreement include providing “false, inaccurate or misleading information” to PayPal, other PayPal customers “or third parties.”

    Given the current political climate it is more than conceivable that PayPal is reacting to Consortium News’ coverage of the war in Ukraine, which is not in line with the dominant narrative that is being increasingly enforced. Last week PayPal also froze the account of the alternative news site MintPressNews.

    PayPal was sued in California in January in a class action for similarly shutting down accounts."

    VPN Users’ Anonymity Under Threat Following Indian Security Order

    Claiming that criminals use encryption to stay anonymous, last year a parliamentary committee urged the Indian government to ban VPNs. While that didn't happen, new security-focused directions published by the Ministry of Electronics and Information Technology look set to make effective online anonymity a thing of the past.

    People being free to share and access ideas, knowledge and opinions with their peers is a universally accepted standard for the entire human race. The big problem is that the definition of ‘free’ differs widely and is often defined by the few, not the many.

    In online terms, true freedom is already under threat. As governments take more control over ‘their’ parts of the internet, citizens are informed that this is for the greater good, to keep their families safe and economies strong. Giving up small freedoms here….and a few others over there….are presented as insignificant sacrifices hardly worth our attention.

    However, once these systems are in place, governments can use them to ‘protect’ citizens from dissenting opinions, unpalatable news, whistleblowing, and our ability to absorb all information, thereby reaching educated conclusions of our own. Early adopters of VPNs recognized this years ago, and as more people retain choice by using them, some governments are calling for VPNs to be restricted or even banned.
    Calls for VPN Ban in India

    In common with many countries worldwide, India has introduced laws to render illegal certain types of content online. It blocks thousands of websites due to copyright infringement and pornography, for example, but is now engaged in censorship to suppress political opposition in the name of national security. It even threatened to put Twitter executives in prison for refusing to censor opponents.

    Due to the increased security and anonymity they provide, good VPN services with high standards enable people to absorb and impart information more freely. They are not a silver bullet but can be considered as part of a toolkit to unfilter internet access and restore freedoms. As a result, India’s government (and more besides) view them as a threat.

    Ethical Values
    Rule #1 – Truth is paramount. Our reporting is fact based with clear and irrefutable video and audio content. Truth is paramount. We never deceive our audience. We do not distort the facts or the context. We do not “selectively edit.”

    Rule #2 – We do not break the law. We maintain one-party consent when recording someone is inherently moral and ethical. We never record when there is zero-party consent. In areas where we are required to have consent from all parties, we seek legal guidance regarding the expectation of privacy’s impact on our right to record.

    Rule #3 – We adhere to the 1st Amendment rights of others. During our investigations we do not disrupt the peace. We do not infringe on the 1st Amendment rights of others.

    Rule #4 – The Zekman Test. The undercover investigations we pursue are judged by us to be of “vital public interest” and “profound importance.” The Zekman Test is our baseline. Undercover investigative reporting is necessary because, “...there’s no other way to get the story...” Whereas the Society of Professional Journalists allows for undercover techniques, if undercover techniques are necessary to expose issues of vital public importance; we believe they are not only allowed but required.

    Rule #5 – We Protect the Innocent When Possible - Embarrassing private details are not to be investigated. We stay away from irrelevant embarrassingly intimate details about private citizens personal lives. We look for individual wrong-doing and judge its public importance. The irrelevant religious or sexual dispositions of our targets are not to be investigated.

    Rule #6 – Transparency. Our methods & tactics must be reasonable and defensible. We use the “Twelve Jurors on Our Shoulder” rule. The work has to be done with such a degree of integrity that it can withstand scrutiny in both law & ethics. We are comfortable with transparency. We must be willing to be ready to disclose our methods upon publication.

    Rule #7 – Verifying and Corroborate Stories – Evaluate impact on third parties and Newsworthiness of Statements Alone. We consistently consider the probable truth or falsity of statements, examine any reasons to doubt the veracity of underlying assertions and whether the assertions are newsworthy. When possible, we will confirm with our subjects that their statements captured on video are accurate & truthful. At the very least, we will give our subjects an opportunity to elaborate and/or respond. In all matters, we rely on the 1st Amendment to protect our ability to publish newsworthy items after our internal deliberations. On whether there is an obligation to ensure the veracity of statements made on video, 1.) consider whether the remarks may potentially impact an innocent third party. (Factors in support of releasing the content) and 2.)The Newsworthiness of the statement alone by itself. (Factors against releasing the content).

    Rule #8 – Raw Video. In certain circumstances we may release the “raw” video to the press and or the public. But as a rule, we do not.

    Rule #9 – Subject Anonymity. We investigate & question sources before promising anonymity. Once we confirm, we will do everything in our power to protect the identity of our confidential sources.

    Rule #10 – Being Accountable. Admit mistakes & correct them promptly.

    Rule #11 – We do not manufacture content. We do not put words in our investigative subjects' mouths. We do not lead the horse to water. Our purpose is to elicit truth.

    Rule #12 – With Great Power comes Great Responsibility.

    [NEW YORK – May 11, 2022] A source within the Federal Bureau of Investigation has come forward to expose the FBI’s targeting of members of the “news media” including information about what the FBI calls a Special Investigative Matter (“SIM”) regarding their investigation into Project Veritas over Ashley Biden’s abandoned diary.

    According to a document obtained and published by Project Veritas, the FBI opened an investigation into Project Veritas knowing full well they were journalists as the document is labeled under a “news media” classification.

    This classification is a direct contradiction to the government’s court filing where they argued that actions taken by the government to surveil, raid and seize materials from Project Veritas journalists were appropriate. The government’s filing stated, “Project Veritas is not engaged in journalism within any traditional or accepted definition of that word,” because it’s reporting is “non-consensual.”

    The whistleblower, who has several years of experience as an FBI Special Agent, came to Project Veritas because, “The direction that the agency has headed troubles a vast majority of the agents.”

    Something else the whistleblower called “alerting” was the fact that the FBI categorized the investigation into Ashley Biden’s diary under Threat Band I, which is usually reserved for “threat issues that are likely to cause the greatest damage to national interests or public safety in the coming year.”

    The document, which lacks certain information due to the restricted classification of the file, also shows the investigation was launched the same day Ashley Biden’s Attorney, Roberta Kaplan, said, “This is insane. We should send to SDNY,” in response to a request for comment on the contents of Ashley Biden’s diary.

    The FBI also used its Cellular Analysis Survey Team (CAST) tools, which includes cellular geolocation tracking of phone devices, to secretly surveil Project Veritas journalists, according to the whistleblower and as revealed on the leaked document.

    The whistleblower, who is still on the Bureau’s payroll, sat down for an interview with Project Veritas CEO and Founder, James O’Keefe. “Tyranny happens incrementally, and it happens by a bunch of people agreeing to small injustices over and over simply to keep their paycheck and their pension,” said the whistleblower, adding, “To maintain your paycheck and pension that gives you the Holocaust.”.

    At the time of this writing, the FBI has not yet responded to a request for comment.

    Congress Escalates Pressure on Tech Giants to Censor More, Threatening the First Amendment

    For the third time in less than five months, the U.S. Congress has summoned the CEOs of social media companies to appear before them, with the explicit intent to pressure and coerce them to censor more content from their platforms. On March 25, the House Energy and Commerce Committee will interrogate Twitter’s Jack Dorsey, Facebooks’s Mark Zuckerberg and Google’s Sundar Pichai at a hearing which the Committee announced will focus “on misinformation and disinformation plaguing online platforms.”

    The Committee’s Chair, Rep. Frank Pallone, Jr. (D-NJ), and the two Chairs of the Subcommittees holding the hearings, Mike Doyle (D-PA) and Jan Schakowsky (D-IL), said in a joint statement that the impetus was “falsehoods about the COVID-19 vaccine” and “debunked claims of election fraud.” They argued that “these online platforms have allowed misinformation to spread, intensifying national crises with real-life, grim consequences for public health and safety,” adding: “This hearing will continue the Committee’s work of holding online platforms accountable for the growing rise of misinformation and disinformation.”

    House Democrats have made no secret of their ultimate goal with this hearing: to exert control over the content on these online platforms. “Industry self-regulation has failed,” they said, and therefore “we must begin the work of changing incentives driving social media companies to allow and even promote misinformation and disinformation.” In other words, they intend to use state power to influence and coerce these companies to change which content they do and do not allow to be published.

    I’ve written and spoken at length over the past several years about the dangers of vesting the power in the state, or in tech monopolies, to determine what is true and false, or what constitutes permissible opinion and what does not. I will not repeat those points here.

    Instead, the key point raised by these last threats from House Democrats is an often-overlooked one: while the First Amendment does not apply to voluntary choices made by a private company about what speech to allow or prohibit, it does bar the U.S. Government from coercing or threatening such companies to censor. In other words, Congress violates the First Amendment when it attempts to require private companies to impose viewpoint-based speech restrictions which the government itself would be constitutionally barred from imposing.

    It may not be easy to draw where the precise line is — to know exactly when Congress has crossed from merely expressing concerns into unconstitutional regulation of speech through its influence over private companies — but there is no question that the First Amendment does not permit indirect censorship through regulatory and legal threats.

    Ben Wizner, Director of the ACLU’s Speech, Privacy, and Technology Project, told me that while a constitutional analysis depends on a variety of factors including the types of threats issued and how much coercion is amassed, it is well-established that the First Amendment governs attempts by Congress to pressure private companies to censor:

    Quote For the same reasons that the Constitution prohibits the government from dictating what information we can see and read (outside narrow limits), it also prohibits the government from using its immense authority to coerce private actors into censoring on its behalf.
    In a January Wall Street Journal op-ed, tech entrepreneur Vivek Ramaswamy and Yale Law School’s constitutional scholar Jed Rubenfeld warned that Congress is rapidly approaching this constitutional boundary if it has not already transgressed it. “Using a combination of statutory inducements and regulatory threats,” the duo wrote, “Congress has co-opted Silicon Valley to do through the back door what government cannot directly accomplish under the Constitution.”

    That article compiled just a small sample of case law making clear that efforts to coerce private actors to censor speech implicate core First Amendment free speech guarantees. In Norwood v. Harrison (1973), for instance, the Court declared it “axiomatic” — a basic legal principle — that Congress “may not induce, encourage or promote private persons to accomplish what it is constitutionally forbidden to accomplish.” They noted: “For more than half a century courts have held that governmental threats can turn private conduct into state action.”

    In 2018, the ACLU successfully defended the National Rifle Association (NRA) in suing Gov. Andrew Cuomo and New York State on the ground that attempts of state officials to coerce private companies to cease doing business with the NRA using implicit threats — driven by Cuomo’s contempt for the NRA’s political views — amounted to a violation of the First Amendment. Because, argued the ACLU, the communications of Cuomo’s aides to banks and insurance firms “could reasonably be interpreted as a threat of retaliatory enforcement against firms that do not sever ties with gun promotion groups,” that conduct ran afoul of the well-established principle “that the government may violate the First Amendment through ‘action that falls short of a direct prohibition against speech,’ including by retaliation or threats of retaliation against speakers.” In sum, argued the civil liberties group in reasoning accepted by the court:

    Quote Courts have never required plaintiffs to demonstrate that the government directly attempted to suppress their protected expression in order to establish First Amendment retaliation, and they have often upheld First Amendment retaliation claims involving adverse economic action designed to chill speech indirectly.
    In explaining its rationale for defending the NRA, the ACLU described how easily these same state powers could be abused by a Republican governor against liberal activist groups — for instance, by threatening banks to cease providing services to Planned Parenthood or LGBT advocacy groups. When the judge rejected Cuomo’s motion to dismiss the NRA’s lawsuit, Reuters explained the key lesson in its headline.
