    JUST IN: The Department of Justice and Jack Smith immediately end their cases against Donald Trump.

    The DOJ cited their policy that presidents can't be prosecuted however it was assumed they would work up until the "last day."

    "What's interesting here is that the DOJ is moving to end them even before he takes office, citing the longstanding DOJ policy that sitting presidents can't be prosecuted."

    "And there were some thought that maybe special counsel Jack Smith was going to sprint through the finish line, was going to work up until the last day, force Trump to fire him, wait till a new Attorney General was appointed."

    As Jonathan Turley notes, the election reflected a certain gag sensation for a public fed a relentless diet of panic and identity politics for eight years.

    The 2024 election will come to be viewed as one of the biggest political and cultural shifts in our history.

    It was the mainstream-media-versus-new media election; the Rogan-versus-Oprah election; the establishment-versus-a-disassociated-electorate election.

    It was also a thorough rejection of lawfare. One of the things most frustrating for Trump’s opponents was that every trial or hearing seemed to give Trump a boost in the polls. As cases piled up in Washington, New York, Florida and Georgia, the effort seemed to move more toward political acclamation than isolation.

    These cases are now legal versions of the Flying Dutchman — ships destined to sail endlessly but never make port.

    If there is a single captain of that hapless crew, it is Special Counsel Jack Smith.

    For more than a year, Smith sought to secure a verdict in one of his two cases in Washington and Florida before the election. His urgency was seemingly shared by Judge Tanya Chutkan in Washington, but by few other judges or justices.

    Around 2 am, Smith became a lame-duck prosecutor.

    Trump ran on ending his prosecutions and can cite a political mandate for it. Certainly, had he lost, the other side would be claiming a mandate for these prosecutions.

    In her book, @MELANIATRUMP described the text she received at 9:10am on August 8, 2022 from her house manager about the FBI raid. Mrs. Trump was in NYC for an appointment that day:

    “The FBI is outside the house,” she wrote. “They are saying we need to leave. The Secret Service is checking the situation. I don’t understand what is happening.”

    That text appears to contradict FBI claims the Secret Service was notified before agents arrived.

    Mrs. Trump at first worried about a threat to the property or staff not realizing until she spoke with her husband moments later their home was the target of an FBI raid

    “Rather than protecting us, the FBI’s actions represented a politically motivated intrusion linked to my husband’s personal presidential documents. Watching the helicopter footage of agents surrounding our home from New York, I felt a profound sense of personal violation.”

    “I was fully aware of the lengths to which my husband’s political adversaries might go, but this development was an unprecedented low.”

    She returned home days later to see what agents had done to her residence. (She instructed staff to leave everything as is.)

    “I maintain my home with meticulous organization, so what greeted me when I walked in was both shocking and deeply upsetting. My belongings—clothes, documents, personal files, and medical records—had been rummaged through, leaving me with a profound sense of violation. The anger I felt was compounded by the realization that strangers had invaded my personal space and sifted through my possessions. I could not be certain whether they had taken any of my belongings.”

    This outrage cannot go unpunished.

    The FLA case revealed egregious misconduct by FBI during and after the raid. Jack Smith was appointed special counsel 3 months later but he inherited this unprecedented, unnecessary, and dangerous raid; his prosecutors defended it in court.

    Every time I read about it, I get more infuriated that this happened to the Trumps and to the country. Over 100 or so papers the DOJ NEVER PROVED represented a crime let alone a threat to national security.

    Liberals will be tearing what's left of their hair out even more this morning as Judge Juan Merchan just granted President-elect Trump's request to file a motion to dismiss the charges in the Stormy Daniels' 'hush money' case and removed the sentencing date for the president-elect from the schedule.

    Manhattan District Attorney Alvin Bragg (D) is opposing that request. Instead, Bragg floated that Merchan could freeze the proceedings while Trump is in office, meaning the conviction would remain on the books but sentencing wouldn’t occur until 2029, at the earliest.

    Merchan ordered Trump to file his formal motion asking for dismissal by Dec. 2 and Bragg to respond by Dec. 9.

    Merchan also confirmed the stay in sentencing for Trump, which was requested by both Trump and Bragg attorneys.

    The sentencing was scheduled for Nov. 26, but on Friday, Merchan said that date "is adjourned."



    The judge will then decide how to proceed.

    In a letter to Merchan on Wednesday, Trump defense attorney and now-nominee for Deputy Attorney General Todd Blanche demanded the case against President-elect Donald Trump be tossed.

    "On November 5, 2024, the Nation’s People issued a mandate that supersedes the political motivations of DANY’s ‘People,’" Blanche wrote.

    "This case must be immediately dismissed."


    Blanche said that "immediate dismissal of this case is mandated by the federal Constitution, the Presidential Transition Act of 1963, and the interests of justice, in order to facilitate the orderly transition of Executive power following President Trump’s overwhelming victory in the 2024 Presidential Election."

    Special counsel Jack Smith on Monday dropped the election interference case against President-elect Donald Trump, seeking a judge’s dismissal of the charges.




    In a 6-page court filing, Smith’s team argued that the Department of Justice (DOJ) has long argued “that the Constitution requires that this case be dismissed before the defendant is inaugurated,” referring to Trump’s recent election victory.

    “This outcome is not based on the merits or strength of the case against the defendant,” the filing states.

    His office said that prosecutors have conferred with Trump’s attorneys, who indicated they do not oppose the government’s motion.

    “Based on the Department’s interpretation of the Constitution, the Government moves for dismissal without prejudice of the superseding indictment,” the court documents state.

    The move marks an end to Smith’s criminal pursuit of Trump over the past two years or so, accusing him of attempting to illegally overturn the 2020 election. Smith also accused Trump of allegedly mishandling classified documents in a separate case, which was dismissed over the summer by a federal judge.

    The decision was anticipated after Smith’s team said in court filings that it was assessing how to wind down both the 2020 election interference case and the classified documents case in the wake of Trump’s win on Nov. 5 over Vice President Kamala Harris.

    According to Smith’s team, the DOJ believes the president-elect can no longer be tried in accordance with longstanding policy that says sitting presidents cannot be prosecuted.

    The president-elect has often criticized the two cases that were brought by Smith, named as the special counsel by now-outgoing Attorney General Merrick Garland, describing them as attempts to use the DOJ to target a political opponent. Earlier this year, Trump told a radio host that if he were elected, he would move to remove Smith as special counsel.

    Over the summer, the election case triggered a U.S. Supreme Court decision that said presidents can enjoy some immunity from prosecution for their official acts and duties.

    Months later, Smith filed a superseding indictment that argued Trump acted on his own accord and not within his presidential duties when he allegedly broke the law. Trump had pleaded not guilty to those charges.

    Trump also faced similar, election-related charges in Fulton County, Georgia. However, that case is in limbo after a co-defendant accused the prosecutor, Fani Willis, of being in a relationship with her special counsel, Nathan Wade, who resigned earlier this year after a judge issued an order.

    That Fulton County judge, however, allowed Willis, an elected Democrat, to remain on the case. But Trump and several co-defendants petitioned the Georgia Court of Appeals to reject the judge’s ruling, effectively pausing the case.

    In his business records case in New York, sentencing for Trump was postponed indefinitely last week by a judge after his election win. On May 30, Trump was convicted on 34 counts of falsifying business records in connection to payments he made during the 2016 presidential campaign, which he had denied were illegal.

    Sentencing in that case was initially scheduled for July but was postponed until Nov. 26. In a ruling on Nov. 22, Judge Juan Merchan wrote that he was granting a request to adjourn that sentencing date.

    Fulton County District Attorney Fani Willis has been disqualified from prosecuting President-elect Trump in his election interference case by a Georgia court of appeals.



    While the court didn't throw out Trump's indictment, Willis and the assistant DAs working in her office were found to have "no authority to proceed" with the case.



    The new ruling means that Georgia's Prosecuting Attorneys' Council will need to find another prosecutor to take over the case and decide whether to continue pursuing it - though if Willis decides to appeal to the state Supreme Court, that could be delayed.

    Today’s ruling by the New York appeals court is a resounding victory for President Trump and his company. The court struck down the outrageous and unlawful $464 million penalty, confirming what we have said from the beginning: the Attorney General’s case was politically motivated, legally baseless, and grossly excessive.

    Appeals Court Tosses Trump's $454 Million Civil Fraud Judgement As Prez Claims 'Total Victory'

    A New York appeals court has tossed out a $454 million civil fraud judgement handed down last year against Donald Trump, his family, and his company.



    While the Appellate Division's First Department upheld the ruling, it found that the $454 million penalty was excessive and at odds with the Eighth Amendment.

    "The documentary evidence supports Supreme Court's conclusion that the Attorney General made a prima facie showing that each defendant participated in the fraudulent scheme," reads the opinion. "The trial record is also replete with evidence supporting the court's determination that the individual defendants had the requisite intent to defraud, a necessary element of each Penal Law claim."

    The decision comes after New York Attorney General Letitia James’s office asked an appeals court last August to uphold the $454 million civil fraud judgment against Trump.

    The appellate judges, however, said of the judgement; "while harm certainly occurred, it was not the cataclysmic harm that can justify a nearly half billion-dollar award to the State."

    In response to the decision, President Trump claimed 'TOTAL VICTORY in the FAKE New York State Attorney General Letitia James Case!"

    "The amount, including Interest and Penalties, was over $550 Million Dollars. It was a Political Witch Hunt, in a business sense, the likes of which no one has ever seen before. This was a Case of Election Interference by the City and State trying to show, illegally, that I did things that were wrong when, in fact, everything I did was absolutely CORRECT and, even, PERFECT," Trump wrote on Truth Social.

    The case can now be appealed by either side to the state's highest court, the New York Court of Appeals.

    "Today's ruling by the New York appeals court is a resounding victory for President Trump and his company," Trump's former personal attorney, Alina Habba, said in response. "The court struck down the outrageous and unlawful $464 million penalty, confirming what we have said from the beginning: the Attorney General’s case was politically motivated, legally baseless, and grossly excessive."

    Following a three-month civil trial last year, Judge Arthur Engoron found Trump liable for inflating his net worth to secure better business deals, writing in his decision that Trump and his co-defendants engaged in frauds that "leap off the page and shock the conscience," adding "Their complete lack of contrition and remorse borders on pathological. They are accused only of inflating asset values to make more money. The documents prove this over and over again."

    Trump has long claimed that the case was politically motivated, saying "I've been persecuted by someone running for office," referring to NY Attorney General Letitia James, who brought the case - and is currently under investigation for her own real estate fraud.

    In his February decision, Engoron temporarily barred Trump and his family from leading New York-based companies, along with the $454 million fine. With interest, the penalty was closer to half-a-billion dollars.

    Trump denied all wrongdoing - arguing that the alleged victims in the case were sophisticated banks who were happy to go into business with the Trump Organization, and profited from the deals. Meanwhile, Trump's lawyers argued that James violated the statue of limitations, misapplied the relevant law, and encouraged the excessive penalty.
