Maui Wildfire Victims Secure $4 Billion Settlement

Thousands of victims of the catastrophic Maui wildfires of 2023 will receive a $4 billion settlement, it was announced on Friday night.

The settlement will resolve all tort claims against seven different parties— the state of Hawai‘i, County of Maui, Hawaiian Electric, Kamehameha Schools, West Maui Land Co., Hawaiian Telcom, and Spectrum/Charter Communications—for their role in the death and destruction caused by the wildfires on August 8 2023. Over 2,200 claims will be settled.

Although the fires were initially blamed on climate change, including by Hawaii Governor Josh Green and White House “energy czar” John Podesta, investigations revealed critical failings by the state’s main utility provider, and that the cause was fallen power lines.

As a result, the government of Maui County filed a lawsuit against the Hawaii Electric Company and its subsidiaries alleging failure to maintain their system and power grid, as well as neglecting their duty to “properly maintain and repair the electric transmission lines, and other equipment including utility poles associated with their transmission of electricity, and to keep vegetation properly trimmed and maintained so as to prevent contact with overhead power lines and other electric equipment.”

A press release was issued to announce the settlement, which remains subject to final documentation and court approval.

“Today, Governor Josh Green, M.D., announced a historic settlement to resolve all tort claims arising from the Maui wildfires,” the release says.

“Less than a year after devastating wildfires on Maui, the seven defendants – state of Hawai‘i, County of Maui, Hawaiian Electric, Kamehameha Schools, West Maui Land Co., Hawaiian Telcom and Spectrum/Charter Communications – undertook significant efforts to find a resolution that addresses the needs and ensures the well-being of plaintiffs, all affected individuals, and their families.

“Under the proposed terms of the global settlement agreement, which remains subject to final documentation and court approval, the seven defendants will pay $4.037 billion to provide compensation to all those who have brought claims for compensation arising from the Aug. 8, 2023 windstorms and wildfires on Maui, including the approximately 2,200 affected parties who filed lawsuits. The state of Hawaiʻi would contribute to the settlement in addition to its $65 million contribution to the One ʻOhana Fund.”

In addition to the failures of the state and utility companies that helped cause the fires, the tragedy on Maui was made yet worse by confusion and obstacles that prevented residents from fleeing. Terrified residents found exit routes blocked by barricades. Those who simply waited in their cars were engulfed by the flames.

“One family swerved around the barricade and was safe in a nearby town 48 minutes later, another drove their four-wheel-drive car down a dirt road to escape,” reported the Associated Press.

“One man took a dirt road uphill, climbing above the fire and watching as Lahaina burned. He later picked his way through the flames, smoke and rubble to pull survivors to safety.

“But dozens of others found themselves caught in a hellscape, their cars jammed together on a narrow road, surrounded by flames on three sides and the rocky ocean waves on the fourth. Some died in their cars, while others tried to run for safety.”

As I mentioned here, a very close friend of mine lost his house in the fire. The following is an email he received from the law firm representing him. I removed all personally identifiable information....

Dear Clients,

We are writing again to clarify reports in the media that a global settlement has been reached in the Maui Fires litigation. 

Today, the Individual Action Plaintiffs (of which you are all included) and the Defendants entered into a Term Sheet establishing a global settlement framework that seeks to resolve all Maui Fire claims for a total sum of $4.037 billion.  We want to caution that this is merely a tentative settlement framework, and other than the global number, there has been no determination of how much each individual will receive – let alone the process by which the parties will arrive at those numbers.  Moreover, not all interested parties have agreed to the framework, most notably the many insurance companies who are seeking subrogation (i.e., repayment) from the Defendants for the insurance monies they paid out to claimants such as yourselves. Because the subrogating insurers are refusing to accept a reasonable portion of the Global Settlement, we have filed a motion asking Judge Cahill to limit the insurers’ ability to recover from the Defendants.

As such, this deal is far from final and there is still an enormous amount of work that must be done before it can be finalized and presented to you, the Individual Plaintiffs, for review and approval.  This process will take many more months and likely longer than a year.  While we know that you, and everyone else involved, are eager for more information regarding the settlement framework and what it will mean for your individual claims, we simply have no way of knowing that information at this time. No one does.

But know this:  We, as your attorneys, are deeply involved in the process and are doing everything in our power to maximize your potential recovery in this case, whether through a successful navigation of the global settlement framework process, or through litigation (if the settlement framework process does not succeed). This tentative settlement framework has been the result of months of extensive negotiations by all parties and is something we truly believe is in the best interest of all victims, as it will allow those harmed by the fire to receive compensation as quickly as possible and avoid the unknown and lengthy bankruptcy process (for the utility and potentially other defendants) that would otherwise be inevitable and impending. 

For now, nothing has changed in our strategy or process with respect to developing your claims to maximize your recovery, be it through the global settlement framework or litigation. Well, releasing that email puts the attorney-client privilege in potential jeopardy. But that may prove to be no big deal if the case settles.

The people who lost so much are entitled to be made whole—and more, for the culpability of those responsible. But the people who are responsible will not pay for any settlement or judgment. Rather, the people who are not responsible will pay for it. It will be passed on to taxpayers and insurance rate payers. Etc….

Ps. I forgot to add: it’s the same model—privatize profits and socialize losses.

You're not going to believe this (yes, you are) but the incident commander for the Maui fires was just picked up for r*ping a 12 year old child....and we already know what kind of blackmail the Deep State uses to control people, so there's that piece of the puzzle.

Speaking of....is the public just never going to get answers on "why" they shut off the hydrants, never used their warning siren system, and sent people in the wrong direction to die on purpose?

Keep in mind this is the fire chief, the police chief was the one that got a lofty raise for moving there after being the incident commander for the Las Vegas shooting cover up, and the Sheriff that was in charge of that same shooting is now magically Nevada's governor somehow despite being hated by even his own party.

Gee, you'd almost think our out-of-control corrupt government coordinates these all these suspicious things on purpose, or something? 🧐
