Wake County [North Carolina, USA] teen faces 10th felony charge in alleged AI-generated explicit images case

A boy, whose name is not public because of his age, faces another felony charge and is accused of using AI to create sexually explicit photos of teen girls.

A Wake County teenager now faces a 10th felony charge of sexual exploitation of a minor after police accused him of using artificial intelligence to create sexually explicit images of underage girls.

WRAL first reported last week that the juvenile faced nine Class E felony charges for allegedly using AI to create the images. Knightdale police have since confirmed that a 10th charge has been filed against the same teenager.

The new charge involves the daughter of a parent who spoke anonymously with WRAL last week. The parent expressed frustration that prosecutors had not initially filed a charge involving the manipulated images of her daughter.

In a new development, that victim will now be added to the investigation, accounting for the tenth and latest charge in the Knightdale Police investigation.

“To protect the integrity of this active and ongoing criminal investigation, the Knightdale Police Department will not be releasing any additional information or providing further comment at this time,” a department spokesperson said.

Several local parents have contacted WRAL, alleging that their daughters were victims connected to the juvenile investigation. The parents said their daughters learned over the summer that their photos had allegedly been altered using artificial intelligence to depict them in a sexually explicit manner.

Parents say non-explicit photos were taken from various sources, including social media, and changed using AI. It is currently unclear from the investigation how many girls may be victims of having their photos manipulated.

"This remains an active and ongoing investigation. In accordance with North Carolina law, no additional information regarding the identities of those involved or other details of the investigation will be released, as the case involves juvenile victims and a juvenile offender," a Knightdale spokesperson said.

"The Knightdale Police Department remains committed to protecting children, thoroughly investigating crimes, and holding offenders accountable under the law."

Examining North Carolina's sexual exploitation laws

In 2024, state lawmakers updated North Carolina's sexual extortion laws to include language prohibiting the use of "artificial intelligence" as a means of producing pornographic material:

Pictures, drawings, video recordings, films or other visual or physical depictions or representations, including digital or computer-generated visual depictions or representations created, adapted, or modified by technological means, such as algorithms or artificial intelligence, but not material consisting entirely of written words.

The teen boy whom Knightdale Police are investigating is charged with second-degree sexual exploitation of a minor. That is defined in state law as anyone who:

(1) Records, photographs, films, develops, or duplicates material that contains a visual representation of a minor engaged in sexual activity.

(2) Distributes, transports, exhibits, receives, sells, purchases, exchanges, or solicits material that contains a visual representation of a minor engaged in sexual activity or that has been created, adapted, or modified to appear that an identifiable minor is engaged in sexual activity.

(3) Distributes, transports, exhibits, receives, sells, purchases, exchanges, or solicits a child sex doll.

Parents who have spoken to WRAL on the condition of anonymity expressed concern that content that would be viewed as sexually explicit to the general public is not considered the same in the eyes of the law.

Joseph Hyde, assistant professor of public law and government at the University of North Carolina's School of Government, confirmed that the language "engaged in sexual activity" may disqualify certain images from falling under the sexual exploitation statute.

"Display does not constitute sexual activity unless the display is of the genitals or pubic area," Hyde said. "In sum, the display of the female breast(s) alone would not constitute sexual activity for purposes of our sexual exploitation statutes."

Hi rgray222, the images may be AI generated but the harm to these girls is very real. What strikes me is that North Carolina updated its statute in 2024 specifically to cover AI generated material, ahead of most jurisdictions and a live case is already exposing a gap in the drafting. Even a proactive legislature is a revision behind the harm. I suspect the next few years will be a steady cycle of jurisdictions updating their laws and discovering the same thing.

Given the recent discussion around AI-generated explicit material, deepfakes and accountability, I thought it worth looking at where AI governance has actually moved over the past six months.

My view is that we are now beyond the "AI ethics" phase. Governments are no longer just debating principles such as fairness, transparency and responsible development. They are confronting much harder questions: Which uses of AI are unacceptable and who is responsible when harm occurs?

Much of the recent acceleration traces back to the Grok controversy of late 2025, where users generated sexual deepfakes of women and children on X. The incident forced regulators to move from abstract concerns about AI misuse into questions of enforcement, accountability and platform responsibility.

The EU has continued its risk-based approach through the AI Act, moving toward explicit restrictions on systems designed to create non-consensual intimate imagery. However, even the world's most advanced AI regulatory framework is having to adapt faster than it can enforce.

The UK has taken a more targeted approach, making the creation or requesting of explicit deepfakes a criminal offence, even where the material is never distributed, and moving toward regulating the supply of tools that enable abuse rather than only punishing the end user.

The United States presents a different challenge. Almost all states have now introduced deepfake-related legislation, but courts are already testing the limits of those laws against constitutional protections such as free speech. Legislatures can be responding to genuine harms while still discovering where legal boundaries actually lie.

Australia has also begun shifting away from its earlier voluntary, standards-based approach, moving toward legislation around AI standards and stronger governance measures. Even the most cautious jurisdictions are recognising that voluntary frameworks alone may not be sufficient. However, the deeper issue goes beyond deepfakes and generated content.

The biggest shift is from AI that creates content to AI that takes actions.

Once AI systems can make decisions, interact with other systems and execute tasks independently, the central question changes: Who is accountable when AI acts? Is it the developer who created the system? The organisation that deployed it? The user who instructed it? The person responsible for oversight?

This is where AI governance becomes much more complex. The challenge is not simply controlling what AI can generate. It is building systems of accountability, oversight and public trust around technologies that are increasingly capable of influencing, persuading, deciding and operating in the real world. The transition has already begun.

The question is no longer what happens when AI becomes capable of acting in society. The question is how society adapts when it already is.

Forgive me if this has been said already but I recently noticed Google Gemini can write music.

We just made a song about Bells Palsy and it was really good. It knew all about Bells Palsy and everything rhymed. Then I did Religious Psychosis and that was even better! I put aliens in it too. My boyfriend doesn't want me to do diabetes.. ha ha. I feel evil. How bad can I even make the song.. cancer? I don't suppose it will let me do child molesters either. I'll edit the post if any more to report later.

That's pretty bizarre isn't it? AI is getting really weird.

It's free for now but eventually I think that kind of thing will cost money.

It writes the song, generates the music, puts it right there so you can play it, and then you have to ask "what are the lyrics" and it'll show you the whole song without having to listen. You don't need an app, just Gemini.google.com (I think you need to sign into Google too)
